DECREE
REGULATIONS ON THE SELECTION AND RECRUITMENT SYSTEM FOR ENROLLMENT IN HIGHER EDUCATION, COLLEGE, AND VOCATIONAL SCHOOLS UNDER THE NATIONAL EDUCATION SYSTEM
Decree No. 134/2006/ND-CP dated November 14, 2006, of the Government stipulates the selection and recruitment system for enrollment in higher education, college, and vocational schools under the national education system, which took effect from December 9, 2006, amended and supplemented by:
Decree No. 49/2015/ND-CP dated May 15, 2015, of the Government amending and supplementing certain articles of Decree No. 134/2006/ND-CP dated November 14, 2006, of the Government stipulating the selection and recruitment system for enrollment in higher education, college, and vocational schools under the national education system, which took effect from July 6, 2015
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the Education Law dated June 14, 2005;
Considering the proposal of the Minister of Education and Training1,
DECREE:
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Decree stipulates the objects, criteria for enjoying the selection and recruitment system, the organization and implementation of the selection and recruitment system, the reimbursement of scholarships and training costs for those selected to enroll in higher education, college, and vocational schools2.
Article 2. Selection and Recruitment System
1.3 Selection and recruitment is the process of enrolling students into higher education, college, and vocational schools without examination to train cadres and civil servants according to job requirements, positions, and staffing quotas; to train public service employees according to job needs, position standards, occupational qualifications, and salary funds of public institutions in areas with special difficulties in economic and social conditions and ethnic minorities who have few or no cadres with higher education, college, or vocational school qualifications.u2. The selection and recruitment system prescribed in this Decree includes: admission; organization and funding for training; employment placement upon graduation; reimbursement of scholarships and training costs for those selected to study under the selection and recruitment system who do not comply with employment placement upon graduation.
Article 3. Principles of Selection and Recruitment4 Implementing the selection and recruitment system must ensure the following principles:5.
Accurate purpose, object, and criteria as prescribed.
Objectivity, fairness, transparency, and clarity.
1. The agency selecting individuals for study under the selection and recruitment system has the responsibility to accept and place them in positions upon graduation.
2. Article 4. Rights and Obligations of Students Studying Under the Selection and Recruitment System
3. Students studying under the selection and recruitment system have the following rights:6 To be fully informed about the selection and recruitment system;
To receive scholarships, tuition waivers, and other preferential benefits as prescribed by current state regulations during the training period;
1. To be accepted and placed in positions upon graduation.
a) Students studying under the selection and recruitment system have the following obligations:
b) To commit before being selected and to comply with their commitments to the sending agency regarding employment placement upon graduation;
c) To comply with laws and internal regulations of educational institutions; to complete the assigned training program by the sending agency;7 To reimburse scholarships and training costs at the level prescribed in Article 13 of this Decree if they fall within any of the cases prescribed in Article 12 of this Decree.
2. OBJECTS, CRITERIA, SELECTION PROCEDURES, ORGANIZATION, AND TRAINING COSTS
a) Commitment before being selected for dispatch and compliance with the commitment to the dispatching agency for studyon the selection for employment positions8 after graduation;
b) Comply with laws and internal regulations of educational institutions; complete the training program according to the assigned field of study by the dispatching agency;
c) Must reimburse scholarship and training costs at the level prescribed in Article 13 of this Decreepoliciesif they fall under any of the cases stipulated in Article 12 of this Decree.
Chapter II
OBJECTS, CRITERIA, SELECTION ORGANIZATION, TRAINING ORGANIZATION AND TRAINING COSTS
Article 5. Recipients and Quotas for Selection
1. Recipients for Selection
a)9 Vietnamese citizens who have continuously resided for five years or more up to the year of enrollment in areas with particularly difficult socio-economic conditions and have completed three years of high school education at schools located in that locality (students from boarding schools for ethnic minorities, students from classes aimed at providing sources counted according to their permanent residence registration) shall be selected for admission to universities, colleges, or secondary vocational schools; those who have completed four years of junior high school education in areas with particularly difficult socio-economic conditions shall be selected for admission to secondary vocational schools; priority shall be given to ethnic minority candidates. The quota for Vietnamese citizens of the Kinh ethnicity shall not exceed 15% of the total number of quotas assigned. Clause Conditions
b) Vietnamese citizens who belong to ethnic minority groups that have not yet produced or have very few cadres with university, college, or secondary vocational school qualifications relative to the population of that ethnic group within the province or centrally governed city, and who have continuously resided for five years or more up to the year of enrollment in areas designated as Zone II (Zone I may also be considered if the ethnic minority group has very few cadres with university, college, or secondary vocational school qualifications relative to the national population of that ethnic group or if the selection of candidates in Zones III and II does not meet the assigned quotas). from that ethnic group within the province or centrally governed city, residing in the area III, II (may consider candidates from area I in cases where there are very few cadres with university, college, or intermediate-level education among members of that ethnic minority nationwide or when the dispatching of candidates from areas III and II does not meet the allocated quota) for five consecutive years up to the year of enrollment.
