Pursuant to Decree No. 24/2014/NĐ-CP dated April 4, 2014 of the Government stipulating the organization of specialized agencies under the People's Committees of provinces and centrally governed cities; Decree No. 107/2020/NĐ-CP dated September 14, 2020 of the Government amending and supplementing certain articles of Decree No. 24/2014/NĐ-CP dated April 4, 2014 of the Government stipulating the organization of specialized agencies under the People's Committees of provinces and centrally governed cities;
Pursuant to Decree No. 37/2014/NĐ-CP dated May 5, 2014 of the Government stipulating the organization of specialized agencies under the People's Committees of districts, towns, and cities under provinces; Decree No. 108/2020/NĐ-CP dated September 14, 2020 of the Government amending and supplementing certain articles of Decree No. 37/2014/NĐ-CP dated May 5, 2014 of the Government stipulating the organization of specialized agencies under the People's Committees of districts, towns, and cities under provinces;
BASED ON THE GOVERNMENT DECREE NO. 52/2022/NĐ-CP OF AUGUST 8, 2022, PROVIDING THE FUNCTIONS, TASKS, POWERS, AND ORGANIZATIONAL STRUCTURE OF THE MINISTRY OF CONSTRUCTION;
The phrase "or examination" is abolished pursuant to Clause 6, Article 8 of Circular No. 15/2025/TT-BVHTTDL dated November 25, 2025, of the Minister of Culture, Sports and Tourism amending and supplementing certain articles of Circulars prescribing job codes, qualification standards, and salary grades for civil servants in the heritage culture, library, grassroots cultural activities, sports, fine arts, art performance, film, and cultural propaganda sectors, which takes effect from January 15, 2026.
Article 1. Amending and supplementing some articles of Circular No. 21/2023/TT-BTTTT dated December 31, 2023 of the Ministry of Information and Communications on functions and technical features of the Administrative Procedure Handling Information System at the ministerial and provincial levels (hereinafter referred to as Circular No. 21/2023/TT-BTTTT) as follows: Ministry of Construction Issuing this Circular to guide the functions, tasks, and authorities of the construction specialized agency under the People's Committee of provinces and centrally governed cities (referred to collectively as provincial level) and the People's Committee of districts, towns, and cities under provinces and centrally governed cities (referred to collectively as district level).
PART I
CONSTRUCTION SPECIALIZED AGENCY BELONGING TO THE PEOPLE'S COMMITTEE AT PROVINCE LEVEL
Article 1. Position and Function
1. The Department of Construction is a specialized agency under the People's Committee at province level; it performs the function of advising and assisting the People's Committee at province level in state management over: Construction planning; architecture; construction investment activities; urban development; technical infrastructure; housing; public offices; real estate market; building materials; and other tasks and authorities as prescribed by law and according to the delegation or authorization of the People's Committee at province level and the Chairman of the People's Committee at province level.
Notwithstanding, the Department of Construction of Hanoi City and Ho Chi Minh City does not perform the function of advising and assisting the People's Committee of the city in state management over the field of construction planning and architecture.
2. The Department of Planning and Architecture of Hanoi City and Ho Chi Minh City is a specialized agency under the People's Committee of the city, performing the function of advising and assisting the People's Committee of the city in state management over the fields of construction planning and architecture, and performing other tasks and authorities as prescribed by law and according to the delegation or authorization of the People's Committee of the city and the Chairman of the People's Committee of the city.
3. The Department of Transport and Construction is a specialized agency under the People's Committee at province level, performing the function of advising and assisting the People's Committee at province level in state management over construction and implementing tasks and authorities related to construction within its jurisdiction as guided by this Circular and other relevant regulations (for other fields under the Department of Transport and Construction, they shall be implemented according to the guidance of the corresponding sectoral management ministry).
4. The Department of Construction, the Department of Planning and Architecture, and the Department of Transport and Construction have legal personality, their own seals and bank accounts; they are subject to the direction and management of organizational structure, staffing, and personnel work by the People's Committee at province level, while also being subject to the direction, guidance, and supervision of the Ministry of Construction in their professional matters.
