Pursuant to the Civil Servant Law dated November 15, 2010; and the Law Amending and Supplementing Certain Provisions of the Civil Servants and Public Officials Law and the Civil Servant Law dated November 25, 2019;

Based on the proposal of the Director of the Cadre and Civil Servant Department;

Pursuant to Decree No. 17/2017/NĐ-CP dated February 17, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Information and Communications;

At the proposal of the Director of the Personnel Department;

The Minister of Information and Communications issues this Circular stipulating standards, conditions, content, and form of examination or promotion assessment for career rank of civil servants in the Information and Communications sector.

Article 1. Scope of Regulation

1. This Circular stipulates standards and conditions for examination or promotion assessment for career rank from Class II to Class I, from Class III to Class II, and from Class IV to Class III (if applicable); content and form of promotion assessment for civil servants in the Information and Communications sector working in public service units, including:

a) Editors, reporters, translators, television directors as prescribed in Joint Circular No. 11/2016/TTLT-BTTTT-BNV dated July 4, 2016 of the Ministers of Information and Communications and Home Affairs stipulating job code and career rank standards for editors, reporters, translators, and television directors in the Information and Communications sector (hereinafter referred to as Joint Circular No. 11/2016/TTLT-BTTTT-BNV);

b) Information security specialists, system administrators, information technology inspectors, software developers as prescribed in Circular No. 45/2017/TT-BTTTT dated December 29, 2017 of the Minister of Information and Communications stipulating career rank standards for civil servants in the Information Technology sector (hereinafter referred to as Circular No. 45/2017/TT-BTTTT) and Circular No. 02/2018/TT-BNV dated January 8, 2018 of the Minister of Home Affairs stipulating job codes for civil servants in the Information Technology sector (hereinafter referred to as Circular No. 02/2018/TT-BNV);

c) Sound technicians, announcers, film editing technicians, camera operators as prescribed in Circular No. 46/2017/TT-BTTTT dated December 29, 2017 of the Minister of Information and Communications stipulating career rank standards for sound technicians, announcers, film editing technicians, and camera operators in the Information and Communications sector (hereinafter referred to as Circular No. 46/2017/TT-BTTTT) and Circular No. 05/2018/TT-BNV dated May 9, 2018 of the Minister of Home Affairs stipulating job codes for sound technicians, announcers, film editing technicians, and camera operators in the Information and Communications sector (hereinafter referred to as Circular No. 05/2018/TT-BNV).

Civil servants in public service units as prescribed in points a, b, and c of this clause are collectively referred to as civil servants in the Information and Communications sector.

2. Content, form, and organization of examination for promotion of career rank of civil servants in the Information and Communications sector shall be carried out in accordance with the provisions of Decree No. 115/2020/NĐ-CP dated September 25, 2020 of the Government stipulating recruitment, utilization, and management of civil servants and Circular No. 06/2020/TT-BNV dated December 2, 2020 of the Minister of Home Affairs promulgating the Regulation on organizing examinations and assessments for civil servants and public officials, upgrading civil servant ranks, and examinations or promotions for civil servant career ranks (hereinafter referred to as Circular No. 06/2020/TT-BNV).

          Article 2. Applicability

This Circular applies to civil servants in the Information and Communications sector in public service units and other organizations and individuals related thereto.

Article 3. Principles examination, promotion assessment for career rank

1. The nomination of civil servants in the Information and Communications sector to participate in examinations or promotion assessments for career rank must be based on job positions, the approved personnel structure according to career rank by the competent authority, the number of civil servants corresponding to the career rank still lacking according to the requirements of job positions and the needs of public service units.

2. Civil servants in the Information and Communications sector participating in examinations or promotion assessments for career rank must meet the required standards and conditions for registration according to the law.

3. The organization of examinations or promotion assessments for career rank of civil servants in the Information and Communications sector must ensure equality, transparency, fairness, and compliance with the law.

Article 4. Standards and Conditions for Promotion Examination

A specialized Information and Communications civil servant shall be nominated to participate in the promotion examination when meeting the following standards and conditions:

1. Being nominated by the competent authority to participate in the promotion examination for the occupational title according to the provisions stipulated in Clause 1, Article 3 of this Circular.

2. Currently holding an occupational title of a specialized Information and Communications civil servant at a lower grade immediately adjacent to the grade specified in the Joint Circular No. 11/2016/TTLT-BTTTT-BNV; Circular No. 45/2017/TT-BTTTT and Circular No. 02/2018/TT-BNV; Circular No. 46/2017/TT-BTTTT and Circular No. 05/2018/TT-BNV.

