CIRCULAR

Guidelines for Ranking Health Care Public Service Units

Pursuant to Decision No. 181/2005/QĐ-TTg dated July 19, 2005 of the Government on classification and ranking of public service organizations and state-owned enterprises, following the agreement of the Ministry of Home Affairs in Circular No. 1735/BNV-TL dated July 13, 2005 and the Ministry of Finance in Circular No. 8363/BTC-PC dated July 5, 2005, the Ministry of Health provides the standards for ranking health care public service units as follows:

This technical regulation sets out technical requirements, testing methods, sampling procedures; management requirements; responsibilities of organizations and individuals producing, trading, and importing cigarettes.

1. Scope of Regulation and Applicability

All health care public service units under the national health system shall be considered and ranked:

a) Central to local hospitals and hospitals under various ministries and sectors.

b) Preventive health units from central to local levels and those under various ministries and sectors.

2. Purpose of Ranking Health Care Public Service Units

a) To improve organizational structure, enhance professional technical skills and work quality.

b) To invest in developing health care public service units at appropriate stages.

c) To delineate medical technical specialties.

d) To develop training plans, staff deployment, and implement policies for personnel in the health sector.

3. Classification of Health Care Public Service Units

Health care public service units are classified into five ranks: Special Rank (applicable only to certain large hospitals), Rank I, Rank II, Rank III, and Rank IV.

II. PRINCIPLES AND STANDARDS FOR RANKING

A. Principles for Ranking

1. The ranking of health care public service units is based on the principle of scoring according to five groups of criteria set forth in this Circular:

- Group I Criteria: Position, function, and mission.

- Group II Criteria: Scale and content of activities.

- Group III Criteria: Labor structure and staff qualifications.

- Group IV Criteria: Professional capacity and work efficiency.

- Group V Criteria: Infrastructure and equipment.

2. Based on the total score achieved by the unit according to the above criteria, the organization will be ranked.

3. All units that have been ranked and those yet to be ranked must undergo review and ranking according to the provisions of this Circular.

4. After five years (sixty months) from the date of the ranking decision, the authority issuing the ranking decision shall be responsible for reviewing and re-ranking the unit.

B. Standards for Ranking

The basis for ranking health care public service units is based on Standards and Scoring Table stipulated in Appendix 1 (for hospitals) and Appendix 2 (for preventive health systems) issued with this Circular.

III. AUTHORITY, FILES, AND PROCEDURES FOR RANKING ORGANIZATIONS

1. Authority to Recognize Ranking

1.1. Authority of the Ministry of Home Affairs:

a) Units ranked as special.

b) Other units established and assigned functions and tasks by the Government and Prime Minister.

1.2. Authority of the Ministry of Health:

a) Deciding to recognize the ranking of health care public service units directly under the Ministry of Health (excluding units ranked as special and other units established and assigned functions and tasks by the Government and Prime Minister).

b) Directing, guiding, and inspecting the application of ranking criteria for health care public service units.

1.3. Authority of Provincial People's Committees and Municipal People's Committees directly under the Central Government:

Deciding to recognize the ranking of health care public service units within their management jurisdiction from Rank I downwards and reporting to the Ministry of Home Affairs and the Ministry of Health.

1.4. Authority of Other Ministries and Sectors:

Deciding to recognize the ranking of health care public service units within their management jurisdiction from Rank I downwards and reporting to the Ministry of Home Affairs and the Ministry of Health.

2. Application Files for Ranking

2.1. Request letter for ranking from the unit.

2.2. Analysis and scoring table according to the groups of criteria and supporting documents proving the scores achieved (based on data from the two preceding years before the year of ranking request and implementation plans for the year of ranking request).

IV. EFFECTIVE DATE OF IMPLEMENTATION

1. This Circular shall take effect fifteen days after its publication in the Official Gazette.

2. This Circular replaces Circular No. 13/BYT-TT dated November 27, 1993 of the Ministry of Health providing temporary guidelines for ranking health care public service units; Circular No. 03/2004/TT-BYT dated March 3, 2004 of the Ministry of Health providing guidelines for hospital ranking; Circular No. 21/BYT/TT dated December 2, 1994 of the Ministry of Health providing guidelines for ranking non-bed hospitals in the health sector; Circular No. 11/2002/TT-BYT dated July 8, 2002 of the Ministry of Health providing regulations on allowances for department heads, deputy department heads, chief physicians, and deputy chief physicians in provincial and municipal preventive health units.

3. From October 1, 2004 until the date when the competent authority decides on the ranking of health care public service units according to the guidelines in this Circular, leaders' personnel may claim back and pay social insurance contributions for the difference between the new allowance rate and the old allowance rate (if applicable) for the current position held under the previous rank.

During the implementation process, if there are any difficulties, please report to the Ministry of Health (Department of Cadres and Civil Servants) for research and resolution./.
