DECREE
Article 1. Scope and Applicability
1. This Decree stipulates the position, functions, tasks, authorities, and organization of statistics of ministries, ministerial-level agencies, and government agencies (hereinafter referred to collectively as Ministry Statistics).
2. This Decree applies to officials, civil servants, and employees belonging to the Ministry Statistics organization.
1. Inland waterway port inspection service is the agency implementing specialized state management functions in inland waterway transport at ports, inland waterway wharfs (hereinafter referred to as ports, wharfs), anchorage areas; on channels and routes when assigned by the Minister of Transport to ensure compliance with laws on inland waterway traffic order and safety and environmental protection.
1. Ministry Statistics is a unit within the organizational structure of ministries and sectors, performing the function of advising the Minister, Sector Head on managing statistical work and organizing statistical activities within their respective sectors and fields.
2. Ministry Statistics is a part of the national statistical organization system, subject to guidance, inspection, and supervision in professional statistical matters by the General Statistics Office.
Article 3. Tasks and Authorities of Ministry Statistics
1. Advising the Minister, Sector Head on building the statistical information system of the ministry or sector.
2. Building statistical programs and projects of the ministry or sector and implementing them after approval by the competent authority.
3. Building and submitting to the Minister, Sector Head for issuance the Statistical Indicators System of the ministry or sector in accordance with the law.
4. Submitting to the competent authority for approval the list of statistical surveys assigned under the National Statistical Survey Program and those serving management and operational needs of the ministry or sector; developing survey plans after being reviewed by the General Statistics Office, submitting to the Minister, Sector Head for approval; organizing the implementation of surveys according to approved plans.
5. Building the Basic Statistical Reporting System and the Comprehensive Statistical Reporting System applicable to specialized agencies under provincial People's Committees, district People's Committees, town People's Committees, and city People's Committees under provinces within the scope of responsibility, after being reviewed by the General Statistics Office, submitting to the Minister, Sector Head for issuance; disseminating, training, and guiding the implementation of issued reporting systems.
6. Organizing the collection, compilation, analysis, forecasting, dissemination, and storage of statistical information according to the ministry or sector's information plan, meeting the requirements of comprehensive statistical information from the General Statistics Office and the need for statistical information usage by agencies, organizations, and individuals.
7. Advising the Minister, Sector Head on unified management and publication of statistical information in accordance with the law.
8. Compiling regular monthly, quarterly, semi-annual, nine-monthly, and annual statistical reports, special topic analytical statistical reports, annual specialized statistical yearbooks, multi-year statistical data systems, and other statistical information products according to assigned functions and tasks; implementing reporting systems within the sector's management field in accordance with regulations.
9. Cooperating with the Inspection and Audit organizations of the ministry or sector to build and submit to the Minister, Sector Head for approval inspection and audit plans regarding compliance with statistical laws by agencies and units under the ministry or sector, implementing after approval by the competent authority; recommending measures to deal with organizations and individuals violating statistical laws; proposing rewards for organizations and individuals with outstanding achievements in statistical work.
10. Advising the Minister, Sector Head on improving the organizational structure of statistical operations; developing recruitment and utilization plans for statistical officials, civil servants, and employees of the ministry or sector, submitting to the Minister, Sector Head for approval.
11. Organizing training and updating statistical, computer, foreign language, and other relevant knowledge for statistical officials, civil servants, and employees of the ministry or sector, specialized agencies under provincial People's Committees, district People's Committees, town People's Committees, and city People's Committees under provinces within the scope of responsibility, and people engaged in statistical work at enterprises, agencies, and organizations under the ministry or sector's management.
12. Organizing research and implementation of scientific topics in the statistical field; applying information technology and communication to statistical work of the ministry or sector.
13. Participating in drafting normative legal documents on statistical work and organizing their implementation after issuance by the competent authority.
14. Performing other tasks and authorities assigned by the Minister, Sector Head.
Article 4. Statistical Organization of Ministries and Sectors
1. Based on the National Statistical Indicators System, the National Census Program, and the Comprehensive Statistical Reporting System applicable to Ministries and Sectors, and in accordance with the requirements for statistical information serving the guidance and management of Ministries and Sectors and the needs for statistical information of organizations and individuals, the Minister or Sector Head shall decide to establish a Statistics Office under a functional unit or submit to the Government to establish a Department or Bureau to perform statistical functions and tasks as prescribed by law.
2. They are guaranteed personnel meeting the quantity and quality requirements; they are prioritized for investment in applying scientific and technological methods and advanced statistical techniques to statistical work of Ministries and Sectors.
3. The Minister or Sector Head is responsible for specifying the specific functions, tasks, and authorities of the Statistics of Ministries and Sectors.
Article 5. Personnel Engaged in Statistical Work of Ministries and Sectors
1. Personnel engaged in statistical work of Ministries and Sectors are civil servants or public officials belonging to the state statistical system; they are assigned the task of implementing statistical activities within Ministries and Sectors.
2. Personnel engaged in statistical work of Ministries and Sectors must meet the criteria stipulated in Clause 2, Article 33 of the Statistics Law.
3. Personnel engaged in statistical work of Ministries and Sectors are independent in their professional and vocational statistical work and are responsible for complying with legal provisions on statistics; they carry out and are accountable for the statistical activities assigned to them.
4. Personnel engaged in statistical work of Ministries and Sectors are trained, further educated, and have their professional and vocational knowledge, information technology skills, foreign languages, and knowledge in other fields enhanced to serve statistical work; they enjoy benefits and policies as prescribed by law.
Article 6. Effectiveness
1. This Decree takes effect from April 15, 2010.
2. Abolish Clause 2, Article 21 of Decree No. 40/2004/NĐ-CP dated February 13, 2004 of the Government detailing and guiding the implementation of certain provisions of the Statistics Law.
Article 7. Implementation Organization
1. For Ministries and Sectors that have established specialized statistical machinery in accordance with Decree No. 40/2004/NĐ-CP dated February 13, 2004 of the Government detailing and guiding the implementation of certain provisions of the Statistics Law or according to the Government's Decree stipulating the functions, tasks, authorities, and organizational structure of Ministries and Sectors, the Minister or Sector Head shall review the existing statistical organization to improve it and ensure its compliance with Clause 1, Article 4 of this Decree.
2. The Ministers, Heads of Ministries equivalent to Ministries, Heads of agencies under the Government, Chairpersons of Provincial People's Committees directly under the Central Government are responsible for implementing this Decree./.
