Announcing the port waters area within the jurisdiction of Dong Thap Province, Vinh Long Province, Ben Tre Province, and the management area of the Dong Thap Maritime Port Office Dong Thap

Pursuant to the Vietnam Maritime Code dated November 25, 2015;
Pursuant to Decree No. 58/2017/NĐ-CP dated May 10, 2017 of the Government qproviding detailed regulations on some provisions of the Vietnam Maritime Code regarding maritime activities management;
Pursuant to Decree No. 12/2017/NĐ-CP dated February 10, 2017of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Transport;
At the proposal of the Director of the Legal Department and the Director of the Vietnam Maritime Administration;
The Minister of Transport issues this Circular announcing the port waters area within the jurisdiction of Dong Thap Province, Vinh Long Province, Ben Tre Province, and the management area of the Dong Thap Maritime Port Office.
Article 1. Announcing the port waters area within the jurisdiction of Dong Thap Province, Vinh Long Province, and Ben Tre Province
The port waters area within the jurisdiction of Dong Thap Province, Vinh Long Province, and Ben Tre Province includes the following water areas:
1. The port waters area of Dong Thap includes:
a) The port waters area at the Cao Lanh city zone;
b) The port waters area at the Sa Dec city zone;
c) The port waters area upstream of My Thuan Bridge;
d) The port waters area at the border zone of Vinh Xuong - Thuong Phuoc.
2. The port waters area of Vinh Long.
3. The port waters area of Ben Tre.
Article 2. Scope of the port waters area within the jurisdiction of Dong Thap Province, Vinh Long Province, and Ben Tre Province
The scope of the port waters area within the jurisdiction of Dong Thap Province, Vinh Long Province, and Ben Tre Province, measured according to the highest tidal level, is specified as follows:
1. The scope of the port waters area of Dong Thap:
a) The scope of the port waters area at the Cao Lanh city zone:
The water area is bounded by the shoreline from point CL1 running along the bank of the Tien River downstream to point CL6 and straight lines connecting points CL1, CL2, CL3, CL4, CL5, and CL6 with coordinates as follows:
CL1: 10°03'00'43.8"N, 105°03'33'28.1"E (500 meters upstream from the edge of the fuel depot wharf);
CL2: 10°03'00'40.7"N, 105°03'33'22.1"E;
CL3: 10°03'00'22.3"N, 105°03'33'31.2"E;
CL4: 10°02'00'40.6"N, 105°03'33'48.5"E;
CL5: 10°02'00'23.6"N, 105°03'33'54.8"E;
CL6: 10°02'00'27.9"N, 105°03'34'06.4"E (500 meters downstream from the edge of the wharf).
b) The scope of the port waters area at the Sa Dec city zone, including:
The water area is bounded by the shoreline from point SD1 running along the bank of the Tien River downstream to point SD6 and straight lines connecting points SD1, SD2, SD3, SD4, SD5, and SD6 with coordinates as follows:
SD1: 10°19'23.2"N, 105°45'15.2"E (300 meters upstream from the edge of the Sa Dec wharf);
SD2: 10°19'28.4"N, 105°45'26.3"E;
SD3: 10°19'17.8"N, 105°45'31.8"E;
SD4: 10°19'05.4"N, 105°45'38.3"E;
SD5: 10°19'02.8"N, 105°45'39.8"E;
SD6: 10°18'56.6"N, 105°45'27.2"E (500 meters downstream from the edge of the Sa Dec wharf).
The anchorage area for vessels is controlled by points with the following coordinates:
PS2: 10°19'30"N, 105°45'18"E;
PS4: 10°19'49"N, 105°45'10"E.