Article 2. Tasks and Authorities
1. Submit to the provincial People's Committee:
a) Draft decisions of the People's Committee at province level related to the construction industry within the scope of management of the Department and other documents assigned by the People's Committee at province level;
b) Draft plans for the development of the construction industry; programs and measures to organize the implementation of tasks related to the construction industry within the province's jurisdiction;
c) Draft decisions on the delegation and authorization of tasks in state management over the construction industry;
d) Draft decisions on the specific functions, tasks, authorities, and organizational structure of the Department; draft decisions on the functions, tasks, authorities, and organizational structure of the sub-department under the Department;
đ) Draft decisions on the socialization of activities providing public services in the construction industry within the authority of the People's Committee at province level and according to the delegation from higher-level state agencies.
2. Submitting to the Chairman of the Provincial People's Committee:
a) Draft documents within the authority of the Chairman of the People's Committee at province level in the construction field as assigned;
b) Draft decisions on the functions, tasks, authorities, and organizational structure of public service units under the Department.
3. Implementing legal normative documents, plans, and other documents in the construction industry issued or approved by competent state agencies; disseminating, guiding, popularizing, educating, and supervising the enforcement of laws in the fields under the delegated state management.
4. Regarding construction planning (including inter-district regional construction planning, district-level regional construction planning, functional area construction planning, urban planning, rural planning):
a) Guiding, inspecting, and organizing the implementation of regulations on the preparation, review, and approval of construction planning and urban design as prescribed; guiding and inspecting the implementation of national technical standards and norms on construction planning;
b) Organizing the preparation, review, and submission to the People's Committee at province level for approval or advising the People's Committee at province level to submit to the competent authority for review and approval of construction planning and management regulations according to the urban planning project on the territory as prescribed by law;
c) Guiding the organization of the preparation, review, and approval of construction planning on the territory as prescribed;
d) Direct, manage, and organize the implementation of approved construction master plans on the territory according to the分级授权,包括:组织公布、公开建设规划;管理界址点、建筑红线、建筑标高的档案;介绍建设项目地点和基础设施工程线路;提供有关规划的信息;
e) Issue, reissue, extend, adjust, supplement, convert, and revoke certificates for practicing construction planning design for individuals and certificates of competence for organizations participating in construction planning design in accordance with laws on construction;
g) Establish and manage databases on construction planning;
5. Regarding architecture:
a) Implement and coordinate with ministries and ministerial-level agencies to organize the implementation, monitor, inspect, and supervise architectural quality in investment construction projects;
b) Organize the establishment of architectural management regulations according to the分级授权 and authorization of the provincial People's Committee; guide and inspect county-level People's Committees in establishing and reviewing urban architectural management regulations within their approval and issuance authority; guide and inspect the implementation of architectural management regulations after they have been approved and issued by competent authorities; organize reviews and evaluations of the implementation of architectural management regulations every five years or at irregular intervals to consider and adjust architectural management regulations;
c) Establish and adjust the list of architectural works of value according to the分级授权的省级人民政府;
d) Issue, adjust, extend, reissue, and revoke certificates for practicing architecture; recognize and convert certificates for practicing architecture for foreign individuals who already hold valid certificates issued by competent authorities abroad;
đ) Establish databases, update, publish, and provide information about organizations and individuals engaged in architectural practice with headquarters in the area;
6. On investment construction activities:
a) Guide and inspect the implementation of legal provisions in investment construction activities, including: Establishing, reviewing, and approving investment construction projects; surveying and designing construction; issuing construction permits; construction, acceptance, warranty, and maintenance of construction works; specialized construction testing and construction inspection; safety during construction; managing investment construction costs, construction contracts; managing the conditions for construction activity capacity of organizations and individuals and issuing permits for foreign contractors;
b) Review feasibility studies for construction investment projects, post-design implementation designs of construction investment projects, and inspect the completion acceptance work of construction projects within the jurisdiction as stipulated;
c) Advise and assist the provincial People's Committee in managing construction order within the jurisdiction according to planning, construction design, and construction permits as stipulated;
d) Implement tender management in construction activities according to laws on construction and bidding within the jurisdiction;
