JOINT CIRCULAR

Guidelines for transferring and grading positions and salaries for civil servants in the statistics sector

Pursuant to Decree No. 117/2003/NĐ-CP dated October 10, 2003 of the Government on recruitment, utilization, and management of cadres and civil servants in state agencies;

Pursuant to Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on the Salary System for Civil Servants, Public Officials, and Military Personnel;

Pursuant to Decree No. 48/2008/NĐ-CP dated April 17, 2008 of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;

Pursuant to Decree No. 116/2008/ND-CP dated November 14, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Planning and Investment;

Pursuant to Decision No. 03/2008/QĐ-BNV dated November 12, 2008 of the Minister of Home Affairs promulgating job titles, code numbers, and professional standards for positions of civil servants in the statistics sector,

The Ministry of Home Affairs and the Ministry of Planning and Investment provide guidelines for transferring and grading positions and salaries for civil servants in the statistics sector as follows:

Article 1. Scope of Regulation

These guidelines regulate the transfer and grading of positions and salaries for civil servants entering the positions of civil servants in the statistics sector as prescribed in Decision No. 03/2008/QĐ-BNV dated November 12, 2008 of the Minister of Home Affairs promulgating job titles, code numbers, and professional standards for positions of civil servants in the statistics sector (hereinafter referred to as Decision No. 03/2008/QĐ-BNV).

Article 2. Applicability

Civil servants currently engaged in statistical work within the national statistical organization system include:

1. Civil servants engaged in centralized statistical work within the statistical organization system.

2. Specialized civil servants engaged in statistical work at Ministries, agencies equivalent to Ministries, government agencies, Supreme People's Court, and Supreme People's Procuracy.

3. Specialized civil servants engaged in statistical work at Departments, bureaus, and sectors under provincial People's Committees and centrally governed cities.

Article 3. Principles for transferring positions

1. Transferring positions must be based on the responsibilities, job positions, and professional qualifications assigned to civil servants.

2. Civil servants eligible for position transfer must meet the professional standards of positions in the statistics sector as stipulated in Decision No. 03/2008/QĐ-BNV.

3. When transferring from the current position to a position in the statistics sector, there shall be no concurrent salary increase.

Article 4. Methods for transferring positions from current positions to positions in the statistics sector

1. Transfer to the Senior Statistician position (position code 23.261) for specialized statisticians currently holding the Senior Officer position and equivalents who meet the conditions and standards specified in Decision No. 03/2008/QĐ-BNV.

2. Transfer to the Principal Statistician position (position code 23.262) for specialized statisticians currently holding the Principal Officer position and equivalents who meet the conditions and standards specified in Decision No. 03/2008/QĐ-BNV.

3. Transfer to the Statistician position (position code 23.263) for specialized statisticians currently holding the Officer position and equivalents who meet the conditions and standards specified in Decision No. 03/2008/QĐ-BNV.

4. Transfer to the Statistician with College Degree position (position code 23.264) for specialized statisticians currently receiving Class A0 salary, having a college degree, and meeting the conditions and standards specified in Decision No. 03/2008/QĐ-BNV.

5. Transfer to the Statistician with Intermediate Degree position (position code 23.265) for specialized statisticians currently holding the Staff position and equivalents who meet the conditions and standards specified in Decision No. 03/2008/QĐ-BNV.

Article 5. Salary Classification

The salary grading for civil servants transferred to positions in the statistics sector according to Article 4 of this Circular shall be implemented in accordance with point a, Clause 2, Section II of Circular No. 02/2007/TT-BNV dated May 25, 2007 of the Ministry of Home Affairs guiding salary grading when upgrading positions, transferring positions, and changing types of civil servants and public officials.

Article 6. Implementation Organization

Based on the guidelines provided in this Circular, implementation shall be organized as follows:

1. Heads of units directly managing and utilizing civil servants in the national statistical organization system shall compile, review, and verify the job positions of civil servants engaged in statistical work under their jurisdiction, develop plans for transferring to positions in the statistics sector, and submit them to competent authorities for examination and decision.

2. The Ministry of Planning and Investment shall approve plans for transferring positions for civil servants engaged in centralized statistical work from their current positions to positions in the statistics sector after coordinating with the Ministry of Home Affairs.

3. Ministries, agencies equivalent to Ministries, government agencies, Supreme People's Court, Supreme People's Procuracy, and provincial People's Committees and centrally governed cities shall approve plans for transferring positions for civil servants engaged in statistical work of subordinate statistical organizations from their current positions to positions in the statistics sector after coordinating with the Ministry of Home Affairs; report lists of civil servants transferred to positions to the Ministry of Planning and Investment for consolidation and overall management of the statistics sector civil servant workforce.

4. Ministries, sectors, and localities mentioned in Clauses 2 and 3 of this Article shall submit comprehensive reports on the transfer of positions for statisticians from their current positions to positions in the statistics sector to the Ministry of Home Affairs for monitoring before December 31, 2009.

Article 7. Effective Date

This Circular shall take effect 45 days from the date of issuance.

During implementation, if any issues arise, ministries, sectors, and localities shall report to the Ministry of Home Affairs for coordination with the Ministry of Planning and Investment to examine and resolve them./.
