PROVISIONS ON THE FUNCTIONS, TASKS, POWERS AND ORGANIZATIONAL STRUCTURE OF THE GENERAL DEPARTMENT OF METEOROLOGY, HYDROLOGY AND ENVIRONMENT UNDER THE MINISTRY OF NATURAL RESOURCES AND ENVIRONMENT

Pursuant to the Law on Government Organization dated June 19, 2015;

Pursuant to Decree No. 123/2016/ND-CP dated September 1, 2016 of the Government stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies;

On the basis of Decision No. 36/2017/NĐ-CP dated April 4, 2017, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Natural Resources and Environment;

At the proposal of the Minister of Natural Resources and Environment;

The Prime Minister promulgates this Decision stipulating the functions, tasks, powers, and organizational structure of the General Department of Meteorology and Hydrology under the Ministry of Natural Resources and Environment.

Article 1. Position and Functions

1. The General Department of Meteorology, Hydrology and Environment is an organization under the Ministry of Natural Resources and Environment, performing the function of advising and assisting the Minister of Natural Resources and Environment to manage state administration and enforce laws on meteorology and hydrology throughout the country; managing and organizing activities of public services within its scope of state management according to the provisions of the law.

2. The General Department of Meteorology and Hydrology has legal personality, bears the State Emblem seal, maintains a separate account; its headquarters is located in Hanoi City.

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

1. To the Minister of Natural Resources and Environment:

a) Draft laws, draft resolutions of the National Assembly; draft ordinances, draft resolutions of the Standing Committee of the National Assembly; draft decrees, resolutions of the Government; draft decisions, directives of the Prime Minister; mechanisms, policies and other documents within the scope of management of the General Department;

b) Strategies, plans, long-term, medium-term, annual programs, projects, proposals, important national tasks and works on meteorology and hydrology;

c) National technical standards, national technical regulations, economic-technical norms within the scope of management of the General Department.

2. To provide professional guidance within the scope of management of the General Department.

3. Organize propaganda, dissemination, and education on laws within the fields under the management of the General Department.

4. Guide, inspect and organize the implementation of regulatory legal documents, mechanisms, policies, strategies, plans, programs, projects, proposals, tasks within the scope of management of the General Department.

5. Regarding the network of meteorological and hydrological stations:

a) Manage activities of monitoring, surveying, and investigating meteorology and hydrology; monitor the operation of meteorological and hydrological stations belonging to construction projects that must be monitored and provide meteorological and hydrological information and data;

b) Review contents related to meteorology and hydrology in planning and designing major national construction projects and in planning and designing construction projects according to the provisions of the law; review construction projects for renovation and upgrading of meteorological and hydrological facilities of the Ministry of Natural Resources and Environment as assigned by the Minister of Natural Resources and Environment;

c) Establish, manage, and operate the national network of meteorological and hydrological stations, lightning location monitoring, climate change surveillance; organize monitoring, surveying, and investigating activities on meteorology and hydrology;

d) Organize calibration and verification of meteorological and hydrological measuring instruments according to the provisions of the law;

đ) Organize protection of meteorological and hydrological facilities and technical corridors within the national network of meteorological and hydrological stations.

6. Regarding forecasting and warning of meteorology and hydrology:

a) Manage activities of forecasting and warning meteorology and hydrology, broadcasting weather forecast and warning information; guide the provision and use of natural disaster forecast and warning information nationwide;

b) Inspect, supervise, and evaluate the quality of forecasting and warning, and broadcasting and transmitting meteorological and hydrological information and natural disasters according to regulations;

c) Reviewing and submitting to the Minister of Natural Resources and Environment for decision-making on issuing, extending, suspending, or revoking permits for weather and climate forecasting and warning activities according to the law;

d) Review and submit to the Minister of Natural Resources and Environment for approval within his authority or submit to competent authorities for approval plans affecting weather; organize implementation or supervise implementation after approval;

đ) Establish, manage, and operate the national system of meteorological and hydrological forecasting and warning; organize forecasting and warning activities on meteorology and hydrology; broadcast meteorological and hydrological forecast and warning information; issue official natural disaster warnings and risk levels;

e) Establish national climate standards; implement the Global Framework for Climate Services (GFCS) in Vietnam according to regulations;

g) Develop radio and television programs on meteorological and hydrological forecasting and warning according to the law;

7. On meteorological and hydrological information and data:

a) Manage and guide the storage, exploitation, and use of meteorological and hydrological information and data;

b) Manage and guide the exchange of meteorological and hydrological information and data with international organizations, foreign organizations, and individuals according to the law;

c) Organize activities of storing, exploiting, and using meteorological and hydrological information and data; establish and manage the national database of meteorological and hydrological information;

d) Organize receipt and use of meteorological and hydrological information and data provided by ministries, sectors, localities, organizations, and individuals according to the law;

đ) Establish and manage the information system serving investigation, survey, forecasting, and warning of meteorological and hydrological events within the national meteorological and hydrological network;

e) Implement the exchange of meteorological and hydrological information and data with international organizations, foreign organizations, and individuals according to the law;

8. Organize research and application of science and technology in activities of investigation, survey, construction, management of station networks, forecasting, and warning of meteorology and hydrology within the scope of management of the General Department.

