CIRCULAR
Regulations on functions, tasks, powers, and organizational structure of Provincial Cultural Centers and Municipal Cultural Centers directly under the Central Government

Pursuant to Decree No. 185/2007/NĐ-CP dated December 25, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports and Tourism;
Pursuant to Circular Joint Circular No. 43/2008/TTLT-BVHTTDL-BNV dated June 6, 2008 of the Ministry of Culture, Sports and Tourism and the Ministry of Home Affairs guiding the functions, tasks, powers, and organizational structure of Departments of Culture, Sports and Tourism under provincial People's Committees and Cultural and Information Offices under district People's Committees;
After reaching consensus with the Ministry of Home Affairs and the Ministry of Culture, Sports and Tourism, the regulations on the functions, tasks, powers, and organizational structure of Provincial Cultural Centers and Municipal Cultural Centers directly under the Central Government (hereinafter referred to as Provincial Cultural Centers) are as follows:
Article 1. Position and Functions
1. Location:
a. Provincial Cultural Centers are public service units subordinate to Departments of Culture, Sports and Tourism;
b. Provincial Cultural Centers have legal personality, seals, separate bank accounts, offices, and operating funds as prescribed by law.
The Ministry-level examination council advises the Minister of Agriculture and Rural Development to decide on awarding the Golden Rice Ear Prize to collectives and individuals with winning products at each organization.
a. Propaganda and dissemination of the Party's guidelines, policies, and state laws; implementation of local political, economic, and social tasks.
b. Organization of cultural activities and talent development to enhance public education levels, meet creative and cultural enjoyment and entertainment needs of the people.
Article 2. Tasks and Authorities
1. Develop annual work programs and plans for approval by the Director of the Department of Culture, Sports and Tourism and organize their implementation.
2. Research and experiment with models of cultural business practices; disseminate and guide the application of advanced models and methods in cultural business practices; compile and publish promotional materials and guides for cultural systems at the grassroots level.
3. Guide, inspect, and evaluate the quality of specialized cultural business activities of grassroots cultural systems; collaborate and coordinate with cultural institutions of various sectors and mass organizations in practicing cultural business.
4. Build, guide, and maintain the operation of mobile propaganda teams, mass art groups, interest groups-clubs, and various forms of cultural activities, both stationary and mobile, to directly reach the masses at the grassroots level to provide guidance, improve cultural-artistic appreciation skills, and meet the creative and cultural enjoyment needs of the people.
5. Exploit, collect, and promote traditional folk art forms; preserve national cultural identity; organize competitions, festivals, art performances, mobile propaganda contests, exhibitions, traditional and modern festivals.
6. Organize training and capacity building for staff of the agency and grassroots cultural units, cultural-art movement nuclei; open classes for artistic and cultural talents.
7. Organize surveys, visits, professional exchanges, cultural exchanges, and develop cultural careers with related units nationwide and internationally.
8. Collaborate with agencies, mass organizations, and individuals to organize cultural-art services, propaganda, exhibitions, advertising, sports, tourism, and recreational activities in accordance with the law.
9. Manage personnel, finance, assets, and infrastructure of the Center in accordance with the law.
10. Perform other tasks assigned by the provincial People's Committee or the Director of the Department of Culture, Sports and Tourism that are consistent with the functions, tasks, and powers of the Center.
đ) Based on the regulations on the delegation of organizational and cadre management, the Director of the Department decides or submits to the competent authority for decisions regarding the appointment and dismissal of heads and deputy heads of units under the Department according to the position standards set by the provincial people's committee;
1. The leadership of the Center includes the Director and one to two Deputy Directors
a. Director:
The Director is the head of the Cultural Center, responsible before the Director of the Department of Culture, Sports and Tourism and the law for personnel, infrastructure, equipment, and all activities of the Center.
b. Deputy Director:
The Deputy Director assists the Director, responsible before the Director and the law for assigned tasks; when the Director is absent, one Deputy Director is authorized by the Director to manage the Center's activities.
c. The Director of the Department of Culture, Sports and Tourism appoints and dismisses the Director and Deputy Director of the Cultural Center in accordance with the law and the delegation of the provincial People's Committee.
2. Departments
a. Administrative Department
Performs administrative, human resources management, administration, financial planning, consolidation, and service tasks.
Required positions:
- Head and Deputy Head of the Department;
- Personnel performing tasks: organization, document management, archiving, accounting, cashier, technical, sound, lighting, security, driver, janitor.
b. Mass Art Department
Performs tasks related to mass cultural and artistic activities, club methods; organizes various cultural and artistic forms, collaborates in implementing cultural services and artistic performances.
Required positions:
- Head and Deputy Head of the Department;
- Director, scriptwriter, choreographer, music composer, methodologist.
c. Propaganda and Exhibition Department
Performs tasks related to propaganda, visual promotion, exhibitions, and advertising; implements mobilization, collaboration, and coordination with social forces to organize commemorations of major holidays, political-social events, cultural, sports, and tourism events.
Required positions:
- Head and Deputy Head of the Department;
- Editor, propagandist, artist, methodologist, and tour guides.
d. Mobile Propaganda Team
Performs tasks organizing various forms of mobile propaganda within the jurisdiction according to annual plan quotas or serving urgent political propaganda tasks, mass movements, and large campaigns at the local level.
Required positions:
- Team Leader and Deputy Team Leader;
- Propagandists and technicians.
Depending on specific conditions, characteristics, and needs of the locality, based on the proposal of the Director of the Department of Culture, Sports and Tourism together with the Director of the Department of Home Affairs, the provincial People's Committee decides the organizational framework and staffing of the Provincial Cultural Center (Information-Exhibition Center, Information-Promotion Center).
3. Staffing
a. The staffing of Provincial Cultural Centers is decided by the provincial People's Committee according to the quota of specialized public service personnel of the locality and in accordance with the law.
b. Based on the specific tasks and job requirements of the unit, the Director of the Cultural Center may enter into labor contracts in accordance with the law.
4. There must be a restroom area, changing room, personal storage area for participants, first aid kit, and initial emergency equipment.
The provincial Cultural Center shall be planned for construction in the center of the province or city, in densely populated areas with convenient transportation; when newly built or renovated, it must ensure the following material requirements:

