CIRCULAR
GUIDELINES FOR THE IMPLEMENTATION OF COMPETITION AND REWARD WORK IN THE FOREIGN AFFAIRS SECTOR
Pursuant to the Law on Competition and Reward dated November 26, 2003; the Law Amending and Supplementing Certain Provisions of the Law on Competition and Reward dated June 14, 2005 and the Law Amending and Supplementing Certain Provisions of the Law on Competition and Reward dated November 16, 2013;
Pursuant to the Decree No. 91/2017/NĐ-CP dated July 31, 2017 of the Government detailing the implementation of certain provisions of the Law on Competition and Reward;
Pursuant to Decree No. 26/2017/NĐ-CP dated March 14, 2017, issued by the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Foreign Affairs;
Article 1. Amending and supplementing certain Articles of Circular No. 09/2024/TT-BCA dated March 13, 2024 issued by the Minister of Public Security regarding the implementation of mass mobilization work by the People's Public Security forceThe Director of the Department of Competition and Reward and Diplomatic Tradition;
The Minister of Foreign Affairs issues this Circular guiding the implementation of competition and reward work in the Foreign Affairs sector.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Circular guides the organization and implementation of competition and reward work in the Foreign Affairs sector, including: organizing competition movements; titles and criteria for competition titles; forms and criteria for rewards; procedures and processes for presenting and granting competition titles and reward forms; authority to decide and present competition titles and reward forms; Competition and Reward Councils, Scientific Councils; Competition and Reward Fund; reporting, inspection, and handling violations related to competition and reward work.
Article 2. Applicability
1. Organizations assisting the Minister of Foreign Affairs in performing state management functions, public service units under the Ministry of Foreign Affairs, Vietnamese representative agencies abroad (hereinafter referred to collectively as units under the Ministry).
2. Civil servants, officials, employees, and workers under the jurisdiction of the Ministry of Foreign Affairs (hereinafter referred to collectively as individuals under the Ministry).
3. External affairs offices under the People's Committees of provinces and centrally governed cities (hereinafter referred to as local external affairs offices); other organizations and individuals operating in the field of foreign relations.
4. Individuals and organizations of Vietnamese people abroad; individuals and organizations from foreign countries and international organizations contributing to the construction and development of the Foreign Affairs sector.
Article 3. Principles of Competition and Reward
1. Principles of Competition
a) Voluntary, conscious, open; solidarity, cooperation, effort, creativity in performing tasks;
b) The awarding of competition titles must be based on the competition movement and registered competition activities.
2. Principles of Reward
a) Accurate, open, fair, timely;
b) Not to grant multiple reward forms for the same achievement; groups and individuals meeting the criteria for a particular reward form should be considered and recommended by the competent authority to grant that form. In one year, no more than two State-level reward forms should be recommended for a group or an individual, except for outstanding and exceptional achievements, process-based rewards, or rewards based on tenure;
c) The reward form must be appropriate to the recipient, their function, assigned tasks, and achieved results; one-time, periodic, or thematic reward forms do not count as conditions or criteria for recommending State-level rewards; previous achievements recognized in rewards cannot be accumulated to propose higher-level rewards later;
d) Achievements for rewards are assessed in the overall performance across all areas of work of the group or individual; emphasis should be placed on rewarding small groups and individuals who are not leaders or managers;
đ) When multiple individuals or groups meet the criteria and standards, preference should be given to women or groups with at least 70% female members for rewards. For female leaders or managers, the time in office required for process-based rewards can be reduced by one-third compared to the general rule; if the retirement age is higher, the time in office for process-based rewards shall follow the general rule;
e) Close integration of spiritual encouragement with material incentives;
g) Do not recommend rewards or request higher authorities to grant rewards to groups or individuals during the period when the competent authority is considering disciplinary actions or investigations due to suspected violations or complaints requiring verification and clarification.
Chapter II
ORGANIZATION OF COMPETITION MOVEMENTS, AWARDS, AND STANDARDS FOR COMPETITION AWARDS
Section I. Forms, contents, registration of competition movements, and responsibilities in organizing competition movements
Article 4. Forms of organizing competition movements
1. Regular competition is a form of competition organized annually to effectively fulfill the assigned functions and tasks of agencies, organizations, and units. The target group for regular competition includes individuals within the same unit, units under the Ministry, or between units within the Ministry's Competition Clusters.
2. Periodic or thematic competition is a form of competition organized to effectively accomplish a key task or a priority field that needs to be concentrated on completing within a specific period.
Article 5. Content of organizing mass competitive movements
1. Clearly define the objectives, scope, and target groups for competition; based on this, set specific competition targets and contents. Determining the content and targets of competition must be scientific, consistent with the actual conditions of the agency or unit, and feasible.
2. Implement measures to organize and mobilize individuals and collectives to participate in the competition movement; regularly monitor the implementation process, promote innovative ideas and effective practices; identify, nurture, and widely publicize outstanding models.