9. Regarding international cooperation:

a) Submit to competent state agencies for participation in international organizations, signing or joining international treaties on meteorology and hydrology; perform liaison roles in participating in international organizations, forums, and implementing international treaties on meteorology and hydrology as assigned by the Minister of Natural Resources and Environment;

b) Cooperate with international organizations in exchanging experts, training, and developing high-quality human resources in meteorology and hydrology;

c) Organize and implement other international cooperation activities on meteorology and hydrology within their authority;

10. Manage, guide, and oversee meteorological and hydrological activities of ministries, sectors, and localities according to the law;

11. Guide, inspect, and organize the implementation of activities serving public services in meteorology and hydrology in accordance with the provisions of the law.

12. Inspect and resolve complaints and reports regarding meteorology and hydrology within the scope of authority.

13. Implement administrative reform according to the program and plan of administrative reform of the Ministry of Natural Resources and Environment; practice thrift; prevent corruption and waste within the scope of management of the General Department;

14. Manage organizational structure, civil servants, officials, and employees according to the law and the delegation of the Minister of Natural Resources and Environment; implement systems, policies, competitions, rewards, punishments, and participate in specialized training and development for civil servants, officials, and employees under the management of the General Department according to the law and the delegation of the Minister of Natural Resources and Environment;

15. Manage finance, assets, and other resources delegated by the Ministry of Natural Resources and Environment and in accordance with the provisions of the law.

16. Manage and organize the implementation of investment projects in the field of meteorology and hydrology in accordance with the delegation of the Minister of Natural Resources and Environment.

17. Perform other tasks assigned by the Minister of Natural Resources and Environment.

9. Information and Data Center for Meteorology and Hydrology.

10. Technology Application Center for Meteorology and Hydrology.

11. Journal of Meteorology and Hydrology.

12. Hydrological and Meteorological Survey Federation.

13. High Altitude Meteorological Station.

14. West North Meteorological and Hydrological Station.

15. North Vietnam Meteorological and Hydrological Station.

16. Northeast Meteorological and Hydrological Station.

17. Red River Delta Meteorological and Hydrological Station.

18. North Central Coast Meteorological and Hydrological Station.

19. Central Central Coast Meteorological and Hydrological Station.

20. South Central Coast Meteorological and Hydrological Station.

21. South Vietnam Meteorological and Hydrological Station.

22. Central Highlands Meteorological and Hydrological Station.

In this Article, organizations specified from Clause 1 to Clause 6 are organizations assisting the Director General of the National Hydro-Meteorological Service in performing state management functions; organizations specified from Clause 7 to Clause 22 are public service units directly under the National Hydro-Meteorological Service.

The Office of the General Department of Meteorology and Hydrology has three departments.

Article 4. Leadership of the General Department

1. The General Department of Meteorology and Hydrology shall have a Director and not more than four Deputy Directors appointed and relieved from office by the Minister of Natural Resources and Environment in accordance with the provisions of the law.

2. The Director General of the National Hydro-Meteorological Service shall be responsible before the Minister of Natural Resources and Environment and before the law for all activities of the National Hydro-Meteorological Service. The Deputy Director General of the National Hydro-Meteorological Service shall be responsible before the Director General and before the law for the field of work assigned to manage.

3. The Director General of the National Hydro-Meteorological Service shall submit to the Minister of Natural Resources and Environment for promulgation regulations on the functions, tasks, powers, and organizational structure of subordinate organizations; appoint and relieve leaders and managers within the National Hydro-Meteorological Service according to the provisions of the law and the delegation of the Minister of Natural Resources and Environment.

Article 5. Effective Date

1. This Decision takes effect from March 9, 2018.

2. This Decision replaces Decision No. 77/2013/QĐ-TTg dated December 24, 2013 of the Prime Minister stipulating the functions, tasks, powers, and organizational structure of the National Hydro-Meteorological Center under the Ministry of Natural Resources and Environment.

Article 6. Responsibility for Implementation

The Minister of Natural Resources and Environment, Ministers, Heads of ministerial-level agencies, Heads of central government agencies, Chairpersons of provincial People's Committees under the central government, and the Director General of the National Hydro-Meteorological Service are responsible for implementing this Decision./.
