This Decree stipulates the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development. This Decree takes effect from January 15, 2023, and replaces Decree No. 15/2017/NĐ-CP.

Regulations on functions, tasks, powersand the organizational structure of the Ministry of Agriculture and Rural Development

On the basis of Law on Government Organization dated June 19, 2015; Law Amending and Supplementing Certain Provisions of the Law on Government Organization and the Law on Local Administration dated November 22, 2019;
Pursuant to Decree No. 123/2016/NĐ-CP dated September 1, 2016 of the Government stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies; Decree No. 101/2020/NĐ-CP dated August 28, 2020 of the Government amending and supplementing certain articles of Decree No. 123/2016/NĐ-CP dated September 1, 2016 of the Government stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies;
At the proposal of the Minister of Agriculture and Rural Development;
The Government promulgates this Decree stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development.
Article 1. Position and Functions
The Ministry of Agriculture and Rural Development is an agency of the Government implementing state management over the following sectors and fields: agriculture, forestry, salt industry, fisheries, irrigation, disaster prevention and control, rural development; state management over public services in the sectors and fields under the Ministry's jurisdiction in accordance with the provisions of the law.
b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;
The Ministry of Agriculture and Rural Development performs the tasks and powers as prescribed in Decree No. 123/2016/NĐ-CP dated September 1, 2016 of the Government stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies, Decree No. 101/2020/NĐ-CP dated August 28, 2020 of the Government amending and supplementing certain articles of Decree No. 123/2016/NĐ-CP, and the specific tasks and powers set forth below:
1\. Submit to the Government draft laws, draft resolutions of the National Assembly; draft ordinances, draft resolutions of the Standing Committee of the National Assembly; draft decrees of the Government according to the annual legislative program of the Ministry that has been approved and other resolutions, mechanisms, policies, projects, programs, regulatory documents within the scope of state management of the Ministry as assigned by the Government and the Prime Minister.
2\. Submit to the Government and the Prime Minister strategies, plans, long-term, medium-term, and annual plans for development; and national programs, projects, and important works within the sectors and fields managed by the Ministry.
3. Submit to the Prime Minister draft decisions, directives, and other documents within the Prime Minister's authority to issue.
5\. Issue circulars, decisions, directives, national technical standards, procedures, norms, economic-technical quotas; organize the establishment of national standards on sector management within the scope of the Ministry’s state management in accordance with the law; guide, inspect the implementation of these documents.
6\. Announce, direct, guide, inspect, audit, evaluate, compile reports, and be responsible for implementing mechanisms, policies, strategies, plans, and programs within the scope of the Ministry’s state management; promote, disseminate, and educate the law on sectors and fields within the scope of the Ministry’s state management.
7\. Inspect regulatory documents issued by ministries, ministerial-level agencies, provincial People's Councils, municipal People's Councils directly under the central government regarding contents related to the sectors and fields under the Ministry’s state management; if discovering regulations issued by these agencies that appear to violate the regulatory documents within the sectors and fields managed by the Ministry, handle them according to the law.
8\. Regarding crop cultivation and plant protection
a\. Direct, guide, inspect the implementation of crop cultivation activities; develop crop planting areas, safe agricultural product production; plan the use, protection, and improvement of soil fertility; prevent erosion, desertification, and land collapse; establish a roadmap and guide the issuance of planting area codes nationwide in accordance with the law;
c\. Direct the implementation of crop structure; farming techniques, planting, harvesting, storage; summarize and evaluate the annual crop production plan; issue a plan to adjust the crop structure on rice-growing land nationwide;
b) Direct, guide the use of the budget for disease prevention and control programs in plants;
d\. Direct the inspection of the collection, storage, conservation, and exploitation of crop germplasm in accordance with the law;
đ\. Manage fertilizers in accordance with the law;
e\. Manage agricultural crop seeds, plant quarantine, plant protection, and plant protection chemicals in accordance with the law.
