CIRCULAR
Guidelines on certain contents for implementing livelihood diversification,
developing poverty reduction models and supporting workers going to work abroad under the National Target Program for Sustainable Poverty Reduction for the period 2021-2025

Pursuant to Resolution No. 111/2024/QH15 dated January 18, 2024 of the National Assembly on certain special mechanisms and policies for implementing national target programs;
Based on Decree No. 62/2022/NĐ-CP dated September 12, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor, Invalids, and Social Affairs;
Pursuant to Decree No. 27/2022/NĐ-CP dated April 19, 2022 of the Government stipulating management mechanisms and organization of implementation of national target programs; Decree No. 38/2023/NĐ-CP dated June 24, 2023 of the Government amending and supplementing certain articles of Decree No. 27/2022/NĐ-CP dated April 19, 2022 of the Government stipulating management mechanisms and organization of implementation of national target programs;
Implementing Decision No. 90/QĐ-TTg dated January 18, 2022 of the Prime Minister approving the National Target Program for Sustainable Poverty Reduction for the period 2021-2025;
At the proposal of the Director of the National Office for Poverty Reduction and the Director General of the Department of Overseas Labor Management;
The Minister of Labor, Invalids and Social Affairs issues this Circular guiding certain contents for implementing livelihood diversification, developing poverty reduction models and supporting workers going to work abroad under the National Target Program for Sustainable Poverty Reduction for the period 2021-2025.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Circular guides certain contents for implementing livelihood diversification, developing poverty reduction models and supporting workers going to work abroad under the National Target Program for Sustainable Poverty Reduction for the period 2021-2025 approved by Decision No. 90/QĐ-TTg dated January 18, 2022 of the Prime Minister (hereinafter referred to as the Program), including:
1. Livelihood diversification activities, poverty reduction model development (Project 2) as stipulated in Clause 2, Section III of the Program, including: support activities for production development as stipulated in Article 21, Article 22, and Article 23 of Decree No. 27/2022/NĐ-CP dated April 19, 2022 of the Government stipulating management mechanisms and organization of implementation of national target programs (hereinafter referred to as Decree No. 27/2022/NĐ-CP) amended and supplemented at Clause 12, Clause 13, and Clause 14 of Article 1 of Decree No. 38/2023/NĐ-CP dated June 24, 2023 of the Government amending and supplementing certain articles of Decree No. 27/2022/NĐ-CP dated April 19, 2022 of the Government stipulating management mechanisms and organization of implementation of national target programs (hereinafter referred to as Decree No. 38/2023/NĐ-CP) and Article 24 of Decree No. 27/2022/NĐ-CP.
2. Support activities for workers going to work abroad under contracts (Sub-project 2 Project 4) as stipulated in Point b, Clause 4, Section III of the Program.
Article 2. Applicability
This Circular applies to agencies, organizations, and individuals participating or related in the management and organization of implementation of livelihood diversification activities, poverty reduction model development, and support activities for workers going to work abroad under contracts within the Program.
Chapter II
LIVELIHOOD DIVERSIFICATION ACTIVITIES,
POVERTY REDUCTION MODEL DEVELOPMENT
Section 1
ELIGIBLE SUPPORT OBJECTS, PRINCIPLES FOR BUILDING AND IMPLEMENTING PROJECTS, PLANS, MODELS, SUPPORT DEVELOPMENT PRODUCTION SCHEMES
Article 3. Support Objectives
Implement according to the provisions at point b, Clause 2, Section III of the Program.
Article 4. Principles for Building and Organizing Implementation of Projects, Plans, Models, and Support Schemes for Production Development
1. Ensure the management principles for support activities for production development under the national target program as stipulated in Article 20 of Decree No. 27/2022/ND-CP (amended and supplemented in Clause 11, Article 1 of Decree No. 38/2023/ND-CP).
2. Ensure the conditions for supporting production development as prescribed in Clause 1, Article 21, Clause 1, Article 22, and Clause 1, Article 23 of Decree No. 27/2022/ND-CP (amended and supplemented in Clause 12, Clause 13, and Clause 14, Article 1 of Decree No. 38/2023/ND-CP) and Clause 1, Article 24 of Decree No. 27/2022/ND-CP.
3. Build, approve, and organize the implementation of projects, plans, models, and support schemes for production development (hereinafter referred to as projects) ensuring transparency, openness, democracy, and gender equality.
4. Projects must be consistent with local socio-economic development plans, the conditions, characteristics, and needs of poor households, near-poor households, newly escaped poverty households, and other participants in the project; suitable to the comparative advantages and strengths of each region; and meet market demands while ensuring sustainable effectiveness.