3. Having been rated as having satisfactorily completed tasks or better in the year immediately preceding the year of submitting the application for the promotion examination; possessing good political and moral qualities; not being within the period of disciplinary action, and not being within the period of implementing regulations related to disciplinary actions on civil servants as prescribed in Article 56 of the Civil Servant Law (amended and supplemented in Clause 8, Article 2 of the Law Amending and Supplementing Certain Provisions of the Civil Servants Law and the Civil Servant Law).

4. Possessing the capacity and professional qualifications necessary to assume an occupational title at a higher grade immediately adjacent to the current held occupational title; meeting the requirements regarding academic degrees, certificates, and other requirements of the occupational title standards for the promotion examination as prescribed in the Joint Circular No. 11/2016/TTLT-BTTTT-BNV; Circular No. 45/2017/TT-BTTTT and Circular No. 46/2017/TT-BTTTT.

5. Meeting the minimum time requirement for holding the occupational title at the immediately lower grade as prescribed in Article 5 of this Circular.

Article 5. Time Requirement for Holding the Occupational Title at the Immediately Lower Grade for Participation in Promotion Examination or Promotion Assessment

1. A civil servant promoting from Grade II to Grade I must have held the Grade II occupational title or equivalent for a minimum of six years. In cases with equivalent time, they must have held the immediately lower grade occupational title for at least one year (twelve months) up to the deadline for submitting the registration form for the promotion examination or assessment.

2. A civil servant promoting from Grade III to Grade II must have held the Grade III occupational title or equivalent for a minimum of nine years. In cases with equivalent time, they must have held the immediately lower grade occupational title for at least one year (twelve months) up to the deadline for submitting the registration form for the promotion examination or assessment.

3. A civil servant promoting from Grade IV to Grade III must have held the Grade IV occupational title or equivalent for a minimum of two years if recruited with an associate degree or higher, and three years if recruited with a vocational school degree. In cases with equivalent time, they must have held the immediately lower grade occupational title for at least one year (twelve months) up to the deadline for submitting the registration form for the promotion examination or assessment.

Article 6. Standards and Conditions for Participation Assessment Promotion

A specialized Information and Communications civil servant with outstanding achievements in professional activities may be nominated to participate in the promotion assessment for the occupational title when meeting the following standards and conditions:

1. Fulfilling all the conditions and standards as prescribed in Article 4 of this Circular.

2. Having outstanding achievements as follows:

a) For civil servants participating in the assessment for promotion from Grade II to Grade I: During the period of holding the Grade II occupational title, receiving awards such as the Labor Medal of Class Three or higher, or achieving the title of National Model Worker;

b) For civil servants participating in the assessment for promotion from Grade III to Grade II: During the period of holding the Grade III occupational title, receiving awards such as the Prime Minister's Commendation or achieving the title of Model Worker at the ministry, department, provincial level, or central-level mass organizations and above;

c) For civil servants participating in the assessment for promotion from Grade IV to Grade III: During the period of holding the Grade IV occupational title, receiving awards such as the Commendation of the Ministry, Department, Provincial Level, or Central-Level Mass Organizations or achieving the title of Model Worker at the grassroots level.

Article 7Application for participation in the promotion assessment

The application for participation in the promotion examination or promotion assessment for the occupational title includes:

1. A resume of the civil servant in accordance with the current regulations within thirty days from the final date of submission of the application for the promotion examination or assessment for the occupational title, confirmed by the agency or unit employing the civil servant.

2. An evaluation and assessment report by the head of the public service institution employing the civil servant or by the head of the competent authority managing the public service institution regarding the fulfillment of the standards and conditions for registering for the promotion examination or assessment for the occupational title as prescribed in Article 4 of this Circular.

3. The decision on recruitment, the decision on appointment to the occupational title of a specialized Information and Communications civil servant (or equivalent), and the most recent decision on salary increment.

4. Copies of the diplomas and certificates required for the occupational title for the promotion examination or assessment. Specifically:

a) The diploma of graduation in the major and the certificate of professional training in the specialty (if any) according to the regulations of each grade of the occupational title for the promotion examination;

b) The diploma of graduation in theoretical political studies according to the regulations of each grade of the occupational title for the promotion examination (if any);

c) The certificate of professional training in the occupational title standards according to the regulations of each grade of the occupational title for the promotion examination.

Civil servants holding the occupational titles of interpreter, television director, information security officer, system administrator, information technology quality inspector, software developer, sound technician, film editor, radio announcer, and film cameraman who participate in the examination or assessment for the promotion of the occupational title before the educational institution is assigned by the Ministry of Information and Communications to organize training and issue corresponding occupational title training certificates can use another certificate of occupational title training of the same grade to substitute.

5. A copy of the documents issued by the competent authority proving the fulfillment of the criteria for professional qualifications and expertise for the occupational title being applied for or considered for promotion according to the regulations. Specifically:

a) The Decision or document from the authorized person regarding the assignment to lead works recognized or awarded prizes by the Art and Science Council; leading or participating in writing specialized topics in theoretical research projects about professional science (at the ministry level, provincial level);

b) The certificate from the Art and Science Council (if applicable) or the award certificate;

c) The acceptance record of the theoretical research project about professional science (at the ministry level, provincial level).

