DIRECTIVE

Regarding the implementation of Circular Joint Circular No. 08/2003/TTLT-BYT-BTC dated July 25, 2003 of the Ministry of Health and the Ministry of Finance guiding the declaration and display of prices for disease prevention and treatment drugs for people.

To implement the Price Law and the directives of the Prime Minister, the Ministry of Health and the Ministry of Finance jointly issued Joint Circular No. 08/2003/TTLT-BYT-BTC dated July 25, 2003 to guide the declaration and display of prices for disease prevention and treatment drugs for people.

Displaying drug prices is a regular activity of retailers, but it is a new and challenging issue for drug production and import facilities. Therefore, the ministries have agreed to postpone the implementation of the requirement for production and import facilities to display retail drug prices until January 1, 2004. To stabilize the drug market and protect consumer interests, the Minister of Health instructs:

1. Strictly continue implementing Joint Circular No. 08/2003/TTLT-BYT-BTC and Circulars No. 9080/YT-QLD dated September 22, 2003; No. 9251/YT-QLD dated September 29, 2003 of the Ministry of Health and the Ministry of Finance.

Directors of Provincial Health Departments, Heads of health sectors are responsible for organizing, urging, inspecting, and supervising the implementation of these documents at drug production, import, and trading facilities within their jurisdiction.

2. All drug production, import, and trading facilities must develop pricing plans ensuring reasonable costs including expenses and appropriate profits; they shall not display drug prices higher than actual costs.

3. The Inspectorate of the Ministry of Health shall lead and coordinate with the Vietnam Drug Administration, the Price Management Department of the Ministry of Finance, and related agencies to conduct inspections on the implementation of Joint Circular No. 08/2003/TTLT-BYT-BTC and Circulars No. 9080/YT-QLD dated September 22, 2003; No. 9251/YT-QLD dated September 29, 2003 of the Ministry of Health and the Ministry of Finance for all drug production and trading facilities nationwide. Strictly handle organizations and individuals who violate the law.

Upon receipt of this Directive, the Director of the Vietnam Drug Administration, the Head of the Inspectorate of the Ministry of Health, the Directors of Provincial Health Departments under the Central Government, and Heads of health sectors must immediately organize its implementation and report the results to the Minister of Health./.
