DECREE
Regulations on functions, tasks, powers, and organizational structure of the Ministry of Construction

Pursuant to the Government Organization Law on February 18, 2025;
At the proposal of the Minister of Construction;
The Government promulgates this Decree to stipulate the functions, tasks, powers, and organizational structure of the Ministry of Construction.
Article 1. Position and Functions
The Ministry of Construction is an agency of the Government, performing state management functions over: urban planning, architecture; construction investment activities; urban development; technical infrastructure; housing; real estate market; building materials; road transport, railway, inland waterway, maritime, civil aviation within the entire country; state management of public services in fields under the Ministry's jurisdiction as prescribed by law.
b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;
The Ministry of Construction performs the tasks and powers as prescribed by the Law on the Organization of the Government, the Government's regulations on the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies, and the following specific tasks and powers:
1. Submitting draft laws, draft resolutions of the National Assembly, draft ordinances, draft resolutions of the Standing Committee of the National Assembly; draft decrees, draft resolutions of the Government according to the annual legislative program of the Ministry that has been approved and other resolutions, projects, programs assigned by the Government, Prime Minister; submitting strategies, plans, proposals, programs for long-term, medium-term, and annual development and important national projects within the Ministry’s jurisdiction and as prescribed by law to the Government,
Prime Minister.
2. Submitting draft decisions, directives, and other documents as assigned to the Government,
Prime Minister.
3. Issuing circulars and other documents within the scope of state management of the Ministry; developing and issuing technical standards, national standards, economic-technical norms, typical designs, model designs, technical guidelines, criteria in fields under the Ministry’s jurisdiction either on its own authority or upon submission to competent authorities; guiding and supervising the implementation of these documents.
4. Directing and organizing information dissemination, propaganda, legal education within the scope of state management of the Ministry; directing, guiding, supervising the organization and implementation of laws related to the industry and sector entrusted within the national territory; reviewing, evaluating, and organizing the implementation of strategies, plans in fields under the Ministry’s jurisdiction.
5. On planning and architecture:
a) Organizing the preparation and review of the overall planning system for cities and rural areas; taking the lead in preparing and reviewing components on urban and rural planning in the national master plan, national marine space plan, regional planning, and other plans as prescribed by law on planning;
b) Organizing the review of planning tasks, urban and rural planning within the Prime Minister's approval authority or reviewing and approving urban and rural planning as assigned by the Prime Minister;
c) Issuing norms, methods for cost estimation and management for planning activities, architectural control regulations;
d) Developing and implementing the orientation for the development of Vietnamese architecture suitable for each stage, submitting to the Prime Minister for approval and issuance; guiding the establishment and management of architectural works of value;
đ) Building, managing, operating, and exploiting databases on planning and architecture connected with the national geographic information system that has been standardized; ensuring synchronous connection with the national database on planning, the national land database across the country;
e) Guiding and supervising the implementation of laws on planning, architecture, spatial management, architectural landscape (including surface and underground spaces);
6. Regarding construction investment activities:
g) Issuing architectural design models for public buildings, rural houses, and other architectural works as prescribed;
h) Stipulating and guiding the organization of planning idea competitions, architectural scheme competitions, and the management of professions in urban and rural planning and architecture.