e) Advise and assist the provincial People's Committee in state management over the activities of project management boards established by the provincial People's Committee;
g) Advise and assist the provincial People's Committee in organizing the implementation of state management tasks regarding construction work quality, construction, maintenance of construction works, judicial appraisal in the construction sector on the territory in accordance with the law;
h) Guide and inspect the implementation of legal provisions on managing investment construction costs on the territory; organize the establishment and submission to the provincial People's Committee for promulgation or publication according to分级授权or delegation: Unit prices for construction works, publication of construction material prices, equipment prices, labor unit prices, machinery and equipment rental prices, construction price indices; advise and propose to the provincial People's Committee guidelines for applying or utilizing construction norms, unit prices, construction price indices, and capital investment rates for local public investment construction projects;
i) Advise and assist the provincial People's Committee in promulgating economic-technical norms for special construction works of the locality according to the guidance of the Ministry of Construction and regulations of the Minister of Construction for consolidation and monitoring;
k) Implement the notification of information on construction norms, construction prices, and construction price indices monthly, quarterly, or annually, in accordance with regulations on managing investment construction costs to ensure timeliness with market construction price fluctuations;
l) Advise and assist the provincial People's Committee in implementing the issuance, adjustment, extension, reissuance, and revocation of construction permits on the territory according to regulations;
m) Issue, adjust, and revoke construction operation permits for foreign contractors operating in the area according to regulations;
n) Organize examinations, issue, reissue, extend, adjust, supplement, convert, and revoke certificates for practicing construction for individuals and certificates of construction activity competence for organizations according to regulations; guide and inspect the issuance, reissuance, extension, adjustment, supplementation, conversion, revocation, and management of various types of construction practice certificates on the territory;
o) Establish databases, update, publish, and provide information on the capabilities of organizations and individuals participating in construction activities with headquarters in the area (including foreign contractors operating in construction);
p) Monitor, inspect, supervise, and comprehensively evaluate investment construction activities under the management authority of the Department;
7. Regarding urban development:
a) Advise and assist the provincial People's Committee in organizing the establishment of various types of urban development programs or reviewing urban development programs according to their authority; determine urban development areas and implementation plans; determine urban development indicators in the province's socio-economic development tasks; organize the implementation of plans, programs, and regulations after they have been approved by competent authorities;
b) Establish mechanisms, policies, and solutions to attract and mobilize resources for the construction and development of integrated cities, new urban areas, management policies and solutions for urban development processes, urban management models, encourage the development of public services in the urban development sector; organize the implementation after being approved and issued by the provincial People's Committee;
c) Organize the implementation of urban development programs and projects that have been approved by competent authorities according to the division of labor of the provincial People's Committee, including: urban upgrading programs, urban development programs, proposals for developing Vietnamese cities to respond to climate change, national action plans on green growth, smart city construction and development projects, urban environmental improvement projects, urban management capacity enhancement projects, urban development investment projects, and other related programs and projects.
d) Organize the annual evaluation and classification of cities, propose the completion of criteria for classifying cities for recognized cities; guide and inspect proposals for recognizing city types submitted to the provincial People's Committee for approval by competent authorities; organize the review and submit proposals for recognizing type V cities to the provincial People's Committee for approval.
đ) Guide and inspect activities related to urban investment and construction, urban development, land exploitation and utilization for urban construction according to approved planning and plans; organize the management of urban development investment according to laws on urban development investment management, construction investment laws, and relevant laws according to the division of labor of the provincial People's Committee; guide urban construction order management.
e) Organize investment promotion activities for urban development; mobilize and coordinate domestic and foreign resources for urban system construction and development within the assigned tasks of the provincial People's Committee; exploit and utilize resources and advise the provincial People's Committee on the handover management in urban areas or implement when authorized by the provincial People's Committee.
g) Monitor, compile, evaluate, and report on urban development situations within the province; organize the establishment and management of urban development information databases.
