MINISTER OF POST AND TELECOMMUNICATIONS

Pursuant to Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies;

Pursuant to Decree No. 90/2002/NĐ-CP dated November 11, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Post and Telecommunications;

At the proposal of the Director of the Cadre and Civil Servant Department and the Director of the Radio Frequency Management Agency.

DECIDES:

Article 1: The Radio Frequency Management Agency is an agency under the Ministry of Post and Telecommunications responsible for managing state affairs in the specialized field of radio frequencies, satellite orbits, and broadcasting and television transmission nationwide.

Article 2: The Radio Frequency Management Agency has the following tasks and powers:

1. Researching, proposing, and participating in the development, amendment, supplementation, and implementation of legal normative documents on radio frequencies, satellite orbits, and broadcasting and television transmission.

2. Developing and submitting to the Minister plans for frequency allocation and utilization, and regulations for coordination with relevant ministries and sectors in the inspection and supervision of radio frequency usage and interference resolution.

3. Developing and submitting to the Minister for issuance planning schemes for frequency bands, channels, and radio frequencies by region; regulations on conditions for frequency allocation, assignment, and use, and radio frequency band conditions.

4. Cooperating with related agencies within the Ministry to develop and submit to the Minister technical conditions and operational regulations for conditional-use radio equipment, frequency and power emission regulations for radio equipment before allowing production or importation for use in Vietnam.

5. Participating with related agencies within the Ministry in training and issuing radio operator certificates.

6. Issuing, temporarily suspending, suspending, and revoking various types of radio frequency licenses; providing business guidance and coordinating with Provincial Postal and Telecommunications Departments in the management of radio frequencies and equipment according to the Minister's regulations.

7. Implementing international frequency registration, international cooperation on radio frequencies and satellite orbits, complaints and resolution of harmful interference in radio frequencies of Vietnam; participating in international control programs and technical activities of international organizations on radio frequencies according to the Minister's classification.

8. Supervising domestic broadcast radio transmissions, foreign broadcasts to Vietnam within the scope of radio information services according to Vietnamese laws and international treaties to which Vietnam is a party.

9. Inspecting and supervising radio frequencies and equipment, handling harmful interference; inspecting and confirming electromagnetic compatibility for radio-emitting devices according to the law.

10. Organizing the implementation of inspections on compliance with legal provisions on radio frequencies, satellite orbits, and broadcasting and television transmission; resolving complaints and accusations and administrative violations in the management of radio frequencies, satellite orbits, and broadcasting and television transmission nationwide according to the law on inspections and the Minister's regulations.

11. Serving as the permanent member of the Radio Frequency Committee and participating in its activities.

12. Collecting, managing, and using fees and charges related to radio frequencies according to the law and the Minister's regulations.

13. Managing the organization, cadres, civil servants, employees, assets, files, and documents of the Agency according to the law and the Minister's classification.

14. Performing other tasks assigned by the Minister.

Article 3:

1. The Radio Frequency Management Agency is headed by the Director, with Deputy Directors

The Director of the Radio Frequency Management Agency is responsible to the Minister of Post and Telecommunications for the results of implementing the functions, tasks, and powers stipulated in Articles 1 and 2 of this Decision.

Deputy Directors assist the Director and are responsible to the Director for the tasks assigned to them.

2. The organizational structure and staffing of the Radio Frequency Management Agency include:

a. Advisory units:

- Office

- Policy Management Frequency Room

- Frequency Planning and International Coordination Room

- Frequency Assignment and Licensing Room

- Broadcasting and Television Frequency Management Room

- Operations Room

- Planning and Basic Construction Investment Room.

- Finance and Accounting Room

- Organization, Cadre, and Labor Room

- Radio Frequency Management Agency Inspectorate

b. Subordinate units:

- Region I Radio Frequency Center

- Region II Radio Frequency Center

- Region III Radio Frequency Center

- Region IV Radio Frequency Center

- Region V Radio Frequency Center

- Region VI Radio Frequency Center

- Region VII Radio Frequency Center

- Region VIII Radio Frequency Center

- Technical and Information Technology Center.

The staffing of the Radio Frequency Management Agency is established by the Director and submitted to the Minister of Post and Telecommunications for decision.

The functions, tasks, and powers of the subordinate centers of the Radio Frequency Management Agency are established by the Director and submitted to the Minister for decision.

The functions, tasks, and powers of the Office and Rooms under the Radio Frequency Management Agency are defined by the Director.

The functions, tasks, and powers of the Radio Frequency Management Agency Inspectorate are implemented according to the law on inspections and the regulations of the Ministry of Post and Telecommunications.

The working relationships between the Office, Rooms, and subordinate units of the Radio Frequency Management Agency are defined by the Director.

Article 4: The Radio Frequency Management Agency has legal personality, its own seal and account according to the law, with headquarters in Hanoi and subordinate units located in various regions.

Article 5: This Decision takes effect 15 days from the date of publication in the Official Gazette and replaces Decision No. 41/2003/QĐ-BBCVT dated March 17, 2003 of the Minister of Post and Telecommunications regarding the functions, tasks, powers, and organizational structure of the Radio Frequency Management Agency.

Article 6: The Head of the Office, the Director of the Cadre Organization Department, the Director of the Radio Frequency Management Bureau, and the Heads of other agencies and units under the Ministry of Posts and Telecommunications are responsible for implementing this Decision./.