3. Organize mid-term reviews, final summaries, and evaluations of the competition movement results; select outstanding and exemplary collectives and individuals for rewards or recommend them for higher-level rewards.
Article 6. Registration of Competition
1. Registration of regular competition: Annually, based on the theme of the competition movement launched by the Minister, units under the Ministry proactively organize individuals and collectives to register for competition with specific contents, targets, and awards; submit the unit's competition registration form to the Department of Competition and Rewards and Diplomatic Tradition before March 15.
Provincial Departments of Foreign Affairs directly under the central government register for competition according to the Competition Cluster of Provincial Departments of Foreign Affairs. The Cluster Leader unit is responsible for compiling the competition registration forms of member units and submitting them to the Department of Competition and Rewards and Diplomatic Tradition before March 15.
2. Registration of periodic or thematic competition:
a) Units under the Ministry and the Competition Cluster of Provincial Departments of Foreign Affairs proactively develop plans to organize periodic or thematic competition movements and submit their registrations to the Department of Competition and Rewards and Diplomatic Tradition within 15 days from the launch date of the competition movement;
b) Units entrusted by the Ministry's leadership to lead the implementation of a key or urgent task, project, proposal, research work, if it is deemed necessary to concentrate resources to complete the task, may launch a thematic competition and submit the collective and individual competition registration forms to the Department of Competition and Rewards and Diplomatic Tradition for consolidation, serving as the basis for the Ministry's Competition and Reward Council to consider and propose rewards.
Article 7. Responsibilities for implementing and organizing competition movements
1. The Minister of Foreign Affairs launches and directs competition movements within the entire foreign affairs sector and in fields under the Ministry's jurisdiction. The Ministry's Competition and Reward Council is responsible for advising the Minister on organizing and directing competition movements within the entire sector.
2. The Department of Competition and Rewards and Diplomatic Tradition, based on annual and five-year tasks, targets, and plans of the Ministry, collaborates with the Party Committee of the Ministry, the Ministry's Trade Union, and related units to propose policies, contents, programs, plans, and measures for competition; organize and inspect competition movements; conduct mid-term and final reviews of competition movements, promote outstanding models; propose rewards and solutions to enhance the effectiveness of competition and reward work.
3. Heads of units under the Ministry are responsible for leading and coordinating with peer-level mass organizations to organize, launch, and direct competition movements within their management scope; actively identify and select collectives and individuals with meritorious achievements for rewards or recommend them for higher-level rewards; publicize, honor, and promote outstanding models.
Section II. Awards and Criteria for Awards
Article 8. Commendation Titles
1. For individuals: "Advanced Worker", "Model Soldier at the Grassroots Level", "Model Soldier of the Ministry of Foreign Affairs", and "National Model Soldier".
2. For groups: "Advanced Labor Group", "Excellent Labor Group", "Flag of Competition of the Ministry of Foreign Affairs", and "Flag of Competition of the Government".
Article 9. Criteria for Awards for Individuals
1. The title "Advanced Worker" is awarded annually to individuals meeting the following criteria:
a) Being rated as "Successfully Completing Tasks" or higher;
b) Adhering well to internal regulations of the organization and policies of the Party and laws of the State; having a spirit of overcoming difficulties to complete tasks; being united, supportive, and helping colleagues; actively participating in competition movements;
c) Actively studying to improve political theory levels, professional knowledge, and skills;
d) Having good morals and a healthy lifestyle.
đ) Individuals who bravely rescue people or state property, resulting in injury, have their treatment time counted towards consideration for the "Advanced Worker" award.
e) Individuals sent for training or development for one year or more, adhering to the rules of the training institution and the Ministry, completing the program on schedule with a minimum grade of Good, are eligible for the "Advanced Worker" award.
g) Short-term study periods, leave, and maternity leave according to labor laws are counted as continuous service time for award consideration.
h) For individuals transferred to new positions, the new unit is responsible for considering awards; if they worked in the previous unit for six months or more, the previous unit must provide comments and evaluations. For individuals awaiting job assignments, the previous unit conducts the award consideration.
i) For individuals temporarily assigned to other units, the award consideration is conducted by the assigning unit and confirmed by the receiving unit.
k) Individuals newly hired for less than ten months or disciplined with a reprimand or higher are not considered for the "Advanced Worker" award.
l) Annually, based on overall achievements in all areas of work, the Competition and Reward Council of the Ministry reviews and proposes to the Minister the maximum percentage of individuals from outstanding and advanced labor groups to be recognized as "Advanced Workers".
2. The title "Model Soldier at the Grassroots Level" is awarded annually to individuals meeting the following criteria:
a) Meeting the criteria for the "Advanced Worker" title and being rated as "Outstandingly Completing Tasks";
b) Proposing initiatives or research topics at the grassroots level or higher that have been accepted and applied; or participating in drafting normative legal documents submitted to the Government, Politburo, or Central Committee;
Unit heads are responsible for reviewing and recognizing the effectiveness and impact of initiatives and research topics proposed by individuals within the unit;
c) Receiving at least two-thirds approval votes from the unit's collective in the evaluation process.
d) The ratio for evaluating the "Model Soldier at the Grassroots Level" title is as follows: Not exceeding 15% of the total number of "Advanced Workers" in outstanding labor groups and 10% in advanced labor groups; applying the principle of rounding decimal fractions.