9\. Regarding animal husbandry and veterinary medicine
a\. Direct, guide, inspect the implementation of livestock development strategies; collect, conserve, exploit, and develop livestock germplasm; build and submit to the Government for approval a list of livestock breeds requiring conservation and export prohibition; define criteria and recognize disease-free livestock zones; direct, guide, organize the implementation of disease prevention, treatment, and control activities; inspect animals and animal products; supervise animal slaughter, preliminary processing, and processing of animal products; inspect veterinary hygiene; manage veterinary drugs; practice veterinary medicine;
d\. Direct, inspect scientific research and application of microorganisms used in veterinary medicine, chemicals used in veterinary medicine; research and produce veterinary vaccines, biological products used in veterinary medicine;
b) Direct, guide the use of the budget for national disease prevention and control programs in animals;
c) Direct the implementation of livestock structure; animal husbandry techniques; summarize and evaluate the implementation of the annual animal husbandry production plan;
đ\. Direct, guide, inspect, supervise the implementation of state management tasks regarding livestock breeds and livestock products, feed, breeding conditions, and livestock waste disposal; livestock and other animal husbandry, humane treatment of livestock;
e\. Implement state management tasks regarding animal husbandry and veterinary medicine in accordance with the law on animal husbandry and veterinary medicine.
a\. Direct, guide the implementation of policies and mechanisms for developing aquaculture in accordance with the law;
10. Regarding fisheries
b\. Build and submit to the Prime Minister for approval the plan for protecting and exploiting aquatic resources; decide to establish marine protected areas covering areas from two provinces or centrally-administered municipalities and above; plan the system of fishing ports and anchorage areas for fishing vessels at the national level; advise the Government to issue regulations on managing marine protected areas;
b) Establish and submit to the Prime Minister for approval the planning for the protection and exploitation of aquatic resources; decide on the establishment of marine conservation areas with an area spanning two or more centrally governed provinces or cities; plan the system of fishing ports and anchorage areas for typhoon shelters for national-level fishing vessels; advise on the submission to the Government for issuance of management regulations for marine conservation areas;
c) Direct, guide, and inspect the implementation of regulations on managing marine protected areas, managing endangered and precious aquatic species, fishery resource protection zones, and managing fishery resources within inland water conservation areas as prescribed by law;
d) Guide and inspect the implementation of legal provisions regarding fishing ports, anchorage and storm shelters for fishing vessels; management regulations concerning safety of fishing vessels, information to prevent natural disasters for fishermen and fishing vessels at sea; determine and allocate catch quotas and allowable harvest quantities by species in offshore areas for centrally governed cities and provinces as prescribed;
đ) Direct, guide, and inspect the implementation of aquaculture activities; environmental monitoring and warning systems in aquaculture; aquaculture procedures, techniques, and seasons; organize the preservation of original seed stocks and economically valuable indigenous aquatic species;
e) Guide and inspect the implementation of legal provisions regarding the list of endangered and precious aquatic species; species that need conservation and protection; measures to protect aquatic ecosystem environments, collection, storage, exploitation of aquatic genetic resources, conservation of gene pools, and biodiversity in the field of fisheries;
g) Carry out state management tasks related to fisheries inspection as prescribed by law;
h) Direct, guide, and inspect the implementation of state management tasks related to fish seed and feed; chemicals, biological preparations, and microorganisms used to treat and improve the environment in aquaculture; products for treating the aquaculture environment according to legal provisions;
i) Carry out state management tasks related to fisheries activities, fishery resources, technical infrastructure, and post-harvest services for the fishing industry;
11. Regarding salt production
a) Implement state management over the salt industry; develop policies, programs, projects, and plans for the development of salt production and trade;
b) Direct, guide, and inspect the technical procedures for salt production, harvesting, initial processing, processing, preservation, summary, and evaluation of annual salt production plans;
c) Issue and inspect the implementation of national technical standards and procedures for salt production, processing, and preservation, and salt products (excluding salt used in the medical field);
12. Regarding forestry
a) Direct, guide, and inspect the implementation of government and prime minister regulations on mechanisms and policies for forestry development; forest management rules; management and protection of endangered and precious forest plant and animal species and lists of such species; and the enforcement of international conventions on the trade of wild plants and animals in danger of extinction as prescribed by law;
Take the lead in coordinating with relevant ministries and agencies to manage special-use forests and protective forests; protect forest ecosystems, forest species, and forest ecosystems for aquaculture, biodiversity, and natural conservation in various types of forests as prescribed by law;
Submit to the Prime Minister for approval the national forestry planning; establish national-level protective forests and special-use forests of national importance or spanning multiple provinces. Advise the Government and the Prime Minister on transferring forest land use purposes to other purposes according to legal provisions;
