Repealing certain provisions of Circular No. 34/2018/TT-BNNPTNT dated November 16, 2018 issued by the Minister of Agriculture and Rural Development amending and supplementing certain articles of Circular No. 33/2014/TT-BNNPTNT dated October 30, 2014 and Circular No. 20/2017/TT-BNNPTNT dated November 10, 2017 issued by the Minister of Agriculture and Rural Development

Pursuant to the Law on Legislative Regulatory Documents dated June 22, 2015; the Law Amending and Supplementing Certain Provisions of the Law on Legislative Regulatory Documents dated June 18, 2020;

Pursuant to the Fisheries Law dated November 21, 2017;

Pursuant to the Livestock Breeding Law on November 19, 2018;

Pursuant to Decree No. 105/2022/NĐ-CP dated December 22, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

At the proposal of the Director of the Plant Protection Department;

The Minister of Agriculture and Rural Development issues this Circular to repeal certain provisions of Circular No. 34/2018/TT-BNNPTNT dated November 16, 2018 issued by the Minister of Agriculture and Rural Development amending and supplementing certain articles of Circular No. 33/2014/TT-BNNPTNT dated October 30, 2014 and Circular No. 20/2017/TT-BNNPTNT dated November 10, 2017 issued by the Minister of Agriculture and Rural Development.

Article 1. Repeal certain provisions of Circular No. 34/2018/TT-BNNPTNT dated November 16, 2018 issued by the Minister of Agriculture and Rural Development amending and supplementing certain articles of Circular No. 33/2014/TT-BNNPTNT dated October 30, 2014 of the Minister of Agriculture and Rural Development regarding the procedures and formalities for plant quarantine for imported, exported, transited, and post-imported objects subject to plant quarantine, and Circular No. 20/2017/TT-BNNPTNT dated November 10, 2017 issued by the Minister of Agriculture and Rural Development guiding the implementation of Decree No. 39/2017/NĐ-CP dated April 4, 2017 of the Government on the management of livestock feed and aquaculture feed (hereinafter referred to as Circular No. 34/2018/TT-BNNPTNT).

1. Repeal Clause 3, Article 1 of Circular No. 33/2014/TT-BNNPTNT dated October 30, 2014 issued by the Minister of Agriculture and Rural Development regarding the procedures and formalities for plant quarantine for imported, exported, transited, and post-imported objects subject to plant quarantine (hereinafter referred to as Circular No. 33/2014/TT-BNNPTNT) amended and supplemented at Clause 1, Article 1 of Circular No. 34/2018/TT-BNNPTNT.

2. Repeal Article 7b, Appendix Ib of Circular No. 33/2014/TT-BNNPTNT added at Clause 3, Article 1 of Circular No. 34/2018/TT-BNNPTNT.

3. Repeal Article 18a, Article 18b of Circular No. 33/2014/TT-BNNPTNT added at Clause 4, Article 1 of Circular No. 34/2018/TT-BNNPTNT.

4. Repeal Article 2 of Circular No. 34/2018/TT-BNNPTNT.

Article 2. Implementation clause

1. This Circular takes effect from May 16, 2024.

2. Transitional Provisions

a) For plant quarantine registration files and state quality inspection files for imported livestock feed and aquaculture feed of plant origin submitted before the date this Circular takes effect, implement according to the provisions of Circular No. 34/2018/TT-BNNPTNT;

b) For applications for exemption or reduction of state quality inspection for imported livestock feed and aquaculture feed of plant origin submitted before the date this Circular takes effect, the Plant Protection Department shall continue to implement according to the relevant laws on livestock and aquaculture;

c) For imported livestock feed and aquaculture feed of plant origin that have been confirmed by the Plant Protection Department to be exempted or reduced from state quality inspection, they shall continue to be exempted or reduced from state quality inspection according to the period specified in the confirmation document./.
