CIRCULAR

Guidelines for certain contents stipulated in Decision No. 55/2007/QĐ-TTg dated April 23, 2007 of the Prime Minister approving the List of Priority Industries and Leading Industries for the period 2007-2010 with a vision to 2020 and some encouraging policies for development.

Pursuant to Decree No. 189/2007/NĐ-CP dated December 27, 2007 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;

Pursuant to Decision No. 55/2007/QĐ-TTg dated April 23, 2007 of the Prime Minister approving the List of Priority Industries and Leading Industries for the period 2007-2010 with a vision to 2020 and some encouraging policies for development;

After reaching consensus with the Ministry of Science and Technology;

The Ministry of Industry and Trade guides the support for free product introduction and research and technological development for priority industries and leading industries as follows:

I. GENERAL PROVISIONS

This Circular guides the support for free product introduction and research and technological development for priority industries and leading industries as specified in Decision No. 55/2007/QĐ-TTg dated April 23, 2007 of the Prime Minister approving the List of Priority Industries and Leading Industries for the period 2007-2010 with a vision to 2020 and some encouraging policies for development.

Thông tư này áp dụng đối với tổ chức, cá nhân có liên quan đến hoạt động kinh doanh đối tượng thủy sản nuôi chủ lực trên lãnh thổ Việt Nam.

Enterprises and production establishments under all economic sectors operating in manufacturing activities within priority industries and leading industries.

3. Principles of Support

a) Only applicable to priority industries and leading industries as specified in Appendix 1 issued together with Decision No. 55/2007/QĐ-TTg;

b) Enterprises belonging to priority industries and leading industries must have at least 50% of their total industrial production revenue from priority industrial products and leading industrial products.

II. PROCEDURE FOR SUPPORTING FREE PRODUCT INTRODUCTION FOR ENTERPRISES

1. Support for free product introduction on the website of the Ministry of Industry and Trade

a) Benefits for enterprises when registering for product introduction on the website of the Ministry of Industry and Trade

- Introduction of the enterprise's brand or images of priority industrial products and leading industrial products on the website of the Ministry of Industry and Trade for a maximum period of one year per registration.

When the period for introducing the brand on the Ministry of Industry and Trade's website expires, enterprises can register annually or multiple times;

- Permission to supplement and change product images registered along with accompanying content not more than three times during the registration period for introduction on the Ministry of Industry and Trade's website, with each change being at least thirty days apart;

- Permission to link the enterprise's website with the Ministry of Industry and Trade's website.

b) Application forms for registering product introduction on the website of the Ministry of Industry and Trade

- Application form for product introduction on the website of the Ministry of Industry and Trade according to Model - MD 1a issued together with this Circular. Attached to the application form is confirmation from the provincial Department of Industry and Trade regarding enterprises meeting the criteria for support as stipulated in Clause 3, Section I of this Circular;

- Notarized copy of business registration certificate;

- Table of main industrial products of the enterprise (data of the last three years) according to the Product Table;

- One 4x6 cm photograph of the General Director or Director of the registering enterprise;

- Images of the brand and priority industrial products and leading industrial products registered for introduction on the Ministry's website, minimum size 9x12 cm and maximum size 21x30 cm;

- If an enterprise has already been introduced on the Ministry's website and wishes to change or supplement information, it should submit a request for change or supplementation according to Model - MD 1b issued together with this Circular.

2. Support for free product introduction on the website of the Provincial Department of Industry and Trade

The support for free product introduction on the website of the Provincial Department of Industry and Trade shall be guided by the Provincial Departments of Industry and Trade under central cities and provinces.

3. Point of contact for receiving applications and processing requests from enterprises

a) The E-commerce and Information Technology Department of the Ministry of Industry and Trade is the point of contact for receiving applications from enterprises sent by the Provincial Departments of Industry and Trade;

b) The Provincial Departments of Industry and Trade are the points of contact for receiving and processing applications for advertising and product introduction information from enterprises producing priority industrial goods and leading industrial goods on the websites of the Ministry of Industry and Trade and local Provincial Departments of Industry and Trade.

4. Support for free exhibition and product introduction at national and local trade fairs and exhibitions

a) Support levels

- Each enterprise participating in exhibition and product introduction is supported by the state budget for renting one standard booth measuring 9 square meters indoors or one plot of land measuring 36 square meters indoors or one plot of land measuring 50 square meters outdoors, with a total amount not exceeding 30 million VND;² within the house or 01 (one) vacant lot of 36 square meters² within the house or 01 (one) vacant lot of 50 square meters² outdoors with a total amount not exceeding 30 (thirty) million Vietnamese dong;

- When participating in domestic export trade fairs, enterprises will be supported with 50% of the costs constituting the booth (including rental fees, construction, electricity and water services, cleaning, security, etc.) based on tender prices or previous booth construction costs, and 100% of promotional and advertising costs.

