Pursuant to the Law on Practicing Thrift and Combating Waste dated November 29, 2005;

Pursuant to Decree No. 62/2003/NĐ-CP dated June 6, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Justice;

Pursuant to Decision No. 25/2006/QĐ-TTg dated January 26, 2006 of the Prime Minister on the issuance of the Action Program of the Government on practicing thrift and combating waste;

Considering the proposal of the Head of the Steering Committee for Practicing Thrift and Combating Waste of the Ministry of Justice.

Pursuant to …;

Article 1. Issuing along with this Decision the Action Program of the Ministry of Justice on practicing thrift and combating waste.

Article 2. This Decision shall take effect 15 days from the date of publication in the Official Gazette.

Article 3. Members of the Steering Committee, Heads of units under the Ministry of Justice, Heads of Enforcement Agencies at all levels are responsible for implementing this Decision.

ACTION PROGRAM OF THE MINISTRY OF JUSTICE

ON PRACTICING THRIFT AND COMBATING WASTE

(Issued together with Decision No. 03/2006/QĐ-BTP dated May 29, 2006

of the Minister of Justice)

A. OBJECTIVES AND REQUIREMENTS OF THE PROGRAM

1. Objectives:

- Practicing thrift and combating waste in the sector primarily involves the Ministry of Justice and its subordinate units to enhance the efficiency of management and utilization of resources for the development of the Justice Sector;

- Enhancing the sense of responsibility of each civil servant, employee, and officer within the Ministry of Justice and its subordinate units regarding practicing thrift and combating waste.

- Creating a foundation and making practicing thrift and combating waste a regular task for each agency and unit in the coming years.

2. The remaining 60% shall be used to supplement the operating funds of units directly responsible for public debt management at the Ministry of Finance (outside the regular state budget allocation for ongoing operations as currently provided) for the purposes specified in Article 4 of this Decision.

- Drafting and issuing guiding documents to implement the Government's Action Program on practicing thrift and combating waste within the scope of management of the sector;

- Implementing immediately and effectively certain tasks to create a strong change in practicing thrift and combating waste in 2006.

B. CONTENTS OF THE ACTION PROGRAM

1. Reviewing, issuing legal normative documents and other legal documents to implement the Law on Practicing Thrift and Combating Waste.

- The Department of Planning and Finance shall take the lead in reviewing the system of standards, norms, and regulations in budget management and usage, investment in construction, and management and usage of office premises. Based on the review results, it will establish a list of missing or unsuitable standards, norms, and regulations to plan revisions, supplements, or new issuances within its authority or to submit to competent authorities for issuance.

2. Organizing study sessions, research, and dissemination of the Law on Practicing Thrift and Combating Waste.

- The Department of Legal Education and Propaganda shall coordinate with the Office of the Ministry and the Department of Organization and Cadres to organize meetings to disseminate the Law on Practicing Thrift and Combating Waste, the Government's Action Program on Practicing Thrift and Combating Waste, and the Ministry of Justice's Action Program on Practicing Thrift and Combating Waste to all civil servants, employees, and officers of the Ministry's units.

- The Department of Legal Education and Propaganda shall assist the Minister in coordinating with the Ministry of Finance to guide the implementation of study sessions, research, and dissemination of the Law on Practicing Thrift and Combating Waste among cadres, civil servants, and officers of ministries, sectors, and localities.

- Heads of Civil Execution Agencies at provincial and district levels shall organize dissemination of the Law on Practicing Thrift and Combating Waste, the Government's Action Program on Practicing Thrift and Combating Waste, and the Ministry of Justice's Action Program on Practicing Thrift and Combating Waste to the staff of their units.

- The Vietnam Law Newspaper, Democratic and Legal Journal, and Information Center shall be responsible for intensifying propaganda and popularization work on laws on practicing thrift and combating waste; highlighting good examples of thrift and waste prevention; and promptly identifying and recommending handling of organizations and individuals who violate these laws and cause waste.

3. Implementing transparency to facilitate inspection and supervision of practicing thrift and combating waste.

Budgetary units shall comply with transparency regulations to facilitate inspection, audit, and supervision of practicing thrift and combating waste, and strengthen inspection of compliance with transparency regulations in budgetary units.

Heads of budgetary units must implement transparency according to the law. First, they must disclose the use of state budget funds and assigned financial resources, procurement and use of office equipment and vehicles, and management and use of office premises and other assets of the unit.

