Regulations on the retention period for files and documents
Ministry of Culture, Sports and Tourism
On the basis of Law on Archives dated June 21, 2024;
Pursuant toDecree No. 43/2025/NĐ-CP dated February 28, 2025 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports and Tourism;
At the proposal of the Director of the Office of the Ministry of Culture, Sports and Tourism;
The Minister of Culture, Sports and Tourism issues this Circular to prescribe the retention period for archives and documents of the cultural, sports, and tourism sector. This Circular prescribes the retention period for archives and documents of the cultural, sports, and tourism sector.
Article 1. Scope of Regulation
This Circular applies to agencies, units under the Ministry of Culture, Sports and Tourism; Departments of Culture, Sports and Tourism; Departments of Culture and Sports; Tourism Departments of provinces and centrally governed cities; and other relevant agencies, organizations, and individuals.
Article 2. Applicability
1. The retention period for archives and documents of the cultural, sports, and tourism sector is prescribed in the Appendix attached to this Circular.
Article 3. Retention Period for Records and Documents
2. The implementation of the provisions on the retention period for archives and documents in the Appendix attached to this Circular shall be carried out as follows:
a) The retention period is used to determine the retention period for archives and documents of the cultural, sports, and tourism sector.
b) The level of determination of the retention period must not be lower than the retention period specified in the Appendix attached to this Circular.
c) For archives and documents formed in the activities of agencies, organizations, and individuals not specified in the Appendix attached to this Circular, the agencies, organizations, and individuals shall apply the retention period equivalent to the group of archives and documents corresponding in the Appendix attached to this Circular and other relevant laws to determine.

The Director of the Office of the Ministry of Culture, Sports and Tourism, Heads of agencies and units under the Ministry of Culture, Sports and Tourism; Directors of Departments of Culture, Sports and Tourism; Culture and Sports; Tourism of provinces and centrally governed cities; and relevant agencies, organizations, and individuals are responsible for implementing this Circular.
Article 4. Implementation provisions
This Circular takes effect from July 1, 2025.
State-owned enterprises that have been assigned by the Ministry of Agriculture and Rural Development to conduct offshore wind power project surveys before the effective date of this Circular shall continue to implement according to the assigned documents; any new matters arising after the effective date of this Circular shall be implemented in accordance with the provisions of this Circular.
2. In the course of implementation, if there are any difficulties, agencies, organizations, units, and individuals are requested to report to the Ministry of Culture, Sports and Tourism (through the Ministry's Office) for consideration and resolution./.
