CIRCULAR

Guidelines for the application of the national standard TCVN 4193:2005 to coffee beans

Pursuant to Decree No. 01/2008/NĐ-CP dated January 3, 2008, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Decree No. 75/2009/NĐ-CP dated September 10, 2009 of the Government amending Article 3 of Decree No. 01/2008/NĐ-CP dated January 3, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to the Law on Standards and Technical Regulations dated June 29, 2006 and Decree No. 127/2007/NĐ-CP dated August 1, 2007 of the Government detailing the implementation of certain provisions of the Law on Standards and Technical Regulations;

Pursuant to the Law on Product and Commodities Quality dated November 21, 2007 and Decree No. 132/2008/NĐ-CP regarding detailed regulations on the implementation of certain provisions of the Law on Product and Commodities Quality;

The Minister of Agriculture and Rural Development guides the application of the national standard TCVN 4193:2005 to coffee beans as follows:

Article 1. Organizations and individuals engaged in production, business, and export of coffee beans voluntarily apply the national standard TCVN 4193:2005 on coffee beans and implement the declaration of conformity according to Clause 1, Article 14 of Decree No. 127/2007/NĐ-CP dated August 1, 2007 of the Government detailing the implementation of certain provisions of the Law on Standards and Technical Regulations.

Article 2. The Department of Quality Management of Forestry, Agriculture, and Fisheries shall be responsible for receiving and submitting for publication on the Ministry's website (http://www.mard.gov.vn), the Department of Quality Management of Forestry, Agriculture, and Fisheries' website (http://www.nafiqad.gov.vn), and the Vietnam Coffee-Cocoa Association's website (www.vicofa.org.vn) the list of organizations and individuals engaged in production, business, and export of coffee applying the national standard TCVN 4193:2005.

Article 3. This Circular takes effect 45 days from the date of issuance and replaces Decision No. 86/2007/QĐ-BNN dated October 15, 2007 of the Minister of Agriculture and Rural Development on temporarily using the national standard TCVN 4193:2005 in quality inspection of exported coffee beans.

Article 4. The Director of the Ministry’s Office, the Director of the Department of Quality Management of Forestry, Agriculture, and Fisheries, the Director of the Science, Technology, and Environment Department, and related organizations and individuals are responsible for implementing this Circular./.
