Guidelines on the functions, tasks, and authorities of the Provincial Inspectorate,
municipal inspectorate under central-level municipalities

Pursuant to Decree No. 109/2025/NĐ-CP dated May 20, 2025 of the Government stipulating the functions, tasks, powers, and organizational structure of the Government Inspector General;
Pursuant to Decree No. 141/2025/NĐ-CP dated June 12, 2025 of the Government stipulating the division of authority between two levels of local administration in the field of state management by the Government Inspectorate;
Pursuant to Decree No. 150/2025/NĐ-CP dated June 12, 2025 of the Government stipulating the organization of specialized agencies under provincial People's Committees, municipal People's Committees under central-level municipalities, and commune-level People's Committees, ward-level People's Committees, and special zone-level People's Committees under provincial and municipal People's Committees under central-level municipalities;

The General Inspectorate of the Government issues this Circular guiding the functions, tasks, and authorities of the Provincial Inspectorate and municipal inspectorate under central-level municipalities.
Article 1. Scope of Regulation and Applicability
This Circular guides the functions, tasks, and authorities of the Provincial Inspectorate and municipal inspectorate under central-level municipalities (hereinafter referred to as the Provincial Inspectorate) in the fields of inspection, citizen reception, complaint resolution, denunciation handling, and anti-corruption, anti-waste, and anti-neglect.
Article 2. Position
1. The Provincial Inspectorate is a specialized agency under the provincial People's Committee, municipal People's Committee under central-level municipalities (hereinafter referred to as the provincial-level People's Committee) with legal personality, its own seal and separate account; it is subject to the direction and management of the Chairman of the provincial-level People's Committee and the guidance, supervision, and professional instruction of the Government Inspectorate.
2. The Provincial Inspectorate has a Chief Inspector, Deputy Chief Inspectors, Inspectors, and other civil servants.
The Chief Inspector of the Provincial Inspectorate is the head of the Provincial Inspectorate, accountable to the provincial-level People's Committee, the Chairman of the provincial-level People's Committee, and the law for the performance of the Provincial Inspectorate's functions, tasks, and authorities, as well as for the implementation of tasks and authorities according to the working regulations and assignments of the provincial-level People's Committee.
Article 3. Functions
The Provincial Inspectorate assists the provincial-level People's Committee in state management over inspection work, citizen reception, complaint resolution, denunciation handling, and anti-corruption, anti-waste, and anti-neglect; implements inspection tasks within the scope of the provincial-level People's Committee's state management; implements citizen reception, complaint resolution, denunciation handling, and anti-corruption, anti-waste, and anti-neglect tasks as prescribed by law.
Article 4. Common Tasks and Authorities
1. Drafting directives, programs, and plans for organizing the implementation of inspection, citizen reception, complaint resolution, denunciation handling, and anti-corruption, anti-waste, and anti-neglect tasks for submission to the provincial-level People's Committee; drafting other documents when assigned.
2. Drafting documents on inspection, citizen reception, complaint resolution, denunciation handling, and anti-corruption, anti-neglect for submission to the Chairman of the provincial-level People's Committee when assigned, within his/her authority to issue such documents.
3. Implementing legal regulatory documents, programs, plans, and other documents on inspection, citizen reception, complaint resolution, denunciation handling, anti-corruption, anti-waste, and anti-neglect; promoting, disseminating, and educating the public about laws on inspection, citizen reception, complaint resolution, denunciation handling, and anti-corruption, anti-neglect.
4. Guiding, supervising, and urging the Chairmen of commune-level People's Committees, ward-level People's Committees, and special zone-level People's Committees (hereinafter referred to as the commune-level People's Committee Chairmen), heads of specialized agencies, administrative organizations, and public service units under the provincial-level People's Committee in implementing laws on citizen reception, complaint resolution, denunciation handling, and anti-corruption, anti-neglect.
5. During the implementation of inspection, citizen reception, complaint resolution, denunciation handling, and anti-corruption, anti-waste, and anti-neglect tasks, exercising the authorities of the Provincial Inspectorate as prescribed by law; requesting relevant agencies and units to assign personnel to participate in inspection teams, complaint and denunciation resolution teams (or groups).
6. Cooperating with the Department of Home Affairs to submit to the provincial-level People's Committee decisions regarding the organizational structure of the Provincial Inspectorate to ensure that there are sufficient specialized and professional departments to fully perform inspection, supervision, evaluation, monitoring, urging, post-inspection processing, citizen reception, complaint resolution, denunciation handling, and anti-corruption, anti-waste, and anti-neglect tasks within the jurisdiction and sectors as prescribed by law.
7. Defining the functions, tasks, and authorities of departments under the Provincial Inspectorate; managing staffing, civil servants, implementing salary policies, incentives, rewards, and disciplinary measures for civil servants under the Provincial Inspectorate's jurisdiction as prescribed by law and delegated by the provincial-level People's Committee.
8. Organizing professional training for Provincial Inspectorate civil servants; implementing professional training on citizen reception, document handling, complaint resolution, denunciation handling, and anti-corruption, anti-neglect for cadres and civil servants in the province upon assignment by the Chairman of the provincial-level People's Committee.
9. Organizing research, promoting the application of science and technology, digital transformation; building databases to serve state management and professional tasks assigned.
10. Requesting reports on citizen reception, complaint resolution, denunciation handling, and anti-corruption, anti-neglect from the commune-level People's Committees, agencies, organizations, and units under the provincial-level People's Committee.
11. Organizing mid-term reviews, summaries, and lessons learned from inspection, citizen reception, complaint resolution, denunciation handling, and anti-corruption, anti-waste, and anti-neglect activities; implementing information collection, synthesis, and reporting on inspection results, complaint resolution, denunciation handling, and anti-corruption, anti-waste, and anti-neglect as prescribed by law.