This ratio may be adjusted based on the proposal of the Competition and Reward Council of the Ministry and the decision of the Minister, ensuring that the number of "Model Soldiers at the Grassroots Level" does not exceed 15% of the total number of "Advanced Workers" in the Ministry.
đ) Unit heads who do not meet the criteria for the "Outstanding Labor Group" title are not considered for the "Model Soldier at the Grassroots Level" title. Groups evaluated with two or more "Model Soldiers at the Grassroots Level" must allocate at least one position to an individual who is not a unit leader.
3. The title "Model Soldier of the Ministry of Foreign Affairs" is awarded to individuals meeting the following criteria:
a) Demonstrating outstanding achievements among those who have continuously received the "Model Soldier at the Grassroots Level" title three times consecutively. The awarding period is the year when the third "Model Soldier at the Grassroots Level" title is achieved;
b) Proposing initiatives or research topics that have been accepted and applied in practice with high effectiveness and national impact; or being a member of the drafting team for normative legal documents at the Decree level or higher that have been issued;
c) Receiving at least 90% approval votes in a secret ballot by the Competition and Reward Council of the Ministry.
4. The title "National Model Soldier" is awarded to individuals meeting the following criteria:
a) Demonstrating the most outstanding achievements among those who have continuously received the "Model Soldier of the Ministry of Foreign Affairs" title twice. The awarding period is the year immediately following the second "Model Soldier of the Ministry of Foreign Affairs" title;
b) Receiving at least 90% approval votes in a secret ballot by the Competition and Reward Council of the Ministry.
c) Initiatives or research topics serving as the basis for the "National Model Soldier" award must be accepted and applied in practice with high effectiveness and national impact.
Article 10. Criteria for commendation titles for collectives
1. The title "Advanced Labor Collective" shall be awarded to collectives meeting the following criteria:
a) Successfully completing assigned tasks and work plans;
b) Actively and effectively participating in regular competitive movements initiated by the Ministry;
c) At least 50% of individuals within the collective achieving the title "Advanced Worker" and having no individual disciplined with a warning or higher level of punishment (the period counted from the date of issuance of the disciplinary decision);
d) Internal solidarity, strictly adhering to the Party's policies and State laws.
2. The title "Outstanding Labor Collective" shall be awarded to collectives meeting the following criteria:
a) Innovatively overcoming difficulties to excellently complete assigned tasks; maintaining regular, practical, and effective competitive movements;
b) All individuals within the collective successfully completing assigned tasks, with at least 70% of them achieving the title "Advanced Worker";
c) Having individuals achieving the title "Model Worker at the Base Level" and no individual disciplined with a warning or higher level of punishment (the period counted from the date of issuance of the disciplinary decision);
d) Internal solidarity, serving as exemplary models in implementing the Party's policies and State laws.
3. The flag "Competition Flag of the Ministry of Foreign Affairs" shall be annually awarded to outstanding collectives that excellently and comprehensively fulfill their assigned tasks, evaluated and reviewed according to competition groups and clusters and meeting the following criteria:
a) For units under the Ministry, achieving the title "Outstanding Labor Collective"; for Provincial Departments of Foreign Affairs, recognized by the People's Committee of the province or centrally-administered city as having excellently fulfilled their assigned tasks;
b) Exceeding set competition targets and assigned tasks; maintaining regular, practical, and effective competitive movements; having new factors and models for other collectives to emulate;
c) Internal solidarity, actively practicing thrift, combating waste, corruption, and other negative behaviors.
4. The flag "Competition Flag of the Government" shall be annually awarded to collectives meeting the following criteria:
a) Achieving outstanding results, exceeding set competition targets and assigned tasks in the year;
b) Being an outstanding exemplary collective leading the competition group of units under the Ministry;
c) Selected by the Ministry's Competition and Reward Council through voting among collectives meeting the criteria for the "Competition Flag of the Ministry of Foreign Affairs," with the number of nominations not exceeding 20% of the total number of collectives meeting the criteria for the "Competition Flag of the Ministry of Foreign Affairs";
In cases where the "Competition Flag of the Government" is awarded, the "Competition Flag of the Ministry of Foreign Affairs" will not be awarded; if nominated but not awarded the "Competition Flag of the Government," the "Competition Flag of the Ministry of Foreign Affairs" will be awarded.
5. The flag "Competition Flag of the Government" shall be awarded to the most outstanding collective in the movement initiated by the President of the State, the Prime Minister, or the Minister for special topics; reviewed and honored when summarizing over five years.
Chapter III
FORMS AND CRITERIA FOR REWARDS
Article 11. Types of rewards
1. Rewards based on achievements and accomplishments are forms of rewarding collectives and individuals who have made outstanding contributions or excellently completed assigned tasks, contributing to the cause of building and defending the country.
