CIRCULAR

Guidelines for issuing, extending, amending, supplementing and managing diplomatic passports and official passports within the country pursuant to Decree No. 05/2000/NĐ-CP.

dated March 3, 2000 of the Government on departure from and entry into Vietnam by Vietnamese citizens. On March 3, 2000, the Government issued Decree No. 05/2000/NĐ-CP on departure from and entry into Vietnam by Vietnamese citizens (hereinafter referred to as the Decree).

These guidelines provide specific instructions on the issuance, extension, amendment,

 

supplementation and management of diplomatic passports and official passports within the country as follows: number 0Decision No. 5/2000/NĐ-CP on exit and entry of Vietnamese citizens (hereinafter referred to as the Decree). AND Diplomatic guidelines specifically address the issuance, extension, amendment, Law No. 42/2024/QH15 supplementation and management of ward diplomatic passports, wardofficial passports withinthe country as follows:

 

I. GENERAL PROVISIONS

1.This Circular provides guidance on implementing the provisions of the Decree related to the subjects eligible for issuance, validity period, procedures for issuance, extension, amendment, supplementation, and responsibility for managing diplomatic passports and official passports (hereinafter collectively referred to as passports) within the country. The issuance, extension, amendment, and supplementation of passports abroad are not within the scope regulated by this Circular.

2.The Consular Department and the Department of Foreign Affairs of Ho Chi Minh City are the agencies responsible for receiving applications and processing the issuance, extension, amendment, and supplementation of passports within the country (hereinafter referred to as passport issuing agencies).

3.The sample stamp of the agency, signature, and title of the authorized person prescribed in Article 15 of the Decree must be introduced in writing to the passport issuing agency before the authorized person signs the dispatch or permission document for officials, civil servants, officers, and non-commissioned officers (hereinafter collectively referred to as officials). For those authorized to dispatch or permit officials to travel abroad under Clause 3 of Article 15 of the Decree, the introduction letter must be signed by the Head of the Ministry or provincial People's Committee and clearly state the scope of authority.4.Vietnamese citizens who meet the requirements of Articles 7, 8, and 10 of the Decree and wish to apply for issuance, extension, amendment, or supplementation of passports may submit their applications directly or through another person in accordance with the provisions of the Decree and this Circular. In cases where necessary, upon request of the passport issuing agency, the applicant must provide additional information or present documents to clarify the subject requesting issuance, extension, amendment, or supplementation of passports.

5.In accordance with the nature of each trip abroad, Vietnamese citizens are only allowed to use one passport for that trip.

II. ELIGIBILITY FOR PASSPORT ISSUANCE

(Articles 7 and 8 of the Decree)

1.Persons falling under the category of going abroad to perform "official duties" as defined from Clause 1

to Clause 4 of Article 7 and Article 8 are individuals dispatched by state agencies, organizations, state-owned enterprises, military units, or public security units to carry out tasks consistent with the functions and responsibilities of such agencies, organizations, or enterprises. 2.Persons falling under the category specified in Clause 2 of Article 7 of the Decree are department-level officials and chief accountants of state-owned enterprises established and operating under the State Enterprise Law dated April 20, 1995 (must be established by the Prime Minister or the Minister, Chairman of the Provincial People's Committee).

3.Persons falling under the category of "going abroad during the term of service," as stipulated in Clause 6 of Article 7 and Clause 9 of Article 8 of the Decree, are spouses or children under 18 years old of members of Vietnamese representative offices abroad, permitted to depart and live together with them as a household during the term of service at the representative office. 4.Persons falling under the category of "traveling along with work trips," as stipulated in Clause 9 of Article 8 of the Decree, are spouses or children under 18 years old of persons specified in Clauses 1 to 7 of Article 8 of the Decree, permitted to accompany them on work trips abroad.

III. VALIDITY PERIOD OF THE PASSPORT(Article 5 of the Decree)

1.Passports

issued to persons falling under the category specified in Clause 7 of Article 7 and Clause 11

III. VALIDITY PERIOD OF PASSPORTS (Article 5 of the Decree)

1. Passport issued for persons falling under Clause 7 Article 7 and Clause 11 Article 8 of the Decree shall have the following validity period:

1 year if the working time abroad is less than 6 months; 2 years if the working time abroad is from 6 months to less than 18 months;

5 years if the working time abroad is 18 months or more. The said passport may be extended once with a term appropriate to the working term, but not exceeding 3 years.

2. Passport issued for children under 18 years old as stipulated in Clause 6, Article 7 and Clause 9, Article 8 of the Decree shall have a validity period until the child turns 18 years old, but not exceeding 5 years.

