Regulations on Statistical Reporting System for the Planning and Investment Sector and Investment

Pursuant to the Statistics Law dated November 23, 2015; the Law Amending and Supplementing Certain Articles and the National Statistical Indicators Catalogue of the Statistics Law dated November 12, 2021;

Pursuant to Decree No. 9/2016/NĐ-CP dated July 1, 2016 of the Government detailing and guiding the implementation of certain provisions of the Statistics Law;4||| Pursuant to Decree No. 2016/NĐ-CP dated July 1, 2016 of the Government detailing and guiding the implementation of certain provisions of the Statistics Law;

Pursuant to Decree No. 94/2022/NĐ-CP dated November 7, 2022 of the Government stipulating the contents of statistical indicators belonging to the national statistical indicator system and the process of compiling gross domestic product indicators, gross regional domestic product indicators;

On the basis of Decree No. 62/2024/NĐ-CP dated June 7, 2024 of the Government amending and supplementing certain articles and appendices of Decree No. 94/2016/NĐ-CP dated July 1, 2016 of the Government detailing and guiding the implementation of certain provisions of the Statistics Law and Decree No. 94/2022/NĐ-CP dated November 7, 2022 of the Government stipulating the content of statistical indicators belonging to the national statistical indicator system and the compilation process for gross domestic product indicators, provincial gross domestic product indicators, and centrally governed city gross domestic product indicators;

Pursuant to the Decree No. 85/2017/NĐ-CP dated July 19, 2017 of the Government stipulating the structure, tasks, and powers of centralized statistical organizations and statistical organizations under ministries and ministerial-level agencies;

On the basis of Pursuant to Decree No. 89/2022/NĐ-CP dated October 28, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Planning and Investment;;

At the proposal of The General Statistics Office Director;

The Minister of Planning and Investment issues this Circular to regulate the statistical reporting system for the Planning and Investment sector.and Investment.

Article 1. Scope of Regulation

This Circular regulates the statistical reporting system for the Planning and Investment sector to collect statistical information within the statistical indicator system of the Planning and Investment sector.

Article 2. Applicability

1. Units under the Ministry of Planning and Investment.

2. Provincial Departments of Planning and Investment; Industrial Park Management Boards, Economic Zone Management Boards of provinces and centrally governed cities and agencies, organizations assigned public investment plans.

3. Other organizations and individuals involved in managing, implementing, or related to the statistical reporting of the Planning and Investment sector.

Article 3. Contents of the Statistical Reporting System for the Planning and Investment Sector

The contents of the statistical reporting system for the Planning and Investment sector include the purpose, scope of statistics, applicable subjects, reporting units, receiving units, table symbols, reporting periods, deadlines for receiving reports, methods of submitting reports, and the list of report forms attached with explanations of statistical report forms.

1. Objective

To meet the requirements for collecting information to compile statistical indicators in the fields of investment, industrial park management, economic zone management, business registration, small and medium enterprise development, collective economy, cooperative society as prescribed in the statistical indicator system of the Planning and Investment sector.

2. Scope of Statistics

Data reported in the system of report forms cover the entire country.

3. Applicable Subjects

The applicable subjects are as prescribed in Article 2 of this Circular.

4. Reporting Units

Specifically provided in the upper right corner of each statistical report form issued together with this Circular.

5. Receiving Units

The receiving unit is the Information Technology and Digital Transformation Center specifically noted in the upper right corner of each statistical form, below the reporting unit.

6. Main Reporting Units

The main reporting units are state management units responsible for the fields of reporting as stipulated in this Circular, including: The Business Registration Management Department, The Small and Medium Enterprise Development Department, The Cooperative Economy Department, The Foreign Investment Department, The National Economy Synthesis Department, The Foreign Economy Department, The Economic Zone Management Department, The Industry and Service Department.

7. Table Symbols consist of three parts separated by a period (.):

a) The first part consists of digits or digits and letters, wherein:

Table symbols consist of two digits (01, 02, 03) representing the form number code.

Table symbols consist of two digits followed by a lowercase letter (a, b, c,...) indicating multiple statistical forms used to collect information for a single statistical indicator.

b) The second part consists of uppercase letters: Indicating the reporting period (T - month; N - year; H - month, quarter, year).

c) The third part consists of uppercase letters: Abbreviations of the reporting unit (National Economy Synthesis Department - THKTQD; Business Registration Management Department - QLĐKKD,...).

