DECISION

Approving the orientation of planning for training and improving cadres and civil servants at commune, ward, and town levels until 2010

Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the Cadres and Civil Servants Ordinance dated February 26, 1998, and the Ordinance dated April 29, 2003 amending and supplementing certain articles of the Cadres and Civil Servants Ordinance dated February 26, 1998;
Pursuant to Decree No. 114/2003/NĐ-CP dated October 10, 2003 of the Government on civil servants at commune level;
Pursuant to Decision No. 85/2002/QĐ-TTg dated June 28, 2002 of the Government Chairman on the issuance of the Implementation Plan for Resolution No. 17-NQ/TW dated March 18, 2002 of the Fifth Plenary Session of the Central Committee of the Communist Party of Vietnam (9th tenure) on "Reforming and Enhancing the Quality of the Political System at Commune, Ward, and Town Levels";
Pursuant to Decision No. 161/2003/QĐ-TTg dated August 4, 2003 of the Prime Minister promulgating the Training and Skill Development Regulations for Civil Servants;

Article 1. Approving the Orientation of Planning for Training and Improving Cadres and Civil Servants at Commune, Ward, and Town Levels until 2010 (hereinafter referred to as cadres and civil servants at commune level) with the main contents as follows:

I. OBJECTIVES, REQUIREMENTS, AND TARGETS OF TRAINING AND IMPROVEMENT PLANNING FOR CADRES AND CIVIL SERVANTS AT COMMUNE LEVEL

1. Objectives

a) General objectives until 2010

Building, standardizing, and gradually rejuvenating the cadre and civil servant team at commune level, particularly key cadres, with firm political resolve, qualities, and capabilities, ensuring sufficient quantity, standards, and structural coherence across generations in terms of qualifications and management skills to reform and enhance the quality of the political system at commune, ward, and town levels.

b) Specific Objectives

Training and improving cadres and civil servants at commune level according to position standards, equipping and supplementing specialized knowledge and management skills to enable them to fulfill their assigned tasks effectively.

- By the end of 2005, strive to achieve:

+ 70 - 80% of specialized cadres holding positions through elections will be trained and improved to meet the prescribed standards regarding theoretical political education, administrative state management, specialized knowledge, and management skills;

+ 80% of commune-level civil servants in delta and urban areas will have a minimum qualification of college level;

+ 100% of key cadres and specialized positions in mountainous, remote, ethnic minority, and island communes will be trained and improved in administrative state management and specialized knowledge to a basic level; selecting 25% of this cadre and civil servant group for planning to train to a college level.

- From 2006 to 2010, based on the results achieved and experiences from this period, strive to raise the qualifications of commune-level cadres and civil servants holding positions to a college level or higher; achieving the goal of rejuvenating the cadre and civil servant team at commune level, particularly key cadres; ensuring sufficient quantity, standards, and structural coherence.

2. Requirements

a) Gradually meeting the requirements for economic and social development, national defense, and security, as well as the management and operational needs of the commune-level government.

b) Ensuring feasibility.

c) Ensuring coherence and continuity within the cadre and civil servant team at commune level.

d) Gradually standardizing and rejuvenating the cadre and civil servant team at commune level, enhancing the quality of the cadre and civil servant team within the political system at the grassroots level.

3. Targets

The training and improvement planning applies to the following targets:

a) Those elected to hold positions for a term (commonly referred to as specialized cadres at commune level) within the grassroots political system including:

- Secretary, Deputy Secretary of the Party Committee, Standing Committee of the Party Committee (in places without a dedicated Deputy Secretary for Party Affairs), Secretary, Deputy Secretary of the Branch Committee (for communes not yet established with a Party Committee);

- Chairperson, Deputy Chairperson of the People's Council;

- Chairperson, Deputy Chairperson of the People's Committee;

- Chairperson of the Vietnam Fatherland Front, Secretary of the Ho Chi Minh Communist Youth Union, Chairperson of the Women's Union, Chairperson of the Farmers' Association, Chairperson of the Veterans' Association.

b) Those recruited or appointed to hold specialized positions under the commune-level People's Committee (commonly referred to as civil servants at commune level) including the following positions:

- Head of Public Security (in places without regular Public Security forces);

- Military Commander;

- Office - Statistics;

- Finance - Accounting;

- Land Administration - Construction;

- Justice - Household Registration;

- Culture - Social Affairs.

c) Those included in the planning to predict sources for the above positions, including:

- Graduates of vocational secondary schools, colleges, and universities who meet the specific requirements of specialized positions at commune level, currently unemployed but residing in the locality;

- Those who have completed their service in military, public security forces, youth volunteers, and other local individuals with high school graduation qualifications meeting the criteria for cadre and civil servant positions at commune level.