2. Rewards based on campaigns or special topics are given to collectives and individuals who achieve outstanding results after the completion of competitive movements initiated by the President of the State, the Prime Minister, or the Minister.
3. Unexpected rewards are given to collectives and individuals who achieve unexpected accomplishments.
Unexpected accomplishments are those achieved outside the program, plan, or assigned tasks.
Extraordinary unexpected accomplishments are unexpected accomplishments achieved at an exceptionally high level when courageously rescuing people or state assets, or during combat or service support, or achieving extraordinary results in the fields of foreign affairs recognized regionally or globally.
4. Rewards for dedication are given to individuals who have participated in activities during various revolutionary stages, held leadership positions in state agencies, public institutions, political organizations, or social-political organizations, making significant contributions and outstanding achievements to the revolutionary cause of the Party and the nation.
5. Diplomatic rewards are given to individuals or foreign organizations, international organizations who have contributed to the construction and defense of the Socialist Republic of Vietnam in one of the following areas: politics, economy, culture, society, security, defense, diplomacy, or other fields.
Article 12. Forms of Awards
1. State-level award forms: Medals of various types; Orders of various types; Title of "Heroic Laborer"; Title of "Heroic People's Armed Forces"; Title of "People's Teacher", "Outstanding Teacher"; Title of "People's Doctor", "Outstanding Doctor"; Ho Chi Minh Prize, State Prize; Certificate of Merit from the Prime Minister.
2. Award forms of the Ministry of Foreign Affairs (referred to as ministry-level awards): Certificate of Merit from the Minister of Foreign Affairs; Commemorative Medal "For the Cause of Vietnam's Diplomacy" and other Commemorative Medals: "For the Cause of Border and National Territory", "For the Cause of Diplomacy Serving Economic Development", "For the Cause of Work with Overseas Vietnamese", "For the Cause of UNESCO in Vietnam".
3. Forms of foreign awards
a) State-level foreign awards:
For foreign individuals: Order of Star, Ho Chi Minh Order, Independence Order of various classes, Labor Order of various classes, Friendship Order, Friendship Medal, and Certificate of Merit from the Prime Minister.
For foreign organizations: Independence Order of various classes, Labor Order of various classes, Friendship Order, and Certificate of Merit from the Prime Minister.
b) Ministry-level foreign awards: Include the award forms specified in Clause 2 of this Article.
Article 13. Recipients and Criteria for State-Level Awards for Collectives and Individuals under the Ministry
1. Recipients and criteria for the titles of "Heroic Laborer", "Heroic People's Armed Forces", Orders of various types, and Certificate of Merit from the Prime Minister shall be implemented according to the provisions of Articles 60 and 61 of the Law on Competition and Reward, and Articles 14, 15, 16, 17, 18, 22, 23, 24, 28, 29, 30, 32, 33, 36, and 38 of Decree No. 91/2017/ND-CP dated July 31, 2017 of the Government (hereinafter referred to as Decree No. 91/2017/ND-CP) and other relevant normative legal documents.
2. Recipients and criteria for granting the Ho Chi Minh Prize and State Prize shall be implemented according to the provisions of Articles 66, 67, and 68 of the Law on Competition and Reward and other relevant normative legal documents.
Article 14. Recipients and Criteria for State-Level Foreign Awards
1. Recipients and criteria for proposing to grant the Order of Star, Ho Chi Minh Order, Independence Order, Labor Order, and Certificate of Merit from the Prime Minister shall be implemented according to the provisions of Section 10, 11, 12, 13, 14 of the Law Amending and Supplementing Certain Provisions of the Law on Competition and Reward 2013; Articles 14, 15, 16, 17, 18, 22, 23, 24, and Clause 4, Article 52 of Decree No. 91/2017/ND-CP of the Government.
2. Recipients and criteria for proposing to grant the Friendship Order and Friendship Medal shall be implemented according to the provisions of Articles 33 and 36 of Decree No. 91/2017/ND-CP.
Article 15. Recipients and Criteria for Ministry-Level Awards
1. Recipients and criteria for granting the Commemorative Medal "For the Cause of Vietnam's Diplomacy" shall be implemented according to the provisions of Article 37 of Decree No. 91/2017/ND-CP and the Regulation on Granting the Commemorative Medal "For the Cause of Vietnam's Diplomacy".
2. Recipients and criteria for granting the Certificate of Merit from the Minister of Foreign Affairs shall be implemented according to the provisions of Article 39 of Decree No. 91/2017/ND-CP and the Regulation on Granting the Certificate of Merit from the Minister of Foreign Affairs.
3. Recipients and criteria for granting the Commemorative Medal "For the Cause of Border and National Territory", Commemorative Medal "For the Cause of Diplomacy Serving Economic Development", Commemorative Medal "For the Cause of Work with Overseas Vietnamese", and Commemorative Medal "For the Cause of UNESCO in Vietnam" shall be implemented according to the Regulations issued together with the Decision of the Minister of Foreign Affairs.
