DECISION NO. 02/TTLT OF JANUARY 25, 1994 ISSUED BY THE JOINT MINISTRIES OF LABOR - WAR INVALIDS AND SOCIAL AFFAIRS - FINANCE GUIDING THE IMPLEMENTATION OF THE SPECIAL ALLOWANCE REGIME
Implementing Article 3 of Decision No. 574/TTg dated November 25, 1993 of the Prime Minister on the special allowance regime applicable to civil servants, officials, and military personnel working in certain remote islands and border areas with particularly difficult living conditions; after reaching consensus with the Ministry of National Defense, the Ministry of Interior, and the Government's Organization-Civil Service Department, the Joint Ministries of Labor - War Invalids and Social Affairs - Finance hereby guide the implementation as follows:
Those individuals working in the areas specified in the annex attached hereto shall be entitled to special allowances including:
- Officers, professional soldiers, civilian employees, non-commissioned officers, and soldiers in the armed forces;
I. SCOPE AND APPLICABLE ENTITIES
- Civil servants and officials in administrative and public service agencies;
- Cadres and civilian employees of Party and mass organizations;
- Workers and officials in enterprises.
II- AMOUNT OF SPECIAL ALLOWANCE AND METHOD OF PAYMENT
a- The special allowance is calculated based on the rank pay, or military rank allowance, grade pay, or position pay.
b- The special allowance includes three levels: 100%, 50%, and 30%, applied to the aforementioned subjects according to the areas specified in the annex attached hereto.
1. Level of Allowance
Example 1: A Major with a rank pay coefficient of 3.5; the monthly salary received as of April 1, 1993 was 237,000 VND; in an area where the special allowance rate is 50%, the monthly special allowance received would be:
237,000 VND x 50% = 118,500 VND/month.
Example 2: An Official with a pay grade coefficient of 2.51; the monthly salary received as of April 1, 1993 was 182,000 VND; in an area where the special allowance rate is 30%, the monthly special allowance received would be:
182,000 VND x 30% = 54,600 VND/month.
2. Method of Payment
- The special allowance is calculated and paid according to the place of work along with the monthly salary or military rank allowance.
- For those receiving salaries from the state budget, the special allowance is paid by the state budget according to the current decentralization regulations. For enterprises, it is included in the unit labor cost and accounted for in production costs or circulation fees.
- The special allowance is only paid for months actually worked in the designated area; if leaving the area for more than one month (excluding leave) or arriving to work for less than a full month, no allowance will be granted.
- This allowance is not used to calculate social insurance benefits.
