Issuing Professional Ethics Rules for Legal Aid

Pursuant to the Legal Aid Law 2017;
Pursuant to Decree No.96/2017/NĐ-CP dated August 16, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Justice;
At the proposal of the Director of the Legal Aid Department and the Director of the Civil Status, Nationality, and Notarization Department;
Minister of theinThe Minister of Justice issues this Circular to issue Professional Ethics Rules for Legal Aid.
Article 1. This Circular promulgates the Professional Ethics Rules for Legal Aid..
Article 2.
1. The Director of the Legal Aid Agency shall be responsible for organizing and inspecting the implementation of the Professional Ethics Rules for Legal Aid throughout the country.
2. The Director of the Department of Justice shall be responsible for directing, inspecting, and supervising the implementation of the Professional Ethics Rules for Legal Aid within their jurisdiction. The Director of the State Legal Aid Center shall be responsible for inspecting and supervising the implementation of the Professional Ethics Rules for Legal Aid by legal aid practitioners and lawyers, and contractual collaborators performing legal aid with the State Legal Aid Center.
3. The head of organizations practicing as lawyers and legal counseling organizations participating in legal aid shall be responsible for overseeing the implementation of the Professional Ethics Rules for Legal Aid by legal aid practitioners working at their organization.
Article 3. This Circular takes effect from June 15, 2020. Decision No. 09/2008/QĐ-BTP dated December 8, 2008 of the Minister of Justice issuing the Professional Ethics Rules for Legal Aid shall cease to be effective from the date this Circular takes effect.
Article 4. The Chief of the Office, the Director of the Legal Aid Agency, the Heads of units under the Ministry, the Directors of the Departments of Justice of provinces and centrally-administered cities, the Directors of the State Legal Aid Centers, the heads of organizations practicing as lawyers and legal counseling organizations participating in legal aid, and related individuals and organizations are responsible for implementing and organizing the implementation of this Circular../.