a) Developing and submitting to competent authorities for promulgation or promulgating on its own authority mechanisms, policies, regulations on project investment construction, construction survey, design, construction, supervision, project management, contractor selection, acceptance, handover for operation and use, warranty, maintenance of construction works, and other activities related to construction; construction activity capacity; foreign contractors engaged in construction in Vietnam; the national information system and database on construction activities;
b) Guiding and supervising the implementation of mechanisms, policies, and regulations mentioned in point a of this clause;
c) Building and managing the national information system and database on construction activities;
d) Guiding the application of building information modeling (BIM) in construction activities; the selection of contractors in construction activities in accordance with construction law and bidding law;
đ) Reviewing feasibility studies for construction investment, detailed design after basic design as prescribed by construction law;
e) Guiding and supervising the implementation of laws on contracts in construction activities, project investment contracts under the public-private partnership (PPP) method as prescribed by law; guiding methods for adjusting construction contract prices; publishing construction contract models; guiding the establishment and management of costs, methods for determining technical infrastructure service prices;
i) Issuing, guiding, and inspecting the implementation of regulations on construction investment cost management; stipulating the application of necessary tools in construction investment cost management work; guiding the content, methods for determining and managing construction investment costs; stipulating the determination of new norms, adjustment of norms; stipulating the determination of construction price indices in areas involving two or more provinces; issuing construction norms; announcing investment capital for construction, comprehensive construction prices, national construction price indices, norms for various losses, and basic data for calculating machinery prices;
k) Guiding and inspecting quality management work for construction projects during survey, design, construction, acceptance, handover, warranty, and maintenance phases; periodically or randomly inspecting, handling or recommending measures to address violations related to construction project quality; suspending or recommending suspension of construction and requiring the project owner, consultants, and contractors to rectify when discovering that the project's quality does not meet requirements or construction activities do not comply with labor safety regulations; organizing inspections of construction project acceptance procedures as prescribed by law;
l) Guiding specialized construction testing activities and construction certification; inspecting, evaluating, and issuing certificates for specialized construction testing activities; guiding and implementing, within their authority, construction appraisal, judicial construction appraisal, cause investigation of construction accidents, and during operation and use of construction projects;
m) Implementing the tasks of the State Acceptance Council for construction project acceptance work; organizing and reviewing awards for construction project quality;
n) Guiding and inspecting maintenance work for construction projects, assessing safety during operation and use; announcing and guiding the handling of projects that have exceeded their service life according to legal provisions;
o) Managing professional practice license numbers and construction activity capability certificates; publicly listing individuals and organizations granted certificates as prescribed; developing and issuing examination questions for professional practice certificates; building and managing software for examinations;
p) Building and managing a database system for construction norms, construction project prices, and construction price indices as prescribed by law;
7. Regarding urban development:
a) Developing strategies, programs, plans, and important national projects on urban development; indicators for the urban development sector in the national socio-economic development tasks for each stage;
b) Developing and submitting to competent authorities for issuance, or issuing within their authority, mechanisms, policies, and regulations on: Urbanization process management; urban space management and development (including above-ground and underground spaces), urban development models; urban upgrading, renovation, and beautification plans, enhancing urban resilience to climate change; exploitation, utilization, and transfer of urban area management; criteria and standards for classifying cities; establishing and managing costs for urban utility services, urban development area planning and assessment costs, urban development programs, proposals, and classification reports;
c) Reviewing and submitting to competent authorities for approval urban development programs, urban development areas, and urban development projects as prescribed by law;
d) Reviewing and submitting to the Prime Minister for decision on recognizing city types for special-class, Class I, and Class II cities; deciding on recognizing city types for Class III and Class IV cities; deciding on recognizing areas expected to establish districts and wards meeting infrastructure development standards;
e) Guiding and inspecting the implementation of urban development mechanisms, policies, and legal regulations; guiding, inspecting, and organizing annual urban classification evaluations based on established criteria and standards; guiding urban construction order management;
f) Guiding and inspecting the management and use of land for urban construction according to approved urban development plans;
g) Organizing promotional and coordination activities for domestic and foreign resources for urban development investment as prescribed by law and assigned by the Government;
h) Organizing the construction, integration, management, and exploitation of the national urban data system;
8. Technical infrastructure includes: clean water supply (excluding rural clean water); drainage and wastewater treatment (excluding on-site wastewater treatment; drainage for agricultural production and salt production); urban parks and greenery; urban lighting; cemeteries (excluding martyrs' cemeteries) and crematoria; urban transportation infrastructure structures; underground construction space management; shared use management of urban technical infrastructure facilities and rural residential areas;
a) Developing orientations, strategies, proposals, and national programs on technical infrastructure development; national indicators for the technical infrastructure sector in national socio-economic development tasks for each stage and organizing implementation after approval;
