JOINT CIRCULAR

Guidelines for the Import of Automobile Spare Parts in CKD Form

Pursuant to the Law on Foreign Investment in Vietnam 1996, the Law Amending and Supplementing Certain Provisions of the Law on Foreign Investment in Vietnam 2000, and Decree No. 24/2000/NĐ-CP dated July 3, 2000 of the Government detailing the implementation of the Law on Foreign Investment in Vietnam;

Pursuant to the Prime Minister's opinion in Notification No. 365/CP-KTTH dated April 10, 1999 of the Government Office;

The Ministry of Planning and Investment, the Ministry of Industry, and the Ministry of Trade issue this Circular guiding automobile assembly enterprises in importing automobile spare parts in CKD form as follows:

1. Automobile production and assembly enterprises permitted to operate in Vietnam may import automobile spare parts in CKD form to explore domestic market consumption for new car models with a maximum quantity of 300 vehicles and a maximum duration not exceeding two years for each new car model.

2. When launching a new product, the enterprise must register to supplement the new product in the list of products in the Economic and Technical Feasibility Study or Feasibility Study Report submitted to the Ministry of Planning and Investment when applying for an Investment License.

3. After the Ministry of Planning and Investment confirms the registration of the supplementary product list, the enterprise shall report to the Ministry of Trade to handle the import procedures according to current regulations.

4. For new car models currently being assembled by the enterprise, if the required quantity has not yet been imported and there is a need, the Ministry of Trade will consider allowing additional imports up to the total quantity of 300 vehicles; otherwise, no further imports will be considered.

This Circular takes effect from the date of issuance.
