Regulations on the training activities for administrative management knowledge for consultants and assessors of quality management systems according to the national standard TCVN ISO 9001:2008 in state administrative agencies
Pursuant to Decree No. 28/2008/NĐ-CP dated March 14, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology;
Pursuant to Decision No. 144/2006/QĐ-TTg dated June 20, 2006 of the Prime Minister on applying the quality management system according to the TCVN ISO 9001:2000 standard in the operations of state administrative agencies and Decision No. 118/2009/QĐ-TTg dated September 30, 2009 of the Prime Minister on amending and supplementing certain articles of Decision No. 144/2006/QĐ-TTg;
The Minister of Science and Technology hereby stipulates the training activities for administrative management knowledge for consultants and assessors of quality management systems according to the national standard TCVN ISO 9001:2008 in state administrative agencies as follows:

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular stipulates the management of training activities, training programs for administrative management knowledge for consultants and assessors of quality management systems according to the national standard TCVN ISO 9001:2008 (hereinafter referred to as QMS) in state administrative agencies.

Article 2. Applicability

Article 1. This Circular applies to the following subjects:

1.1. Consultants and assessors of QMS in state administrative agencies (hereinafter referred to as consultants and assessors).

1.2. Training institutions for administrative management knowledge for consultants and assessors.

1.3. Organizations and individuals related to the construction, assessment, certification, and application of QMS in state administrative agencies.

Article 2. Cases exempted from compliance with this Circular:

2.1. Consultants and assessors who have graduated from a regular university program in public administration at the National Academy of Politics and Administrative Science.

2.2. Consultants and assessors who have obtained certificates of completion of a civil service management training course at the specialist level or higher.

Chapter II

MANAGEMENT OF TRAINING ACTIVITIES

Article 3. Conditions for operation of training institutions

Training institutions conducting training in administrative management knowledge for consultants and assessors must meet the following conditions:

1. They must be enterprises, scientific and technological organizations, or other organizations established in accordance with the law that have training functions.

2. They must have a training plan; the training curriculum must be approved by the head of the training institution and comply with the provisions of Chapter III of this Circular.

3. They must have a sufficient number of lecturers as approved in the training plan, meeting one of the following requirements:

3.1. For lecturers within the establishment's staff: they must have graduated from a regular university program in public administration at the National Academy of Politics and Administrative Science and have at least five years of work experience in the field of administrative management.

3.2. For part-time lecturers: they must be leaders at various levels of ministries, sectors, and localities and hold the rank of specialist or above in the civil service.

3.3. For guest lecturers: they must be professional teachers teaching public administration at domestic universities or experts and managers with a bachelor's degree or higher and at least ten years of experience in the field of administrative management.

Article 4. Procedures and formalities for issuing the Certificate of Eligibility to Conduct Training in State Administrative Management Knowledge

1. Training institutions that wish to train state administrative management knowledge for consulting and evaluation experts shall prepare and submit one set of training activity registration documents to the Standardization, Measurement and Quality Control General Department. The registration documents include:

1.1. A registration form for participating in training activities in state administrative management knowledge for consulting and evaluation experts according to the model prescribed in Appendix I of this Circular.

1.2. A copy of the Decision on Establishment or a copy of the Business License/Registration Certificate.

1.3. A training plan and one set of training textbooks compiled in accordance with the provisions of Chapter III of this Circular, which have been approved by the head of the training institution.

1.4. A list of lecturers according to the model prescribed in Appendix II of this Circular, accompanied by copies of certificates and diplomas as stipulated in Clause 3, Article 3 of this Circular; scientific curriculum vitae of lecturers according to the model prescribed in Appendix III of this Circular.

During the examination of the documents, if necessary, copies of relevant documents and certificates will be reviewed and compared with the originals or additional certified copies will be requested.