3. A venue to organize various forms of mass art activities, propaganda, promotion, and exhibitions;
4. A venue for club activities, vocational training, and talent development classes;
5. An area for services, entertainment, and physical exercise;
6. An area for greenery, flower gardens, and ornamental plants;
7. Special equipment including sound and lighting devices, musical instruments, artistic performance equipment; audiovisual equipment; electronic information network connection devices; exhibition and visual promotion equipment; professional training learning equipment; physical exercise and entertainment equipment; mobile propaganda means (cars, boats, motorcycles); other equipment.
1. Operating funds for the provincial Cultural Center shall come from the following sources:
a) Income from library card fees;
a. Funds allocated from the state budget to ensure regular operations; to carry out scientific research tasks; to train and develop staff; national target programs; to execute urgent tasks; investment in basic construction projects and to implement personnel reduction policies according to state regulations; (funds allocated to the provincial Cultural Center according to the laws on public service units provided annually by the provincial People's Committee from the local budget);
b. Revenue from public service activities: fees and charges; service activities; profits from joint ventures and cooperative activities;
c. Revenue from sponsorships and aid from organizations and individuals both domestically and internationally; revenue from credit loans; joint venture capital and other lawful revenues.

c. Expenditures to ensure the development of public services, contributing to improving the living standards of staff and workers within the unit in accordance with the law and internal expenditure regulations.
3. Financial mechanism:
The provincial Cultural Center implements the financial mechanism for public service institutions in accordance with the law and the guidance of specialized financial agencies.
1. The provincial Cultural Center is directly managed and directed by the Department of Culture, Sports, and Tourism.
Article 6. Work Relations
2. The provincial Cultural Center is managed, directed, guided, and inspected in terms of professional tasks and work methods by the Grassroots Cultural Administration under the Ministry of Culture, Sports, and Tourism.
3. The provincial Cultural Center guides, inspects professional tasks and work methods, and collaborates in organizing activities with district-level and grassroots Cultural-Sports Centers.
4. The provincial Cultural Center collaborates in organizing activities, provides assistance, and guides professional tasks and work methods with cultural institutions of various sectors, economic-social organizations, public cultural service units, and mass organizations at the local level.
5. Social organizations within the provincial Cultural Center operate in accordance with the law and the charters of these organizations.
1. This Circular takes effect 45 days from the date of issuance and replaces Decision No. 41/2001/QĐ-BVHTT dated October 3, 2001, issued by the Minister of Culture and Information regarding the Regulations on the Organization and Operation of Provincial Cultural-Information Centers.
Article 7. Implementation Organization
2. The provincial People's Committees shall implement this Circular based on the provisions concerning the functions, tasks, authorities, and organizational structure of the provincial Cultural Center.
3. During implementation, if any issues arise or difficulties occur, the provincial People's Committees shall report to the Ministry of Culture, Sports, and Tourism for study, amendment, and supplementation as necessary./.