The anchorage area for vessels is located at points with the following coordinates:
N1: 10°17'56.1"N, 105°46'12.7"E;
N2: 10°18'21.5"N, 105°45'55.1"E;
N3: 10°18'39.8"N, 105°45'44.7"E.
c) The scope of the port waters area at the upper part of My Thuan Bridge: is the anchorage area for vessels located at points with the following coordinates:
MTH1: 10°16'51.9"N, 105°53'28.8"E;
MTH2: 10°17'04.9"N, 105°53'12.9"E;
MTH3: 10°17'16.7"N, 105°52'59.4"E.
d) The scope of the port waters area at the border zone of Vinh Xuong - Thuong Phuoc:
Is limited by circles with a diameter of 600 meters, with centers at points BG1, BG2 with the following coordinates:
BG1: 10°54'33.9"N, 105°11'07.3"E;
BG2: 10°54'34.2"N, 105°11'28.5"E.
a) A straight line passing through point VL1 with coordinates: 10°15'40"N, 105°56'49"E (500 meters upstream from the edge of the Vinh Long wharf) and perpendicular to the left boundary of the protected channel of Co Chieng River;
b) A straight line passing through point VL2 with coordinates: 10°15'34"N, 105°57'23"E (500 meters downstream from the edge of the Vinh Long wharf) and perpendicular to the left boundary of the protected channel of Co Chieng River;
c) The left boundary of the protected channel of Co Chieng River;
d) The shoreline running from point VL1 downstream to point VL2.

d) The boundary on Ham Luong River: is the water area limited by circles with a diameter of 350 meters, with centers at points HL1, HL2, HL3 with the following coordinates:
Limited by straight lines connecting points BT1, TG2, TG1, BT2, BT3, and BT4 with the following coordinates:
BT1: 10°09'02"N, 106°47'23"E;
BT2: 9°40'04"N, 107°00'01"E;
BT3: 9°40'04"N, 106°43'54"E;
BT4: 9°47'14"N, 106°37'02"E;
TG1: 10°10'53" N, 106°59'54" E;
TG2: 10°10'53"N, 106°47'36"E.
From point BT1 running along the coast southward through Dai Gate, Ba Lai Gate, to point BT6 with coordinates: 10°00'44"N, 106°41'19"E, connected by a straight line to point BT5 with coordinates: 9°53'03"N, 106°41'08"E. From point BT5 running along the coast southward to point BT4.
Limited from point TG4 connected to point TG5, running along the left boundary of the Tien River channel upstream to point TG6, continuing to connect successively to points TG7 and CP, from point CP running along the Tien River downstream to point GH, continuing to connect successively to points TH1, TH2, and TG4 with the following coordinates:
TG4: 10°18'18"N, 106°28'46"E;
TG5: 10°18'24"N, 106°28'45"E;
TG6: 10°20'40"N, 106°21'53"E;
TG7: 10°20'32"N, 106°21'51"E;
CP: 10°19'58"N, 106°21'51"E;
GH: 10°17'51"N, 106°26'45"E;
TH1: 10°18'16"N, 106°27'23"E;
TH2: 10°18'14"N, 106°28'29"E.
HL1: 10°12'55"N, 106°21'03"E;
HL2: 10°12'46"N, 106°21'11"E;
HL3: 10°12'36"N, 106°21'20"E.
4. The boundary of the port waters area within the jurisdiction of Dong Thap Province stipulated in this Circular is determined on the Mekong River Chart produced in 2008 by the Southern Marine Safety Assurance Corporation. The coordinates of the points of the port waters area within the jurisdiction of Dong Thap Province stipulated in this Circular are applied according to the VN-2000 Coordinate System and converted to other coordinate systems accordingly in Appendix 1 issued together with this Circular.
5. The boundaries of the maritime areas of the seaports within the provinces of Vinh Long and Ben Tre specified in this Circular shall be determined based on Chart number I-300-08 published by the Vietnam People's Navy in 1978, Charts numbers IA-100-23, IA-100-24 published by the Vietnam People's Navy in 2003, and the Mekong River Chart produced in 2008 by the Southern Maritime Safety Assurance Corporation. The coordinates of the points of the maritime areas of the seaports within the provinces of Vinh Long and Ben Tre stipulated in this Circular shall be applied according to the VN-2000 Coordinate System and converted to other coordinate systems accordingly as set out in Appendix 2 issued together with this Circular.