b) Carry out state management tasks related to forest rangers as prescribed by law;
c) Direct, guide, and inspect the implementation of combined forestry, agriculture, and aquaculture production activities in forests as prescribed by law; take the lead in coordinating with relevant ministries and agencies to organize surveys, evaluations, collection, and preservation of unique or valuable microorganisms and fungi threatened with extinction to include them in the list of endangered and precious species requiring priority protection;
d) Direct the implementation of policies for paying for forest environmental services as prescribed by law;
đ) Direct the implementation of state management tasks related to forest management, forest protection, forest development, forest utilization; timber harvesting; organizing forestry production linked to timber processing and trade; establishing a national forest seedling system, national botanical gardens, prevention of forest pests, forestry crop seeds; organizing fire prevention and firefighting tasks; organizing specialized firefighting forces; managing activities for issuing sustainable forest certification and forest valuation as prescribed by law;
e) Guide and inspect the transfer, leasing, recovery, investigation, and inventory of forests; monitor changes in forests; establish and manage forest databases;
g) Take the lead in coordinating with relevant ministries and agencies to propose the signing of international treaties and agreements on forestry; serve as the focal point and national representative to implement the rights and obligations of member states under the Convention to Combat Desertification and other international treaties and agreements related to forestry;
13. Regarding irrigation
a) Carry out state management tasks related to the exploitation and protection of irrigation works as prescribed by law;
b) Direct, guide, and inspect basic investigations, strategies, planning, programs, projects, policies, and laws on irrigation, rural clean water, drainage, and flood control (excluding urban drainage and wastewater treatment, concentrated rural residential areas, and industrial zones); investment in construction, repair, and upgrading of irrigation works and rural clean water facilities; operation of irrigation reservoirs and irrigation works as prescribed by law;
c) Direct, guide, and inspect the establishment, approval, and implementation of irrigation planning serving agriculture and multi-purpose objectives linked to economic and social sectors as prescribed by law;
d) Approve irrigation planning, rural clean water supply planning involving two or more provinces; complex technical or large-scale irrigation works within a province serving water supply, drainage, drought prevention, saline intrusion prevention, land improvement, desertification control, and rural water supply and drainage as prescribed by law;
d) Direct, guide, inspect technical procedures, irrigation policies; manage irrigation and water management, manage hydraulic infrastructure assets, guide and inspect the implementation of regulations on discharging wastewater into hydraulic works;
e) Guide and inspect the establishment of plans for developing rural water supply networks and clean water supply systems in provincial planning as prescribed by law;
g) Direct, guide, and inspect the implementation of measures to prevent, combat, and mitigate the consequences of droughts, salinity intrusion, flooding, desertification; organize monitoring, forecasting, and warning about droughts, salinity intrusion, flooding, water quantity and quality within the hydraulic works system as prescribed by law;
h) Direct, guide, and inspect plans for protecting hydraulic works and their protection zones;
i) Direct, guide, and inspect the establishment of plans for constructing, managing, using, and protecting rural water supply and drainage facilities;
k) Organize the establishment and review of disaster prevention and control, and hydraulic works planning to submit to the Prime Minister for approval as prescribed by law; guide and inspect the implementation of such plans after they have been approved by competent authorities;
l) Direct, guide, and inspect basic investigations, strategies, planning for hydraulic works, organize inventory of water resources in hydraulic works combined with forecasting droughts, water shortages, salinity intrusion, desertification, floods, inundations, and flooding; invest in building hydraulic works to store, regulate, transfer, distribute, supply, irrigate, drain, and discharge water for agricultural production, salt production; combine water supply, drainage, and discharge for daily life and other economic sectors; prevent and reduce adverse impacts caused by natural disasters related to water and climate change, protect the environment, prevent water pollution, degradation, and depletion, adapt to climate change to ensure water security, dam safety, and reservoir safety under the Ministry's jurisdiction as prescribed by law;
m) Implement state management tasks regarding dam and reservoir safety as prescribed by law; perform tasks within the scope of the Ministry's state management as stipulated in the Law on Water Resources and other laws;
14. On disaster prevention and control
a) Direct, guide, and inspect the implementation of strategies, plans, programs, projects, policies, and laws on disaster prevention and control;
b) Direct, guide, and inspect the implementation of legal provisions on mechanisms, policies, human resources, materials, equipment, information systems, emergency supplies, and resources for disaster prevention and control;
c) Guide and inspect the establishment and implementation of disaster prevention and control plans and emergency response plans; inspect disaster prevention and control plans in localities', ministries', and sectors' socio-economic development plans and projects;