II. ORIENTATION OF PLANNING FOR TRAINING AND IMPROVEMENT OF CADRES AND CIVIL SERVANTS AT COMMUNE LEVEL

1. Planning for training and improvement of cadres and civil servants at commune level by position

Planning for training and improvement of cadres and civil servants at commune level by position focuses on the following contents:

- Training and supplementary training in theoretical political education, administrative state management, and specialized knowledge for those currently holding positions through elections or specialized positions within the age range for planning (under 45 years old) who meet cultural standards but lack the aforementioned knowledge;

- Updating specialized knowledge for those holding positions through elections or specialized positions nearing retirement age as prescribed but lacking specialized knowledge standards;

- Supplemental training in specialized knowledge and skills for those proposed for concurrent positions through concentrated study or part-time study.

Training and improvement of specialized positions at commune level should prioritize those who have not been trained or improved in specialized knowledge and skills while currently responsible for such roles.

2. Planning for training and improvement of cadres and civil servants at commune level by region

a) Delta and urban areas

Planning for training and improvement of cadres and civil servants at commune level focuses on the following contents:

- Training incumbent cadres according to the principle that those within the planning age range but lacking certain knowledge will be trained and improved in that area to reach a college level or higher.

- Training individuals to replace retired officials currently working at local levels and those who are elderly.

b) Mountainous communes, remote areas, ethnic minority regions, and island territories

The training and capacity building plan for commune-level civil servants focuses on the following contents:

- Planning education levels linked with specialized vocational training and political theory according to programs guided by the Ministry of Education and Training to quickly establish a cadre of commune-level civil servants with sufficient knowledge and management capabilities for economic and social affairs in their locality.

- Planning the training of cadres through the fulfillment of duties in armed forces (military, police) and voluntary youth organizations; through the rotation of cadres from districts and provinces to work at grassroots levels.

3. Planning the training and capacity building of commune-level civil servants

For individuals who have completed their obligations in armed forces (military, police), voluntary youth organizations, and other local residents with a high school diploma, meeting the criteria for commune-level civil servant positions; graduates from vocational schools, colleges, and universities residing in the locality without employment, the planning for training and capacity building will include the following:

- Developing plans for training sources among those who have fulfilled their duties in armed forces (military, police), voluntary youth organizations, and have a high school diploma;

- Conducting surveys, compiling, analyzing, and categorizing graduates from vocational schools, colleges, and universities residing in the locality without employment; developing plans to supplement missing knowledge for these individuals;

- Anticipating plans for training and capacity building of non-professional cadres and contractual staff to be included in the cadre planning for professional civil servants (considered as reserve civil servants of the grassroots level);

- Forecasting the training needs of the locality to develop plans for training reserve cadres according to job titles to prepare for supplementation and replacement when necessary.

III. CONTENTS, PROGRAMS, FORMS, TRAINING AND CAPACITY BUILDING INSTITUTIONS FOR COMMUNE-LEVEL CIVIL SERVANTS

1. Requirements

a) Programs, textbooks, training materials for commune-level civil servants shall be developed in accordance with the spirit of innovation, consistent with the Party's policies, state laws, administrative reform requirements, and geographical characteristics, educational levels, and management capabilities of commune-level authorities in each region.

b) Training and capacity building content must be closely aligned with practical situations, specific to each position, function, and responsibility, emphasizing the combination of theoretical training according to program objectives with situational training and methods for handling specific situations in management and professional tasks.

2. Contents, Programs for Training and Capacity Building

a) For party and mass organization cadres: Secretaries, Deputy Secretaries of the Party Committee, Standing Members of the Party Committee, Secretaries, Deputy Secretaries of the Branch Committee (for communes that have not established a Party Committee), Chairpersons of the Vietnam Fatherland Front, Secretaries of the Ho Chi Minh Communist Youth Union, Chairpersons of the Women's Union, Farmers' Association, Veterans' Association, need to be trained and developed:

- Intermediate level in political theory and intermediate level in professional and vocational training according to the current position (for communes in plains and urban areas);

- Combining academic qualifications with training in political theory and professional and vocational training programs (for mountainous, remote, ethnic minority, and island communes).

b) For government cadres: Chairpersons, Deputy Chairpersons of the People's Council; Chairpersons, Deputy Chairpersons of the People's Committee, need to be trained:

- Intermediate level in political theory, intermediate level in public administration management, and intermediate level in professional and vocational training (for communes in plains and urban areas);

- Combining academic qualifications with training in political theory, public administration management, and professional and vocational training programs (for mountainous, remote, ethnic minority, and island communes).

c) For specialized positions within the People's Committee at the commune level (as stipulated in Point b Clause 3 Section I of this Article), the content and program of training:

- Intermediate level in professional and vocational training, basic knowledge in office computer skills (for communes in plains);

- For cadres and civil servants in wards of cities directly under provincial and central governments, general training in office computer skills programs;

- Combining academic qualifications with professional and vocational training (for mountainous, remote, ethnic minority, and island communes);

d) Training and capacity building in ethnic languages for commune-level cadres and civil servants who do not know the ethnic language in communes where ethnic minorities make up 50% or more of the population.

3. Forms of Training

Forms of training include regular, non-regular, semi-concentrated, short-term, and long-term capacity building.