5. Prioritize support for projects specified in point b, Clause 2, Section III of the Program and Clause 1, Article 20 of Decree No. 27/2022/ND-CP (amended and supplemented in Clause 11, Article 1 of Decree No. 38/2023/ND-CP); prioritize implementing support contents as prescribed in Clause 4, Article 21, and Clause 4, Article 22 of Decree No. 27/2022/ND-CP (amended and supplemented in Clause 12 and Clause 13, Article 1 of Decree No. 38/2023/ND-CP).
6. The specific content and expenditure levels of projects shall be implemented according to the provisions in Article 57 of Circular No. 55/2023/TT-BTC dated August 15, 2023 issued by the Minister of Finance on the management, use, and settlement of state budget funds for national target programs from 2021 to 2025 (hereinafter referred to as Circular No. 55/2023/TT-BTC).
Section 2
DIVERSIFIED ECONOMIC ACTIVITIES AND POVERTY REDUCTION MODELS IMPLEMENTED BY MINISTRIES, CENTRAL AGENCIES, OR THEIR SUBORDINATE UNITS
Article 5. Agencies and Units Implementing Projects and Content of Support
1. Agencies and Units Implementing Projects
Ministries, central agencies, or their subordinate units assigned plans and budgets for implementing support activities for production development (hereinafter referred to as agencies and units implementing projects) shall organize the implementation of projects in accordance with regulations.
2. Content of Support for Project Implementation
Implement according to the provisions at point c, Clause 2, Section III of the Program, Articles 20, 21, 23 of Decree No. 27/2022/ND-CP (amended and supplemented in Clause 11, Clause 12, and Clause 14, Article 1 of Decree No. 38/2023/ND-CP) and Article 24 of Decree No. 27/2022/ND-CP.
Article 6. Establishing Project Proposals, Approving, and Organizing Implementation of Production Development Projects Linked to Value Chains
1. Announcing Selection of Project Proposal Applications
Agencies and units implementing projects shall announce the selection of project proposal applications for production development linked to value chains through media outlets or on their official websites, publicly posting at their main offices regarding: project name; project activity content; implementation period; funding sources; application deadline; address for receiving proposals; method of submission.
2. Preparing Project Proposal Applications
a) The lead unit in the linkage prepares the project proposal application in accordance with Clause 2, Article 21 of Decree No. 27/2022/ND-CP (amended and supplemented in Clause 12, Article 1 of Decree No. 38/2023/ND-CP).
b) When preparing the project proposal application, the lead unit in the linkage shall coordinate with the People's Committee of the district where the project is expected to be implemented to survey and select project activity content, participating entities, and implementation areas in compliance with the provisions of Clause 1 of this Article.
3. Evaluation, Selection, and Approval of Projects
a) Agencies and units implementing projects shall organize the implementation of projects in accordance with Clause 6, Article 21 of Decree No. 27/2022/ND-CP (amended and supplemented in Clause 12, Article 1 of Decree No. 38/2023/ND-CP) and relevant laws.
b) The lead unit in the linkage shall cooperate with the local authorities where the project is implemented to notify the basic content of the approved project to poor households, near-poor households, newly escaped poverty households, people with disabilities (without stable livelihoods), and other related participants in the project.
c) The lead unit in the linkage and associated parties shall fulfill their responsibilities as prescribed in Clause 7, Article 21 of Decree No. 27/2022/ND-CP (amended and supplemented in Clause 12, Article 1 of Decree No. 38/2023/ND-CP).
d) The lead unit in the linkage shall compile and report the results of project implementation to the agency or unit implementing the project using Model 02 Appendix attached to this Circular when requested and upon completion of the project.
d) The leading unit in the collaboration shall compile and report the results of implementing the project to the agencies and units responsible for the project according to Model No. 02 attached as an appendix to this Circular when requested and upon completion of the project.
Article 7. Construction and implementation of production development support projects according to tasks
1. Construction and approval of projects
a) The agency or unit implementing the project shall construct and submit the project for approval by the Minister or Head of the central agency in accordance with point a, Clause 4, Article 23 of Decree No. 27/2022/NĐ-CP (amended and supplemented by Clause 14, Article 1 of Decree No. 38/2023/NĐ-CP).
b) The agency or unit implementing the project shall announce the plan to select entities to place orders, assign tasks, and select contractors to provide products and services for the project on media or on the electronic news website, publicly posting at the main office of the agency or unit regarding: basic contents of the project (project name, time, location, objectives, main activities, budget); requirements for the capacity of participating units to implement the project; registration deadline; address for receiving registrations or other relevant contents suitable for specific management requirements of each field (if necessary).
c) Organize the selection of entities to place orders, assign tasks, and select contractors to provide products and services for the project in accordance with the relevant laws on assigning tasks, placing orders, or tendering for public goods and services funded from the state budget using regular operating funds.
d) The agency or unit implementing the project shall issue a decision to assign tasks to the assigned party or sign a placement order contract with the accepting party or winning bidder to implement the project in accordance with regulations; guide, supervise, settle payments, and disburse funds in accordance with point d, Clause 4, Article 23 of Decree No. 27/2022/NĐ-CP (amended and supplemented by Clause 14, Article 1 of Decree No. 38/2023/NĐ-CP).