4. Praise Letters from Heads of Units with Legal Entity Status, Separate Accounts, and Individual Seals shall be implemented according to the provisions of Clause 1 and Clause 3 of Article 40 of Decree No. 91/2017/ND-CP.
Chapter IV
PROCEDURES FOR CONSIDERING AND GRANTING COMPETITION AWARDS AND AWARD FORMS, AUTHORITY TO DECIDE AND BESTOW SUCH AWARDS
Section I. Procedures, formalities, and files for awarding commendation titles and forms of reward
Article 16. Reward procedures
1. The level that manages individuals, organizations, and salary funds shall be responsible for rewarding or submitting to a higher level for rewards for objects within its management scope (except for external rewards).
2. For organizations and individuals specifically responsible for party work, mass organizations, the reward procedures shall be implemented according to the provisions of Clause 4, Article 46 of Decree No. 91/2017/NĐ-CP.
3. The level that initiates competitive campaigns in batches or on specific topics shall select exemplary models for rewards or submit to a higher level for rewards when summarizing the results.
4. External reward examination process
a) Units under the Ministry shall proactively review and submit to the Ministry's leadership for approval of the policy to reward foreign individuals, organizations, and international organizations within their field or area of responsibility at least three months before the expected date of awarding national-level rewards and one month for ministry-level rewards, except for special and urgent cases based on diplomatic requirements and instructions from the Ministry's leadership.
b) The Department of Commendation and Award and Diplomatic Tradition shall be responsible for coordinating with related units to complete the formalities and files according to regulations and initiate the submission for rewards after receiving the approval opinion on the policy from the Ministry's leadership.
5. Diplomatic endorsement for external rewards is providing opinions on the diplomatic aspect regarding the proposal to reward foreign individuals, organizations, and international organizations as suggested by ministries, agencies, central mass organizations, and provincial people's committees directly under the Central Government.
The Department of Commendation and Award and Diplomatic Tradition is the main unit to consolidate opinions from related units, propose endorsement opinions, and submit to the Ministry's leadership for decision.
Article 17. Formalities for submitting rewards
1. Examination of commendation titles and forms of reward according to general procedures
a) The Department of Commendation and Award and Diplomatic Tradition shall be responsible for reviewing the files, formalities, conditions, and standards according to regulations; reporting to the Ministry's Commendation and Award Council for review and submitting to the Minister for consideration and decision to grant commendation titles and forms of reward at the ministry level or recommending to a higher level for national-level commendation titles and forms of reward.
In cases where the recommendation is to confer the "Gold Star Order", "Ho Chi Minh Order", "Independence Order" of various grades; the titles "People's Teacher", "People's Doctor", "National Labor Medalist", and "Heroic Laborer", after obtaining the agreement of the Ministry's Commendation and Award Council, it must seek and obtain the consent of the Party Committee of the Ministry before submitting.
The procedure for conferring the title "Heroic Soldier of the People's Armed Forces" shall be carried out according to the guidelines of the Ministry of National Defense.
b) The endorsement of national commendation titles and forms of reward shall be implemented according to the provisions of Article 47 of Decree No. 91/2017/NĐ-CP.
c) When granting the titles "Commendation Medalist of the Ministry of Foreign Affairs", "National Labor Medalist", "Heroic Laborer", and "Heroic Soldier of the People's Armed Forces", the Ministry's Commendation and Award Council must convene and vote secretly; the collective or individual proposed for reward must have a voting rate of approval for reward of 90% or more.
d) For units with the obligation to pay state budget, the file proposing to grant commendation titles and forms of reward for the collective unit or individual must be accompanied by a confirmation letter from the competent tax authority. Units subject to audit must provide an audit report from the competent audit authority for the five years prior to the reward application. For units not subject to audit, the achievement report must specify the basis for not being subject to audit.
e) The head of the unit is responsible under the law for the formalities, files, procedures, accuracy of achievements, and contents related to the implementation of the Party's policies and State laws.
2. Cases examined for rewards according to simplified procedures shall follow the provisions of Article 55 of Decree No. 91/2017/NĐ-CP.
Article 18. Documents for Proposing to Award Commendation Titles
The documents for proposing to award commendation titles for collectives and individuals under the Ministry shall be implemented in accordance with the provisions stipulated in Articles 49, 50, and 51 of Decree No. 91/2017/NĐ-CP.
Article 19. Documents for Proposing to Award State-Level Commendations
1. The documents for proposing to award state-level commendations for collectives and individuals under the Ministry shall be implemented in accordance with the provisions stipulated in Articles 52, 53, 54, and 57 of Decree No. 91/2017/NĐ-CP.
2. The documents for proposing to award state-level commendations for foreign individuals and organizations, international organizations include five sets (originals):
a) A report to the Prime Minister accompanied by a list of proposed commendations;
b) A report on achievements of foreign individuals and organizations, international organizations built by the unit proposing commendations (according to the model attached to this Circular);
c) Minutes of the meeting of the Ministry's Competition and Reward Council;
d) A document from the competent authority regarding obligations to be fulfilled towards the Socialist Republic of Vietnam according to the law (if applicable).
