AMENDING AND ADDING CERTAIN PROVISIONS OF CIRCULAR NO. 04/2017/TT-BXD DATED MARCH 30, 2017 ISSUED BY THE MINISTER OF CONSTRUCTION ON SAFETY MANAGEMENT IN CONSTRUCTION PROJECT IMPLEMENTATION

Pursuant to the Labor Safety and Health Law dated June 25, 2015;
Pursuant to Decree No. 81/2017/NĐ-CP dated July 17, 2017 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Construction;
Pursuant to Decree No. 46/2015/NĐ-CP dated May 12, 2015 of the Government on construction project quality management and maintenance;
Pursuant to Decree No. 59/2015/NĐ-CP dated June 18, 2015 of the Government on construction project investment management;
Pursuant to Decree No. 44/2016/NĐ-CP dated May 15, 2016 of the Government detailing certain provisions of the Labor Safety and Health Law regarding technical safety inspection activities, occupational safety training, and labor environment monitoring;

The Minister of Construction issues this Circular amending and adding certain provisions of Circular No. 04/2017/TT-BXD dated March 30, 2017 issued by the Minister of Construction on safety management in construction project implementation.
Article 1. Amending and supplementing Clause 16 of Circular No. 04/2017/TT-BXD dated March 30, 2017 issued by the Minister of Construction on safety management in construction project implementation as follows:
"Article 16. Management of Information Related to Technical Safety Inspection Activities
1. Posting information of organizations granted a Certificate of Qualification for Technical Safety Inspection Activities on an online software system (hereinafter referred to as the software) including: name, address, code number of the technical safety inspection organization; list of machines, equipment, and materials certified in the Certificate of Qualification for Technical Safety Inspection Activities; date of issuance and expiration date of the Certificate of Qualification for Technical Safety Inspection Activities; any violations committed by the inspection organization (if applicable).
2. Posting information of individuals granted a Certificate of Technical Inspector on the software including: full name; inspector code number; identification card number or citizen identity card number; list of machines, equipment, and materials certified to conduct technical safety inspections; date of issuance and expiration date of the Certificate of Technical Inspector; any violations committed by the inspector (if applicable).
3. The application of information technology in technical safety inspection activities is regulated as follows:

b) Professional agencies are responsible for establishing, posting, and updating information of organizations and individuals specified in Clause 1 and Clause 2 of this Article on the software; guiding organizations and individuals conducting technical safety inspections to use the software.
c) Organizations and individuals engaged in technical safety inspection activities have the right to use the software as stipulated at point a of this clause for their own management and implementation of technical safety inspections on machines, equipment, and materials with strict requirements for labor safety used in construction.
Article 2. Effective Date
1. This Circular shall take effect from September 15, 2019.
2. During the implementation of this Circular, any difficulties should be reported by agencies, organizations, and individuals to the Ministry of Construction for study and resolution./.
