Pursuant to the Law T, amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CP dated December 25, 2001;

Pursuant to DecreeNo. ||| Decree No. 36/2012/NĐ-CP dated April 18, 2012 of the Government stipulates the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies; organization |||

At the proposal of the Minister of Natural Resources and Environment,

The Government promulgates this Decree stipulating the functions, tasks, powers, and organizational structure of the Ministry of Natural Resources and Environment.

Article 1. Position and Functions

||| The Ministry of Natural Resources and Environment is an agency of the Government, performing state management functions in the following areas: Land; water resources; mineral resources and geology; environment; meteorology and hydrology; climate change; surveying and mapping; comprehensive and unified state management over seas and islands; state management of public services in sectors and fields under the Ministry's jurisdiction.commission ||| Article 2. Tasks and

||| The Ministry of Natural Resources and Environment performs the tasks and powers prescribed in Decree No. 36/2012/NĐ-CP dated April 18, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies, and the following specific tasks and powers:

|||y||| Submit to the Government draft laws, draft resolutions of the National Assembly, draft ordinances, draft resolutions of the Standing Committee of the National Assembly, draft resolutions, decrees of the Government, and

1. ||| decisions of the Prime Minister according to the annual legislative program of the Ministry that has been approved and other projects and programs assigned by the Government and the Prime Minister. DECREES:|||No.||| Submit to the Government and the Prime Minister for approval and organization of implementation of strategies, plans, long-term development plans, five-year plans, annual plans, and important national programs and projects in the natural resources and environmental sector. ||| Total number of subjects who have completed execution of the decision ||| of the annual internal audit plan, audit decision ||| Approve strategies, plans, and programs for the development of sectors and fields under the Ministry’s state management jurisdiction, according to the division of authority and delegation from the Government and the Prime Minister; inspect and guide the implementation after approval.on |||

2. ||| Issue decisions, directives, circulars, and other documents on state management of sectors and fields under the Ministry’s jurisdiction; direct, inspect, and organize the implementation of legal normative documents within the Ministry’s jurisdiction; disseminate, promote, and educate on laws related to natural resources and the environment; establish national standards, issue national technical regulations, and economic-technical norms in sectors and fields under the Ministry’s state management jurisdiction.Deputy ministers of ministerial-level agencies, ||| Regarding land:y ||| Guide and inspect the implementation of strategies, plans, programs, projects, and proposals on land management and use after they have been decided and approved by competent authorities;amend||| Develop nationwide land use planning and regional land use planning; review provincial and centrally-administered city land use plans and plans for land use for national defense and security purposes; provide written comments on land use content in industry and field plans involving land use;to ||| Chair and coordinate with relevant ministries and sectors to formulate and adjust the framework of land prices, principles, and methods for determining land prices; inspect and provide written comments on issues related to land, compensation, and land clearance for investment projects under the National Assembly and Prime Minister's approval and conditional investment projects;

||| Establish land price lists and specific land valuations; create land price maps; compile, provide data, and information on land price frameworks, land price lists, and specific land prices; a) For PPP projects, the tenderer shall post the selection results of investors and attach the approval decision on the System no later than ten days from the date the document is issued in accordance with point b of Clause 2, Article 4 of Decree No. 35/2021/NĐ-CP. ||| Guide and inspect the investigation, survey, measurement, creation of land registry maps, current land use status maps, and land use planning maps; the establishment and adjustment of land use plans; land allocation, leasing, recovery, and change of land use purpose; land use rights, housing ownership, and other property rights attached to land; land registry file establishment and management, construction of land registry data; issuance of land use right certificates, housing ownership certificates, and certificates for other property rights attached to land; implementation of land users' rights and obligations as prescribed by law; ||| d) Guide and inspect land statistics and inventory work within their jurisdiction; 15. Perform other state management tasks in the field of finance in accordance with the assignment, delegation, or authority of the district People's Committee and the law. At the proposal of||| v||| Guide and inspect compliance with conditions and procedures for public services in land management and use, issuance of practice certificates in the land sector as prescribed by law;

4. ||| Guide, inspect, and implement legal provisions on compensation, support, and resettlement when the State recovers land; guide and inspect the determination of land users eligible for compensation, support, or non-compensation, non-support;无效 ||| Guide, inspect, and organize the recovery of land, development of land funds, and bidding for projects using land;concerning the classification and determination of state management authority in the field of crop production ||| Issue and manage the use of blank land use right certificates, housing ownership certificates, and certificates for other property rights attached to land; guiding||| k) Organize investigations and evaluations of land potential and utilization efficiency to serve state management of land and socio-economic development needs;policies||| l) Build a national information system and store data on land;to||| m) Direct, guide, and inspect the resolution of land disputes according to the law.

Political Theory Department;||| Regarding water resources:

a) ||| Guide and inspect the implementation of policies, laws, strategies, and water resource plans as prescribed by law; organize the implementation of plans, programs, proposals, and projects on preventing, controlling pollution, degradation, depletion, and restoring polluted and depleted water sources to ensure comprehensive, multi-purpose, economical, and efficient exploitation and use of water resources in river basins under the Ministry's jurisdiction after being decided and approved by competent authorities;

e) Regarding water resources:For power plants invested under the Build-Operate-Transfer (BOT) model, n is determined according to the operational period of the power plant stipulated in the BOT contract.Guide and inspect the organization of implementation of policies, laws, strategies, and water resource planning as prescribed by law; organize the implementation of plans, programs, projects, and programs to prevent, control pollution, degradation, depletion of water sources, restore polluted and depleted water sources, respond to and mitigate water source pollution incidents to ensure comprehensive, multi-purpose, efficient, and economical exploitation and use of water resources in river basins under the Ministry's jurisdiction after being decided and approved by competent authorities; đEstablish overall basic investigation plans for water resources, national water resource planning; organize the establishment and approval of water resource planning for inter-provincial river basins, inter-provincial water sources, and

g) Organize basic investigations of water resources; compile results of basic investigations, exploitation, utilization, and protection of water resources implemented by ministries, sectors, and localities; inventory, evaluate, and forecast water resources; build, manage, and operate water resource monitoring and supervision systems, exploitation, use and discharge of wastewater into water sources for inter-provincial river basins, inter-provincial water sources, and vinternational water sources; build, manage, and operate national water resource information and database systems; store, manage, announce, and provide information andêdata on water resources, exploitation, utilization of water resources, and water source conditions on various12. guiding, implementing registration, recognition, issuance, revocation of various environmental permits and certificates according to the provisions of the law; 1. The Minister of Natural Resources and Environment shall stipulate the functions, tasks, powers, and organizational structure of subordinate units under the Ministry, except for units specified in Clauses 10 to 13 and Clause 22 of this Article; submit to the Prime Minister for stipulating the functions, tasks, powers, and organizational structure of General Departments under the Ministry, the National Hydro-meteorological Service Center, and decide to issue a list of other existing service organizations directly under the Ministry.specialized agency under the People's Committee of the province/city. This Decree takes effect from May 1, 2013.

Article 4. Effective date

1. Transitional Provisions trThe General Department of Geology and Mineral Resources continues to perform its functions, tasks, and powers according to current regulations until the Prime Minister decides on the functions, tasks, powers, and organizational structure of the General Department of Geology and Mineral Resources of Vietnam.