b) Guiding the development of technical infrastructure plans according to technical infrastructure development orientations, regional planning, provincial planning, urban planning, and rural planning; construction projects for technical infrastructure facilities as assigned by the Prime Minister;
c) Developing mechanisms, policies, and regulations on technical infrastructure development, operation, exploitation, use, and handover systems; guiding procedures for technical infrastructure services;
d) Guiding and inspecting clean water business operations and ensuring safe water supply; business operations of management and operation facilities for crematoria;
d) Establish and promulgate technical standards for urban infrastructure construction; specify the classification of urban roads; establish and submit to competent authorities for issuance of national standards on urban road construction;
e) Establish and submit to competent authorities for issuance, or issue within their authority, regulations on conformity assessment and technical infrastructure capacity for investment construction projects;
g) Guide, monitor, and inspect the implementation of laws and regulations on technical infrastructure;
9. On road, railway, inland waterway, maritime, and civil aviation transportation infrastructure:
a) Submit to the Government regulations on management and protection of road, railway, inland waterway, maritime, and civil aviation transportation infrastructure according to the provisions of the law; direct the organization of implementation of planning and development plans for the transportation infrastructure system approved by the Government and the Prime Minister;
b) Issue national technical standards on transportation infrastructure and regulations on management, operation, and maintenance of transportation infrastructure within their authority;
c) Perform tasks and powers of specialized construction project management agencies and agencies responsible for managing investment construction programs and projects for transportation infrastructure; announce lists of investment projects and forms of investment in transportation infrastructure according to the provisions of the law;
d) Organize the implementation, guide, and inspect the management, operation, and maintenance of transportation infrastructure; manage and operate assets of transportation infrastructure under their assigned jurisdiction according to the provisions of the law;
đ) Submit to the Government and the Prime Minister for decision-making or make decisions within their authority regarding the announcement, classification, naming, adjustment, closure, opening, demolition, commissioning, suspension, and temporary suspension of operation of road, railway, inland waterway, maritime, and civil aviation transportation infrastructure according to the provisions of the law;
e) Organize the registration, issuance of certificates and permits according to their authority and the provisions of the law;
10. On housing:
a) Develop mechanisms, policies, and solutions for various types of housing, national target programs supporting housing, public investment programs on housing; organize and direct the implementation of social housing development programs and national target programs supporting housing;
b) Develop the National Housing Development Strategy for each period, determine basic targets for housing development in economic and social development tasks for each stage; implement after approval by the Prime Minister. Specify funding levels for housing development programs and plans at the provincial level; inspect provincial-level housing development programs and plans according to the provisions;
c) Issue model contracts for the sale, lease purchase, and rental of social housing, resettlement housing, and housing under state property; proof of eligibility for social housing support policies;
d) Represent the owner for civil servant housing, social housing funded by central government budget, and student housing managed by directly affiliated public educational institutions;
đ) Review contents related to housing for housing construction investment projects within the authority to decide or approve investment proposals of the Prime Minister according to the law; take the lead in reviewing investment proposal decisions and project investment decisions for civil servant housing projects and commercial housing purchases for civil servant housing within the authority to decide on investment proposals of the Prime Minister; provide opinions on civil servant housing construction projects of the Ministry of Defense and the Ministry of Public Security;
e) Issue management and usage regulations for apartment buildings; define training and professional development programs for apartment building management operations. Announce a list of units qualified to manage and operate apartment buildings on the Ministry's electronic portal;
g) Develop and submit to the Prime Minister for issuance of standards, areas, and equipment quotas for civil servant housing; decide on the eligible users of civil servant housing of the ministry and sector; review or provide opinions on civil servant housing needs and development plans according to the law;
Organize the establishment, operation, maintenance, renovation, repair, and rental arrangements for civil servant housing for central agency staff as assigned by the Prime Minister;
h) Develop and submit to the Government regulations on determining rent prices for civil servant housing; prices for selling, renting, and lease-purchase of social housing not funded by public investment or trade union finances; prices for social housing and people's armed forces housing under state property; methods for determining service charges for managing and operating apartment buildings under state property;
i) Regulations on construction requirements for multi-story, multi-unit residential buildings for individuals;
k) Inspect the allocation of land funds and the appropriateness of land fund allocation for developing social housing, worker dormitories in industrial zones, and housing for people's armed forces in accordance with prescribed planning;
l) Approve or report to the Prime Minister for decision-making on converting the function of housing according to the provisions of the law;
11. On the real estate market:
a) Take the lead and coordinate with ministries, equivalent agencies, and provincial People's Committees in developing proposals, policies for real estate development, organization, and management; measures to regulate the real estate market;
b) Manage the issuance of real estate brokerage practice certificates, real estate brokerage activities; the establishment and operation of real estate trading floors;
Issue a framework training program for real estate brokerage knowledge and real estate trading floor management; study models of state-managed real estate trading floors;
c) Guide and inspect the implementation of laws on real estate business, conditions for organizations and individuals engaging in real estate business, conditions for real estate being put into business, and cooperate with provincial People's Committees to organize inspections and reviews of real estate business activities according to the provisions.
