Guidelines for Implementing Certain Provisions under the State Management Field of the Government Inspectorate Related to Two-Level Local Administration

Pursuant to the Law on Petition dated November 11, 2011;

Pursuant to the Law on Receiving Citizens dated November 25, 2013;

Pursuant to the Law on Reporting Wrongdoing dated June 16, 2018;

Pursuant to the Law on the Organization of the Government dated February 18, 2025;

Pursuant to the Law on Local Administration Organization dated June 16, 2025;

Pursuant to Resolution No. 190/2025/QH15 dated February 19, 2025 of the National Assembly on handling certain issues related to the restructuring of the state apparatus;

Pursuant to Decree No. 109/2025/NĐ-CP dated May 20, 2025 of the Government stipulating the functions, tasks, powers, and organizational structure of the Government Inspector General;

Pursuant to Decree No. 141/2025/NĐ-CP dated June 12, 2025 of the Government stipulating the division of authority of two-level local administration in the state management field of the Government Inspectorate;

At the proposal of the Director of the Legal Department;

The General Inspectorate issues this Circular guiding the implementation of certain provisions under the state management field of the Government Inspectorate related to two-level local administration.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

Article 1. This Circular guides the implementation of certain provisions under the state management field of the Government Inspectorate related to two-level local administration regarding the organization of receiving citizens, handling petitions and reporting wrongdoing at the commune level, information and reporting systems of the People's Councils and People's Committees at the commune level on receiving citizens, handling petitions and reporting wrongdoing, and anti-corruption measures.

Article 2. This Circular applies to the People's Committees of provinces and centrally governed cities (hereinafter referred to as the People's Committee at the provincial level), specialized agencies under the People's Committee at the provincial level and equivalent agencies (hereinafter referred to as specialized agencies under the People's Committee at the provincial level); the People's Committees of communes, wards, and special zones directly under the province (hereinafter referred to as the People's Committee at the commune level), specialized agencies under the People's Committee at the commune level; relevant agencies, organizations, and individuals.

Article 2. Responsibilities of the Chairman of the People's Committee at the provincial level, the Chairman of the People's Committee at the commune level, and related agencies in citizen reception work, petition handling, and anti-corruption

Clause 1. The Chairman of the People's Committee at the provincial level is responsible for directing the implementation of citizen reception work, petition handling, and anti-corruption within the scope of provincial management; examining, resolving, and addressing difficulties and obstacles in implementing citizen reception work, petition handling, and anti-corruption according to the proposal of the Chairman of the People's Committee at the commune level.

Clause 2. The Provincial Inspectorate (hereinafter referred to as the Provincial Inspectorate) is responsible for guiding, monitoring, and urging the People's Committee at the commune level in the implementation of citizen reception work, petition handling, and anti-corruption.

Clause 3. Specialized agencies under the People's Committee at the provincial level within their functions, tasks, and authorities are responsible for coordinating with the People's Committee at the commune level in citizen reception work, petition handling, and anti-corruption.

Clause 4. The Chairman of the People's Committee at the commune level directs and organizes the implementation of citizen reception work, petition handling, and anti-corruption within the commune's management area; reports to the People's Committee at the provincial level and the Provincial Inspectorate on the results of citizen reception work, petition handling, and anti-corruption as prescribed.

Chapter II

GUIDELINES FOR IMPLEMENTING CERTAIN PROVISIONS ON CITIZEN RECEPTION, PETITION HANDLING

Article 3. Implementation of Citizen Reception Tasks at the Commune Level

Clause 1. The Chairman of the People's Committee at the commune level is responsible for directing and organizing the implementation of citizen reception work at the commune level as stipulated in Article 3 of Decree No. 141/2025/NĐ-CP dated June 12, 2025 of the Government stipulating the division of authority of two-level local administration in the state management field of the Government Inspectorate and relevant laws.

Clause 2. The Office of the People's Council and People's Committee at the commune level is responsible for assisting the Chairman of the People's Committee at the commune level in performing the following tasks:

Point a. Assigning personnel to receive citizens regularly at the People's Committee office;

Point b. Advising the Chairman of the People's Committee at the commune level on the implementation of regular and emergency citizen reception tasks as prescribed;

Point c. Receiving, classifying, and processing complaints, accusations, suggestions, and reflections as prescribed;

Point d. Summarizing the situation and results of citizen reception work and document processing at the commune level; reporting periodically and urgently to competent agencies and organizations.

Clause 3. The Office of the People's Council and People's Committee at the commune level advises the Chairman of the People's Committee at the commune level on coordinating with the Party Committee Office, the Inspection Committee of the Party Committee at the commune level, and relevant agencies and organizations in citizen reception work at the People's Committee office.