3.2.4. For Paragraph 4: IV. PROCEDURES FOR ISSUING PASSPORTS

(Article 10 of the Decree) The application for issuing passports must be carried out in accordance with the provisions of Article 10 of the Decree and meet the following requirements:

In the dossier, there must be three identical photos, size 4 x 6 cm, taken looking straight ahead, bareheaded, without colored glasses, taken within the last year, of which one photo is affixed to the Application Form, stamped over one quarter of the photo, two photos attached. Officers, professional soldiers in the People's Army, police officers in the People's Public Security, and staff members of sectors with specific uniforms must submit photos in civilian clothes. 2. Documents appointing or permitting travel abroad must:

5. Certificate of archival business inspection results Clearly state the full name, position of the person appointed or permitted to travel abroad, destination country, duration of stay abroad, purpose, source of funding for the trip;

1.GENERAL PROVISIONSBe signed directly by the authority specified in Article 15 of the Decree (not using photocopied signatures) and stamped by the agency; In case the applicant for the passport is an employee of a State-owned enterprise directly under the Prime Minister, the document appointing or permitting travel abroad must be signed directly by the Chairman of the Board of Directors (for Board Members) or General Director (for Deputy General Directors and other employees) and stamped by that enterprise.

If the document consists of two pages or more, it must be stamped across the pages;

If there are amendments or supplements in the document, they must be stamped on those amendments or supplements. 3. In case parents or guardians request to include children under 16 years old traveling together in the same passport:

a) If parents or guardians are civil servants, the document permitting them to travel abroad must clearly state the full name and date of birth of the accompanying child; the joint application form for issuing the passport must affix the child's photo, stamped and confirmed by the head of the agency, organization, unit directly managing the parents or guardians, or by the head of the police station where the child is registered as a permanent resident or long-term temporary resident.

b) If parents or guardians do not fall under the above category, the joint application form for issuing the passport must affix the child's photo, stamped and confirmed by the head of the police station where the child is registered as a permanent resident or long-term temporary resident.

4. In case of traveling with or visiting members of Vietnamese representative offices abroad as stipulated in Clause 6, Article 7 and Clause 9, Article 8 of the Decree, the dossier must also include a written opinion of the Department of Organization and Cadres of the Ministry of Foreign Affairs.

5. In case of traveling to countries that do not grant visa exemption for holders of diplomatic passports or official passports of Vietnam, additional copies of invitation letters from the foreign side or information about the name of organizations or individuals inviting, the content of work... must be submitted to facilitate the issuance of a letter of introduction for visa application.

V. PROCEDURES FOR EXTENDING, AMENDING AND REPLACING PASSPORTS

Before the passport expires, the holder can apply for extending the passport. If the passport has already expired, a new passport issuance procedure must be followed. The dossier includes:

1. A request for extending the passport (according to the prescribed form);

2. Documents appointing or permitting travel abroad meeting the requirements specified in Clause 2, Part 2. 2. Amending and supplementing passports: 1. A request for amending and supplementing the passport (according to the prescribed form);

2. Valid proof showing that amending and supplementing the passport is necessary. 3. Supplementing children under 16 years old into the passports of their parents or guardians:

a) For children traveling along with their parents or guardians on official business trips as stipulated in Clause 8 of the Decree, the dossier includes: H,N, AMENDING AND - Office of the President of the Stateis a communicable disease or parasite listed by the Ministry1. An application form (according to the prescribed form), affixed with the child's photo, stamped and confirmed by the head of the police station where the child is registered as a permanent resident or long-term temporary resident; attached are two identical photos, size 3 x 4 cm, taken looking straight ahead, bareheaded, without colored glasses, taken within the last year; POSITIONS, 2. A document from the competent authority specified in Article 15 of the Decree permitting the parents or guardians to take the child on an official business trip; 3. The original passport. (Article 11 of the Decree)

b) For children traveling with or visiting members of Vietnamese representative offices abroad as stipulated in Clause 6, Article 7 and Clause 9, Article 8 of the Decree, the dossier includes:

3.2.4. For Paragraph 4: The passport issuing authority shall consider the extension, amendment, and supplementation of passports within 2 working days from the date of receiving a complete and valid dossier.

5. Issuing a new passport due to damage, wear and tear, running out of pages, or expiration of the validity period (for passports that have been extended once): IVthis Circular.

The dossier should be the same as when applying for a first-time passport issuance and accompanied by the old passport.

5. Certificate of archival business inspection results 1. An application form (according to the prescribed form), affixed with the child's photo, stamped and confirmed by the head of the police station where the child is registered as a permanent resident or long-term temporary resident; attached are two identical photos, size 3 x 4 cm, taken looking straight ahead, bareheaded, without colored glasses, taken within the last year;

The passport issuing authority will check the old passport, and if it confirms that it is a valid passport without damage or dirt on the personal data page and photo page, it will issue a new passport within 5 working days from the date of receiving a complete and valid dossier and issue a notice to invalidate the old passport.

3.2.4. For Paragraph 4: The passport issuing authority shall consider the extension, amendment, and supplementation of passports within 2 working days from the date of receiving a complete and valid dossier.

