CIRCULAR
Supplementary Guidelines for Supporting Participants in Revolutionary Activities Prior to January 1, 1945 to Improve Housing Conditions Pursuant to Decision No. 20/2000/QĐ-TTg dated February 3, 2000 of the Government Prime Minister
Improving housing conditions for participants in revolutionary activities prior to December 31, 1944 according to Decision No. 20/2000/QĐ-TTg dated February 3, 2000 of the Government Prime Minister
Based on Decision No. 20/2000/QĐ-TTg dated February 3, 2000 of the Government Prime Minister regarding support for individuals who participated in revolutionary activities before August 1945 to improve housing conditions;

After reaching consensus with the Central Organization Committee of the Party (Document No. 152/CV-TCTW dated June 6, 2001), the Ministry of Finance (Document No. 4773/TC-CSTC dated May 25, 2001), the Ministry of Labor, Invalids, and Social Affairs (Document No. 1228/LĐTBXH-TBLS dated May 10, 2001), and obtaining approval from the Government Prime Minister (Document No. 710/CP-CN dated August 6, 2001), the Ministry of Construction hereby provides supplementary guidelines for supporting participants in revolutionary activities prior to December 31, 1944 to improve housing conditions as follows:
I. ON THE APPLICABLE SUBJECTS:
1. Individuals participating in revolutionary activities as stipulated in Article 1 and Article 2 of Decision No. 20/2000/QĐ-TTg dated February 3, 2000 of the Government Prime Minister (hereinafter referred to as Decision No. 20) include those admitted to the Party or re-admitted before August 19, 1945, recognized by competent authorities;
2. Individuals participating in revolutionary activities as stipulated in Clause 1 above, currently receiving preferential allowances for revolutionary activities prior to 1945 under Circular No. 32/TT-TC dated October 14, 1960 of the Central Organization Committee "Guidelines for Implementing Policies for Long-Serving Cadres and Party Members" and Circular No. 03/NV dated February 1, 1963 of the Ministry of Interior (now the Ministry of Labor, Invalids, and Social Affairs) guiding "Implementation of Preferential Allowances for State Workers with Merit When Retiring," but without a recognition decision from competent authorities, shall be proposed by ministries, sectors, and localities to compile lists (with attached files according to regulations on recognizing pre-1945 revolutionary participants) to be sent to the Central Organization Committee of the Party for review, to issue unified documents before provincial and centrally-administered city People's Committees decide to provide housing improvement support according to Decision No. 20.
II. ON SOME SPECIFIC CONTENTS:
1. In cases where both husband and wife in a household participated in revolutionary activities from January 1, 1936 to December 31, 1944, recognized by competent authorities, and both are alive as of February 18, 2000 (the effective date of Decision No. 20), the support will be implemented as follows:
a. If renting state-owned houses classified as Grade 1, 2, 3, 4, or detached villas (not multi-story buildings with multiple households and apartment-style structure), permission to convert to private ownership is granted, then support will be provided for the current residence, with the combined support standards for both husband and wife as stipulated in Decision No. 20, without additional support beyond the current living space and land area;
b. If renting a multi-story building with multiple households and apartment-style structure, support will be provided for the couple's living space, and each person will receive VND 20 million (twenty million dong);
c. If renting a state-owned house that cannot be converted to private ownership, the support will be implemented as follows:
- For multi-story buildings with multiple households and apartment-style structure, it will be converted to an apartment within such buildings, and support will be provided for the converted apartment, with each person receiving VND 20 million (twenty million dong);
- For houses classified as Grade 1, 2, 3, 4, or detached villas, land will be allocated and funds provided for constructing new housing, applying the highest support standard (for either husband or wife) as specified in Decision No. 20, and the local residential land quota;
2. Individuals eligible for support under Article 1 of Decision No. 20, currently renting state-owned houses (convertible to private ownership), will have support implemented based on the principle of maintaining the original residence, without requiring the return of rented housing to apply for monetary support, land allocation, or housing conversion;
3. Individuals eligible for support under Article 1 and Article 2 of Decision No. 20, who have been given "Compassionate Houses," will now receive an additional VND 20 million (twenty million dong);
4. Individuals eligible for support under Article 1 of Decision No. 20, currently renting state-owned houses classified as Grade 1, 2, 3, 4, or detached villas (multi-story buildings with multiple households but not apartment-style structure), convertible to private ownership, will receive support for the current rented living space and land area, without additional monetary support as in the case of multi-story buildings with multiple households and apartment-style structure;
5. Individuals eligible for support under Article 1 of Decision No. 20, who purchased state-owned housing under the "price conversion" policy before July 5, 1994 (the effective date of Decree No. 61/CP), when implementing Decision No. 20, will not be required to refund previously paid amounts for "price conversion," but will receive VND 20 million (twenty million dong) per household;
6. Individuals eligible for support under Article 1 of Decision No. 20, who moved before February 18, 2000, and have rented state-owned housing in multiple provinces or centrally-administered cities, may choose one location for support procedures, but only one location will be supported;
7. Individuals eligible for support under Article 1 of Decision No. 20, who have transferred rental contracts for state-owned housing (multi-story buildings with multiple households and apartment-style structure, regardless of whether they are closed or open units), will receive an additional VND 20 million (twenty million dong).
7. Persons eligible for support under Article 1 of Decision 20 who have housing lease contracts for state-owned houses (multi-story buildings with multiple households having apartment-style structures, regardless of whether they are closed or open) but have transferred such contracts shall only be entitled to additional support of twenty million Vietnamese dong (VND 20,000,000).
8. In cases where both the husband and wife of a household fall under the support provisions set forth in Articles 1 and 2 of Decision 20 but both have passed away before February 18, 2000, and their children face housing difficulties, the People's Committee of the province shall provide support to improve housing conditions according to the provisions of Decision 20 and Circular No. 5/2000/TT-BXD dated June 27, 2000, of the Ministry of Construction based on specific circumstances. If the children reside in different provinces or centrally governed cities, in addition to the provisions stipulated in Point 5, Clause II of Circular No. 05/2000/TT-BXD dated June 27, 2000, of the Ministry of Construction, the child seeking support must present a confirmation letter from the province or city managing the original file of the person entitled to support as specified in Articles 1 and 2 of Decision 20.
9. During the implementation process, if there are any obstacles or new issues arising, they shall be resolved within the authority of the ministries, sectors, and People's Committees of the provinces and centrally governed cities. In cases exceeding their authority, they shall report to the Central Organization Commission of the Party and the Ministry of Construction for consolidation and submission to the Prime Minister for consideration and decision.
1. The Director of the Finance and Planning Department is responsible for guiding and supervising the implementation of this Circular.