Clause 4. In cases involving large groups of people, complex situations, and potential impacts on security and public order, the Office of the People's Council and People's Committee at the commune level advises the Chairman of the People's Committee at the commune level to promptly report to the Chairman of the People's Committee at the provincial level for guidance on handling.

The Chairman of the People's Committee at the provincial level directs the Provincial Inspectorate, the Provincial Citizen Reception Board, and relevant functional agencies to guide and coordinate with the People's Committee at the commune level to handle promptly.

Article 4. Handling complaints at commune level

1. The People's Council Office and People's Committee Office at the commune level shall advise the Chairman of the People's Committee at the commune level to assign specialized agencies to examine the acceptance of complaints; if the conditions for acceptance are met, the Chairman of the People's Committee at the commune level shall issue a notice of acceptance; if the conditions for acceptance are not met, a notice of non-acceptance shall be issued to the complainant and the reasons shall be clearly stated.

2. The specialized agency assigned shall conduct verification or advise the Chairman of the People's Committee at the commune level to establish a Verification Team to conduct verification of the complaint content; report the results of the verification, advise the Chairman of the People's Committee at the commune level to examine and issue a decision to resolve the complaint in accordance with the regulations.

3. The People's Council Office and People's Committee Office at the commune level shall advise the Chairman of the People's Committee at the commune level on monitoring, urging, and organizing the implementation of the decision to resolve the complaint issued by the Chairman of the People's Committee at the commune level that has legal effect.

4. In cases where the complainant disagrees with the decision to resolve the complaint made by the Chairman of the People's Committee at the commune level and appeals to the Chairman of the People's Committee at the provincial level, the Chairman of the People's Committee at the provincial level shall review and resolve the second-level appeal in accordance with the law.

Article 5. Handling denunciations at commune level

1. The Chairman of the People's Committee at the commune level shall himself or assign a specialized agency under the People's Committee at the commune level to initially process information about the denunciation, inspect, verify information about the denouncer, the conditions for accepting the denunciation, and advise the Chairman of the People's Committee at the commune level to examine the acceptance of the denunciation.

If the conditions for accepting the denunciation are met, the Chairman of the People's Committee at the commune level shall issue a decision to accept the denunciation and assign a specialized agency under the People's Committee at the commune level to verify the content of the denunciation. If the conditions for acceptance are not met, the Chairman of the People's Committee at the commune level shall not accept the denunciation and notify the denouncer of the reasons.

2. The specialized agency assigned shall conduct verification of the content of the denunciation or advise the Chairman of the People's Committee at the commune level to establish a Verification Team to verify the content of the denunciation; report the results of the verification and advise the Chairman of the People's Committee at the commune level to examine and issue a conclusion on the content of the denunciation.

3. The Chairman of the People's Committee at the commune level shall decide to handle according to his authority or recommend handling the violation behavior based on the conclusion of the denunciation content; notify the conclusion of the denunciation content to the denouncer; direct the monitoring and urging of the implementation of the conclusion of the denunciation content, the decision to handle the violation behavior reported.

Article 6. Amending Circular No. 01/2024/TT-TTCP dated January 20, 2024 of the Government Inspector General on the reporting system for inspection work, receiving citizens, resolving complaints and denunciations, and preventing and combating corruption and negative practices

1. Amend Point a Clause 2 Article 7 as follows:

"a) For periodic reports:

- Specialized agencies under the People's Committee at the commune level and organizations and individuals related within the management area of the commune shall submit their reports to the People's Committee at the commune level no later than the 16th day of the last month of the reporting period;

The People's Committee at the commune level, specialized agencies under the People's Committee at the provincial level, and organizations and individuals related within the management area of the province shall submit their reports to the People's Committee at the provincial level no later than the 18th day of the last month of the reporting period;

The People's Committee at the provincial level shall compile, approve, and submit the report to the State Inspectorate no later than the 20th day of the last month of the reporting period. ...".

2. The provincial inspectorate shall be responsible for guiding the People's Committee at the commune level to implement the information and reporting system as stipulated in Circular No. 01/2024/TT-TTCP and Clause 1 of this Article.

Chapter III

IMPLEMENTING PROVISIONS

Article 7. Effective Date

This Circular takes effect from July 1, 2025.

Article 8. Responsibility for Implementation

1. The Chairman of the People's Committee at the provincial level, the Chairman of the People's Committee at the commune level, and relevant agencies, organizations, and individuals shall be responsible for implementing this Circular.

2. During the implementation process, in case of difficulties or obstacles, agencies, organizations, and individuals are advised to promptly reflect to the State Inspectorate for guidance on implementation or amendment and supplementation as appropriate.
