CIRCULAR
Regulations on certain measures to implement the Chemical Law and Decree No. 25/2026/NĐ-CP of the Government detailing and providing methods for organizing and guiding the implementation of certain provisions of the Chemical Law regarding the development of the chemical industry and chemical safety and security.

Pursuant to Decree No. 40/2025/NĐ-CP of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade, amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CP;
Decree No. Pursuant to Decree No. 25/2026/NĐ-CP of the Government detailing and providing methods for organizing and guiding the implementation of certain provisions of the Chemical Law regarding the development of the chemical industry and chemical safety and security;
At the proposal of the Director of the Chemicals Administration;
The Minister of Industry and Trade issues this Circular stipulating certain measures to implement the Chemical Law and Decree No. 25/2026/NĐ-CP of the Government detailing and providing methods for organizing and guiding the implementation of certain provisions of the Chemical Law regarding the development of the chemical industry and chemical safety and security.
Article 1. Scope of Regulation
This Circular stipulates certain measures to implement the Chemical Law and Decree No. 25/2026/NĐ-CP of the Government detailing and providing methods for organizing and guiding the implementation of certain provisions of the Chemical Law regarding the development of the chemical industry and chemical safety and security, including:
1. Recording the code number of the chemical consulting certificate.
2. Forms used in issuing, reissuing, amending, and revoking the chemical consulting certificate.
3. Contents of the Prevention and Response Plan for Chemical Incidents; Prevention and Response Measures for Chemical Incidents; Prevention and Response Measures for Chemical Incidents during Transportation; Provincial Prevention and Response Plan for Chemical Incidents.
4. Forms used in reviewing and approving the Prevention and Response Plan for Chemical Incidents.
5. Contents, procedures, forms, and files for chemical incident response drills.
6. Levels of authority for reviewing and approving the Prevention and Response Plan for Chemical Incidents within the jurisdiction of the Ministry of Industry and Trade.
Article 2. Applicability
This Circular applies to agencies, organizations, and individuals engaged in activities related to chemicals within the territory of the Socialist Republic of Vietnam.
Article 3. Recording the code number of certificates, forms used in issuing, reissuing, amending, and revoking the chemical consulting certificate
1. Recording the code number of the chemical consulting certificate
a) The code number of a newly issued certificate shall be recorded according to the individual identification number for citizens of the Socialist Republic of Vietnam or the work permit number or confirmation of non-requiring work permit status for foreigners;
b) The code number of an amended certificate shall be recorded according to the structure: (Newly issued certificate code number).XX, where XX is the sequence number of the amendment;
c) The code number of a reissued certificate shall be recorded according to the code number of the most recent previously issued certificate.
2. The forms used in issuing, reissuing, amending, and revoking the chemical consulting certificate are specified in Appendix I attached hereto, including:
a) Form 01a: Application form for issuing, reissuing, and amending the chemical consulting certificate;
b) Form 01b: Confirmation of work experience;
c) Form 01c: Confirmation by the legal representative of the investor regarding completed tasks by the individual;
d) Form 01d: Decision on revoking the chemical consulting certificate.
Article 4. Prevention and Response to Chemical Incidents
1. The contents of the Prevention and Response Plan for Chemical Incidents; Prevention and Response Measures for Chemical Incidents; Prevention and Response Measures for Chemical Incidents during Transportation; Provincial Prevention and Response Plan for Chemical Incidents shall be implemented in accordance with the guidelines set out in Appendix II attached hereto.
2. The forms used in reviewing and approving the Prevention and Response Plan for Chemical Incidents are specified in Appendix III attached hereto, including:
a) Form 03a: Application form for reviewing the Prevention and Response Plan for Chemical Incidents;
b) Form 03b: Minutes and notification of review results of the Prevention and Response Plan for Chemical Incidents;
c) Form 03c: Review and evaluation sheet of the Prevention and Response Plan for Chemical Incidents by members of the Review Board;
d) Form 03d: Report on the implementation of the Review Board's requirements;
đ) Form 03đ: Minutes and report on the Review Board's inspection results;
e) Form 03e: Stamp of approval on the cover page of the approved Prevention and Response Plan for Chemical Incidents.
3. The Chemical Administration reviews and approves the Prevention and Response Plan for Chemical Incidents in civil matters for objects regulated under point a clause 2 Article 33 of Decree No. 25/2026/NĐ-CP.
Article 5. Chemical accident response drill
1. The contents of chemical accident response drills must include the following:
a) Time and location of the drill organization;
b) Assumed scenario for the drill;
c) Response procedures for the assumed scenario;
d) Information on collaborating units, direct participating forces, equipment, and devices serving the drill work.
2. The process of organizing chemical accident response drills shall be carried out as follows:
a) Develop an overall drill script including the contents prescribed in Clause 1 of this Article;
b) After developing the drill organization script, the entity or individual conducting the drill shall develop specific practice exercises for participating forces according to the overall script that has been developed;
c) Organize training and joint exercises for participating forces when necessary;
d) Conduct the drill according to the overall script that has been developed;
đ) Summarize and draw lessons learned;
e) Prepare a report on the drill organization;
g) Implement the system of updating drill files on the specialized chemical database and store drill files for at least three years from the date of completion of the drill organization.
3. Drill files for chemical accident response include:
a) Overall drill script for chemical accident response;
b) List of participating forces and equipment in the chemical accident response drill;
c) Report on the organization of chemical accident response drills prepared according to Model 04 stipulated in Appendix IV issued together with this Circular.
Article 6. Effectiveness
1. This Circular takes effect from January 17, 2026.
2. During implementation, if any difficulties arise, agencies, organizations, and individuals should send their opinions to the Ministry of Industry and Trade (through the Chemicals Department) for timely review, amendment, supplementation, or guidance.