2. Within fifteen working days from the date of receipt of complete and valid documents, the Standardization, Measurement and Quality Control General Department will examine the documents, conduct on-site inspections if necessary, and issue the Certificate of Eligibility to Conduct Training in State Administrative Management Knowledge for Consulting and Evaluation Experts according to the model prescribed in Appendix IV of this Circular if the training institution meets the conditions. The certificate is valid for three years from the date of issuance.

In cases where the conditions are not met, the training institution will be notified in writing of the reasons.

Article 5. Procedures and formalities for reissuing the Certificate of Eligibility

1. One month before the expiration of the validity period of the Certificate of Eligibility, if the training institution wishes to continue training state administrative management knowledge for consulting and evaluation experts, it shall prepare and submit one set of registration documents for reissuing the Certificate of Eligibility to the Standardization, Measurement and Quality Control General Department. The reissuance registration documents include:

1.1. A registration form for reissuing the Certificate of Eligibility to Conduct Training in State Administrative Management Knowledge for Consulting and Evaluation Experts according to the model prescribed in Appendix V of this Circular.

1.2. A report on the status of training activities during the validity period of the Certificate of Eligibility.

2. Within fifteen working days from the date of receipt of complete and valid documents, the Standardization, Measurement and Quality Control General Department will examine the documents, conduct on-site inspections if necessary, and reissue the Certificate of Eligibility to Conduct Training in State Administrative Management Knowledge for Consulting and Evaluation Experts if the training institution meets the conditions. The certificate is valid for three years from the date of issuance.

In cases where the conditions are not met, the training institution will be notified in writing of the reasons.

Chapter III TRAINING PROGRAM FOR STATE ADMINISTRATIVE MANAGEMENT KNOWLEDGE FOR CONSULTING AND EVALUATION EXPERTS

Article 6. General Requirements

1. Regarding the content of the training program for state administrative management knowledge for consulting and evaluation experts, it includes three parts:

1.1. Basic knowledge;

1.2. Specialized knowledge; and

1.3. Final course assessment.

2. Regarding duration

The training program consists of ten topics with a total duration of eighty-five hours, including theoretical training time and time for exchange, discussion, and situation analysis within each topic. The examination duration is five hours, including mid-term examination (after basic knowledge section) of two hours and final examination of three hours. The teaching method centers on students, combining theoretical instruction with exchange, discussion, and situation analysis to deepen student understanding. The number of participants does not exceed twenty-five people per course.

Article 7. Provisions on the framework of the training program

1. Basic Knowledge Section:

Total duration is twenty-five hours of study, including the following topics and contents:

1.1 Topic 1: State Machinery and Relationships

Duration is five hours, including the main contents as follows:

1.1.1 State management and distinguishing state management from other types of management.

1.1.2 Characteristics of state management activities.

1.1.3 State machinery: - Legislative body. - Judicial body. - Executive body.

1.1.4 Relationships among organizations in the state organization system based on principles of division of labor, decentralization, and coordination.

1.1.5 Impact of factors on the organization and operation of the state machinery.

1.2 Topic 2: State Administrative Machinery and System of State Administrative Agencies

Duration is ten hours, including the main contents as follows:

1.2.1 State administrative machinery: - General theory of state administrative machinery. - Factors constituting the state administrative machinery.

1.2.2 Principles of organizing the state administrative machinery.

1.2.3 System of central state administrative agencies: - Government. - Ministries, agencies equivalent to ministries. - Agencies under the Government. - Relationships among central state administrative agencies.

1.2.4 System of local state administrative agencies: - People's Committees system. - System of specialized agencies.

1.2.5 Relationships between the central and local state administrative management systems: - Hierarchical relationships. - Directive relationships.

1.3 Topic 3: Administrative Reform

Duration is ten hours, including the main contents as follows:

1.3.1 Administrative reform is an inevitable and continuous process: - Essence and characteristics of administrative reform. - General trends of administrative reform.

