of the Prime Minister on the establishment of the Management Board of the Chu Lai Open Economic Zone, Quang Nam Province

PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to Decree No. 108/2006/NĐ-CP dated September 22, 2006 of the Government detailing and guiding the implementation of certain provisions of the Investment Law;

Pursuant to Decision No. 253/2006/QĐ-TTg dated November 6, 2006 of the Prime Minister promulgating the Operation Regulations of the Chu Lai Open Economic Zone, Quang Nam Province;

Pursuant to Decision No. 45/2007/QĐ-TTg dated April 3, 2007 of the Prime Minister stipulating the management authority over cadres of the Management Boards of industrial parks, export processing zones, high-tech zones, economic zones, and other boards with different names under the Ministry and provincial People's Committees directly under the Central Government;

Considering the proposal of the Chairman of the People's Committee of Quang Nam Province and the Minister of Home Affairs,

DECISION:

Article 1. Amending and supplementing certain articles of Decision No. 184/2003/QĐ-TTg dated September 8, 2003 of the Prime Minister on the establishment of the Management Board of the Chu Lai Open Economic Zone, Quang Nam Province, as follows:

1. Amending and supplementing Article 2:

"Article 2. The Management Board of the Chu Lai Open Economic Zone, Quang Nam Province shall perform the tasks and powers prescribed in:
1. Article 81 of Decree No. 108/2006/NĐ-CP dated September 22, 2006 of the Government detailing and guiding the implementation of certain provisions of the Investment Law;
2. Article 28 of the Operation Regulations of the Chu Lai Open Economic Zone promulgated together with Decision No. 253/2006/QĐ-TTg dated November 6, 2006 of the Prime Minister.

3. Other relevant legal documents."

2. Amending and supplementing Article 3:

"Article 3. Organizational structure and staffing:
1. The Management Board of the Chu Lai Open Economic Zone, Quang Nam Province shall have a Director, not more than three Deputy Directors appointed and relieved from office by the Chairman of the People's Committee of Quang Nam Province in accordance with the law.
2. The Director of the Management Board of the Chu Lai Open Economic Zone shall submit to the Chairman of the People's Committee of Quang Nam Province for decision the organizational structure, administrative apparatus, and staffing of the Management Board of the Chu Lai Open Economic Zone in accordance with the law on decentralization of administrative and public service staffing management and the staffing management mechanism for state-owned units."

Article 2. Effectiveness

This Decision shall take effect 15 days after its publication in the Official Gazette. Any previous regulations contrary to this Decision are hereby abolished.

Article 3. Responsibility for Implementation

Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, the Chairman of the People's Committee of Quang Nam Province, and the Director of the Management Board of the Chu Lai Open Economic Zone, Quang Nam Province are responsible for implementing this Decision./.
