1. Establishment of national railway infrastructure maintenance plans: under the Ministry of Natural Resources and Environment

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to Decree No. 36/2012/NĐ-CP dated April 18, 2012, of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

Pursuant to Decree No. 21/2013/NĐ-CP dated March 4, 2013, promulgated by the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Natural Resources and Environment;

At the proposal of the Minister of Natural Resources and Environment;

The Prime Minister issues a Decision to stipulate the functions, tasks, powers, and organizational structure of the National Hydro-Meteorological Center under the Ministry of Natural Resources and Environment,

Article 1. Position and Functions

1. The National Hydro-Meteorological Center (hereinafter referred to as the Center) is a public service organization under the Ministry of Natural Resources and Environment, performing basic surveying, forecasting, and providing meteorological and hydrological information, air and water environment monitoring, lightning location monitoring, climate change surveillance for disaster prevention and control, economic and social development, ensuring national security and defense throughout the country; organizing other public services as prescribed by law.

2. The Center has legal personality, its own seal, and separate bank accounts as prescribed by law; its headquarters is located in Hanoi City.

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

1. Submit to the Minister of Natural Resources and Environment the strategic development plan, planning, programs, five-year plans, annual plans, projects, and implementation programs of the Center after approval.

2. Participate in drafting legal documents, technical standards, economic and technical norms on meteorology and hydrology.

3. Organize the implementation of the national network development plan for meteorological and hydrological observation, including surface meteorology, high-altitude meteorology, agricultural meteorology, continental hydrology, and marine meteorology (hereinafter collectively referred to as meteorology and hydrology), lightning location monitoring, climate change surveillance; implement the national strategy on forecasting and warning natural disasters within the Center's responsibility.

4. Conduct observations and data collection on the national meteorological and hydrological network, lightning location monitoring, climate change surveillance; organize investigations and surveys on meteorology and hydrology, riverbed and estuary changes, coastal areas to supplement basic investigation materials at locations lacking observation stations, places frequently hit by typhoons, floods, natural disasters, and other dangerous meteorological and hydrological phenomena; carry out environmental air and water quality monitoring tasks as assigned by the Minister of Natural Resources and Environment.

5. Organize the implementation of meteorological and hydrological forecasting and warning activities; issue official notifications on weather conditions, tropical depressions, typhoons, floods, tidal surges, and other dangerous meteorological and hydrological phenomena as prescribed by law; organize sea level monitoring and data transmission for tsunami warning, flood prevention, saltwater intrusion prevention, and climate change impacts, landscape environmental effects.

6. Participate in building, managing, and operating the national system for natural disaster warnings; provide forecasting and warning information on natural disasters nationwide.

7. Organize the evaluation of basic surveying and forecasting quality within the Center's management scope; build, manage, and maintain basic and specialized meteorological and hydrological databases managed by the State; organize the provision of meteorological and hydrological information and data according to the law.

8. Participate in reviewing applications for issuing, extending, and revoking permits for specialized meteorological and hydrological facilities and forecasting and warning permits; participate in reviewing technical standards for construction works, measuring equipment of specialized meteorological and hydrological facilities, lightning location devices built with state budget funds as assigned by the Minister of Natural Resources and Environment.

9. Build, manage, and develop information systems and other technologies serving basic surveys, meteorological and hydrological forecasting, and natural disaster warnings within the national meteorological and hydrological network.

10. Organize the selection, testing, calibration, and verification of meteorological and hydrological measurement instruments.

11. Implement decisions on establishing, upgrading, downgrading, relocating, and dissolving meteorological and hydrological facilities; protect the technical safety corridors of meteorological and hydrological facilities under the Center's management as prescribed by law and as assigned by the Minister of Natural Resources and Environment.

12. Participate in reviewing the use of basic survey data on meteorology and hydrology, lightning location monitoring data for key national construction projects and construction projects under the decision-making and investment management authority of the Minister, heads of ministries equivalent to ministries, heads of government agencies, provincial People's Committee Chairmen, and municipal People's Committee Chairmen directly under the central government as assigned by the Minister of Natural Resources and Environment.