d) Chair and coordinate with ministries, ministerial-level agencies, provincial People's Committees in building, managing, and operating the national information system on housing and the real estate market; connect and share information from the database on housing and the real estate market with the national database and other specialized databases according to the provisions of the law; establish and publish indices for evaluating the real estate market nationwide;
đ) Review or provide opinions on the transfer of the entire or part of a real estate project within the Prime Minister’s authority to examine and decide; provide review opinions on investment proposals and adjustments to investment proposals for real estate projects under the business law on real estate within the Prime Minister’s authority to approve investment proposals according to the law;
e) Chair and coordinate with relevant agencies to implement measures to prevent and combat money laundering in the field of real estate business according to the law;
12. On construction materials:
a) Organize the development and submit to the competent authority for issuance of legal normative documents and policies on management and development of construction materials;
b) Organize the establishment, review, and submit to the competent authority for approval of planning and adjustment of planning for Group II minerals according to the law on planning and minerals; guide and inspect the implementation of mineral planning after being approved by the Prime Minister;
c) Propose and report to the Prime Minister to encourage or restrict the development, production, use, import, and export of construction materials; issue regulations on technical standards and guidelines for exporting types of minerals used as construction materials according to the law;
d) Propose and report to the Prime Minister to stipulate phased restrictions and elimination of construction material production facilities with outdated technology, high raw material consumption, high energy consumption, and environmental pollution; phased use of non-fired construction materials, resource-saving construction materials, energy-saving construction materials, environmentally friendly construction materials, and domestically produced construction materials;
đ) Guide and inspect provincial People's Committees in establishing, reviewing, approving, and managing the implementation of local programs and plans for developing construction materials; schemes for exploration, exploitation, and use of common minerals as construction materials in provincial planning;
e) Guide and inspect localities and enterprises in implementing legal provisions on product quality and goods quality of construction materials;
g) Guide activities related to the assessment and evaluation of product quality and goods quality of construction materials; quality of minerals used as construction materials; designate and manage the activities of conformity assessment organizations serving state management requirements for product quality and goods quality of construction materials; test, certify conformity regarding product quality and goods quality of construction materials and building components;
h) Issue or submit to the competent authority for issuance of lists, conditions, and technical standards for construction materials that can be exported and imported; restricted construction materials for export and import; construction materials subject to conditional business; guide and inspect the implementation;
i) Guide and inspect localities and enterprises in implementing legal provisions on the production and use of resource-saving, energy-saving, and environmentally friendly construction materials in construction projects;
13. On transportation means, assemblies, systems, spare parts of transportation means; marine exploration, exploitation, and transport equipment; dedicated loading and unloading, construction equipment; machinery, equipment, materials with strict safety and labor hygiene requirements in transportation (excluding transportation means for defense and security purposes and fishing vessels) and specialized technical equipment:
a) Specify registration and license plate issuance for railway and inland waterway transportation means, and special-purpose motorcycles participating in traffic; organize the implementation of registration for railway and inland waterway transportation means, maritime, civil aviation transportation means according to authority and legal provisions;
b) Specify technical safety quality, environmental protection, and labor hygiene safety requirements for transportation means; marine exploration, exploitation, and transport equipment;
c) Specify and guide the implementation of technical standards, inspection, testing, trial, certification of technical safety quality and environmental protection, management of activities for declaration of compliance and certification of compliance for road motor vehicle transportation means, assemblies, systems, spare parts; railway, inland waterway, maritime, civil aviation transportation means; marine exploration, exploitation, and transport equipment; dedicated loading and unloading, construction equipment, specialized equipment and facilities used in transportation and other purposes according to legal provisions;
d) Issue Airworthiness Certificates for aircraft; issue Export Airworthiness Certificates for aircraft, aircraft engines, aircraft propellers when exporting; issue or recognize Type Certificates for aircraft, aircraft engines, aircraft propellers when manufactured in Vietnam or imported;
đ) Specify technical design review procedures in production, assembly, repair, modification, importation of transportation means; dedicated loading and unloading, construction equipment; marine exploration, exploitation, and transport equipment; and specialized technical equipment for transportation according to legal provisions;