d) Direct, guide, supervise activities to restore and reconstruct after natural disasters according to laws and international treaties that Vietnam has joined; compile, evaluate, and publish statistics on losses caused by natural disasters; guide and inspect the implementation of monitoring and supervision of activities related to works and disaster prevention and control measures; monitor, analyze, and evaluate potential losses from natural disasters affecting Vietnam as prescribed by law;
đ) Organize information dissemination, education to enhance community awareness on disaster prevention and control; direct and guide the construction and improvement of the effectiveness of grassroots disaster prevention and control forces and people's dike management forces;
e) Implement state management tasks regarding planning for disaster-resilient residential areas and production organization; flood prevention planning for rivers with dikes; dike planning; investment plans for building, repairing, upgrading, reinforcing, protecting, and utilizing dikes and dike households as prescribed by law;
g) Manage investment in building, repairing, and protecting disaster prevention and control works including dikes, dams, flood prevention, drought prevention, landslide prevention works; typhoon shelters for ships and other works serving disaster prevention and control as prescribed by law;
h) Implement state management tasks regarding disaster prevention and control as prescribed in the Law on Dikes, the Law on Disaster Prevention and Control, the Law on Planning, the Law on Water Resources, and other laws;
15. On rural development
a) Direct and implement the national target program for new rural development and the action program to eliminate hunger in Vietnam as assigned by the Government;
b) Compile and submit to the Prime Minister for approval comprehensive plans and programs for rural development; strategies for developing rural industries and crafts linked to households and cooperatives; issue policies to encourage the development of rural industries and the preservation and development of craft villages;
c) Organize and inspect the implementation of programs, mechanisms, and policies for the development of agricultural machinery, rural industries, and crafts linked to households, cooperatives, and agricultural cooperative unions after approval by competent authorities; direct the establishment and implementation of programs, projects, and plans to support production organizations, develop craft villages, and rural industries as prescribed by law;
d) Chair guiding and inspecting the implementation of resettlement plans for residents affected by hydraulic and hydropower works; stabilize residents in disaster-prone, particularly difficult, border, island, coastal, and inland areas affected by rising sea levels due to climate change, free migration, and weakly protected forest areas; direct, guide, and inspect the implementation of permanent settlement and population arrangement work in rural areas, ethnic minority regions, and mountainous areas;
đ) Direct, guide, and inspect the organization of vocational training for rural laborers; procedures for confirming natural disasters and epidemics in implementing agricultural insurance support policies as prescribed by law;
e) Direct, guide, and inspect rural technical infrastructure construction programs according to specialized legal provisions;
16. On food safety for agriculture, forestry, fisheries, and salt
a) Direct, organize the implementation, guide, inspect, supervise the enforcement of laws on food safety concerning primary production of agricultural, forestry, aquatic products, and salt within the scope of management under the Ministry;
b) Direct, organize the implementation, guide, inspect, supervise the enforcement of laws on food safety during the production, collection, slaughtering, preliminary processing, processing, preservation, transportation, export, import, business of products, groups of products, foods, goods, and production and business establishments of food products according to the division of labor assigned by the Government;
c) Take the lead in managing food safety for production establishments producing multiple types of food products under the jurisdiction of two or more specialized management agencies but with the largest production volume under the jurisdiction of the Ministry;
d) Organize monitoring, risk assessment, warning, prevention, blocking, and remediation of food safety incidents concerning food products within the scope of management under the Ministry; inspect and supervise the enforcement of traceability, recall, and handling of unsafe food products within the scope of management under the Ministry;
đ) Issue, revoke confirmation of genetically modified organisms meeting conditions for use as food;
e) Designate food testing facilities serving state management, certification testing facilities; make final conclusions when there are differences in test results among testing facilities within the assigned management field;
g) Manage food safety for wholesale markets, agricultural product auctions;
h) Designate state inspection agencies for imported food safety concerning products within the assigned management field;
i) Announce national lists of countries and territories and lists of production and business establishments permitted to export to Vietnam within the assigned management field;
17. Regarding quality management for seeds, materials, livestock, poultry, animals, tools, equipment, products, services in agriculture, forestry, salt industry, aquaculture, and water conservancy works, dyke projects;
a) Implement and inspect the implementation of mechanisms, policies, strategies, plans, programs for the development and enhancement of product and commodity quality under the Ministry’s jurisdiction;
b) Enact a list of products and goods that have the potential to cause safety hazards (products and goods group 2) within the scope of the ministry's management.