2. Implementation of projects
a) The entity assigned tasks or signing placement order contracts, winning bids to implement the project shall cooperate with the local authority where the project is implemented to notify the basic contents of the project approved by the competent authority to poor households, near-poor households, newly escaped poverty households, persons with disabilities (without stable livelihoods), and related participants in the project; organize the implementation of project activities and signed contracts.
b) The entity assigned tasks or signing placement order contracts, winning bids to implement the project shall compile and report the results of project implementation to the agency or unit implementing the project according to Model No. 02 Appendix (project proposal template and project implementation result report) attached to this Circular when requested and upon completion of the project.
Article 8. Construction and implementation of special production development support projects
1. The agency or unit implementing the project shall construct the project according to Model No. 01 Appendix attached to this Circular and submit it for approval by the Minister or Head of the central agency.
2. Based on the approved project, the agency or unit implementing the project shall cooperate with the local authority where the project is deployed to notify the basic contents of the project to poor households, near-poor households, newly escaped poverty households, persons with disabilities (without stable livelihoods), and related participants in the project.
3. The agency or unit implementing the project shall be responsible for organizing the implementation of the project in accordance with the specified target groups, objectives, and contents, ensuring progress and effectiveness.
4. The agency or unit implementing the project shall compile and report the results of organizing the implementation of the project to the approving agency according to Model No. 02 Appendix attached to this Circular when requested and upon completion of the project.
Section 3
DIVERSIFICATION OF LIVELIHOODS AND POVERTY REDUCTION MODELS IMPLEMENTED BY LOCAL AUTHORITIES
Article 9. Construction and organization of implementation of projects to support the development of production linked to value chains
1. Implement in accordance with the provisions of Article 21 of Decree No. 27/2022/NĐ-CP (amended and supplemented at Clause 12, Article 1 of Decree No. 38/2023/NĐ-CP).
2. The People's Committee of the province shall construct and submit to the People's Council of the province for decision the contents to implement the project to support the development of production linked to value chains as prescribed in Point d, Clause 1, Article 40 of Decree No. 27/2022/NĐ-CP (amended and supplemented at Clause 22, Article 1 of Decree No. 38/2023/NĐ-CP) or decide according to its authority the contents prescribed in Clause 3, Article 4 of Resolution No. 111/2024/QH15 dated January 18, 2024 of the National Assembly on certain special mechanisms and policies to implement national target programs (hereinafter referred to as Resolution No. 111/2024/QH15).
Article 10. Construction and organization of implementation of projects to support the development of community-based production
1. Implement in accordance with the provisions of Article 22 of Decree No. 27/2022/NĐ-CP (amended and supplemented at Clause 13, Article 1 of Decree No. 38/2023/NĐ-CP).
2. The People's Committee of the province shall construct and submit to the People's Council of the province for decision the contents to implement the project to support the development of community-based production as prescribed in Point d, Clause 1, Article 40 of Decree No. 27/2022/NĐ-CP (amended and supplemented at Clause 22, Article 1 of Decree No. 38/2023/NĐ-CP) or decide according to its authority the contents prescribed in Clause 3, Article 4 of Resolution No. 111/2024/QH15.
Article 11. Construction and organization of implementation of projects to support the development of production based on tasks
Implement in accordance with the provisions of Article 23 of Decree No. 27/2022/NĐ-CP (amended and supplemented at Clause 14, Article 1 of Decree No. 38/2023/NĐ-CP).
Chapter III
SUPPORT ACTIVITIES FOR LABORERS WORKING ABROAD UNDER CONTRACTS
Article 12. Objectives and principles of support
1. Support Objectives
Implement in accordance with the provisions of Point b, Clause 4, Section III of the Program.
2. Support Principles
a) Ensuring that the support targets and contents comply with the provisions of Point b, Clause 4, Section III of the Program and are consistent with the needs of the laborers.
b) Ensuring efficiency, transparency, democracy, and gender equality.
Article 13. Contents of Support
1. For laborers belonging to poor households, ethnic minority laborers residing in poor districts, particularly difficult communes in coastal areas, islands, and sea regions who wish to work abroad under contracts: the support contents shall be implemented in accordance with the provisions of Clause 1, Article 69 of Circular No. 55/2023/TT-BTC.
2. For laborers belonging to near-poor households, newly escaped from poverty households residing in poor districts, particularly difficult communes in coastal areas, islands, and sea regions who wish to work abroad under contracts: the support contents shall be implemented in accordance with the provisions of Clause 2, Article 69 of Circular No. 55/2023/TT-BTC.