Article 3. Pilot reception and delivery zones, quarantine zones, anchorage areas, cargo transfer areas, storm shelters, water areas, and other related water zones
The Director of the Vietnam Maritime Administration shall organize the announcement of the pilot station, quarantine area, anchorage, cargo transfer zone, and storm shelter for vessels entering and leaving the seaports within the provinces of Dong Thap, Vinh Long, and Ben Tre, as well as other water areas and maritime zones as prescribed.
Article 4. Responsibilities of the Dong Thap Marine Port Authority and related parties
1. The Dong Thap Marine Port Authority shall have the responsibility:
a) To implement tasks and powers as prescribed by the Vietnam Maritime Code and relevant laws concerning maritime activities in the maritime areas of the seaports within the provinces of Dong Thap, Vinh Long, and Ben Tre;
b) Based on actual conditions regarding weather, climate, and technical specifications of vessels, to designate specific locations for vessels to pick up and drop off pilots, undergo quarantine, anchor, transfer cargo, and avoid or shelter from storms in the prescribed maritime areas, ensuring maritime safety, maritime security, and environmental pollution prevention;
c) To notify the Vung Tau Marine Port Authority or the Can Tho Marine Port Authority about the name, nationality, main technical specifications, and other necessary information of vessels entering and leaving the seaports within the provinces of Dong Thap, Vinh Long, and Ben Tre at least two hours before the vessels arrive in the maritime areas of the province of Ba Ria-Vung Tau or the maritime areas of the seaports within the provinces of Tra Vinh, Soc Trang, and seaports on the Hau River within the provinces of Hau Giang, Vinh Long, Dong Thap, and the city of Can Tho;
d) To notify the Vung Tau Marine Port Authority, Ho Chi Minh City Marine Port Authority, or the Can Tho Marine Port Authority about vessels entering the seaports within the provinces of Dong Thap, Vinh Long, and Ben Tre but must anchor or avoid storms in the maritime areas of the province of Ba Ria-Vung Tau, the maritime areas of the seaports within Ho Chi Minh City and Long An, Tien Giang provinces, or the maritime areas of the seaports within the provinces of Tra Vinh, Soc Trang, and seaports on the Hau River within the provinces of Hau Giang, Vinh Long, Dong Thap, and the city of Can Tho, at least two hours before the vessels arrive in the maritime areas of the province of Ba Ria-Vung Tau, the maritime areas of the seaports within Ho Chi Minh City and Long An, Tien Giang provinces, or the maritime areas of the seaports within the provinces of Tra Vinh, Soc Trang, and seaports on the Hau River within the provinces of Hau Giang, Vinh Long, Dong Thap, and the city of Can Tho.
2. The Vung Tau Marine Port Authority, Ho Chi Minh City Marine Port Authority, and Can Tho Marine Port Authority shall have the responsibility: based on actual conditions regarding weather, waves, tide levels, and tonnage of vessels entering and leaving the seaports within the provinces of Dong Thap, Vinh Long, and Ben Tre, to designate specific locations for vessels to pick up and drop off pilots, undergo quarantine, anchor, and avoid storms; within one hour from receiving notification from the Dong Thap Marine Port Authority, they must report back to the Dong Thap Marine Port Authority.
Article 5. Effective Date
1. This Circular shall take effect from April 15, 2022.
2. Repeal Decision No. 45/2007/QĐ-BGTVT dated September 4, 2007, of the Minister of Transport announcing the maritime areas of the seaports within the province of Dong Thap and the management area of the Dong Thap Marine Port Authority.
Article 6. Responsibility for Implementation
The Head of the Ministry's Office, the Head of the Ministry's Inspectorate, the Heads of the Departments under the Ministry, the Director of the Vietnam Maritime Administration, the Director of the Vietnam Inland Waterway Administration, the Directors of the Transport Departments of the provinces and cities: Dong Thap, Vinh Long, Ben Tre, Ba Ria-Vung Tau, Ho Chi Minh City, Can Tho, the Director of the Dong Thap Marine Port Authority, the Director of the Vung Tau Marine Port Authority, the Director of the Ho Chi Minh City Marine Port Authority, the Director of the Can Tho Marine Port Authority, the Heads of agencies, organizations, and individuals concerned shall be responsible for implementing this Circular./.
