CIRCULAR
Amending Clause 3, Section IV of Circular No. 23/2005/TT-BYT dated August 25, 2005 of the Ministry of Health guiding the classification of medical public service units

Implementing Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on salary systems for civil servants, public officials, and members of the armed forces; Circular No. 02/2005/TT-BNV dated January 5, 2005 of the Ministry of Home Affairs guiding the implementation of position allowances for leaders among civil servants, public officials, and employees.
Following the agreement expressed in Circular No. 3270/BNV-TL dated August 28, 2006 of the Ministry of Home Affairs and Circular No. 9306/BTC-PC dated July 31, 2006 of the Ministry of Finance, the Ministry of Health amends and supplements Clause 3, Section IV of Circular No. 23/2005/TT-BYT dated August 25, 2005 of the Ministry of Health guiding the classification of medical public service units as follows:
1. Amend Clause 3, Section IV as follows:
"3. From October 1, 2004 to the date when the competent authority decides to classify medical public service units according to the guidance provided in this Circular, leaders and managerial staff shall be entitled to back pay and back payment of social insurance for the difference between the leadership position allowance based on the new coefficient and that based on the old coefficient (if any) of their current positions under the previous classification.
For units that have not been classified since before October 2004 but are now classified according to the provisions of Circular No. 23/2005/TT-BYT dated August 25, 2005 of the Ministry of Health, they shall be entitled to receive the leadership position allowance according to the new classification from October 1, 2004 (in cases where the leader was appointed to a leadership position after October 1, 2004, the allowance shall be calculated from the date of appointment to the leadership position)."
2. Effective Date
This Circular takes effect fifteen days after its publication in the Official Gazette.
During the implementation process, if there are any difficulties, please report them to the Ministry of Health (Department of Organization and Cadres) for study and resolution./.
