Guidelines for issuing import permits for raw timber of Cambodian origin

Pursuant to the Government Decree No. 33/CP dated April 19, 1994 on state management of export and import activities;

Pursuant to the Prime Minister's Decision No. 1124/1997/QĐ-TTg dated December 25, 1997 on the export of wood products and forest products and the import of raw timber;

Pursuant to the documents No. 02/CP-KTTH-m dated January 13, 1998 of the Government and No. 15/VPCP-KTTH-m dated January 19, 1998 of the Government Office;

The Ministry of Trade guides the procedures for issuing import permits for Cambodian timber raw materials through formal channels as follows:

This technical regulation sets out technical requirements, testing methods, sampling procedures; management requirements; responsibilities of organizations and individuals producing, trading, and importing cigarettes.

Article 1. This Circular regulates the formal importation of raw timber of Cambodian origin (which has been granted an export permit by the competent authority in Cambodia) through border gates on land.

Article 2. Raw timber referred to in this Circular includes round logs (peeled or unpeeled), sawn timber, and planks of all species.

Artificial boards, glued laminated timber, and other wooden products imported according to Clause 3(a), Article 5, Decision No. 1124/1997/QĐ-TTg dated December 25, 1997 of the Prime Minister, are not subject to the regulations of this Circular.

Article 3. Enterprises with import-export business licenses for relevant goods, if they have complete and valid documentation, are entitled to apply for the import of raw timber from Cambodia.

II. APPLICATION DOCUMENTS FOR IMPORT PERMIT

The application documents for import permit include:

The enterprise's request letter must clearly state the name of the selling enterprise, the original species, specifications of the timber (round logs, sawn timber, or planks), quantity sold, and the port of entry.

A copy of the Import-Export Business License

The original principle contract signed with the Cambodian enterprise.

A copy of the export permit issued by the Cambodian Prime Minister's Office or the Cambodian Council of Ministers' Office or the Cambodian Ministry of Commerce, specifying the exporting enterprise, type of timber, specifications, and quantity permitted for export. This copy must be translated into Vietnamese, certified by the Vietnamese Embassy in Cambodia, or the Vietnamese Trade Counselor in Cambodia, or a Vietnamese notary public, or the Cambodian Embassy in Hanoi.

III. IMPLEMENTATION PROVISIONS

Article 1. Import permits for raw timber of Cambodian origin issued by the Ministry of Agriculture and Rural Development before the issuance of this Circular remain valid but their implementation period shall not exceed September 30, 1998.

Article 2. Payment procedures for imported goods and customs procedures for imported goods shall be carried out in accordance with current regulations.
