duties, powers, and organizational structure of the Ministry of Posts and Telecommunications

THE GOVERNMENT
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the Posts and Telecommunications Ordinance dated May 25, 2002;
Pursuant to Resolution No. 02/2002/QH11 dated August 5, 2002 of the National Assembly of the Socialist Republic of Vietnam, the eleventh session, first meeting, which stipulates the list of ministries and ministerial-level agencies of the Government;
Pursuant to Resolution No. 11/2002/NQ-CP of the Government's regular session in September 2002 dated October 4, 2002;
Considering the proposal of the Head of the Cadre and Civil Service Department,
At the proposal of the Minister of Posts and Telecommunications and the Minister of Home Affairs,
DECREE:
Article 1. Position and Functions
The Ministry of Posts and Telecommunications is an agency of the Government responsible for managing state affairs related to postal services, telecommunications, information technology, electronics, internet, broadcasting, radio frequency spectrum, and national communication infrastructure throughout the country (hereinafter referred to collectively as postal services, telecommunications, and information technology); managing state affairs concerning public services and representing the State's ownership interest in enterprises with state capital in the fields of postal services, telecommunications, and information technology in accordance with the law.
b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;
The Ministry of Posts and Telecommunications shall be responsible for performing the tasks and powers prescribed in Decree No. 86/2002/NĐ-CP of the Government dated November 5, 2002 on the functions, duties, powers, and organizational structure of ministries and ministerial-level agencies, and the following specific tasks and powers:
1. Submitting draft laws, ordinances, and other regulatory legal documents on postal services, telecommunications, and information technology to the Government;
2. Submitting strategic plans, development plans, long-term plans, five-year plans, annual plans, and important projects on postal services, telecommunications, and information technology to the Government;
3. Issuing regulatory legal documents, standards, quality requirements, and regulations on the application of standards and quality in the fields of postal services, telecommunications, and information technology within its authority;
4. Organizing and directing the implementation of regulatory legal documents, strategic plans, development plans, long-term plans, five-year plans, and annual plans on postal services, telecommunications, and information technology after approval; promoting legal education and disseminating information on postal services, telecommunications, and information technology;
5. Managing state affairs in the field of information technology applications;
6. Uniformly managing programs for developing the information technology and electronics industries;
7. Directing and inspecting the implementation of tasks serving communication needs; managing security and confidentiality in postal services, telecommunications, and information technology activities in accordance with the law;
8. Managing and certifying standards, quality of networks, works, products, and services in postal services, telecommunications, and information technology;
9. Specifying and managing numbering, codes, domain names, and addresses used in postal services, telecommunications, and information technology;
10. Managing interconnection and integration of public telecommunications, dedicated telecommunications, and private networks in telecommunications operations;
11. Planning, allocating, and assigning radio frequencies; inspecting and supervising the use of radio frequencies and broadcasting equipment; organizing coordination of radio frequencies with other countries and registering radio frequencies and satellite orbits with relevant international organizations;
12. Directing and inspecting prices and tariffs for service activities in the fields of postal services, telecommunications, and information technology in accordance with the law;
13. Leading the review and submitting to the Prime Minister for decision-making on investment projects in the fields of postal services, telecommunications, and information technology in accordance with the law;
14. Managing the issuance, temporary suspension, cessation, and revocation of licenses and certificates in postal services, telecommunications, radio frequencies, and internet in accordance with the law;
15. Deciding on measures to mobilize postal and telecommunications networks and services, postal and telecommunications means and equipment, and information technology facilities to serve urgent cases of national security, natural disasters, and enemy threats upon authorization from the Government and the Prime Minister;
16. Implementing international cooperation in the fields of postal services, telecommunications, and information technology in accordance with the law;
17. Deciding on the printing and issuance of postal stamps; recalling and handling postal stamps; specifying storage, certification, destruction, and import/export of postal stamps;
18. Organizing and directing the implementation of scientific research plans and the application of scientific and technological progress in the fields of postal services, telecommunications, and information technology;
19. Deciding on specific policies and measures and directing the operation mechanisms of public service organizations in the fields of postal services, telecommunications, and information technology in accordance with the law; managing and directing the activities of affiliated organizations under the Ministry;
20. Performing specific tasks and powers within the scope of representing the State's ownership interest in enterprises with state capital in the fields of postal services, telecommunications, and information technology managed by the Ministry in accordance with the law;
21. Managing state affairs concerning the activities of associations and non-governmental organizations in the fields of postal services, telecommunications, and information technology in accordance with the law;
22. Inspecting, auditing, resolving complaints, accusations, anti-corruption, and dealing with violations of laws in the fields of postal services, telecommunications, and information technology within the Ministry's jurisdiction;
23. Deciding and directing the implementation of the Ministry's administrative reform program according to the goals and content of the State administrative reform program approved by the Prime Minister;
24. Managing organizational structures and staffing; directing the implementation of salary systems and incentive, reward, and disciplinary policies for civil servants, public officials, and employees under the Ministry's management; training and enhancing professional skills for civil servants, public officials, and employees in the fields of postal services, telecommunications, and information technology; establishing job titles for civil servants and employees, and specifying technical and vocational job title standards in the fields of postal services, telecommunications, and information technology;
25. Manage financial resources and assets assigned, and organize the execution of allocated budgets in accordance with the provisions of the law.
Article 3. Organizational Structure of the Ministry
a) Organizations assisting the Minister in performing state management functions:
1. Department of Postal Services;
2. Department of Telecommunications;
3. Department of Information Technology Industry;
4. Department of Science and Technology;
5. Planning and Finance Department;
6. International Cooperation Department;
7. Department of Legal Affairs;
8. Cadre and Civil Servant Affairs Department;
9. Radio Frequency Management Agency;
10. Quality Management Agency for Postal Services, Telecommunications, and Information Technology;
11. Postal Services, Telecommunications, and Information Technology Regional Agency I;
12. Postal Services, Telecommunications, and Information Technology Regional Agency II;
13. Postal Services, Telecommunications, and Information Technology Regional Agency III;
14. Inspectorate;
15. Office.
b) Scientific and technological organizations under the Ministry:
1. The Postal Strategy, Telecommunications, and Information Technology Center;
2. Vietnam Internet Center;
3. Information Center;
4. Postal, Telecommunications, and Information Technology Journal;
5. Vietnam Post Newspaper.
Article 4. Effective date
This Decree takes effect from the date of signature.
Abolish Decree No. 12/CP dated March 11, 1996 of the Government on the functions, tasks, powers, and organizational structure of the General Department of Posts.
Article 5. Responsibilities for Implementation
The Minister of Posts and Telecommunications, the Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, and Chairpersons of provincial people's committees under central cities are responsible for implementing this Decree./.