e) Issue licenses for facilities designing, manufacturing, repairing, maintaining, or testing aircraft, aircraft engines, aircraft propellers, and aircraft equipment and accessories in Vietnam; stipulate conditions and procedures for issuing operating licenses for service providers ensuring flight operations, technical systems, and flight operation assurance equipment; promulgate national technical standards for new shipbuilding, repair facilities; stipulate conditions and standards for quality safety technical inspection and environmental protection facilities for transportation means, exploration, exploitation, and transport equipment on the sea, and other facilities and equipment according to the provisions of the law;
g) Develop a list of products and goods that may cause safety hazards as prescribed; issue inspection procedures and manage various types of machines, equipment, materials, and substances with strict requirements for safety and hygiene under its authority; organize the issuance, reissuance, extension, and revocation of certificates of qualification for vehicle inspection activities and certificates of qualification for occupational safety and health technical inspection activities according to its authority;
14. On labor safety in construction:
a) Take the lead in developing national standards on labor safety and construction, and promulgate national technical standards on labor safety and hygiene within its management scope;
b) Implement state management over machines, equipment, materials, and substances with strict requirements for safety and hygiene used in construction; develop detailed lists of machines, equipment, materials, and substances with strict requirements for safety and hygiene; establish and promulgate inspection procedures and guidelines for inspecting the operation of machines, equipment, and materials with strict requirements for safety and hygiene under its management after obtaining the opinion of the competent authority;
Establish, manage, and update databases on technical safety inspections for machines, equipment, and materials with strict requirements for labor safety used in construction;
c) Organize training, upgrading, and examination of inspection skills for machines, equipment, and materials with strict requirements for labor safety and hygiene for inspection objects under its management;
d) Issue, extend, reissue, revoke Certificates of Qualification for Technical Safety Inspection Activities and issue, reissue inspector certificates under its management, and publish them on the Ministry's electronic information website;
đ) Guide the implementation of statistics, declarations, investigations, and reports on technical accidents causing labor safety hazards within its management scope; guide and inspect labor safety and hygiene within its management scope;
15. Specify the training, examination, certification, recognition, and revocation of professional licenses, certificates for drivers of transportation vehicles, operators of specialized transportation equipment (excluding driver license examinations for road motor vehicles; operators of specialized equipment for defense and security purposes and fishing vessels); inspectors, technical inspection staff, and special workers in the field of transportation according to its authority;
16. On road, rail, inland waterway, maritime, civil aviation, and multimodal transport:
a) Guide and inspect the implementation of transport business conditions, development mechanisms, and policies for transport services according to the Government's regulations;
b) Establish and promulgate national technical standards in the field of transport operation;
c) Announce civil air routes after approval by the Prime Minister; announce road, rail, inland waterway, maritime transport routes, and public transport networks according to the law;
d) Guide the implementation of multimodal transport according to the Government's regulations;
đ) Organize the issuance of permits for civil aviation activities; direct and inspect the implementation of coordination management regulations for civil aviation activities;
e) Specify detailed management of activities at civil airports (excluding flight operations), seaports, inland ports, railway stations, and management of railway and inland waterway transport routes, and maritime transport routes;
17. On traffic safety and security (excluding the task of ensuring aviation security on aircraft and on the ground):
a) Lead or coordinate the implementation of comprehensive strategies, programs, plans, and projects on traffic safety nationwide after approval by the Government and the Prime Minister; guide and inspect the implementation of laws and regulations on road, rail, inland waterway, maritime, and civil aviation traffic safety within the scope of the Ministry's functions and tasks;
b) Issue the Civil Aviation Safety and Security Program according to its authority; specify detailed procedures for building, evaluating, and approving ship security plans, port security plans, and water area security plans; specify the issuance of related security certifications for ships and ports; lead or coordinate the implementation of accident investigations and oil spill response in road, rail, inland waterway, maritime, and civil aviation according to the law;
c) Organize investigations of aircraft accidents and maritime accidents according to its authority and the law;
d) Lead or coordinate the implementation of search and rescue, oil spill response in road, rail, inland waterway, maritime, and civil aviation according to its authority;
18. On the environment in construction and transportation activities:
a) Direct and guide the integration of environmental protection plans, digital transformation, green transition, climate change response, energy-saving and efficient use plans into strategies, plans, and programs for the development of sectors under the Ministry's state management scope;
