JOINT CIRCULAR
Guidelines for Implementing the Transfer and Classification of Forest Rangers' Civil Servant Ranks

Pursuant to Decree No. 117/2003/NĐ-CP dated October 10, 2003 of the Government on Recruitment, Utilization, and Management of Cadres and Civil Servants in State Agencies;
Pursuant to Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on the Salary System for Civil Servants, Public Officials, and Military Personnel;
Pursuant to Decree No. 119/2006/NĐ-CP dated October 16, 2006 of the Government on the Organization and Operation of Forest Rangers;
Pursuant to Decision No. 09/2006/QĐ-BNV dated October 5, 2006 of the Ministry of Home Affairs on the Establishment of Job Titles, Code Numbers, and Professional Standards for Forest Ranger Civil Servant Ranks;
The Ministry of Home Affairs and the Ministry of Agriculture and Rural Development provide guidelines for implementing the transfer and classification of forest ranger civil servant ranks as stipulated in Decision No. 09/2006/QĐ-BNV dated October 5, 2006 of the Minister of Home Affairs as follows:
Chapter I. SCOPE AND APPLICABLE SUBJECTS:
1. Scope of Regulation: This Circular guides the transfer and classification of ranks and salary grades for cadres and civil servants assigned to forest ranger civil servant ranks as specified in Decision No. 09/2006/QĐ-BNV dated October 5, 2006 of the Minister of Home Affairs on the establishment of job titles, code numbers, and professional standards for forest ranger civil servant ranks (hereinafter referred to as Decision No. 09/2006/QĐ-BNV).
2. Applicable Subjects: Cadres and civil servants currently directly performing forest ranger duties in agencies, organizations, and units as defined in Article 3 of Decree No. 119/2006/NĐ-CP dated October 16, 2006 of the Government on the organization and operation of forest rangers.
Chapter II. PRINCIPLES FOR TRANSFER AND CLASSIFICATION OF RANKS:
1. The transfer and classification of ranks must be based on the responsibilities, positions, and professional qualifications assigned to cadres and civil servants.
2. Cadres and civil servants eligible for transfer and classification of ranks must meet the professional standards of the forest ranger civil servant ranks as prescribed in Decision No. 09/2006/QĐ-BNV.
3. When transferring from old ranks to new forest ranger ranks, there shall be no concurrent promotion in salary grade.
Chapter III. METHODS FOR TRANSFERRING AND CLASSIFYING FOREST RANGER CIVIL SERVANTS FROM OLD RANKS TO NEW RANKS:
1. Classification into the Senior Forest Ranger rank - code number 10.225 for the following subjects:
a) Forest ranger cadres and civil servants currently holding the Senior Specialist rank and equivalent ranks.
b) Forest ranger cadres and civil servants currently holding the old Senior Forest Ranger rank - code number 10.078, meeting the professional standards of the Senior Forest Ranger rank as prescribed in Decision No. 09/2006/QĐ-BNV, aged 55 years or older for males and 50 years or older for females, and currently receiving the highest salary grade in their rank with an additional seniority allowance of 5% or more.
2. Classification into the Forest Ranger rank - code number 10.226 for the following subjects:
a) Forest ranger cadres and civil servants currently holding the old Senior Forest Ranger rank - code number 10.078;
b) Forest ranger cadres and civil servants currently holding the Specialist rank and equivalent ranks;
c) Forest ranger cadres and civil servants currently holding the old Forest Ranger rank - code number 10.079, meeting the professional standards of the Forest Ranger rank as prescribed in Decision No. 09/2006/QĐ-BNV.
3. Classification into the College-level Forest Ranger rank - code number 10.227 for the following subjects: Forest ranger cadres and civil servants currently holding the old Forest Ranger rank - code number 10.079, meeting the professional standards of the College-level Forest Ranger rank as prescribed in Decision No. 09/2006/QĐ-BNV.
4. Classification into the Intermediate-level Forest Ranger rank - code number 10.228 for the following subjects:
a) Forest ranger cadres and civil servants currently holding the old Forest Ranger rank - code number 10.079 with a specialized secondary education in forestry;
b) Forest ranger cadres and civil servants currently holding the Clerk rank and equivalent ranks.
5. Classification into the Junior-level Forest Ranger rank - code number 10.229 for the following subjects: Forest ranger cadres and civil servants currently holding the old Junior-level Forest Ranger rank - code number 10.080 and other equivalent ranks.
Chapter IV. SALARY GRADING: .
The salary grading for civil servants transferred to forest protection ranks shall be carried out according to the standards set forth in Decision No. 09/2006/QĐ-BNV in accordance with the current legal regulations on salary grading when upgrading, transferring ranks, or changing types of civil servants and public officials.
Chapter V. IMPLEMENTATION:
1. The heads of units directly managing and using civil servants within the forest protection organizational system shall carry out the consolidation, inspection, and review of the positions of forest protection civil servants under their authority, develop plans for transferring and grading into forest protection civil servant ranks as prescribed in Decision No. 09/2006/QĐ-BNV, and submit these plans to the competent authorities for consideration and decision.
2. The Ministry of Agriculture and Rural Development shall approve the plans for transferring and grading ranks for forest protection civil servants from old forest protection ranks and equivalent ranks to forest protection civil servant ranks as prescribed in Decision No. 09/2006/QĐ-BNV of subordinate forest protection units after reaching consensus with the Ministry of Home Affairs.
3. People's Committees of provinces and centrally governed cities shall approve the plans for transferring and grading ranks for forest protection civil servants from old forest protection ranks and equivalent ranks to forest protection civil servant ranks as prescribed in Decision No. 09/2006/QĐ-BNV of forest protection units under their management after reaching consensus with the Ministry of Home Affairs.
4. After implementing the transfer and grading of ranks for forest protection civil servants from old forest protection ranks and equivalent ranks to forest protection civil servant ranks as prescribed in Decision No. 09/2006/QĐ-BNV, the Ministry of Agriculture and Rural Development and People's Committees of provinces and centrally governed cities shall submit consolidated reports to the Ministry of Home Affairs and the Ministry of Agriculture and Rural Development for monitoring before December 31, 2007.
Chapter VI. EFFECTIVE DATE OF ENFORCEMENT: .
This Circular shall take effect fifteen days after its publication in the Official Gazette. During implementation, if there are any difficulties, units are requested to report in writing to the Ministry of Home Affairs and the Ministry of Agriculture and Rural Development for joint study and resolution.