Article 20. Documents for Proposing Ministry-Level Commendations
1. The documents for proposing to award the "For the Cause of Vietnam’s Diplomacy" Commemorative Medal include one set (original):
a) A letter accompanied by a list of proposed commendations from the agency or unit;
b) A report on achievements and work history (according to the model attached to this Circular);
2. The documents for proposing to award the Certificate of Merit of the Minister of Foreign Affairs include one set (original):
a) A letter accompanied by a list of proposed commendations from the agency or unit;
b) A report on achievements (according to the model attached to this Circular).
Article 21. Time Limit for Submitting Documents, Reviewing Documents, and Announcing Commendation Results
1. Time limit for submitting documents
a) For annual commendation titles awarded at the end of the year for collectives and individuals under the Ministry: Follow the guidelines for summarizing competition and reward activities issued by the Department of Competition and Reward and Diplomatic Tradition;
b) For the Flag of Excellence of the Government, the Flag of Excellence of the Ministry of Foreign Affairs, and the Outstanding Soldier of the Ministry of Foreign Affairs: Before February 28 each year;
c) For commendations based on achievements and merits: Before April 15 each year;
d) For special commendations, commendations for long-term dedication, and other forms of commendations: Follow the guidelines of the Department of Competition and Reward and Diplomatic Tradition or the main unit proposing commendations.
3. Time for announcing the results of review and rewards
a) For Ministry-level commendations: Within 25 working days from the date of receiving complete documents as prescribed.
b) For state-level commendations: Within 30 working days from the date of receiving complete documents as prescribed.
3. Time for announcing commendation results:
a) For state-level commendations: After receiving the commendation decision of the President or the Prime Minister, within 10 working days, the Department of Competition and Reward and Diplomatic Tradition is responsible for copying the decision and sending it to relevant units and announcing the commendation results to the commended collectives and individuals.
b) For Ministry-level commendations: After the Minister signs the commendation decision, within 10 working days, the Department of Competition and Reward and Diplomatic Tradition is responsible for announcing the commendation results to the commended collectives and individuals.
Section II. Authority to Decide and Bestow Commendation Titles and Reward Forms
Article 22. Authority to Decide
1. The authority to decide on bestowing national commendation titles and reward forms shall be implemented in accordance with Articles 77 and 78 of the Law on Commendation and Rewards.
2. The Minister of Foreign Affairs decides to bestow:
a) "The Flag of Excellence of the Ministry of Foreign Affairs" to units under the Ministry and leading units in the Cluster of Provincial Department of Foreign Affairs.
b) The title "Outstanding Labor Collective" and "Advanced Labor Collective" to units under the Ministry.
c) The title "Excellence Medalist of the Ministry of Foreign Affairs" to individuals under the Ministry.
d) The title "Excellent Medalist at the Base Level" to individuals working at overseas representative offices of Vietnam and units within the Office Block of the Ministry.
đ) Certificates of Merit from the Minister of Foreign Affairs and Commemorative Medals "For the Cause of Vietnam's Diplomacy".
3. The Minister of Foreign Affairs decides to bestow or delegates to the Deputy Minister responsible for the field of work to examine and bestow Commemorative Medals "For the Cause of Border and National Territory", "For the Cause of Diplomacy Serving Economic Development", "For the Cause of Work with Overseas Vietnamese", and "For the Cause of UNESCO in Vietnam".
4. Heads of domestic units with legal personality examine and bestow the titles "Outstanding Labor Collective", "Advanced Labor Collective", "Excellent Medalist at the Base Level", "Advanced Worker", and Certificates of Merit to collectives and individuals under their management authority.
Article 23. Organization of Bestowing Commendation Titles and Reward Forms
1. The announcement, bestowal, and acceptance of reward forms and commendation titles shall be carried out in accordance with Decree No. 145/2013/NĐ-CP dated October 29, 2013, of the Government regarding the organization of commemoration days; ceremonial procedures for bestowal and acceptance of reward forms and commendation titles.
2. The State Protocol Agency takes the lead and coordinates with relevant units to organize the bestowal of reward forms at the Ministry level or national rewards presented by the Ministry of Foreign Affairs to individuals and organizations from foreign countries and international organizations in Vietnam.
3. Overseas representative offices of Vietnam take the lead in organizing the bestowal of Orders of Friendship and Medals of Friendship to individuals and organizations from foreign countries in the host country upon written recommendation by the awarding agency. The recommending agency is responsible for transferring the decision, award items, and coordinating with the overseas representative office to ensure solemnity and appropriateness to actual conditions.
Chapter V
COMPETITION AND AWARD COUNCIL
Article 24. The Ministry of Foreign Affairs' Commendation and Reward Council
1. The Ministry of Foreign Affairs' Commendation and Reward Council is an advisory body to the Minister on commendation and reward activities in the diplomatic sector. The Council is established by the Minister and is subject to the leadership of the Minister.