c) Designate and manage the activities of organizations assessing product and good conformity within the scope of the ministry's management.
18. Regarding storage, processing, transportation of agricultural and forestry products, aquatic products;
a) Submit to competent authorities for issuance of mechanisms, policies, strategies, programs, projects on processing, storage, and transportation of agricultural and forestry products, aquatic products;
b) Direct, guide, inspect the implementation of strategies, projects, programs, mechanisms, policies for development of the processing sector linked to production and market; support reduction of post-harvest losses in industries under the Ministry's management;
c) Guide, inspect, supervise the implementation of regulations on conditions for establishments engaged in preliminary processing, processing, storage, and transportation of agricultural products under the Ministry's management;
d) Guide, evaluate, support improvement of processing capacity for agricultural and forestry products, aquatic products;
19. Regarding agricultural, forestry, aquatic product trade and salt;
a) Take the lead in implementing tasks of negotiating to promote opening up of agricultural product markets; removing technical barriers in export and import of agricultural products; developing cooperation and linkage in production and consumption of agricultural products according to the division of labor assigned by the Government and Prime Minister;
b) Coordinate with the Ministry of Industry and Trade to develop mechanisms, policies for promoting agricultural trade and market development; plans, programs for trade promotion; national brand programs for agricultural, forestry, aquatic products, and salt;
c) Take the lead in drafting, submitting to competent authorities for issuance and organizing implementation of programs, projects on trade promotion for agricultural and aquatic products, development of agricultural brands; implement activities related to market analysis, trade promotion, and programs related to national brands for agricultural, forestry, aquatic products, and salt within the Ministry's management scope;
d) Issue specific lists of goods prohibited from import, goods prohibited from export; lists of goods subject to specialized management of the Ministry upon export and import according to the provisions of the law;
đ) Coordinate with the Ministry of Industry and Trade to implement provisions of the law on trade defense measures (including anti-dumping, countervailing, and safeguard measures) concerning imported agricultural products from foreign countries; assist industry associations and enterprises when being investigated or subjected to trade defense measures by foreign countries against exported Vietnamese agricultural products;
e) Coordinate with the Ministry of Science and Technology to build and implement geographical indications for agricultural, forestry, and aquatic products within the Ministry's management scope;
20. Implement state management over organic agriculture; propose mechanisms, policies for developing circular agriculture, ecological agriculture;
21. Regarding investment and construction investment;
a) Direct, guide, inspect, supervise activities on investment, construction investment; construction activities in accordance with the provisions of the law;
b) Carry out state management tasks over construction investment and quality management of specialized works and fields under the Ministry's management scope according to the provisions of the law;
c) Review the contents of pre-feasibility study reports and feasibility study reports of programs, projects, plans within the scope of the ministry's management;
Approve investment orientation; decide on investment; approve design, budget estimate, final account, and manage bidding for programs and projects under the Ministry's authority according to the provisions of the law;
d) Guide, monitor, assess, inspect, audit programs and projects on investment and construction under the Ministry's decision-making authority according to the provisions of the law;
đ) Organize overall supervision and evaluation of investment; supervise and evaluate construction investment and specialized investment projects within the industry and field management scope of the Ministry according to the provisions of the law;
22. Regarding enterprises, cooperatives, and other forms of collective and private economy;
a) Submit to the Government for issuance of mechanisms, policies encouraging and supporting household economy, farms, cooperative groups, cooperatives, cooperative unions, and production linkage in industries and fields under the Ministry's management; coordinate with the Vietnam Union of Cooperatives, relevant ministries, and sectors to study and issue mechanisms, policies encouraging and supporting household economy, farms, cooperative groups, cooperatives under the Ministry's management;
b) Guide and inspect compliance with business and service regulations with conditions according to the list prescribed by the Government and handle violations within authority.
