Pursuant to Decree No. 116/2008/NĐ-CP dated November 14, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Planning and Investment;
Pursuant to Decision No. 800/QĐ-TTg dated June 4, 2010 of the Prime Minister approving the National Target Program on New Rural Development for the period 2010-2020;
Pursuant to Decision No. 498/QĐ-TTg dated March 21, 2013 of the Prime Minister supplementing the investment mechanism for the National Target Program on New Rural Development for the period 2010-2020;
The Ministry of Planning and Investment guides some basic principles regarding management of construction investment projects applying special mechanisms as follows:
Article 1. Scope and Applicability
Article 1. This Circular guides the procedures for preparing, reviewing, approving budgets, organizing construction, inspecting completion, and settling accounts for construction projects with an investment capital under VND 3 billion, using state budget funds, simple technology, applying model designs, typical designs, located in village areas (referred to collectively as villages), assigned to communities benefiting from the program to implement autonomously under the National Target Program on New Rural Development for the period 2010-2020.
2. The subjects applying this regulation are agencies, organizations, individuals, and beneficiary communities implementing construction investment activities as stipulated in Clause 1 of this Article.
Article 2. Preparing, reviewing, and approving investment project budgets
1. Preparing an investment project budget (hereinafter referred to as the budget)
a) Procedure for preparing the budget
Based on the list of projects eligible for special mechanisms approved by the People's Committee at the district level, local support investment plans, and guidance from higher-level authorities, the Village Construction Management Board (referred to as the Village Management Board) informs and disseminates to villages and community residents about the special investment mechanism.
- The Village Management Board assigns specialized staff to work with the village and the Village Development Board to prepare the investment project budget. After preparing the budget, the village and the Village Development Board organize meetings with villagers to gather their opinions on the budget contents and voluntary contributions from residents.
- The Village Development Board completes the budget according to the consensus reached at the village meeting and submits it to the People's Committee of the commune (with the minutes of the village meeting) for review and approval.
b) Contents of the budget
- Name of the project, investment objectives, construction location, investor, scale of the project, technical standards according to model designs, typical designs, time frame, and other relevant information (if applicable).
- Budget value, including state support funding, resident contributions, other mobilized funds (if applicable), contribution forms; sources of investment capital and regulations on settlement of accounts.
- Construction drawings of the project (if applicable) based on model designs, typical designs issued by competent state agencies.
- Self-execution capacity of residents and beneficiary communities.
2. Reviewing the budget
a) After completing the budget, the village reports to the Village Management Board and submits it to the People's Committee of the commune for review.
b) Documents for review include: Budget, minutes of village meetings, and related legal documents concerning construction (if applicable).
c) Review team: The People's Committee of the commune establishes a Review Team consisting of: The head of the People's Committee of the commune as the Team Leader, representatives of the Community Investment Supervision Board (referred to as the Community Supervision Board), financial and accounting staff of the commune, experts or persons with professional qualifications selected by the community.
d) Content of review: Technical feasibility; construction site; fund mobilization capacity (state, resident contributions, other resources); compatibility of the project with local planning; reasonableness of costs compared to local price levels and similar ongoing projects; self-execution capacity of residents and communities tasked with constructing the project.
đ) The Review Team must report the results of the review in writing to the People's Committee of the commune, and simultaneously send it to the Village Development Board.
In cases where the review opinions are not consistent with the draft budget, the inconsistencies must be recorded in the review result report for the village to adjust and supplement.
e) Time for review and reporting results: Not exceeding 10 working days from the date of receiving complete valid documents.
3. Approving the budget
The People's Committee of the commune approves the budget based on the budget submitted by the village and the review results reported by the Review Team.
Article 3. Construction and Acceptance of Works
1. Based on the approved budget estimate, the People's Committee of the commune shall notify the investment support plan to the village and the Commune Management Board shall proceed to conclude economic contracts with the Village Development Board to organize the implementation of construction works.
2. The Commune Management Board shall be responsible for assigning specialized staff to assist the village in construction. The Community Supervision Board of the commune shall be responsible for supervision during the construction process.
3. The Commune Management Board, the Community Supervision Board, and the Village Development Board shall organize the acceptance of works in accordance with regulations.
Article 4. Payment and Final Settlement
Implementation shall be carried out in accordance with the joint Circular No. 26/2011/TTLT-BNNPTNT-BKHĐT-BTC dated April 13, 2011 of the Ministry of Agriculture and Rural Development, the Ministry of Planning and Investment, and the Ministry of Finance on guiding the implementation content of Decision No. 800/QĐ-TTg approving the National Target Program on New Rural Development for the period 2010-2020 and any subsequent amendments and supplements (if any).
Article 5. Effective Date
This Circular takes effect from September 15, 2013.
In the course of implementation, if there are difficulties or obstacles, organizations and individuals concerned are requested to reflect them in writing to the Ministry of Planning and Investment for study and resolution./.