8. Regarding technical infrastructure, including: urban and industrial zone water supply; urban and rural concentrated residential area wastewater discharge and treatment, industrial zone wastewater treatment; solid waste collection, storage, and treatment facility management; urban parks and greenery; urban lighting; cemeteries (excluding martyrs' cemeteries) and crematoriums; urban transportation infrastructure structures; underground urban construction management; common use management of urban technical infrastructure facilities:
a) Develop plans, programs, targets, and policies for technical infrastructure development within the jurisdiction, submit for approval by competent authorities; guide and inspect implementation after approval.
b) Organize the preparation and review at the appropriate level and according to legal regulations on planning within the scope of technical infrastructure in the area, submit to the provincial People's Committee for approval.
c) Organize investment promotion activities, mobilize and exploit resources for technical infrastructure development in the area.
d) Guide the establishment and management of costs for technical infrastructure services under the department's management; organize the preparation and submission to the provincial People's Committee for publication or issuance of budget standards for technical infrastructure services not included in the standards published by the Ministry of Construction, or those already existing but not suitable with specific technical procedures and conditions of the province; advise and propose to the provincial People's Committee guidelines for applying or adapting standards and unit prices for technical infrastructure services within the province and budget cost estimates for such services using local government funds; monitor and supervise implementation.
đ) Establish and manage databases on technical infrastructure.
e) Guide and inspect compliance with legal provisions on technical infrastructure in the area.
9. Regarding housing:
a) Study and build programs and plans for provincial housing development, including commercial housing, social housing, public service housing, resettlement housing, housing for households and individuals, and provincial target programs supporting housing for disadvantaged groups facing housing difficulties; organize implementation after approval by competent authorities.
b) Take the lead and coordinate with relevant agencies:
Provide opinions on the examination of investment project development housing proposal files approved by the provincial People's Committee or decided upon by the provincial People's Committee according to investment and housing laws; select developers for commercial housing, urban, and social housing projects to be submitted to the provincial People's Committee for decision-making according to their authority.
Develop mechanisms and policies for housing development and management suitable to the specific conditions of the province for the provincial People's Committee to submit to the provincial People's Council for issuance according to their authority; urge, guide, and inspect implementation after issuance by the provincial People's Committee.
c) Review the sale, rental, and lease-purchase prices for social housing projects within the province according to the division of labor of the provincial People's Committee; establish frameworks for sale, rental, and lease-purchase prices for social housing built by households and individuals, and management and operation service fees for social housing according to the division of labor of the provincial People's Committee.
d) Advise the provincial People's Committee to review, adjust, and supplement land funds allocated for social housing development in general, district, and detailed urban planning; advise and submit to the provincial People's Committee for consideration and decision on reclaiming land funds from commercial housing and new urban development projects handed over to investors but not implemented or delayed compared to approved schedules, and 20% land funds reserved for social housing in commercial housing and new urban development projects but not yet utilized to be handed over to investors interested in building social housing.
đ) Build and submit to the provincial People's Committee for approval plans for managing the public service housing fund (including land requirements and construction investment capital) according to the standards for public service housing area set by the Prime Minister.