2. The Council has 17 members, including:
a) The Chairman of the Council is the Minister.
b) The Vice-Chairman of the Council is the Deputy Minister responsible for commendation and reward activities.
c) Four permanent members appointed by the Minister, including: Director of the Ministry's Office, Head of the Cadre and Civil Service Department, Head of the Foreign Policy Department, and Head of the Department of Commendation and Reward and Diplomatic Tradition.
d) Two ex officio members appointed by the Minister, including: Permanent Secretary of the Party Committee of the Ministry and Chairman of the Ministry's Trade Union.
e) Nine non-permanent members representing the domestic competition clusters, nominated and elected by heads of domestic units for a two-year term.
g) The unit responsible for the Council's permanent functions is the Department of Commendation and Reward and Diplomatic Tradition.
h) The Secretary of the Council is the Deputy Head of the Department of Commendation and Reward and Diplomatic Tradition responsible for commendation and reward activities. The Secretary is not a member of the Council and does not have voting rights in the Council.
The structure and number of Council members may change based on work requirements according to the Chairman's decision, but the number of Council members must be odd to ensure voting procedures.
3. The Council operates in accordance with the Charter issued together with Decision No. 4256/QĐ-BNG dated December 27, 2013, of the Minister of Foreign Affairs.
Article 25. The Competition and Reward Council at the Basic Level
1. Domestic units under the Ministry with legal personality shall establish a Competition and Reward Council at the basic level, consisting of:
a) The Chairman of the Council is the head of the unit;
b) The permanent Vice Chairman is a unit leader tasked with advising the Unit Head on competition and reward work; other Vice Chairmen are decided by the Chairman of the Council;
c) Members are representatives of party committees, mass organizations, and heads of certain units, decided by the Chairman of the Council.
2. The Competition and Reward Council at the basic level operates according to the Charter issued by the Unit Head, performing advisory and consulting functions regarding competition and reward work; it works based on the principle of democratic centralism and decides by majority vote; in cases where the opinions of Council members are evenly divided, the opinion of the Chairman of the Council will be taken.
Article 26. Recognition of Inventions and Research Topics
1. The process of recognizing inventions is carried out in accordance with Decree No. 13/2012/NĐ-CP dated March 2, 2012, of the Government promulgating the Invention Regulation and Circular No. 18/2013/TT-BKHCN dated August 1, 2013, of the Ministry of Science and Technology guiding the implementation of certain provisions of the Invention Regulation promulgated by Decree No. 13/2012/NĐ-CP dated March 2, 2012, of the Government.
2. The examination and acceptance of research topics shall be carried out in accordance with the Law on Science and Technology and detailed implementing regulations.
The subjects recognized for having research topics to serve as grounds for awarding commendation titles and forms of reward are the head of the topic and those directly involved in researching the topic.
3. Annually, the Diplomatic Academy is responsible for compiling and submitting to the Department of Competition and Reward and Diplomatic Tradition a list of research topics from the basic level upwards that have been accepted for review to serve as grounds for examining reward proposals and commendation title awards.
Chapter VI
COMPETITION AND REWARD FUND
Article 27. Competition and Reward Fund
1. Establish a Competition and Reward Fund of the Ministry and a Competition and Reward Fund of units under the Ministry with legal personality to organize competition movements and implement policies and systems for rewards.
2. The Competition and Reward Fund of the Ministry of Foreign Affairs is established and managed by the Minister; the Competition and Reward Fund of units under the Ministry with legal personality is established and managed for use in accordance with regulations by the unit heads.
Article 28. Sources of Formation of the Competition and Reward Fund
1. The Competition and Reward Fund of the Ministry is formed from state budget funds up to a maximum of 20% of the total salary fund according to rank levels of officers, civil servants, and public officials within the establishment and approved annual wages, and from contributions from individuals and organizations both domestically and internationally.
2. The Financial Management Bureau collaborates with relevant units, proposes to the Minister - Chairman of the Ministry's Competition and Reward Council to decide on the ratio of establishment and sources of formation of the Ministry's Competition and Reward Fund; the contribution ratio from the Competition and Reward Funds of units under the Ministry with legal personality to the Ministry's Competition and Reward Fund.
Article 29. Use of the Competition and Reward Fund
1. The Competition and Reward Fund is used to cover expenses for organizing and implementing competition movements and rewarding for commendation titles and reward forms specified in this Circular, including the following items:
a) Expenses for printing and making reward items (certificates, commendations, medals, orders, badges, commemorative medals, flags, boxes, frames);
b) Cash rewards or commemorative gifts;
c) Expenses for organizing, directing, mid-term reviews, final summaries of competition movements; propaganda and dissemination of exemplary models; inspection, supervision, and implementation of legal provisions on competition and reward work.
