Guidance on implementing the adjustment of monthly subsidy levels from October 1,

2008 for village cadres who have retired according to Decision No. 130/CP dated June 20,

1975 of the Council of Ministers, Decision No. 111/HĐBT dated October 13,

1981 of the Council of Ministers.

Pursuant to Clause 2, Article 4 of Decree No. 101/2008/NĐ-CP dated September 12, 2008 of the Government adjusting pensions, social insurance subsidies, and monthly subsidies for village cadres who have retired (hereinafter referred to as Decree No. 101/2008/NĐ-CP);

The Ministry of Home Affairs and the Ministry of Finance provide guidance on implementing the adjustment of monthly subsidy levels from October 1, 2008 for village cadres who have retired according to Decision No. 130-CP dated June 20, 1975 of the Council of Ministers, Decision No. 111-HĐBT dated October 13, 1981 of the Council of Ministers as follows:

I. APPLICABLE OBJECTS

The applicable objects of this Circular are village cadres who have retired and are receiving monthly subsidies according to Decision No. 130-CP dated June 20, 1975 of the Council of Ministers, Decision No. 111-HĐBT dated October 13, 1981 of the Council of Ministers (hereinafter referred to as retired village cadres).

II. ADJUSTMENT OF MONTHLY SUBSIDY LEVELS

From October 1, 2008, implement the adjustment of monthly subsidy levels for retired village cadres according to the provisions of Article 2 of Decree No. 101/2008/NĐ-CP (increasing the monthly subsidy level by 15% over the monthly subsidy level received at the time of September 2008) as follows:

1. Formula for adjusting the monthly subsidy level from October 1, 2008:

In which, the monthly subsidy level received at the time of September 2008 is the monthly subsidy level stipulated in Clause 2, Section II of Circular Joint No. 06/2007/TTLT-BNV-BTC dated December 28, 2007 of the Ministry of Home Affairs and the Ministry of Finance guiding the implementation of the adjustment of monthly subsidy levels from January 1, 2008 for village cadres who have retired according to Decision No. 130-CP dated June 20, 1975 of the Council of Ministers, Decision No. 111-HĐBT dated October 13, 1981 of the Council of Ministers.

2. The monthly subsidy level received from October 1, 2008 for retired village cadres (rounded off according to the calculation formula specified in Clause 1 above) is as follows:

a) For former Secretaries of the Party Committee, Chairmen of the People's Committee of villages: VND 780,000/month;

b) For former Deputy Secretaries, Deputy Chairmen, Standing Members of the Party Committee, Secretaries of the People's Council, Secretaries of the People's Assembly, Village Militia Commanders, Chiefs of Public Security Stations: VND 750,000/month;

c) For other positions: VND 690,000/month.

III. IMPLEMENTATION

1. Provincial People's Committees guide and implement the payment of monthly subsidies from October 1, 2008 according to the guidance provided in this Circular for the objects under their management.

2. The source of funds for adjusting the monthly allowance for retired elderly village cadres shall be implemented according to the guidance of the Ministry of Finance.

3. Retired village cadres who move to a new legal place of residence within the same district must present a transfer certificate issued by the People's Committee of the commune; within the same province, a transfer certificate issued by the Department of Home Affairs - Labor, Invalids and Social Affairs of the district; outside the province, a transfer certificate issued by the Department of Home Affairs; the transfer certificate must be accompanied by the file and decision on retirement (in case of loss, there must be a confirmation letter from the competent authority at the same level). The provincial department at the new place of residence will continue to pay the transferred cadre. If the retired village cadres moved to a new legal place of residence before the effective date of Decree No. 101/2008/NĐ-CP, the current paying place will continue to pay the object.

4. This Circular takes effect 15 days after its publication in the Official Gazette.

The regulations stipulated in this Circular shall be implemented from October 1, 2008.

Abolish Circular Joint No. 06/2007/TTLT-BNV-BTC dated December 28, 2007 of the Ministry of Home Affairs and the Ministry of Finance guiding the implementation of the adjustment of monthly subsidy levels from January 1, 2008 for village cadres who have retired according to Decision No. 130-CP dated June 20, 1975 of the Council of Ministers, Decision No. 111-HĐBT dated October 13, 1981 of the Council of Ministers.

During the implementation process, if there are any difficulties, ministries, sectors, and localities should report to the Ministry of Home Affairs and the Ministry of Finance for research and resolution./