In case there is suspicion that the old passport has been tampered with, had its photo replaced, or damaged or dirtied on the personal data page or photo page, making it impossible to verify the authenticity of the personal data and photo in the passport, the passport issuing authority will request the authority that issued the old passport to verify. That authority is responsible for replying within 10 working days from the date of receipt of the request. The passport issuing authority will consider and decide on the issuance of a new passport within 5 working days from the date of receiving the verification results.

VI. RESPONSIBILITIES OF PERSONNEL MANAGEMENT OF PASSPORTS(Article 16 of the Decree)

a) For children traveling with their parents on official business as stipulated in Clause 9 Article 8 of the Decree, the application dossier shall include: .

1 application form (as prescribed), affixed with the child's photograph, stamped with a border seal and acknowledged by the Chief of the Police Station of the commune or ward where the permanent or long-term temporary residence is registered; attached are two identical photographs, size 3 x 4 cm, taken looking straight ahead, bareheaded, without colored glasses, taken not more than 1 year ago;

A written authorization from the competent authority as prescribed in Article 15 of the Decree allowing the parent or guardian to take the child on official business trips;

3.2.4. For Paragraph 4: passport.

b) For children traveling with or visiting members of Vietnamese representative offices abroad as stipulated in Clause 6 Article 7 and Clause 9 Article 8 of the Decree, the application dossier shall include:

1 application form (as prescribed), affixed with the child's photograph, stamped with a border seal and acknowledged by the Chief of the Police Station of the commune or ward where the permanent or long-term temporary residence is registered; attached are two identical photographs, size 3 x 4 cm, taken looking straight ahead, bareheaded, without colored glasses, taken not more than 1 year ago;

3.2.4. For Paragraph 4: The passport issuing authority shall consider the extension, amendment, and supplementation of passports within 2 working days from the date of receiving a complete and valid dossier.

Opinionverification letter issued by the Department of Organization and Cadres of the Ministry of Foreign Affairs.

If chemicals, insecticides, and bactericides do not fall under the scope of Clauses 1 and 2 of this Article, the Ministry of Health will consider each case individually.The issuing authority shall consider extending, amending, or supplementing passports within 2 working days from the date of receiving complete and valid applications.

5. Issuance of new passports due to damage, wear and tear, full pages, or expiration of the validity period of the old passport (for passports that have been extended once):

The issuing authority shall examine the old passport, if it confirms that it is a valid passport and is not damaged or soiled on the personal information page or photo page, then it shall issue a new passport within 5 working days from the date of receiving complete and valid applications and issue a notice to invalidate the old passport.

In cases where there is suspicion that the old passport has been tampered with, had its photo replaced, or is damaged or soiled on the personal information page or photo page without ensuring the authenticity of the personal information and photo in the passport, the issuing authority shall request a written verification from the authority that issued the old passport. This authority shall be responsible for replying within 10 working days from the date of receipt of the request. The issuing authority shall consider and decide on the issuance of a new passport within 5 working days from the date of receipt of the verification results.

VI. RESPONSIBILITY FOR MANAGING PERSONNEL IN CHARGE OF PASSPORT MANAGEMENT (Article 16 of the Decree)

1. The person authorized to dispatch or permit officials and employees to goabroad, as defined in Article 15 of the Decree, shall be responsible for managingpersonnel and organizing the management of passports:

Shallbe responsible for personnel dispatched or permitted to go abroad by themselves.

Shallretain and manage passports after each official trip abroad.

Shallonly hand over passports to officials and employees going on official missions asprovided for in Articles 7 and 8 of the Decree.

Inthe case where a passport is lost, they must immediately notify the authoritythat issued the passport to cancel it.

Forpassports issued by Vietnamese representative offices abroad, they must notifythe Consular Department of the Ministry of Foreign Affairs.

Inthe case where their officials and employees are transferred or seconded to workat other agencies, organizations, or units while their passports are still valid,they must process the transfer of passports to the new managing agency,organization, or unit.

Inthe case where their officials and employees no longer fall under the categoryof those entitled to diplomatic passports or official passports (retirement,departure from the payroll, termination of labor contracts, conscription, death,disappearance). . .) and their passports are still valid, they must recover and transfer them to thepassport issuing authority for cancellation.

2. The person authorized to dispatch or permit officials and employees to goabroad, as defined in Article 15 of the Decree, needs to establish a regulationfor management, clearly defining the responsibilities of the person or departmentdirectly managing passports; the responsibilities of the person assigned topassport usage; the establishment of a passport management ledger; the mechanismfor passport handover; reporting procedures; and handling violations.

3. Organs The managing authority mentioned in Clauses 2, 3, and 4 of Article 15 of theDecree shall be responsible for coordinating with the passport issuing authorityin handling cases of improper passport use causing foreign relations consequences, overstaying abroad beyond the permitted period, changing the purpose of thetrip during the stay abroad, and other cases as required by the passport issuingauthority or Vietnamese representative offices abroad.

VII. IMPLEMENTATION

1. The Consular Department shall study and issue application forms and requestforms as prescribed in this Circular.