The aforementioned Zones III, II, and I are determined according to the regulations on the demarcation of ethnic minority and mountainous regions issued by the Prime Minister.
2. Quotas for Selection
a) Quotas for selection are determined annually within the plan for admissions to universities, colleges, and secondary vocational schools of the State and are assigned by competent authorities according to each profession and level of training;hnước and dispatched by theshall authority to assign according to each profession and level of training;

Article 6. Criteria for Enjoying Selection Benefits
The criteria for individuals enjoying selection benefits include:
1. Graduation from high school (or secondary vocational school) for those selected for university or college admission and graduation from junior high school or high school for those selected for secondary vocational school admission; having a good conduct rating in the final year of schooling (or final year of program) with a minimum of "good"; having a minimum academic performance rating in the final year of schooling (or final year of program) of "average" for ethnic minority individuals and "good" for Kinh individuals.yếtin the final year (or final semester) achieving a good grade or higher; ranking in academic performance in the final year (or final semester) achieving a passing grade or higher for ethnic minorities and a good grade or higher for Han Chinese.1. Article 7. Organization of Selection (excluding selection into educational institutions under the Ministry of National Defense and the Ministry of Public Security)
1. Procedures for organizing selection:
a)10 Each year when drafting the selection plan, the People's Committees of provinces and centrally governed cities (hereinafter referred to collectively as provincial People's Committees) report on the results of recruitment into positions for graduates selected for employment over the past three consecutive years within the planning period. Based on the requirements of the position tasks and staffing quotas for positions as civil servants; based on job needs, position tasks, occupational qualification standards, and the salary fund of public institutions for positions as civil servants; based on economic and social development orientations, the provincial People's Committee proposes selection quotas for undergraduate programs by profession to the Ministry of Education and Training; selection quotas for college and secondary vocational school programs by profession to the central government agency managing vocational education;onsive con of the province proposes dispatch quotas for university-level training fields to the Ministry of Education and Training; dispatch quotas for vocational training fields at college and intermediate levels to the central state management agency for vocational education;amendTO into pursuant to Clause 2 of Article 5 of this Decree.of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Home Affairsdegree with the Ministry of Education and Training, college and intermediate levels with the central state management agency for vocational education and the Ethnic Minority Committee.
b) The Minister of Education and Training, the central government agency managing vocational education,11according to their authority, shall take the lead and coordinate with the Ministry of Home Affairs, the Ministry of Planning and Investment, the Ministry of Finance, and the Ethnic Council to review and assign selection quotas to provincial People's Committees as stipulated in Clause 2 of Article 5 of this Decree. ||Association, Department of Education and Training, Department of Planning and Investment, Department of Finance, Provincial People's Committee, People's Council, United Front Organization.
c)12 The provincial People's Committee organizes the selection and placement of training according to the selection system with training institutions; decides to send people to study according to the prescribed recipients, criteria, and assigned quotas; reports the results of the selection to the Ministry of Education and Training for undergraduate programs, to the central government agency managing vocational education and the Ethnic Council for college and secondary vocational school programs.ìMinister of Education and Training, Central State Management Agency for Vocational Education
Each year, the provincial People's Committee establishes a Selection Committee to assist the provincial People's Committee in implementing the selection work. Members of the Selection Committee include: the Chairman of the Committee is the Chairman or Vice-Chairman of the provincial People's Committee; the Vice-Chairman in charge of the Committee is the Director of the Provincial Department of Home Affairs; the Vice-Chairman of the Committee is the Head of the Ethnic Council of the Province; other members include representatives from the leadership of the Provincial Department of Labor, Invalids and Social Affairs, the Provincial Department of Education and Training, the Provincial Department of Planning and Investment, the Provincial Department of Finance, and the Provincial People's Council.đượ , according to their authority, prescribe procedures and application forms for studying under the dispatch system.
2. Central State Management Agency for Vocational Education;13admitted to study officially at educational institutions shall be allowed to repeat a year without exceeding one year. During the repeating year, the student enjoys rights and fulfills obligations as in the first year.