4. Training and Capacity Building Institutions

a) Strengthening and consolidating the capacity for training and capacity building of political schools, military schools of provinces and centrally-administered cities, vocational schools, colleges, and universities assigned the task of training and capacity building for commune-level civil servants.

b) Developing plans to enhance the quality of teaching staff at institutions training commune-level civil servants.

5. Implementation Measures

a) Continuing to perfect legal documents on the training and capacity building of commune-level civil servants.

b) Surveying, statistics, and analyzing the current status of commune-level civil servants based on criteria such as age, gender, ethnicity, religion, position, years of service, academic qualifications, political theory, public administration management, and professional and vocational training, serving as a basis for developing training and capacity building plans for commune-level civil servants.

c) Forecasting needs and developing training and capacity building plans for commune-level civil servants from now until 2005 and 2010.

d) Develop training and capacity-building plans for village-level civil servants by position and region; plan for source cadres and civil servants.

Article 2. Allocation of organizational implementation

1. Ministry of Home Affairs

a) Guide provinces and centrally-administered cities to develop training and capacity-building plans for village-level civil servants; compile national training and capacity-building plans for village-level civil servants.

b) Lead and coordinate with the Ministry of Finance to amend and supplement policies and systems for village-level civil servants sent for training and capacity building.

c) Lead and coordinate with relevant agencies to research and unify the framework programs for training and capacity building for village-level civil servants.

d) Lead and coordinate with the Ministries of Finance, Justice, Natural Resources and Environment, Education and Training, Labor, Invalids and Social Affairs, Culture, Sports and Tourism, National Defense, and Public Security to direct vocational secondary schools, colleges, and specialized universities assigned tasks for training and capacity building for village-level professional civil servants to develop programs, compile textbooks, and prepare training materials on various professional subjects to train and build capacity for village-level civil servants.

đ) Lead and coordinate with relevant agencies to prepare program contents, textbooks, and training materials for ethnic language training for state civil servants and village-level civil servants in localities with ethnic minorities.

e) Inspect the annual and five-year training and capacity-building plans for village-level civil servants in provinces and centrally-administered cities; compile and evaluate the results and effectiveness of training and capacity building for village-level civil servants nationwide; report periodically every two years.

2. The Ministry of Planning and Investment, the Ministry of Finance

a) The Ministry of Planning and Investment leads and coordinates with the Ministry of Finance and the Ministry of Home Affairs to guide localities to balance the annual and five-year budget plans allocated for the training and capacity building of village-level civil servants.

b) The Ministry of Finance leads and coordinates with the Ministry of Planning and Investment and the Ministry of Home Affairs to develop investment plans for infrastructure and teaching equipment for institutions directly tasked with training and capacity building for village-level civil servants in provinces and centrally-administered cities, to be submitted to the Prime Minister for decision.

3. Ho Chi Minh National Political Academy

Lead and coordinate with the Ministry of Home Affairs (National Administration Academy) to integrate intermediate political theory training programs with intermediate public administration management training programs to organize training for village-level civil servant teams.

4. The Ministry of Education and Training

Lead and coordinate with the Ministry of Home Affairs to issue regulations guiding the implementation of combined academic education and professional training for specialized positions within village People's Committees in mountainous areas, remote regions, ethnic minority areas, and islands. Prioritize the Central Highlands, northern mountainous provinces, and southwestern provinces.

5. Ministry of Public Security, Ministry of National Defense

Lead and coordinate with the Ministry of Home Affairs to direct specialized schools under their ministries:

a) Develop programs and compile textbooks on professional subjects to train intermediate level for Village Police Chiefs and Military Commanders at the village level in plains and urban areas.

b) Develop programs and compile training materials on professional subjects for Village Police Chiefs and Military Commanders in mountainous areas, remote regions, ethnic minority areas, and islands.

6. People's Committees of provinces and centrally-administered cities

Based on government regulations on village-level civil servants; geographical and natural characteristics, economic and social development requirements, and educational levels of each locality; planning for village-level civil servants and the capabilities of local training institutions, People's Committees of provinces and centrally-administered cities:

a) Direct and guide district-level People's Committees to conduct surveys, statistics, analysis, and classification of village-level civil servants to serve the work of developing training and capacity-building plans.

b) Compile training and capacity-building plans for village-level civil servants; develop five-year and annual training and capacity-building plans for village-level civil servants in their locality, submit them to the Ministry of Home Affairs, and organize their implementation.

c) Compile the number of civil servants trained annually, evaluate the effectiveness of annual training and capacity-building for grassroots civil servants, and report to the Ministry of Home Affairs.

d) Within the scope of government regulations, issue appropriate policies and systems based on local realities to motivate and encourage village-level civil servants to participate in learning.

Article 3. This Decision takes effect fifteen days from the date of publication in the Official Gazette.

Article 4. Ministers, heads of ministerial-level agencies, heads of agencies under the Government, Chairpersons of People's Councils, and Chairpersons of People's Committees of provinces and centrally-administered cities are responsible for implementing this Decision.