13. Carry out climate change-related tasks related to meteorology and hydrology as assigned by the Minister of Natural Resources and Environment.

14. Perform member duties of the Central Steering Committee for Flood and Storm Prevention and Control, Provincial and Municipal Flood and Storm Prevention and Rescue Command Centers as prescribed.

15. Organize the implementation of international cooperation programs, projects, and activities after approval; participate in multilateral, bilateral activities, international treaties, and agreements on meteorology and hydrology as assigned by the Minister of Natural Resources and Environment.

16. Organize professional training and capacity building for civil servants and employees of the Center as prescribed and assigned by the Minister of Natural Resources and Environment.

17. Research, apply, and transfer meteorological and hydrological technology as prescribed by law.

18. Promote community awareness on disaster prevention, avoidance, and mitigation as assigned by the Minister of Natural Resources and Environment.

19. Organize the provision and exploitation of meteorological and hydrological and environmental services as prescribed by law.

20. Manage and organize the implementation of investment projects in the field of meteorology and hydrology as classified by the Minister of Natural Resources and Environment.

21. Implement administrative reform according to the Ministry of Natural Resources and Environment's administrative reform program and plan.

23. Implement anti-corruption measures, promote thrift, and combat waste; handle complaints, reports, and citizen recommendations concerning matters within the Center's jurisdiction in accordance with the law.

24. Manage organizational structure and staffing; appoint, reappoint, transfer, rotate, relieve from duty, resign, detail, retire, and terminate employment; implement salary systems and incentive policies, commendation, and reward systems for civil servants, officials, and employees under the Center in accordance with the分级授权的部长规定和法律规定。

25. Manage financial resources and assets allocated according to the分级授权的自然资源部规定和法律规定。

26. Carry out other tasks and authorities delegated by the Minister of Natural Resources and Environment and in accordance with the law.

13. Northern Vietnam Meteorological and Hydrological Station (headquarters located in Việt Trì City, Phú Thọ Province).

14. Northeast Meteorological and Hydrological Station (headquarters located in Hải Phòng City).

15. North Delta Meteorological and Hydrological Station (headquarters located in Hà Nội City).

16. North Central Coast Meteorological and Hydrological Station (headquarters located in Vinh City, Nghệ An Province).

17. Central Coast Meteorological and Hydrological Station (headquarters located in Đà Nẵng City).

18. South Central Coast Meteorological and Hydrological Station (headquarters located in Nha Trang City, Khánh Hòa Province).

19. Southern Meteorological and Hydrological Station (headquarters located in Hồ Chí Minh City).

20. Western Highlands Meteorological and Hydrological Station (headquarters located in Pleiku City, Gia Lai Province).

The Minister of Natural Resources and Environment decides to establish self-financing public service organizations under the National Meteorological and Hydrological Center in accordance with the law.

Article 4. Leadership of the Center

1. The Center's leadership consists of a General Director and no more than three Deputy General Directors.

2. The General Director and Deputy General Directors are appointed and relieved of duty by the Minister of Natural Resources and Environment in accordance with the law.

3. The General Director defines the functions, tasks, authorities, and organizational structure of subordinate organizations under the National Meteorological and Hydrological Center.

4. The General Director is responsible before the law and the Minister of Natural Resources and Environment for all activities of the Center; Deputy General Directors are responsible to the General Director and the law for the areas assigned to them.

Article 5. Effectiveness and Responsibility for Implementation

1. This Decision takes effect from February 12, 2014, and replaces Decision No. 128/2008/QĐ-TTg dated September 17, 2008, of the Government Chairman on the functions, tasks, authorities, and organizational structure of the National Meteorological and Hydrological Center under the Ministry of Natural Resources and Environment.

2. The Minister of Natural Resources and Environment, ministers, heads of ministerial-level agencies, heads of government-affiliated agencies, chairmen of provincial people's committees directly under the central government, and the General Director of the National Meteorological and Hydrological Center are responsible for implementing this Decision./.