1.3.2 Administrative reform in Vietnam: - Administrative reform in Vietnam before 2000. - Administrative reform in Vietnam since 2001.

1.3.3 Difficulties and obstacles to administrative reform: - Difficulties and obstacles from within administrative agencies. - Difficulties and obstacles from outside.

2. Specialized Knowledge Section

Total duration is sixty hours of study, including the following topics and contents:

2.1 Topic 4: Objects of State Administrative Management

Duration is five hours, including the main contents as follows:

2.1.1 State organizations, political organizations, political-social organizations, non-governmental organizations, foreign organizations operating in Vietnam, organizations established and operating under the Enterprise Law, Investment Law... - Common characteristics of these organizations. - Relationships of these organizations with state administrative agencies. - Rights and obligations of these organizations.

2.1.2 Citizens: rights and obligations.

2.2 Topic 5: Activities of State Administrative Management

Duration is five hours, including the main contents as follows:

2.2.1 Fundamental principles of state administrative management activities: - Principle of Party leadership over state administrative management activities. - Principle of socialist rule of law. - Principle of equality. - Principle of transparency. - Principle of democracy. - Principle of democratic centralism.

2.2.2 Regulatory activities of the system of state administrative management agencies: - Regulatory activities of central state administrative agencies. - Regulatory activities of local state administrative agencies.

2.2.3 Enforcement activities: - Types of individual administrative decisions. - Application of laws: enforcement, punishment, etc.

2.2.4 Service provision activities of state administrative agencies: - Public services and service provision activities of state administrative agencies. - Trends of public service provision reform and the role of state administrative agencies.

2.3 Topic 6: Administrative Procedures and Processes

Duration is ten hours, including the main contents as follows:

2.3.1 Process and factors affecting the process of handling matters for organizations and citizens: - Concept of process. - Factors affecting the process.

2.3.2 Processes within the system of state administrative agencies: - Process of issuing administrative decisions. - Process of issuing regulatory legal documents. - Process of handling matters for organizations and citizens.

2.3.3 Process of resolving complaints, reports, suggestions, and requests from citizens and organizations.

2.3.4 Internal processes of state administrative agencies: - Processes related to archives and records management. - Processes related to internal personnel management. - Disciplinary processes.

2.3.5 Process of handling administrative procedures for organizations and citizens under the "one-stop" model: - Nature of the model. - Contents of the model. - Challenges to implement according to national standard TCVN ISO 9001:2008.

2.3.6 Administrative procedures.

2.3.7 Fundamental principles for determining administrative procedures: - Internal administrative procedures. - Administrative procedures serving organizational and citizen requirements.

2.4 Topic 7: Inspection, Supervision, and Oversight of State Administrative Management Activities

2. 5.1. Characteristics of management activity products: - General management activity products. - State administrative management activity products. - Factors affecting the formation of state administrative management activity products.

2. 5.2. State administrative management activity products: - Types of normative legal documents. - Types of individual management documents.

2. 5.3. Public service provision activities: - Types of public services provided by state administrative agencies. - Distinctive features of public services.

2. 5.4. Intermediate and final products in state administrative management activities: - Draft documents (letters, directives, management documents, normative legal documents...). - Reviewing and approving documents. - Issuing and distributing documents (final product).

2. 6. Special Topic 9: Civil Service, Civil Servants, and Administrative Offices Duration: 10 sessions, including the following main contents:

2. 6.1. General issues about civil service in state management agencies: - Concept of civil service. - Basic characteristics of civil service activities. - Factors ensuring civil service activities.

2. 6.2. Civil servants: - People working for state agencies and classification. - Civil servants as part of people working in state agencies. - Rights, benefits, and obligations of workers in state agencies. - Ethics of civil servants and communication in state management activities.

2. 6.3. Administrative offices: - Administrative offices where civil servants perform state management activities. - Requirements for state administrative offices. - Scientific organization of work in administrative offices affects the effectiveness of applying quality management systems.