12. Implementing international cooperation in the fields of inspection, citizen reception, complaint resolution, denunciation handling, and anti-corruption as prescribed by law and assigned or authorized by the provincial-level People's Committee and the Government Inspectorate.
13. Managing and using allocated financial resources and assets in accordance with the law and delegated by the provincial-level People's Committee.
14. Performing other tasks assigned by the provincial-level People's Committee and as prescribed by law.
Article 5. Tasks and Authorities in the Field of Inspection
1. Drafting the inspection plan proposal, submitting it to the Chairman of the Provincial People's Committee for consideration and comments; issuing the inspection plan, sending it to the Chairman of the Provincial People's Committee, the Government Inspectorate, the State Audit Agency, relevant agencies and organizations, and notifying the inspected entities; organizing the implementation of the inspection plan.
2. Inspecting the implementation of policies, laws, tasks, and authorities of agencies, organizations, and units under the Provincial People's Committee; the People's Committee of the commune level; units and individuals under specialized agencies under the Provincial People's Committee and the People's Committee of the commune level; inspecting compliance with laws in fields within the scope of management of specialized agencies under the Provincial People's Committee; inspecting the management and use of state capital and assets at enterprises where the Provincial People's Committee represents the owner, except when the Government Inspectorate conducts inspections.
3. Inspecting cases within its jurisdiction upon discovering signs of law violations; inspecting other cases when assigned by the Chairman of the Provincial People's Committee.
4. Monitoring, urging, and inspecting the implementation of conclusions and recommendations of the Provincial Inspectorate, decisions on handling inspections by the Chairman of the Provincial People's Committee, and the Chief Inspector of the Province; proposing heads of agencies and units under the Provincial People's Committee, and Chairmen of the People's Committee of the commune level to consider, rectify, and address deficiencies discovered through inspections.
5. Recommending competent authorities to amend, supplement, or issue regulations in accordance with management requirements; recommending suspension, cancellation, or abolition of unlawful provisions discovered through inspections; recommending the Chairman of the Provincial People's Committee to resolve issues related to inspection work.
Article 6. Tasks and Authorities in the Field of Receiving Citizens, Handling Complaints and Petitions
1. Guiding the People's Committee of the commune level and agencies, organizations, and units under the Provincial People's Committee in receiving citizens, processing petitions, and resolving complaints and petitions.
2. Inspecting the responsibility of implementing laws on receiving citizens, handling complaints, and petitions by the People's Committee of the commune level, agencies, organizations, and units under the Provincial People's Committee; recommending measures to effectively implement citizen reception, complaint, and petition resolution work within the scope of management of the Chairman of the Provincial People's Committee as prescribed by law.
3. Verifying, reporting verification results, and recommending measures to resolve complaints and petitions within the jurisdiction of the Chairman of the Provincial People's Committee when assigned.
4. Monitoring, urging, and inspecting agencies under the management of the Chairman of the Provincial People's Committee in handling complaints; recommending the Chairman of the Provincial People's Committee or recommending competent authorities to apply necessary measures to stop violations, consider responsibilities, and handle those who violate laws on complaints.
5. Reviewing the resolution of petitions that have been resolved by the Chairman of the Commune People's Committee, heads of specialized agencies under the Provincial People's Committee and equivalent bodies but show signs of law violations; if there is evidence indicating that the resolution of petitions violates the law, recommending the Chairman of the Provincial People's Committee to review and resolve again according to regulations.
6. Monitoring, urging, and inspecting the implementation of decisions on resolving complaints, conclusions on petition contents, and decisions on handling petitions by the Chairman of the Provincial People's Committee when assigned.
7. Receiving and processing petitions; resolving complaints and petitions within its jurisdiction as prescribed by law.
Article 7. Tasks and Authorities in the Field of Preventing and Combating Corruption, Waste, and Negligence
1. Inspect the implementation of legal provisions on preventing and combating corruption, waste, and negligence by People's Committees at the commune level and agencies, organizations, and units under the People's Committee at the provincial level.
2. Coordinate with the State Audit Agency, Investigative Agencies, People's Procuracy, and People's Courts in the prevention, detection, prevention, and handling of corruption, waste, and negligence.
3. Inspect cases involving signs of corruption carried out by personnel working at agencies, organizations, units, and state-owned enterprises under the management authority of local authorities, except for cases within the jurisdiction of the Government Inspectorate.
4. Monitor assets and income of individuals required to declare their work at agencies, organizations, units, and state-owned enterprises under the management authority of local authorities in accordance with regulations.
5. Inspect the implementation of laws on preventing and combating corruption against public companies, credit institutions, and social organizations in accordance with the law on preventing and combating corruption.
6. Conduct internal inspections and supervision to prevent acts of corruption, waste, and negligence in the activities of the Provincial Inspectorate.
Article 8. Effective Date
1. This Circular takes effect from the date of signature.
2. This Circular replaces Circular No. 02/2023/TT-TTCP dated December 22, 2023, issued by the Government Inspectorate guiding the functions, tasks, authorities, and organization of the Provincial Inspectorate, city-level inspectorates directly under the central government; county, district, town, and city-level inspectorates under provinces and cities directly under the central government.
Article 9. Responsibility for implementation
1. The People's Committee at the provincial level and the Chairman of the People's Committee at the provincial level are responsible for directing and organizing the implementation of this Circular.
2. During the implementation process, if there are difficulties or need for amendments and supplements, the People's Committee at the provincial level and relevant agencies, organizations, and individuals shall promptly report to the Government Inspectorate for consideration and resolution within its jurisdiction./.