e) Establish and issue a framework for rental prices of public service housing; a framework for rental, lease-purchase, and sale prices of state-owned housing that are appropriate to the actual conditions of the province; organize the implementation of tasks related to receiving self-managed housing funds from the central and provincial levels to unify management and sell state-owned housing to current tenants in accordance with the law;
g) Participate in appraising various types of houses within the jurisdiction according to the price framework, principles, and appraisal methods for various types of houses set by the State;
h) Guide and inspect the implementation of housing construction standards, social housing standards; guide the classification, model design, typical design, management regulations, usage, warranty, and maintenance systems for housing and social housing within the jurisdiction;
i) Organize the implementation of national policies and laws on housing development and management; implement housing support policies for social groups in accordance with the law;
k) Summarize and evaluate the situation and results of housing development and social housing development within the jurisdiction on an annual basis or as required, report to the Provincial People's Committee, the Ministry of Construction for consolidation and reporting to the Government;
l) Organize surveys, statistics, and periodic evaluations of state-owned housing within the jurisdiction; organize the establishment, management of databases, and provision of information on state-owned housing within the jurisdiction;
10. Regarding office premises:
a) Guide and inspect the implementation of construction standards for office premises and workplaces; guide the classification, model design, typical design, management regulations, usage, warranty, and maintenance systems for state-owned office premises and workplaces within the jurisdiction;
b) Coordinate with the Department of Finance to implement changes in the purpose of use, purchase, sale, and rental of state-owned office premises and workplaces within the jurisdiction in accordance with the law;
c) Organize surveys, statistics, and periodic evaluations of state-owned office premises within the jurisdiction; organize the establishment of databases and provision of information on state-owned office premises within the jurisdiction;
11. On the real estate market:
a) Develop and submit to the Provincial People's Committee for issuance mechanisms and policies for real estate market development and management; solutions to enhance transparency in real estate transactions and business activities within the jurisdiction; organize implementation after approval and issuance by the Provincial People's Committee;
b) Implement policies and measures to regulate and stabilize the real estate market within the jurisdiction in accordance with the law;
c) Guide the implementation of legal provisions regarding the eligibility criteria for developers of housing projects, industrial infrastructure projects, and other real estate investment projects within the jurisdiction; guide the provisions on real estate entering the market;
d) Organize the review of project transfer documents for new urban areas, housing development projects, and industrial infrastructure projects to be submitted by the Provincial People's Committee to the Prime Minister for decision-making or for the Provincial People's Committee to decide on project transfers within its authority; guide the inspection of legal provisions in real estate sales, rentals, and lease-purchases within the jurisdiction;
đ) Inspect training and capacity-building activities for real estate brokers and property trading floor management; implement the issuance and management of real estate broker practice certificates within the jurisdiction;
e) Monitor and compile the situation, organize the establishment of information systems on the real estate market, real estate business activities, and real estate service businesses within the jurisdiction; periodically report or as required for the Ministry of Construction to report according to regulations;
12. On construction materials:
a) Advise and assist the Provincial People's Committee in establishing, reviewing, approving, and managing the implementation of local programs and plans for building materials development; schemes for exploration, exploitation, and utilization of common building materials minerals in provincial planning;
b) Manage and organize the implementation of approved planning for exploration, exploitation, processing, and utilization of building materials minerals and cement raw materials within the jurisdiction in accordance with the law;
c) Provide comments on the review of investment projects for the construction of building materials production facilities within the jurisdiction as stipulated;
d) Guide activities related to the review and evaluation of: Mining and processing technologies for building materials minerals and cement raw materials; building materials production technologies; quality of building materials products;
đ) Guide, inspect, and organize the implementation of technical standards and regulations on safety and labor hygiene in mining, processing of building materials minerals and cement raw materials, and building materials production activities;
e) Guide legal provisions on construction material business for organizations and individuals engaged in construction material business within the jurisdictional area as assigned by the provincial People's Committee;
g) Advise and assist the Provincial People's Committee in managing the quality of building materials products and goods within the jurisdiction in accordance with the law;
h) Monitor and compile the situation of mining, processing, and production of building materials and cement raw materials by organizations and individuals within the jurisdiction;
i) Develop and organize the implementation of programs and projects to encourage, support, and promote the development of construction machinery products;
13. Guide the implementation of self-management mechanisms for public service units under the department's jurisdiction in accordance with the law; manage the activities of public and non-public service units within the construction sector;
14. Advise and assist the Provincial People's Committee in managing state enterprises, collective economic organizations, private enterprises, and guide and inspect the activities of associations and non-governmental organizations operating in the sectors managed by the department within the jurisdiction in accordance with the law;
15. Implement international cooperation and integration in the fields managed by the department in accordance with the law and the division, delegation, or authorization of the Provincial People's Committee.
16. To establish, direct, and organize the implementation of plans for researching, applying scientific and technological advancements, and environmental protection; to build information systems and reference materials serving state management tasks and specialized activities assigned to the Department in accordance with the law.