Heads of budgetary units are responsible for reporting the implementation of transparency in their units and the results of supervising practicing thrift and combating waste to the Steering Committee for Practicing Thrift and Combating Waste for consolidation and periodic reporting to the Minister.

4. Inspecting, auditing, and handling violations of regulations on practicing thrift and combating waste.

The Inspectorate of the Ministry, in coordination with relevant units, shall inspect and handle violations of practicing thrift and combating waste that have been discovered through inspections and audits but not yet resolved, and publicly announce the results of handling within the agency.

In 2006, the Inspectorate of the Ministry and the Department of Planning and Finance need to focus on auditing and inspecting some budgetary units in areas such as management of construction investments, management and use of administrative and public service funds, and funding for projects. Additionally, they must inspect and audit according to the Minister's decision when there are complaints or reports.

The People's Inspectorates within their duties and powers shall supervise the implementation of laws on practicing thrift and combating waste.

5. Effectively implementing practicing thrift and combating waste in various fields:

5.1. Management and use of state budget:

- The Department of Planning and Finance shall strictly implement the stages of budget preparation, allocation, management, use, and settlement for budgetary units; and strengthen control over budget spending according to the approved budget and standards.

- Budgetary units implementing the self-management regime and bearing responsibility for the use of staff positions and administrative management funds must establish Internal Expenditure Regulations, clearly stipulating the use of budget funds for conference, seminar, symposium, reception, business trip, electricity, water, official telephone, fuel, office supplies, books, magazines, publications... expenditures must be frugal and in accordance with state regulations. Publicize business trips and travel expenses down to each individual within the unit.

- The Institute of Legal Science shall review research topics that have been approved by the Ministry's leadership. Conduct evaluations and compile a list of research topics that are delayed or ineffective, reporting to the Ministry's leadership for consideration and handling. Implement a pilot mechanism for competitive bidding to select agencies, units, organizations, or individuals to carry out research topics.

- The Department of Legal Propaganda and Education shall take the lead and coordinate with the Legal Publishing House, the Department of Planning and Finance, the Ministry's Office, and related units to review publications, newsletters, books, newspapers, magazines, gift books, and propose strict management measures to avoid waste and improve efficiency.

- The Ministry's Office shall develop a proposal to review and reduce administrative documents and papers in the operations of agencies and units in accordance with Directive No. 10/2006/CT-TTg dated March 23, 2006, of the Prime Minister.

5.2. Investment Management in Construction Projects:

- The Department of Planning and Finance shall review investment construction projects that lack necessary procedures according to regulations to reallocate capital to projects with complete procedures that can commence construction in 2006.

- In 2006, based on the Construction Law, the Bidding Law, and guiding documents, the Department of Planning and Finance shall be responsible for developing a management procedure for investment in construction projects to enhance the effectiveness of management and investment, submitting it to the Minister for consideration and approval.

5.3. Management and Use of Assets and Working Equipment:

The Department of Planning and Finance shall take the lead and coordinate with the heads of budgetary units to direct a comprehensive inventory of assets and working equipment, properly disposing of assets that have reached their depreciation period or are damaged and unusable according to regulations.

The heads of budgetary units shall be responsible for establishing asset management and usage regulations at their units to enhance the effectiveness of management and use, linking responsibilities to individuals assigned to manage and use public assets.

5.4. Strengthening Supervision and Evaluation of Compliance with Labor Rules and Discipline:

The Ministry's Office shall cooperate with the Department of Cadre and Civil Servant Affairs to strengthen supervision and evaluation of compliance with labor rules and discipline among cadres and civil servants. Based on this, they shall develop measures to improve the implementation of labor rules and discipline by each cadre and civil servant. Incorporate the implementation of labor rules and discipline into annual performance reviews and awards for individuals, units, and groups.

C. IMPLEMENTATION:

Based on this Action Program, the heads of units shall be responsible for strictly organizing and implementing, conducting inspections, summarizing, and correcting promptly. They must report progress and results of assigned tasks in the Action Program to the Steering Committee monthly in the first month of each quarter.

The Steering Committee shall be responsible for monitoring, urging, and periodically compiling reports to the Minister every quarter on the implementation of the Action Program.

The Steering Committee shall be responsible for compiling the situation of implementing the Action Program, reporting to the Minister for consideration and approval, and sending it to the Ministry of Finance before September 15th annually./.