c) Carry out state management tasks over cooperative groups, cooperatives, cooperative unions, farms in industries and fields under the Ministry's management.
d) Perform the rights and responsibilities of the state-owned enterprise representative agency according to the division of labor by the Government and in accordance with the provisions of the Law on Management and Use of State Capital for Production and Business Investment, the Enterprise Law, and other relevant laws.
23. Manage the national reserve of crop seeds, plant protection chemicals, veterinary drugs, and other goods as assigned by the Government.
24. Regarding science and technology
a) Direct scientific and technological activities within the sectors and fields under the Ministry's management.
b) Direct the implementation of state management over plant variety rights in accordance with intellectual property laws; coordinate with the Ministry of Science and Technology in state management and protection of intellectual property rights.
c) Direct the implementation of state management tasks concerning high-tech and innovation activities in agriculture as prescribed by law.
d) Organize the implementation of state management tasks and basic and applied research and technology activities in crop production, plant protection, animal husbandry, veterinary medicine, fisheries, salt industry, irrigation, dyke management, forestry, agricultural environment, disaster prevention, response, and aftermath mitigation, rural development.
25. Regarding agricultural extension
a) Submit to competent authorities for issuance or issue within their authority mechanisms, policies, strategies, organization, and activities related to agricultural extension.
b) Guide and inspect the implementation of regulations concerning agricultural extension activities.
c) Develop plans and organize central-level agricultural extension activities; manage central-level agricultural extension funds in accordance with the law.
d) Submit to competent authorities for issuance or issue within their authority policies on socializing agricultural extension activities and cooperation policies with domestic and foreign organizations and individuals to attract capital and resources for agricultural extension activities.
đ) Implement state management tasks regarding agricultural extension activities as prescribed by law.
26. Regarding environmental protection, climate change, and biodiversity
a) Direct the implementation of state management over environmental protection for activities under the Ministry's jurisdiction as prescribed by law.
b) Direct the implementation of state management tasks concerning biodiversity and biosafety within the sectors and fields under the Ministry's jurisdiction as prescribed by law.
c) Direct and implement adaptation measures to climate change and rising sea levels within the Ministry's jurisdiction as assigned by the Government and the Prime Minister.
27. Direct, guide, and organize investment promotion activities in sectors and fields under the Ministry's jurisdiction.
28. Conduct technical safety inspections for machines, equipment, materials, and substances requiring strict labor safety standards in activities under the Ministry's jurisdiction as prescribed by law.
29. Implement international cooperation and economic integration in sectors and fields under the Ministry's jurisdiction as prescribed by law.
30. Decide and direct the implementation of the Ministry's administrative reform program according to the goals and content approved by the Prime Minister; propose or decide within their authority on the delegation of state management tasks to local authorities.
31. Regarding organizational management and public service activities
a) Perform state management tasks concerning public services and product provision in sectors and fields under the Ministry's jurisdiction as prescribed by law.
Submit to the Government for issuance of mechanisms and policies on public service provision; socialize public service activities within the sectors and fields under the Ministry's jurisdiction.
b) Submit to the Prime Minister for planning the network of public institutions and services; list of essential public services funded by the state budget within the sectors and fields under the Ministry's jurisdiction.
c) Issue economic and technical norms applicable in public service sectors managed by the state; regulations on tendering, ordering, and assigning public service tasks; quality criteria, supervision, evaluation, and inspection mechanisms for public service quality; effectiveness of public institution operations within the sectors and fields under the Ministry's jurisdiction.
d) Guide the implementation of policies and laws and support organizations in conducting public service activities within the sectors and fields under the Ministry's jurisdiction as prescribed by law.
32. Perform management tasks concerning associations and non-governmental organizations operating in sectors and fields under the Ministry's jurisdiction as prescribed by law.