17. To provide professional guidance on specialized matters within the scope of state management assigned to the Department for specialized agencies under the People's Committee at the district level and professional positions under the People's Committees at the commune, ward, and town levels.
18. To inspect and supervise organizations and individuals in the enforcement of laws related to construction, handle cases of violation within their authority or refer them to competent authorities for handling; to resolve disputes, complaints, and accusations, and implement anti-corruption and thrift measures in areas managed by the Department in accordance with the law or as delegated by the provincial People's Committee or the Chairman of the provincial People's Committee.
19. To monitor, compile, report periodically and urgently on the implementation of assigned tasks to the provincial People's Committee, the Ministry of Construction, and other competent authorities as prescribed by law; to implement comprehensive statistical reporting systems for the construction industry according to the regulations of the Ministry of Construction and the division of labor by the provincial People's Committee.
20. To define the functions, tasks, powers, and organizational structure of the Office, Inspectorate, and specialized departments in line with the functions, tasks, and powers of the Department as guided by the central managing ministry and in accordance with the regulations of the provincial People's Committee.
21. To manage the organizational structure, civil servant quota, cadre structure, job positions, and number of personnel in public service units based on professional titles; to implement salary systems and incentive policies, training, rewards, and disciplinary actions for civil servants, cadres, and workers under the Department's jurisdiction in accordance with the law and as delegated by the provincial People's Committee.
22. To manage finances and assets allocated and to implement the state budget as prescribed by law and as delegated by the provincial People's Committee.
23. To perform other tasks as delegated, authorized, or assigned by the provincial People's Committee or the Chairman of the provincial People's Committee and as prescribed by law.
24. The Department of Construction of Hanoi City and the Department of Construction of Ho Chi Minh City have the duties and powers defined from Clause 1 to Clause 3 and from Clause 6 to Clause 23 of this Article.
25. The Department of Planning and Architecture of Hanoi City and the Department of Planning and Architecture of Ho Chi Minh City have the duties and powers defined from Clause 1 to Clause 5 and from Clause 13 to Clause 23 of this Article.
Chapter II
SPECIALIZED AGENCIES FOR CONSTRUCTION UNDER THE PROVINCE PEOPLE'S COMMITTEE
Article 3. Position and Functions
1. The Urban Management Division and the Economic and Infrastructure Division are specialized agencies under the People's Committee at the district level responsible for advising and assisting the People's Committee at the district level in state management over the following areas: construction planning; architecture; construction investment activities; urban development; technical infrastructure; housing; office buildings; building materials on the local territory and implementing certain tasks and powers as delegated by the People's Committee at the district level and as prescribed by law.
For other areas under the Urban Management Division and the Economic and Infrastructure Division, they shall follow the guidance of the relevant central managing ministry.
2. The Urban Management Division and the Economic and Infrastructure Division shall have their own seals and bank accounts; they shall be subject to the direction and management of the People's Committee at the district level regarding organization, job positions, civil servant quotas, and cadre structures, and shall comply with the professional and administrative guidance of the People's Committee at the district level. They shall also be subject to professional and administrative guidance in construction-related state management areas by specialized agencies under the People's Committee at the provincial level.
Article 4. Tasks and Powers
1. To submit to the People's Committee at the district level: draft decisions; medium-term and annual development plans; programs and measures to implement tasks related to administrative reform in the construction sector; draft documents specifying the functions, tasks, powers, and organizational structures of the Urban Management Division and the Economic and Infrastructure Division.
2. To submit to the Chairman of the People's Committee at the district level draft documents within the Chairman's authority to issue as assigned.
3. To guide and implement legal regulations, plans, programs, projects, and other documents in construction-related state management areas that have been approved by competent authorities; to disseminate information, educate, and monitor the enforcement of laws in these areas.
4. To advise and assist the People's Committee at the district level in organizing the implementation of tasks in the following areas: construction planning; architecture; construction investment activities; urban development; technical infrastructure; housing; office buildings; building materials on the local territory in accordance with the law and as assigned by the provincial People's Committee.