Article 8. Training Organization
1. Preparatory University and College Training
a) Individuals selected for university or college training must complete one year of preparatory studies. The organization of training and admission to regular studies at educational institutions shall be carried out in accordance with the regulations of the Ministry of Education and Training and the central government agency managing vocational education;on issuance of diplomas is carried out according to the current regulations of the Ministry of Education and Training and the Central State Management Agency for Vocational Education14
b) After completing one year of preparatory studies, if the student does not meet the conditions for admission to regular studies at educational institutions, they can repeat the preparatory year for no more than one year. During the preparatory year, the student enjoys the rights and fulfills the obligations as in the first year.developmentpolicy scholarships provided by the State.of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Home Affairs3. Experts, leading scientists, chief engineers participating in national defense and security industrial activities at key national defense industrial facilities and key security industrial facilities.
2. Regular Training
a) When studying regularly at educational institutions, students selected through the selection system are trained within the formal education system and are placed together with other students of the same educational institution according to the training profession ordered by the provincial People's Committee with educational institutions;
b) The organization of training, recognition of graduation, and issuance of certificates shall be carried out in accordance with the current regulations of the Ministry of Education and Training and the central government agency managing vocational education;of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Home Affairsprovince, Ministry of Defense, Ministry of Public Security will pay directly to educational institutions through the government procurement mechanism.15.
Article 9. Training Expenses for Selected Candidates
1. The training expenses for selected candidates shall be allocated within the state budget estimate for education and training each year according to current regulations.
Scholarships for selected candidates under the selection policy shall be guaranteed by local budgets and directly provided to students according to the national scholarship policy. , Ministry of Finance guides the organization of dispatch, training, and allocation of dispatch training funds for eligible candidates and quotas specified in Article 5, meeting the criteria set forth in Articles 5 and 6 of this Decree to universities, colleges, and intermediate-level educational institutions.
2. Article 10. Selection for Educational Institutions under the Ministry of National Defense and the Ministry of Public Security
1. Based on this Decree, the Ministry of National Defense shall take the lead and coordinate with the Ministry of Education and Training, the State Management Agency for Vocational Education, and the Ministry of Finance to guide the organization of selection, training, and funding for training for eligible candidates as specified in Article 5, who meet the criteria set forth in Articles 5 and 6 of this Decree, at universities, colleges, and secondary vocational schools managed by the Ministry of National Defense for the purpose of training officers and technical staff for the Ministry of National Defense. in Central16managed by the Ministry of Public Security to train technical staff for the Ministry of Public Security. cof the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Home AffairsPeople's Committee of the province directs the acceptance of applications and selection or forwarding of applications to relevant agencies and units for employment position selection according to regulationso stipulated in the Civil Servant Law and the Civil Servant Law for those who study under the dispatch system after graduation.17 upon graduation. 2. Based on this Decree, the Ministry of Public Security shall take the lead and coordinate with the Ministry of Education and Training, the State Management Agency for Central Vocational Education, and the Ministry of Finance to guide the organization of selection, training, and funding for training for eligible candidates as specified in Article 5, who meet the criteria set forth in Article 6 of this Decree, at universities, colleges, and secondary vocational schools managed by the Ministry of Public Security for the purpose of training officers and technical staff for the Ministry of Public Security.on not required to reimburse scholarships and training costs:18stipulated in this Decree after graduation.19 pursuant to this Decree after graduation.
Chapter III
ACCEPTANCE, SELECTION FOR JOBS AND SCHOLARSHIP REIMBURSEMENT, TRAINING COSTS
20 Article 11. Acceptance and Selection for Job Positionsfor selected candidates after graduation
21 Each year, educational institutions shall submit lists, transfer files, and graduation certificates of selected candidates who have graduated to the provincial People's Committee.1. The provincial People's Committee shall direct the acceptance of applications and selection or transfer of applications to agencies and units that plan to employ them for job positions according to the provisions of the Civil Servants Law and the Public Servant Law for selected candidates after graduation.
2.22 Notify publicly the dispatch plan at least twelve months prior to the application submission period for dispatch on provincial mass media, ensuring objectivity, fairness, and transparency. D đcouncillORSpropose° criteria, organize

Article 12. Cases Requiring Scholarship and Training Cost Reimbursement
Selected candidates falling into any of the following cases shall be required to reimburse scholarships and training costs:ì Enter into training contracts with educational institutions to implement the dispatch system and allocate budgets according to the provisions of this Decree.
1. Those who are disciplined with expulsion or voluntarily withdraw without justifiable reasons approved by the sending agency.of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Home AffairsEntrust the Department of Home Affairs to take the lead in coordinating with educational institutions to manage students studying under the dispatch system during the training period.
2. Those who do not comply with the selection for job positions after graduation as stipulated in this Decree.24 Entrust the Department of Home Affairs to take the lead in accepting applications from students studying under the dispatch system and coordinating with related units to organize selections or forward applications to relevant agencies and units for employment position selections.