8. Reporting Period

The statistical reporting period is a specific time frame prescribed for the reporting subject to reflect the results of activities in numerical data according to the criteria in the statistical report form. The reporting period is recorded in the middle section of each statistical form (after the name of the report form). The statistical reporting period is calculated based on the Gregorian calendar and is specified in each statistical report form, including:

a) Monthly statistical report.

b) Quarterly statistical report.

c) Semi-annual statistical report.

d) Annual statistical report.

đ) Special report: Statistical report in cases where unexpected events occur or when there is a need to serve the operational work of the Ministry of Planning and Investment.

e) Other statistical reports: Statistical reports with specific reporting periods and deadlines noted in each report form.

9. Deadline for Receiving Reports

The deadline for receiving reports is the specific date noted in each statistical report form issued together with this Circular.

10. Methods of Submitting Reports

a) Direct submission and receipt of reports through the Planning and Investment Sector Statistical Information System, authenticated by accounts provided to representatives of reporting agencies and units. Report forms will be compiled and printed directly from the System.

b) In cases where the Planning and Investment Sector Statistical Information System is not operational or experiencing data transmission issues, the reporting unit submits the report via the email address [email protected]. Reports submitted via email are presented in one of two formats: A scanned color copy of the paper form signed by the Head and stamped by the reporting agency or unit, or an electronic file authenticated by the digital signature of the Head of the reporting agency or unit.

c) For contents that must be managed under the confidentiality regime of the Ministry of Defense, the Ministry of Public Security, the Ho Chi Minh Mausoleum Management Board, and other relevant agencies and units, they shall submit reports in accordance with the regulations on protecting state secrets and the reporting periods prescribed in this Circular to the Ministry of Planning and Investment.

11. List of Report Forms and Explanations of Statistical Report Forms

The list of reporting forms, forms, and explanations of the forms for indicators on investment; economic zone management, industrial park management; business registration; small and medium enterprise development; collective economy, cooperative society as prescribed in the Appendices issued together with this Circular includes:

a) Appendix I: Reporting form on investment;

b) Appendix II: Reporting form on economic zone and industrial park management;

c) Appendix III: Reporting form on business registration;

d) Appendix IV: Reporting form on small and medium enterprise development;

đ) Appendix V: Reporting form on collective economy and cooperative society;

e) Appendix VI: List of statistical indicators for monitoring and evaluating investment;

g) Appendix VII: List of statistical indicators for tender management;

h) Appendix VIII: List of statistical indicators for foreign direct investment attraction.

Article 4. Content of statistical reports on indicators for monitoring and evaluating investment, tender management, and attracting foreign direct investment

1. The content of the report and the reporting form for statistical indicators on monitoring and evaluating investment shall be implemented in accordance with the provisions of Government Decree No. 29/2021/NĐ-CP dated March 26, 2021, stipulating procedures and formalities for assessing national key projects and monitoring and evaluating investment; Circular No. 05/2023/TT-BKHĐT dated June 30, 2023, issued by the Minister of Planning and Investment, stipulating sample reporting forms for monitoring and evaluating investment; online reporting system and management operation of the information system on monitoring and evaluating investment programs and projects using state capital.

2. The content of the report and the reporting form for statistical indicators on tender management shall be implemented in accordance with the provisions of Circular No. 07/2024/TT-BKHĐT dated April 26, 2024, issued by the Minister of Planning and Investment, detailing sample tender request documents, evaluation reports, review reports, inspection reports, and implementation situation reports of tender activities.

3. The content of the report and the reporting form for statistical indicators on the situation of attracting foreign direct investment in provinces and centrally-administered cities shall be implemented in accordance with the provisions of Circular No. 03/2021/TT-BKHĐT dated April 9, 2021, issued by the Minister of Planning and Investment, stipulating sample documents and reports related to investment activities in Vietnam, investment from Vietnam abroad, and investment promotion, and Circular No. 25/2023/TT-BKHĐT amending and supplementing some articles of Circular No. 03/2021/TT-BKHĐT dated April 9, 2021, issued by the Ministry of Planning and Investment, stipulating sample documents and reports related to investment activities in Vietnam, investment from Vietnam abroad, and investment promotion.

4. Method of submitting reports

a) In cases where online reporting has been implemented on specialized information systems: Integrate and share the reported data from specialized information systems to the information system for statistics in the Planning and Investment sector.

b) In cases where online reporting has not been implemented on specialized information systems: Directly submit and receive reports on the information system for statistics in the Planning and Investment sector.

c) The main reporting units include: Department of Investment Monitoring and Appraisal, Tender Management Department, Foreign Investment Department.