5. To advise and assist the People's Committee at the district level in establishing architectural management regulations and urban planning design management regulations as assigned, delegated, or authorized by the provincial and district-level People's Committees.
6. To advise and assist the People's Committee at the district level in issuing, reissuing, extending, amending, and revoking construction permits for projects and supervising construction activities in accordance with the law and as assigned by the provincial People's Committee.
7. Implement the review of feasibility study reports for investment construction projects, design implementation after basic design, and inspect the acceptance work of construction projects within the jurisdiction according to the分级审批 of the provincial People's Committee.
8. Advise and assist the county-level People's Committee in formulating urban development programs; coordinate during the formulation and review of urban development programs; participate in drafting proposals to recognize fifth-class cities within the jurisdiction.
9. Organize the formulation, review, and submission to the county-level People's Committee for approval, or organize the formulation for the county-level People's Committee to submit to the competent authority for review and approval, the planning for construction within the jurisdiction in accordance with the provisions of the law.
10. Advise and assist the county-level People's Committee in organizing the implementation of mechanisms and policies on housing and public offices; manage the housing fund and the right to manage and use public offices within the jurisdiction according to the分级审批 of the provincial People's Committee; organize the implementation of investigations, statistics, and periodic evaluations of housing and public offices within the jurisdiction.
11. Guide and inspect the construction of works in accordance with architectural management regulations, urban planning management regulations, and urban design plans that have been approved by the competent authority; organize the publication and disclosure of construction plans; provide information about construction plans; manage boundary markers, construction boundaries, and construction levels within the jurisdiction according to the分级审批.
12. Guide, inspect, and organize the implementation of technical infrastructure regulations in accordance with the law and the division of responsibilities and分级审批 of the provincial and county-level People's Committees.
13. Advise and assist the county-level People's Committee in state management over collective economic organizations, private economic organizations, and guide the activities of associations and non-governmental organizations operating in areas under the state management of the Construction sector within the jurisdiction in accordance with the law.
14. Provide professional guidance and business operations training for staff and civil servants at commune, ward, and town levels in the fields managed by the Department.
15. Organize the application of scientific and technological advancements; build information and data systems to serve state management work and professional operations of the Department.
16. Inspect organizations and individuals in the enforcement of laws in the fields managed by the Department, report to the county-level People's Committee for handling or submit cases of violations to the competent authority for handling; resolve complaints and grievances, implement anti-corruption and thrift measures in the Construction sector in accordance with the law and the division of responsibilities of the county-level People's Committee.
17. Monitor, compile, and report periodically and urgently on the implementation of assigned tasks to the county-level People's Committee, the Construction Department, the Planning and Architecture Department, and other competent authorities in accordance with the law.
18. Manage organizational structure, job positions, civil servant quotas, and salary systems, policies, incentives, rewards, disciplinary actions, training, and professional development for civil servants under the management of the Department in accordance with the law and the division of responsibilities of the county-level People's Committee.
19. Manage the financial and asset affairs of the Department in accordance with the law and the division of responsibilities and分级审批 of the county-level People's Committee.
20. Perform other tasks assigned, delegated, or authorized by the county-level People's Committee, the Chairman of the county-level People's Committee, and in accordance with the law.
Chapter III
IMPLEMENTATION
Article 5. Effective Date
1. This Circular takes effect from November 11, 2022.
2. This Circular replaces Joint Circular No. 07/2015/TTLT-BXD-BNV dated November 16, 2015, issued by the Minister of Construction and the Minister of Home Affairs, guiding the functions, tasks, and powers of specialized agencies under the People's Committees of provinces and centrally-administered municipalities, counties, districts, towns, and provincial cities regarding state management in the Construction sector.
Article 6. Responsibility for Implementation
1. The provincial People's Committee and the Chairman of the provincial People's Committee are responsible for directing and organizing the implementation of this Circular.
2. During the implementation process, if there are difficulties or need for supplementation or amendment, the provincial People's Committee shall promptly reflect to the Ministry of Construction for consideration and resolution within its authority./.