33. Guide the functions, tasks, powers, job position catalogues, staffing norms of specialized agencies in agriculture and rural development under provincial People's Committees and district, town, and city People's Committees directly under the Central Government.
Perform management tasks concerning organizational structure, civil servant staffing, job positions, number of personnel; recruitment, training, development, management, utilization, salary systems, commendation, rewards, disciplinary actions, and other policies for cadres, civil servants, public officials, and workers under the Ministry's jurisdiction and within the Ministry's management scope as prescribed by law.
34. Conduct inspections, receive citizens' complaints, resolve grievances and accusations; prevent corruption, waste, and negative practices, and handle violations of law related to the sectors and fields as prescribed by law.
35. Implement digital transformation in agriculture as prescribed by the Government and the Prime Minister.
36. Perform management tasks concerning the development and application of information technology, remote sensing, and statistics within the Ministry's jurisdiction as prescribed by the Law on Information Technology, the Statistics Law, and other relevant laws.
37. Financial management, assets, and other resources assigned and organized to implement the allocated budget in accordance with the provisions of the law.
38. The National Standing Committee for disaster prevention and control; forest protection and development plans; new rural construction; desertification prevention; international trade management of endangered precious wild animals and plants; animal and poultry disease prevention; national notification and question-and-answer forum on sanitary and phytosanitary measures in Vietnam (Vietnam SPS); focal point for ASEAN cooperation on disaster management, international forums, and implementation of international treaties on disaster prevention and control as assigned by the Government and in accordance with the provisions of the law.
39. Perform other tasks and powers assigned by the Government or the Prime Minister, or as provided by the law.

Organizations specified from Clause 1 to Clause 21 are organizations assisting the Minister in performing state management functions; organizations specified from Clause 22 to Clause 28 of this Article are public service units serving the state management functions of the Ministry.
The Minister of Agriculture and Rural Development shall stipulate the functions, tasks, powers, and organizational structure of subordinate units; submit to the Prime Minister for issuance the list of other public service units directly under the Ministry.
Article 4. Effective date
1. This Decree takes effect from January 15, 2023.
2. This Decree replaces Decree No. 15/2017/NĐ-CP dated February 17, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development.
Article 5. Transitional Provisions
1. The Quality Control and Inspection Department for Agricultural and Aquatic Products, the Processing and Market Development Department for Agricultural Products, the Water Resources Administration, the Disaster Prevention and Control Administration, the Forestry Administration, the Fisheries Administration, the Agricultural Management Cadre Training College I, the Agricultural Management Cadre Training College II, the Information and Statistics Center, and the National Agricultural Extension Center continue their operations according to current regulations until the Decision stipulating the functions, tasks, powers, and organizational structure of the units specified in Clauses 15, 16, 17, 18, 19, 20, 21, 23, 24, 25, and 26 of Article 3 issued by the Minister of Agriculture and Rural Development becomes effective.
2. The Minister of Agriculture and Rural Development shall stipulate the functions, tasks, powers, and organizational structure of the Quality Control, Processing and Market Development Department ensuring the continuation of the responsibilities and powers of the Quality Control and Inspection Department for Agricultural and Aquatic Products and the Processing and Market Development Department for Agricultural Products; the Irrigation Department ensuring the continuation of the responsibilities and powers of the Water Resources Administration; the Dike Management and Disaster Prevention Department ensuring the continuation of the responsibilities and powers of the Disaster Prevention and Control Administration; the Fisheries Department and the Fishery Surveillance Department ensuring the continuation of the responsibilities and powers of the Fisheries Administration; the Forestry Department and the Forest Protection Department ensuring the continuation of the responsibilities and powers of the Forestry Administration in accordance with the law and international treaties to which the Socialist Republic of Vietnam is a member until competent authorities issue or amend relevant legal provisions.
3. Public service units directly under the Water Resources Administration, the Disaster Prevention and Control Administration, the Forestry Administration, and the Fisheries Administration continue their operations according to current regulations until reorganization decisions are made by competent authorities.
Article 6. Responsibility for Implementation
The Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairpersons of provincial and centrally governed city People's Committees are responsible for implementing this Decree.