2. Principles of cash rewards
a) Higher commendation titles and reward forms receive higher cash rewards;
b) Within the same form and level of reward, cash rewards for groups are higher than for individuals;
c) At the same time, for the same achievement, if an individual receives multiple commendation titles with different cash rewards, they receive the highest cash reward;
d) At the same time, if an individual achieves multiple commendation titles at different times, they receive cash rewards for all achieved commendation titles;
đ) At the same time, if an individual achieves a commendation title and also receives a reward, they receive cash rewards for both the commendation title and the reward form.
Article 30. Levels of prize money and preferential treatment
1. The levels of prize money accompanying commendation titles and forms of reward shall be implemented in accordance with the provisions stipulated in Articles 69, 70, 71, 72, 73, and Article 74 of Decree 91/2017/NĐ-CP.
2. Individuals who are awarded commendation titles or forms of reward, in addition to being rewarded according to regulations, shall be given priority for early salary increment before the scheduled time, priority for dispatch to study, training, and professional enhancement both domestically and internationally as prescribed by law, and other preferential treatments as prescribed by the Ministry.
Article 31. Management of the Commendation Fund
1. The Financial Administration Department shall be responsible for managing and utilizing the Ministry's Commendation Fund; implementing annual settlement in accordance with current regulations on the establishment and management of the Commendation Fund; guiding and inspecting units under the Ministry with legal personality in the collection and expenditure of the Commendation Fund.
2. At the end of each fiscal year, heads of units under the Ministry with legal personality shall report to the Financial Administration Department for settlement of the collection and expenditure of their unit's Commendation Fund for consolidation. Unused portions of the Commendation Fund at various levels shall be carried over to the next year for continued use in commendation activities.
Chapter VII
PROPAGANDA, TRAINING, REPORTING, INSPECTION AND HANDLING OF VIOLATIONS REGARDING COMPETITION AND REWARD
Article 32. Propaganda, Popularization, and Widespread Promotion of Model Examples
1. The Standing Committee of the Ministry’s Competition and Reward Council shall coordinate with unit heads to advise the Competition and Reward Council:
a) To develop plans and organize the implementation of propaganda work on President Ho Chi Minh's patriotic competition spirit; Party policies and State laws on competition and reward;
b) To develop plans to organize propaganda for the widespread promotion of model examples, good people and deeds, selecting collectives and individuals with outstanding achievements in competition movements for timely recognition, honor, and reward.
2. The Competition and Reward and Diplomatic Tradition Department shall coordinate with the Information and Press Department, World and Vietnam Newspaper, the Ministry of Foreign Affairs Trade Union, and related units to intensify propaganda work on President Ho Chi Minh's patriotic competition spirit, Party policies, and State laws on competition and reward; to recognize, honor, and promote widespread model examples within the entire sector.
Article 33. Training and Capacity Building
1. The Competition and Reward and Diplomatic Tradition Department shall take the lead and coordinate with relevant units to develop plans and content for vocational training and capacity building for cadres, civil servants, and public officials engaged in competition and reward work throughout the sector, and advise on organizing implementation.
2. Units’ advisory departments on competition and reward shall have the responsibility to advise unit leaders to develop annual plans to organize training and capacity building for professional staff engaged in competition and reward within their jurisdiction.
Article 34. Reporting System
1. Units under the Ministry shall organize summaries and evaluations of competition and reward work and submit reports to the Competition and Reward and Diplomatic Tradition Department before December 15th each year.
2. Competition and Reward Clusters, Groups, and units under the Ministry that initiate competition movements in phases or special topics must organize mid-term and final reviews of these movements, submit reports on results to the Competition and Reward and Diplomatic Tradition Department for consolidation and reporting to the Ministry’s Competition and Reward Council.
Article 35. Inspection and Supervision
1. The Department of Competition - Awards and Diplomatic Tradition shall take the lead and coordinate with relevant units to develop plans for inspecting the implementation of legal provisions on competition and awards; advise the Ministry Inspectorate in developing specialized inspection plans for implementing legal provisions on competition and awards within the entire sector.
2. Heads of units under the Ministry shall be responsible for directing and supervising the organization of competition movements and the implementation of policies and laws on competition and awards within their management scope.
Article 36. Handling Violations
1. Procedures and processes for handling violations shall be carried out in accordance with Articles 78 and 79 of Decree No. 91/2017/ND-CP.
2. Cases for revoking award decisions:
a) If an individual deceives in declaring achievements to receive awards such as Orders, Medals, Certificates of Merit, or Letters of Commendation, the award decision will be revoked and the awarded items and money will be recovered;
b) Based on the conclusion of the competent authority determining that an individual has falsely declared achievements to receive awards, the recommending agency shall have the responsibility to propose the competent authority to revoke the award decision and recover the awarded items and money.
Chapter VIII
IMPLEMENTING PROVISIONS
Article 37. Responsibility for Implementation
1. Heads of units under the Ministry and related organizations and individuals are responsible for implementing this Circular.
2. The Head of the Department of Competition - Awards and Diplomatic Tradition shall take the lead and coordinate with relevant units to assist the Minister of Foreign Affairs in guiding, supervising, and urging related agencies and units to implement this Circular.
Article 38. Effective Date
This Circular takes effect from the date of issuance./.