3.25 Those whose working time after graduation in the job position designated by the provincial People's Committee is less than twice the duration of their scholarship and training cost benefits.
4. Responsible for recovering scholarship and training cost reimbursements from cases required to reimburse according to Article 12 of this Decree and handling cases that fail to fulfill reimbursement obligations.26 Those who are disciplined and not selected for job positions after graduation or dismissed during the selection process for job positions.27
Article 13. Amount of Compensation, Method of Calculating Scholarship and Training Costs Compensation
1. The amount of compensation includes the policy scholarship for students and training costs covered by the state budget. The compensation amount shall be paid into the state budget.
2. Method of Calculating Compensation
a) For cases stipulated in Clauses 1 and 2 of Article 12 of this Decree, the method of calculating compensation is determined as follows:
TS = (HB + CF) x n
Where TS is the total amount to be compensated; HB is the policy scholarship that the student receives in one year; CF is the training cost for the student in one year; n is the number of years the student has studied under the selection system.
b) For cases stipulated in Clause 3 and Clause 4 of Article 12 of this Decree, the method of calculating compensation is determined as follows:
Where T is the time the selected person must serve the recruitment examination for the job position28; t is the time the selected person has served according to the recruitment examination for the job position29; symbols TS, HB, CF, and n are defined as specified in point a of this clause.
Article 14. Acceptance, Recruitment into Job Positions and Compensation for Scholarships and Training Costs for Students Under the Selection System at Educational Institutions Under the Ministry of Public Security and the Ministry of National Defense.
The Ministry of Public Security and the Ministry of National Defense shall base on the provisions of this Decree to specify detailed regulations on acceptance, recruitment into job positions31 and compensation for scholarships and training costs for students under the selection system at higher education, college, and secondary vocational educational institutions32 managed by the Ministry of Public Security and the Ministry of National Defense.
Chapter IV
IMPLEMENTATION
Article 15. Responsibilities of Ministries
1.33 The Ministry of Education and Training is responsible for directing training work and implementing policies for students under the selection system at the university level.
2.34 The central state agency managing vocational education is responsible for directing training work and implementing policies for students under the selection system at the college and secondary vocational levels.
3. The Ministry of Public Security and the Ministry of National Defense, within their respective authorities, shall direct uniformly the selection, training, acceptance, recruitment into job positionsdevelopmentand implementation of policies for students under the selection system at educational institutions under the Ministry of Public Security and the Ministry of National Defense.policiesThe Ministry of Finance shall take the lead in guiding and allocating the budget to implement the selection system as prescribed in this Decree.35 The Ministry of Home Affairs shall guide the construction of training plans for cadres of localities to ensure the selection system achieves its intended purpose and requirements. cThe Committee for Ethnic Minorities shall take the lead and coordinate with relevant agencies to guide localities in determining the scope and extent of ethnic minority groups lacking or having very few cadres with university, college, and secondary vocational qualifications, and the division of regions as prescribed in Article 5 of this Decree.
4. 7. The Ministry of Planning and Investment shall take the lead in compiling the selection quotas proposed by ministries, sectors, and localities to include in the annual and five-year plans, and submit them for approval by the Prime Minister.
5. Announce the public plan for selection twelve months before the deadline for submitting application forms for selection through provincial mass media, ensuring objectivity, fairness, and transparency. Propose quotas, organize selection and send people to study, direct the organization of recruitment into job positions as prescribed.logoSign training contracts with educational institutions to implement the selection system and allocate the budget as prescribed in this Decree.
6. Assign the Department of Home Affairs to take the lead in coordinating with educational institutions to manage students under the selection system during the training period.shall Assign the Department of Home Affairs to take the lead in accepting applications from students under the selection system and coordinating with related units to organize recruitment or sending applications to agencies and units expected to use them for recruitment into job positions.urinary catheterShall be responsible for recovering scholarship and training cost compensation for cases required to compensate as stipulated in Article 12 of this Decree and handling cases where compensation is not implemented.

7. There shall be policies to create sources of admissions for the candidates specified in Clause 1, Point b, Article 5 on the basis of creating favorable conditions for students of these ethnic groups to study at boarding schools for ethnic minorities.
Article 17. Responsibilities of educational institutions admitting students under the quota system and implementing all regulations and policies for such students as prescribed.
1. Chapter V
IMPLEMENTING PROVISIONS
41Article 19. Effective Date
This Decree takes effect fifteen days after its publication in the Official Gazette. All provisions contrary to this Decree are hereby abolished.ướvới this Decree shall be abolished.