b) Organize the state management on environmental protection in construction, management, exploitation, and use of transportation infrastructure structures, manage the activities of transportation vehicles and other activities within the scope and authority granted by law and international treaties to which the Socialist Republic of Vietnam is a member;
c) Prescribe the issuance of Environmental Standard Certificates for road motor vehicles, railway vehicles, inland waterway vessels, maritime vessels, offshore exploration, transport equipment, and civil aviation aircraft (excluding military and police transportation vehicles used for national defense and security purposes and fishing boats); take the lead in guiding the inspection and confirmation of compliance with environmental standards for automobiles and other motor vehicles;
d) Draft and promulish normative legal documents on environmental protection, climate change response, energy conservation and efficiency in the fields under the ministry's management as prescribed by law;
đ) Issue national technical regulations on quality, safety technology, and environmental protection for transportation vehicles within the authority prescribed by law;
e) Issue technical standards, energy consumption quotas, and guide and inspect compliance with energy consumption quotas for transportation vehicles as prescribed by law;
g) Develop and implement environmental protection activities, climate change response, energy conservation and efficiency within the ministry's management scope;
h) Develop and manage specialized meteorological and hydrological observation networks in the transportation sector;
19. Develop, guide, and implement the Science and Technology Innovation Strategy; organize scientific research plans, development, transfer, and application of science and technology in the ministry's management fields; organize the appraisal, evaluation, and recognition of construction technology and scientific and technological progress within the ministry's state management field; draft and guide, inspect measurement activities and product quality management in the industry and field under the ministry's management; direct the development and implementation of tasks related to digital transformation, information technology application programs, and electronic government construction in the industry; build and manage databases to ensure information services for state management and meet the needs of organizations and individuals involved in construction and transportation activities; build and manage the operation of online public service delivery systems in the ministry's management fields;
20. Implement statistical work and archive materials and data on the ministry's state management fields as prescribed by law;
21. Regarding public services:
a) State management over public services in the industry and fields under the ministry's state management scope as prescribed by law;
b) Prescribe criteria and quality standards for public services; mechanisms for inspecting, evaluating, and certifying the quality of public services and the effectiveness of operations of public service enterprises in the management field;
c) Guide organizations in implementing public services according to the law;
22. Regarding enterprises and cooperatives:
a) Submit to competent authorities for issuance of mechanisms and policies encouraging and supporting enterprise and cooperative development in the ministry's state management fields as prescribed by law and coordinate with relevant agencies and organizations to direct, guide, and inspect the implementation;
b) Approve or submit to competent authorities for approval comprehensive restructuring plans, reorganization and development plans for state-owned enterprises operating in the ministry's state management fields and direct their implementation according to assigned levels of authority;
c) Guide and inspect the implementation of regulations for business sectors and services with conditions and handle violations within the authority;
d) Exercise rights, responsibilities, and obligations of the state owner towards state-owned enterprises and state capital invested in other enterprises as prescribed by law;
23. Regarding Public-Private Partnership (PPP) models:
a) Issue or submit to competent authorities for issuance of normative legal documents, strategies, and investment plans from non-state budget funds for infrastructure transportation projects;
b) Submit to the Government, Prime Minister for approval or approve according to authority mechanisms and policies attracting non-state budget funds for infrastructure transportation and service projects under PPP models;
c) Organize investment promotion and mobilization of non-state budget funds in accordance with strategies, plans, and approved project lists;
d) Guide, inspect, and compile priority project lists and programs to attract non-state budget funds; monitor and evaluate the implementation and effectiveness of non-state budget fund attraction and utilization in projects;
đ) Manage and guide investment under PPP models in the fields and scope of the ministry's state management as prescribed by law on public-private partnerships;
24. Draft and implement proposals, programs, and projects to encourage, support, and promote the development of construction and transportation mechanical products;
25. Draft and implement plans and strategies for human resource training and development in the industry and fields under the ministry's state management scope; draft and organize professional knowledge training and capacity building programs for construction officials, civil servants, and employees; draft and organize training and capacity building programs on construction management, urban development, and transportation for leadership and professional staff at all levels.