3. For other laborers residing in poor districts, particularly difficult communes in coastal areas, islands, and sea regions who wish to work abroad under contracts: the support contents shall be implemented in accordance with the provisions of Clause 3, Article 69 of Circular No. 55/2023/TT-BTC.
4. For laborers working abroad under agreements signed between the Government of Vietnam and the receiving country's government: the support contents shall be implemented in accordance with the provisions of Clause 4, Article 69 of Circular No. 55/2023/TT-BTC.
5. For laborers and relatives of laborers residing in poor districts, particularly difficult communes in coastal areas, islands, and sea regions who are introduced and advised to work abroad under contracts.
6. For those directly introducing and advising laborers and relatives of laborers residing in poor districts, particularly difficult communes in coastal areas, islands, and sea regions to work abroad under contracts: the support contents shall be implemented in accordance with the provisions of Clause 5, Article 69 of Circular No. 55/2023/TT-BTC.
Article 14. Methods of Support
1. For activities supporting vocational training, skill enhancement, language training for workers eligible for support: implement through tendering, ordering, and assigning tasks.
2. In cases where workers eligible for support have completed vocational training, skill enhancement, language training, orientation education, and are waiting to depart: the Department of Labor, Invalids, and Social Affairs will directly support workers based on invoices or receipts for training fees, skill enhancement, health examinations, passports, visas, criminal records, and other relevant documents proving the worker's eligibility for support.
Businesses and units implementing these activities are responsible for providing workers with invoices or receipts as prescribed and assisting workers in paying related expenses.
3. For activities introducing and advising workers and relatives of workers residing in poor districts, extremely difficult communes in coastal areas, and islands to work abroad under contracts: the Department of Labor, Invalids, and Social Affairs shall implement according to Circular No. 55/2023/TT-BTC.
4. For activities supporting advanced foreign language training for workers going to work abroad under agreements signed between the Government of Vietnam and receiving countries' governments: the Ministry of Labor, Invalids, and Social Affairs shall implement through tendering, ordering, and assigning tasks.
Chapter IV
IMPLEMENTATION
Article 15. Implementation Organization
1. The Ministry of Labor, Invalids, and Social Affairs is responsible for:
a) Directing the implementation of this Circular.
b) Inspecting, supervising, compiling, and summarizing results of implementation as prescribed.
2. Ministries, agencies at ministerial level, and government agencies related to the implementation shall coordinate with the Ministry of Labor, Invalids, and Social Affairs:
a) Directing, guiding, and implementing diversified livelihood activities, poverty reduction models, and supporting workers to work abroad under contracts according to their functions and responsibilities.
b) Inspecting, supervising, compiling, reporting, and summarizing results of implementation as prescribed.
3. Provincial People's Committees are responsible for:
a) Directing, guiding, and implementing diversified livelihood activities, poverty reduction models, and supporting workers to work abroad under contracts according to their assigned functions and responsibilities.
b) Directing the Department of Labor, Invalids, and Social Affairs to take the lead in coordinating with relevant agencies to guide and implement this Circular within their jurisdiction.
Inspecting, supervising, interim summarizing, compiling, evaluating, and reporting periodically every six months and annually on the results of implementation of this Circular as prescribed.
c) Directing district and commune-level People's Committees to implement diversified livelihood activities, poverty reduction models, and supporting workers to work abroad under contracts within their jurisdictions; inspecting, supervising, interim summarizing, compiling, evaluating, and reporting periodically every six months and annually on the results of implementation as prescribed.
d) Inspecting, supervising, compiling, and reporting results of implementation within their jurisdictions as prescribed.
Article 16. Implementation Provisions
1. This Circular takes effect from June 5, 2024.
2. Circular No. 09/2022/TT-BLDTBXH dated May 25, 2022, issued by the Minister of Labor, Invalids, and Social Affairs guiding certain contents of implementing diversified livelihoods, developing poverty reduction models, and supporting workers to work abroad under contracts under the National Target Program on Sustainable Poverty Reduction for the period 2021-2025, and Circular No. 02/2023/TT-BLDTBXH dated April 12, 2023, issued by the Minister of Labor, Invalids, and Social Affairs amending and supplementing Clause 1 of Circular No. 09/2022/TT-BLDTBXH dated May 25, 2022, issued by the Minister of Labor, Invalids, and Social Affairs guiding certain contents of implementing diversified livelihoods, developing poverty reduction models, and supporting workers to work abroad under contracts under the National Target Program on Sustainable Poverty Reduction for the period 2021-2025 shall cease to be effective from the date this Circular takes effect.
3. For projects approved by competent authorities before the date this Circular takes effect, they shall continue to be implemented according to the approved decisions and relevant laws.
4. During the implementation process, if there are any difficulties or issues arising, please promptly report them to the Ministry of Labor, Invalids, and Social Affairs.