Article 5. Responsibilities for Implementation

1. The Center for Information Technology and Digital Transformation under the Ministry of Planning and Investment shall be responsible for:

a) Taking the lead and coordinating with relevant agencies and units to build, upgrade, manage, operate, exploit, and guide the use of the information system for statistics in the Planning and Investment sector; digitizing reporting forms; implementing the assignment of reports to main reporting units through the system; granting access rights to the system;

b) Coordinating with main reporting units to monitor and inspect the implementation of the online reporting system for statistics in the Planning and Investment sector as stipulated in this Circular and relevant laws;

c) Taking the lead and coordinating with relevant units to implement integration, connection, and sharing of data and figures between the information system for statistics in the Planning and Investment sector and other information systems and databases.

2. Reporting units shall be responsible for:

a) Collecting, compiling, and preparing data for the statistical indicators assigned;

b) Fully and accurately complying with the reporting form regarding the content, time, and period of the report; being responsible for the accuracy of the reported information and figures and providing explanations when required;

c) Cooperating closely and following guidance on professional statistical operations from the General Statistics Office, local Statistical Departments, and relevant units of the Ministry of Planning and Investment;

d) When there are modifications to previously reported figures or unusual fluctuations in figures during the reporting period, the reporting unit must send an explanatory report through the information system for statistics in the Planning and Investment sector to the receiving unit.

3. Relevant units under the Ministry of Planning and Investment shall be responsible for:

a) Main reporting units:

Taking the lead and coordinating with the Center for Information Technology and Digital Transformation to monitor and inspect the implementation of reporting regulations, guiding reporting units when encountering difficulties with reporting regulations for assigned indicators; taking the lead in compiling and preparing data for statistical indicators within their assigned fields; being responsible for the accuracy of the compilation and preparation of aggregated information and figures; having the responsibility to explain aggregated information and figures and reported indicators upon request from relevant authorities; sending aggregated data for indicators under their responsibility to the Department of National Economic Synthesis for reporting when requested;

b) Coordinating with the Center for Information Technology and Digital Transformation to organize the implementation of integration, connection, and sharing of data and figures of statistical indicators within their assigned fields into the information system for statistics in the Planning and Investment sector.

4. The Department of National Economic Synthesis under the Ministry of Planning and Investment shall be responsible for:

a) Compiling reports on statistical indicators in the Planning and Investment sector according to management requirements, directives, and operational instructions from the Government.

a) Compile reports on statistical indicators of the Planning and Investment sector according to management requirements, directives, and operational guidance of the Government,

b) Chair and coordinate with relevant units to advise on adjusting and supplementing the reporting system for the industry of Planning and Investment statistics during implementation, according to the management and operation requirements of the Ministry of Planning and Investment;

c) Chair and monitor the implementation of the online reporting system for aggregated indicators of the industry of Planning and Investment as stipulated in this Circular and related laws. Chair and coordinate with relevant units to organize the summary of the implementation of the reporting system for the industry of Planning and Investment.

5. The General Statistics Office, Provincial/City-level Statistics Offices shall be responsible for closely coordinating with focal units, participating in guiding and supporting agencies and organizations in implementing the reporting system for the industry of Planning and Investment regarding professional statistical methods in collecting and aggregating industry statistical indicators as stipulated in this Circular.

Article 6. Funding for Implementation

1. The budget for implementing the reporting system for the industry of Planning and Investment shall be allocated from the regular operating expenses of state administrative agencies at the ministry, sectoral, and local levels according to the regulations on the state budget.

2. The budget for other organizations and individuals to implement their reporting systems shall be self-funded by those organizations and individuals.

3. The investment and maintenance costs for information technology infrastructure and the Statistical Information System of the industry of Planning and Investment shall be implemented in accordance with the regulations on the state budget, public investment, and other related laws.

Article 7. Effective Date

1. This Circular takes effect from April 1, 2025, and replaces Circular No. 19/2022/TT-BKHĐT dated August 10, 2022, issued by the Minister of Planning and Investment, which stipulates the Reporting System for the Industry of Planning and Investment and Statistics.

2. In cases where referenced documents in this Circular are amended, supplemented, or replaced, they shall be implemented according to the new regulations.

3. During implementation, if there are any difficulties, please submit comments to the Ministry of Planning and Investment for timely guidance, research, and resolution./.