26. To establish and implement plans and programs for international cooperation and integration in areas under the Ministry's administrative management according to the Government's assignment; to organize negotiations, sign, and implement international treaties on behalf of the Government according to the Government's authorization; to organize negotiations, sign, and implement international agreements on behalf of the Ministry as prescribed by law; to participate in international organizations according to the Government's assignment.
27. To decide and direct the implementation of the Ministry’s administrative reform program according to the goals and content of the State administrative reform program approved by the Prime Minister; to propose competent authorities to decide or decide within their authority on the delegation of tasks within the scope of the Ministry's administrative management to local governments.
28. To perform duties and powers over associations and non-governmental organizations under the Ministry's administrative management as prescribed by law.
29. To inspect, examine, receive citizens, handle complaints, denunciations, reflections, and suggestions from organizations and citizens; to implement anti-corruption measures, wastefulness, and handle violations of law in areas under the Ministry's administrative management as prescribed by law.
30. To manage organizational structure, staffing, officials, civil servants, public employees, and workers; to implement salary systems and incentive policies, rewards, and disciplinary measures for officials, civil servants, public employees, and workers; to train and develop officials, civil servants, and public employees under the Ministry's administrative management.
31. To manage and implement financial work, state assets, development investment, and construction within the Ministry's jurisdiction; to implement state budget management as allocated according to the law.
32. To perform other tasks when assigned, delegated, or authorized by the Government, the Prime Minister, and as prescribed by law.

The organizations specified from Clause 1 to Clause 19 of this Article are organizations assisting the Minister in performing state management functions; the organizations specified from Clause 20 to Clause 23 of this Article are public service units serving the Ministry's state management functions.
The Planning and Finance Department has five divisions.
The Vietnam Maritime and Inland Waterway Administration, the Vietnam Civil Aviation Administration, and the Vietnam Highway Administration have seals with the National Emblem shape.
The Minister of Construction shall issue decisions specifying the functions, tasks, powers, and organizational structures of the units under the Ministry; to submit to the Prime Minister for issuance of decisions regarding the list of other public service units under the Ministry as prescribed.
Article 4. Effective date
1. This Decree shall take effect from March 1, 2025.
2. This Decree replaces the following Decrees:
a) Decree No. 52/2022/NĐ-CP dated August 8, 2022, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Construction;
b) Decree No. 56/2022/NĐ-CP dated August 24, 2022, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport.
3. The Vietnam Highway Administration, the Vietnam Expressway Administration, the Vietnam Maritime Administration, the Vietnam Inland Waterway Administration, and the Vietnam Civil Aviation Administration continue to operate according to current regulations until the Minister of Construction completes the restructuring and issues decisions specifying the functions, tasks, powers, and organizational structures of these units as prescribed, to be completed before March 31, 2025. The Enterprise Management Department continues to maintain operations to handle legal procedures related to the restructuring of the Vietnam Shipbuilding Corporation Group and ceases operations before December 31, 2030.
Article 5. Responsibilities for Implementation
The Minister of Construction, Ministers, Heads of Ministries equivalent to ministries, Heads of government agencies, Chairmen of provincial and centrally-administered city People's Committees are responsible for implementing this Decree.
