CIRCULAR

Supplementing certain contents of Circulars No. 02/2005/TT-BXD;

Circular No. 04/2005/TT-BXD and Circular No. 06/2005/TT-BXD

of the Ministry of Construction

Pursuant to the Construction Law No. 16/2003/QH11 dated November 26, 2003 of the National Assembly, session XI, fourth meeting;

Pursuant to the Government Decree No. 16/2005/NĐ-CP dated February 7, 2005 on Management of Investment Project Construction Works;

Pursuant to the Government Decree No. 36/2003/NĐ-CP dated April 4, 2003 on the functions, tasks, powers, and organizational structure of the Ministry of Construction;

In response to the proposals from some ministries, sectors, and localities regarding the supplementation of Circular No. 02/2005/TT-BXD dated February 25, 2005 guiding contracts in construction activities; Circular No. 04/2005/TT-BXD dated April 1, 2005 guiding the preparation and management of project investment construction work costs; Circular No. 06/2005/TT-BXD dated April 15, 2005 guiding the method for establishing machinery and equipment construction prices, the Ministry of Construction supplements the following contents:

1. Supplementing cases for adjusting construction contract prices at Section 3.2, Point II, Part II of Circular No. 02/2005/TT-BXD dated February 25, 2005 guiding contracts in construction activities. as follows:

a. When the investor or the project owner adjusts the project due to the emergence of new factors that bring higher economic and social benefits to the project.

b. When the approved urban planning changes directly affecting the project.

2. Supplementing general cost rates in Table 2 of Appendix No. 3 of Circular No. 04/2005/TT-BXD dated April 1, 2005 guiding the preparation and management of project investment construction work costs. as follows:

- For civil works:

+ Restoration and recovery of historical and cultural relics: 10%.

- For transportation works:

+ Routine maintenance and repair of roads and railways: 12%.

+ Routine maintenance and repair of waterways and maritime signaling systems: 20%.

The common costs of electrical line and substation testing, material, component, and structural testing for construction projects shall be calculated at 65% of the labor cost in the budget estimate.

3. Circular No. 06/2005/TT-BXD dated April 15, 2005 guiding the method for establishing machinery and equipment construction prices.

- Supplementing machinery and equipment for construction into the table of parameters serving the establishment of machinery and equipment construction prices as detailed in this Circular.

- When establishing machinery and equipment construction prices for preparing survey construction unit prices, the labor cost for machine operators is not included in the machinery price as it has been accounted for in the labor norms for survey construction; when preparing unit prices for material, component, and structural construction testing, the labor cost for machine operators, fuel, and energy costs are not included in the machinery price as these expenses have already been accounted for in the labor norms and material norms.

- Specifically, the fuel and energy consumption norms for river work vessels and high-speed boats stipulated in this table are norms during travel; operation norms are calculated at 65% of the corresponding equipment norm.

- For types of machinery and equipment with similar usage characteristics to those specified, the Construction Departments and investors should apply the parameters of similar machinery and equipment to determine the basis for establishing machinery and equipment prices appropriately.

Implementation organization.

This Circular takes effect fifteen days from the date of publication in the Official Gazette.

Any difficulties encountered during implementation should be reported to the Ministry of Construction for consideration and resolution./.