- Each enterprise may only enjoy one-time support from the Central Trade Promotion Fund per year. Localities may provide additional support from their own funds for local trade fairs or regional or nationwide trade fairs. The method and level of support are determined by each locality.

b) Source of funds

Funding for supporting enterprises' exhibition and product introduction comes from funds allocated by the state budget, including:

- The Central Trade Promotion Fund;

- Local Trade Promotion Funds.

c) Procedures for requesting support from enterprises

Enterprises register to participate in trade fairs and exhibitions upon invitation from Exhibition Companies. The application package for support to participate in exhibition and product introduction includes:

- Application for support to participate in exhibitions and product presentations according to Model - MD 2 issued together with this Circular. The application must be accompanied by confirmation from the provincial Department of Industry and Trade that the enterprise meets the criteria for support as stipulated in Clause 3, Section I of this Circular;

- Budgeted costs for renting booths at trade fairs by the enterprise;

- List of main products of the enterprise according to the Product Form (data of the last three years);

The enterprise's dossier shall be submitted to the Central or local Export Promotion Fund;

5. Scientific research and technological development support

a) Support methods

- Enterprises are supported to carry out scientific research, technological development, and environmental protection activities at production facilities, and are provided with low-interest loans according to the charter of the National Science and Technology Development Fund;

- For pilot production projects of priority industrial products and key industries not included in the national science and technology development plan, they will be supported with repayable funding up to 50% of the project capital;

- Non-repayable support will not exceed 30% of the budget for enterprises producing priority industrial products and key industries within the scope of state-prioritized science and technology;

b) Source of funds

The funds for supporting scientific research, technological development, and environmental protection are drawn from the National Science and Technology Development Fund under the Ministry of Science and Technology and the local Science and Technology Development Funds. These budgets are prepared annually in accordance with the provisions of the State Budget Law;

c) Procedures for requesting support

Annually, after receiving the notification letter on registering the scientific and technological research plan published on the Ministry of Industry and Trade’s website, enterprises shall prepare a research and development project registration dossier including:

- Research and development project registration form according to Model - MD 3 issued together with this Circular. The form must be accompanied by confirmation from the provincial Department of Industry and Trade that the enterprise meets the criteria for support as stipulated in Clause 3, Section I of this Circular;

- Detailed description of the research and development project;

- Notarized copy of the business registration certificate of the enterprise;

- List of main products of the enterprise (data of the last three years prior to the support application) according to the Product Form;

The dossier shall be sent to the Science and Technology Development Fund of the Ministry of Science and Technology or local funds for consideration of support;

III. IMPLEMENTATION

1. The Planning Department of the Ministry of Industry and Trade is responsible for compiling the implementation status of Decision No. 55/2007/QĐ-TTg;

2. The E-commerce and Information Technology Department of the Ministry of Industry and Trade shall provide free product listings for enterprises producing priority industrial products and key industries on the Ministry’s website as stipulated in Point b, Clause 1, Article 2 of Decision No. 55/2007/QĐ-TTg;

3. The Trade Promotion Department of the Ministry of Industry and Trade is the agency responsible for receiving and processing applications for support to participate in exhibitions and product presentations at domestic export trade fairs organized jointly with the Ministry of Industry and Trade for enterprises producing priority industrial products and key industries;

4. The Science and Technology Department of the Ministry of Industry and Trade is responsible for coordinating with the Ministry of Science and Technology to guide and implement procedures for central government support for research and development and environmental protection activities;

5. Responsibilities of the People's Committees of provinces and centrally governed cities

a) Establish and publish a list of priority industrial products and key industries in their locality based on the criteria set forth in Decision No. 55/2007/QĐ-TTg and incorporate them into annual and five-year plans for implementation as stipulated in Clause 2, Article 3 of Decision No. 55/2007/QĐ-TTg;

b) Issue guidance documents on procedures for enterprises to receive support from state agencies in their locality as stipulated in Decision No. 55/2007/QĐ-TTg and this Circular;

c) Before October 30 each year, submit to the Ministry of Industry and Trade a list of priority industrial products and key industries in their locality and propose corresponding incentive mechanisms and policies;

6. Provincial Departments of Industry and Trade shall advise the People's Committee of their locality to perform the following tasks:

a) Compile a list of enterprises producing priority industrial products and key industries in their locality for approval by the People's Committee as a basis for support activities;

b) Implement support policies for enterprises in their locality, including: providing free product listings on the Department of Industry and Trade’s website, and supporting product displays at local trade fairs and exhibitions;

c) Develop a mechanism for using the budget to support enterprises producing priority industrial products and key industries in their locality for pilot production (new products; imported material and component substitutes) to perfect new advanced technologies and equipment before applying them to large-scale industrial production;

d) Summarize the implementation status of Decision No. 55/2007/QĐ-TTg and this Circular and report to the Ministry of Industry and Trade every six months and annually (before May 31 and November 30 each year);

7. This Circular takes effect fifteen days after its publication in the Official Gazette;

During the implementation of this Circular, if any issues arise, organizations and individuals should promptly reflect them to the Ministry of Industry and Trade for review and resolution./.