A. GUIDELINES FOR PREPARING THE PLAN AND MEASURES
1. Presentation Techniques
a) Paper size
The chemical accident prevention and response plan and measures shall be presented on A4 paper (210 mm x 297 mm).
b) Layout style
The plan and measures shall be presented along the length of the A4 paper.
c) Margins
- Top margin: Align the top margin from 20 to 25 mm;
- Bottom margin: Align the bottom margin from 20 mm;
- Left margin: Align the left margin from 30 to 35 mm;
- Right margin: Align the right margin from 20 mm;
- Header: On the left side, record the unit's name, on the right side, record "Plan/Measures for Preventing and Responding to Chemical Accidents".
- Footer: Use Insert Page Number, center-align the line (example: Page 2/7)
d) Font
- Use Unicode font, named Times New Roman, size 14, upright style of Microsoft Word editor;
- Normal density without compressing or stretching the space between characters: Paragraph (Before: 6pt; After: 0pt; Line: single).
2. Presentation of Plan and Measures Content
- The content of the plan and measures must be concise, clear, coherent, clean, not erased, and not overuse abbreviations or common English terms. Do not abbreviate long phrases or infrequent terms in the plan and measures. If there are technical terms or abbreviations in the plan and measures, they must be explained;
- Sub-items should be automatically formatted, with a maximum of four digits. Each group of sub-items must have at least two sub-items. For example: If there is sub-item 2.1.1, then there must be 2.1.2;
- Diagrams, drawings, and forms in the plan and measures must have annotations and be numbered sequentially. Images must be clear and not compressed or stretched beyond regulations. Example: Figure 3.2: the second figure in part 3 or section 3;
- Cover of the chemical accident prevention and response plan should be hardbound in blue with gold foil lettering (after revisions according to the comments of the review board). The spine of the plan should bear the name of the unit and the year of implementation;
- Inside cover: Similar to the cover page, printed on regular paper, signed by the representative of the project sponsor with full name and stamped;
- Table of contents: Automatically generated in Word;
- List of tables and figures;
- Map of the land area where the production facility is located: Color-printed on A3 paper;
- Map describing storage locations and conditions of chemicals within the production site layout (underground, semi-underground, above ground): Color-printed on A3 paper;
- Layout diagram of equipment and process flow diagram, quantity of hazardous chemicals at main production equipment and intermediate storage tanks: Printed on A3 paper;

3. Production technology, detailed description of production processes, usage, transportation, and storage of chemicals.

7. List of industrial works, military facilities, residential areas, administrative zones, commercial areas, religious structures, and environmentally sensitive areas within a 1000-meter radius around the project location, chemical facility;
8. Assessment of the influence of the above conditions on preventive and emergency response measures for chemical accidents;
Chapter 2
PREVENTION AND EMERGENCY RESPONSE TO CHEMICAL ACCIDENTS
1. Risk prediction
Establish a list of risk points including locations of major hazardous chemical production equipment, equipment or areas concentrating hazardous chemical storage, along with production and storage conditions; number of workers expected to be present in the area;
2. Scenario prediction
Predict typical accident scenarios that may occur at identified risk points, estimate subsequent consequences, impact range, and degree of impact on people and the surrounding environment if the accident is not controlled or prevented, classify the accident (the determination of consequences must be based on the maximum level of operation of hazardous chemical production or storage equipment under the most severe conditions);
3. General management solutions for preventing chemical accidents.
- Regulations, procedures, warnings, monitoring.
- Specialized chemical safety training.
- Inspection, maintenance, and repair plans for technological equipment.
- Plans to inspect and monitor potential accident sources; regular and spot-check inspection plans; responsibilities of inspectors, inspection contents, and monitoring.
- Plan to enhance capabilities in preventive and emergency response work for chemical accidents.
4. Technical solutions for preventing and responding to chemical accidents
- Identify technical solutions to prevent chemical accidents in typical areas identified.
- Develop technical plans to respond to chemical accidents based on predicted scenarios including: technical methods, materials, and equipment for response; selection of personal protective equipment; deployment and mobilization plans for base forces to respond to accidents.
- Evacuation plan for people and assets.
5. Plan to build human resources and equipment for preventive and emergency response work for chemical accidents
5.1. Human Resources
- Emergency response organizational structure and command system.
- Minimum requirements for positions related to chemicals and emergency response forces.
5.2. Material and Equipment Capabilities
- List of equipment and means used for emergency response to chemical accidents: equipment name, quantity, condition; protective systems and backup systems for rescue, accident prevention, and personal protective equipment for workers and rescue forces suitable for hazardous chemicals in the facility, project.
- Early warning systems, internal information systems, and external notification systems in case of emergencies.
- Replacement, repair, and supplementation plans for the aforementioned equipment.
6. Plan for coordination of internal and external forces participating in emergency response when beyond control.