2. 7. Special Topic 10: Quality of Activities of State Administrative Agencies Duration: 10 sessions, including the following main contents:

2. 7.1. Concept and characteristics of the quality of state administrative management activities (measurable, non-measurable, qualitative, quantitative).

2. 7.2. Criteria for evaluating the quality of state administrative management activities.

3. Mid-term and final examinations and issuance of training certificates

3. 1. Mid-term examination:

The mid-term examination takes place after the basic knowledge section, lasting 02 sessions, which can be conducted through short tests, multiple-choice questions, or group discussions to assess.

3. 2. Final examination:

The final examination is a written test lasting 03 sessions, consisting of essay and multiple-choice sections or a combination thereof.

The final examination is graded on a scale of 10 points, with a score of 5 points or higher being satisfactory; scores from 5 to under 7: average; scores from 7 to under 9: good; scores from 9 to 10: excellent.

3. 3. Issuance of training certificates:

3. 3.1. At the end of the course, the training institution bases its decision to issue a training completion certificate to those who meet the requirements on the results of the mid-term and final examinations.

3. 3.2. The training certificate includes personal information, photograph of the participant (according to the model specified in Appendix VI of this Circular).

Chapter IV

RIGHTS AND OBLIGATIONS OF TRAINING INSTITUTIONS AND STUDENTS

Article 8. Rights and Obligations of Training Institutions

1. Organize courses on administrative management knowledge according to the Certificate of Eligibility for Training Activities issued by the General Department of Standardization, Metrology and Quality Control.

2. Adhere to the training program, content registered, and relevant training regulations stipulated in this Circular and related laws.

3. Use the teaching staff as registered in the application dossier.

4. Retain complete individual training records of students for at least 03 years.

5. Report the training outcomes of each course to the General Department of Standardization, Metrology and Quality Control (according to the model specified in Appendix VII of this Circular). In case of changes in organizational structure or teaching staff, report immediately to the General Department of Standardization, Metrology and Quality Control for monitoring and management.

6. Subject to regular or surprise inspections by the General Department of Standardization, Metrology and Quality Control.

7. Training institutions violating provisions of this Circular and related laws will be subject to handling according to the following forms depending on the severity of the violation: cancellation of training outcomes of the course; revocation of the Certificate of Eligibility for Training, and handling violations according to the law.

In cases of violation handling mentioned above, the training institution shall be responsible for compensating losses to organizations and individuals who have paid fees to participate in training.

Article 9. Rights and Obligations of Trainees

1. Select a training institution that has been issued a Certificate confirming eligibility to conduct training activities in accordance with regulations.

2. Submit application files for training and pay training fees as stipulated by the training institution.

3. Seriously participate in the course, and upon completion of the course and passing the examination, obtain a certificate of training in administrative management knowledge.

4. Have the right to lodge complaints and reports regarding issues related to the training of administrative management knowledge at the training institution according to the provisions of this Circular.

Chapter V

IMPLEMENTATION

Article 10. Tasks of the General Department of Standards, Metrology and Quality Control

The General Department of Standards, Metrology and Quality Control shall be responsible for performing the following tasks:

1. Implementing this Circular.

2. Review applications and issue Certificates confirming eligibility to conduct training activities in administrative management knowledge for consulting and evaluation experts at training institutions according to the provisions of this Circular.

3. Conduct inspections on the implementation of training activities at training institutions concerning compliance with regulations on training administrative management knowledge for consulting and evaluation experts. Handle violations according to the provisions of this Circular and relevant laws.

4. Annually, in December, report the consolidated situation of training to the Ministry of Science and Technology and make recommendations if necessary.

Article 11. Implementation Provisions

1\. This Circular takes effect forty-five days from the date of issuance.

2. During the implementation process, if there are difficulties or suggestions for changes to content to suit actual conditions, organizations and individuals must reflect these in writing to the Ministry of Science and Technology for consideration and resolution./.