6. The commendation decision of the competent authority for the staff member being considered for promotion of the occupational title.

                Article 8. Content and form of promotion examination

1. Content of promotion examination: Reviewing the application file, assessing, inspecting, and testing the fulfillment of requirements for the criteria and conditions of the occupational title of Information and Communication professionals according to Articles 4, 5, 6, and 7 of this Circular.

2. Form of examination:

a) Round 1: Assessing the application file for promotion according to Article 7 of this Circular, if meeting the required conditions, the applicant will proceed to Round 2;

b) Round 2: Testing professional knowledge and skills; foreign languages; computer skills according to the requirements of the occupational title of the staff member applying for promotion through an interview or practical test. Each test score is graded out of 100 points.

The specific content and form of inspection and testing shall be reviewed and reported by the Promotion Examination Council to the head of the organization with authority to organize the promotion examination for approval before implementation.

Article 9. Organization of promotion examination

1. The promotion examination of the occupational title of Information and Communication professionals shall be conducted through the Promotion Examination Council for Information and Communication professionals established by the head of the organization with authority to organize the promotion examination.

2. The Promotion Examination Council for Information and Communication professionals shall conduct the promotion examination in accordance with Circular No. 06/2020/TT-BNV.

Article 10. Determination of successful candidates in the promotion examination period

1. Successful candidates in the promotion examination period for the occupational title of Information and Communication professionals are those who achieve at least 50 out of 100 points in all tests and examinations in Round 2 (professional knowledge and skills; foreign languages; computer skills), ranked in descending order of total points within the allocated quota for promotion of the occupational title.

2. In case two or more candidates have the same total points in the last quota, the determination of successful candidates shall be made in the following priority order:

a) Candidates with higher commendation achievements;

b) Candidates with higher results in professional knowledge and skills tests;

c) Specialists belonging to ethnic minorities;

d) Older candidates (based on date of birth);

đ) Candidates with longer tenure;

e) Candidates with longer tenure in their current occupational title.

If still unable to determine, the Promotion Examination Council for Information and Communication professionals shall discuss and decide by majority vote.

3. Results of the promotion examination will not be carried over to subsequent examination periods.

Article 11. Effective Date

1. This Circular takes effect from August 15, 2021.

2. From the date this Circular takes effect, the following provisions cease to be effective, including:

a) Point d Clause 3 Article 4; Point d Clause 3 Article 5; Point d Clause 3 Article 7, Point d Clause 3 Article 8; Point đ Clause 3 Article 10; Point đ Clause 3 Article 11; Point đ Clause 3 Article 13; Point đ Clause 3 Article 14 of Joint Circular No. 11/2016/TTLT-BTTTT-BNV dated July 4, 2016 of the Minister of Information and Communications and the Minister of Home Affairs on the code number, criteria for occupational titles of editorial, reporter, translator, and television director positions in the information and communication sector;

b) Point c Clause 3 Article 4; Point c Clause 3 Article 5; Point c Clause 3 Article 7; Point c Clause 3 Article 8; Point c Clause 3 Article 9; Point c Clause 3 Article 11; Point c Clause 3 Article 12; Point c Clause 3 Article 14; Point c Clause 3 Article 15; Point c Clause 3 Article 16 of Circular No. 45/2017/TT-BTTTT dated December 29, 2017 of the Minister of Information and Communications on the criteria for occupational titles of information technology professionals;

c) Point d Clause 3 Article 3; Point d Clause 3 Article 4; Point c Clause 3 Article 5, Point d Clause 3 Article 7; Point d Clause 3 Article 8; Point d Clause 3 Article 9; Point đ Clause 3 Article 11; Point đ Clause 3 Article 12; Point d Clause 3 Article 13; Point đ Clause 3 Article 15; Point đ Clause 3 Article 16; Point d Clause 3 Article 17 of Circular No. 46/2017/TT-BTTTT dated December 29, 2017 of the Minister of Information and Communications on the criteria for occupational titles of sound technicians, announcers, film editing technicians, and cameramen in the information and communication sector.

3. In cases where the referenced legal normative documents in this Circular are amended, supplemented, or replaced, they shall be implemented according to the amended, supplemented, or replaced documents.

Article 12Responsibility for Implementation

1. The Minister, Heads of Ministries equivalent to Ministries, Heads of Government Agencies, Chairpersons of Provincial People's Committees directly under the Central Government, and related agencies, organizations, and individuals are responsible for implementing this Circular.

2. During the implementation process, if there are difficulties or obstacles, organizations and individuals are requested to report to the Ministry of Information and Communications for consideration and resolution./.
