Regarding support for persons who were engaged in revolutionary activities before the August Revolution of 1945 to improve their housing conditions
On the basis of the Ordinance on Preferential Treatment for Persons Engaged in Revolutionary Activities, Martyrs, and Their Families, War Invalids, Veterans, Persons Engaging in Anti-French Resistance, and Those Who Have Contributed to the Revolution, issued on August 29, 1994, and Decree No. 28/CP dated April 29, 1995 of the Government guiding the implementation of this ordinance;

Pursuant to the Government Organization Law dated September 30, 1992;
At the proposal of the Minister of Construction, the Minister of Labor, Invalids and Social Affairs, the Minister of Finance, and the Director General of the Land Administration Bureau,
Persons who were engaged in revolutionary activities before 1945 (joined revolutionary organizations on or before December 31, 1944, and have been recognized by competent authorities with a decision), when purchasing housing they are renting that belongs to the state according to Decree No. 61/CP dated July 5, 1994 (hereinafter referred to as Decree No. 61/CP), shall be supported by the state according to the following decisions:

Article 1. 1- Persons who joined revolutionary organizations on or before December 31, 1935 shall be exempt from all house purchase costs and land use fees;
2- Persons who joined revolutionary organizations during the period from January 1, 1936 to December 31, 1944, and have been awarded the Gold Star Medal, Ho Chi Minh Medal, or First-Class Independence Medal shall be exempt from house purchase costs for up to 200 square meters of usage and exempt from land use fees for up to 300 square meters;
3- Persons who joined revolutionary organizations during the period from January 1, 1936 to December 31, 1944, but not covered by the provisions of Clause 2 of this Article, shall be exempt from house purchase costs for up to 100 square meters of usage and exempt from land use fees for up to the residential land area standard set by the People's Committee of the province or centrally-administered city (hereinafter collectively referred to as the provincial-level People's Committee);
4- Persons who were engaged in revolutionary activities before 1945 and currently reside in a fully-equipped apartment in multi-story buildings with multiple households shall, in addition to being exempt from all house and land use fees, also receive an additional support of 20 million Vietnamese dong;
5- Persons who were engaged in revolutionary activities before 1945 and currently reside in an un-equipped apartment in multi-story buildings with multiple households shall be converted to a fully-equipped apartment in such buildings, exempt from all house and land use fees, and receive an additional support of 20 million Vietnamese dong;
6- In cases where the housing of those persons receiving support as stipulated in Clauses 1, 2, and 3 of this Article cannot be converted to private ownership as specified in Article 5 of Decree No. 61/CP, the provincial-level People's Committee shall provide support based on specific local conditions as follows:
- For persons receiving support as stipulated in Clause 1, they may be converted to other housing (existing or newly constructed) or allocated land without payment up to a maximum of 400 square meters and provided construction funding up to 200 square meters of floor space for new housing construction;
- For persons receiving support as stipulated in Clause 3, land will be allocated without payment up to a maximum of 300 square meters and construction funding up to 200 square meters of floor space for self-construction of new housing;
- For persons receiving support as stipulated in Clause 3, land will be allocated without payment up to the residential land area standard set by the provincial-level People's Committee but not exceeding 300 square meters and construction funding up to 100 square meters of floor space for self-construction of new housing;
If the person receiving support does not have the conditions to construct housing and requests assistance, the provincial-level People's Committee shall organize construction in accordance with general regulations, with agreement from the person receiving support;
The calculation basis for the support funds for the cases stipulated in this clause is the cost of constructing new housing; for cases residing in detached houses, the price of a second-class villa shall be applied, while for other cases, the price of a second-class house as prescribed in Decree No. 61/CP shall be applied;
Persons who were engaged in revolutionary activities before 1945 and do not reside in state-owned rental housing or have returned rented housing to the state shall be supported with 50 million Vietnamese dong;
Article 2. Persons who joined revolutionary organizations during the period from January 1, 1945 to before the August Revolution of 1945 and have been recognized as pre-revolutionary resistance cadres, when purchasing housing they are renting that belongs to the state according to Decree No. 61/CP, shall be exempt from land use fees for multi-story buildings with multiple households or have their land use fees reduced by 80% for single-story houses and multi-story buildings with single households, but the area for calculating the reduction amount shall not exceed the residential land area standard set by the provincial-level People's Committee;
Article 3- The land use fee reduction stipulated in this Article shall also apply to cases receiving support through land allocation for housing construction;
The housing and land areas of persons receiving support as stipulated in Articles 1 and 3 are the current rental areas, purchased according to current regulations; if renting in multiple places, all rental areas shall be combined. If the housing and land areas exceed the support level, the purchaser must pay for the excess area according to the regulations in Decree No. 61/CP for the house portion and Decree No. 87/CP dated August 17, 1994 for the land portion;
Article 4. In cases where persons engaged in revolutionary activities eligible for support under Articles 1 and 3 have passed away but their spouse is still alive, the spouse shall receive the support standards as prescribed;
Article 5. For cases eligible for support under Article 1 where both spouses have passed away and children face housing difficulties, the provincial-level People's Committee shall provide support to improve housing based on specific conditions (reducing costs for purchasing state-owned housing, reducing land use fees when allocating land, providing financial support or other forms), with the total support amounting to a maximum of 50 million Vietnamese dong;
Households with members receiving support under Article 1 of this Decision shall not be entitled to the preferential treatments prescribed in Decision No. 118/TTg dated February 27, 1996 and Decision No. 64/1998/QD-TTg dated March 21, 1998 of the Prime Minister;
Article 6. In cases receiving support under Article 3 of this Decision, if there are multiple individuals within the household eligible for preferential treatment, the preferential standards prescribed in Decision No. 118/TTg and Decision No. 64/1998/QD-TTg of the Prime Minister shall be cumulatively applied.
In cases supported as provided for in Article 3 of this Decision, if there are multiple persons eligible for preferential treatment within the household, the preferential standards specified in Circular No. 118/TTg and Decision No. 64/1998/QĐ-TTg of the Prime Minister shall be aggregated.
In cases where individuals eligible for support under this Decision have purchased state-owned housing in accordance with Decree No. 61/CP or have been supported through land allocation for housing pursuant to Decision No. 118/QĐ-TTg, they shall be refunded any difference (if any) between the level of support provided under this Decision and that provided under Decision No. 118/QĐ-TTg and Decision No. 64/1998/QĐ-TTg of the Prime Minister.
Individuals eligible for monetary support under Clause 4, Article 1 and Article 2, if previously assisted by local authorities with funds to improve their housing but not up to the level specified in this Decision, shall be supplemented to reach the required level.
Article 7. Implementation
1- Within one year from the date this Decision takes effect, the support measures stipulated in Clause 1, 2, 3, 4, Article 1 and Article 2 must be completed; support for remaining cases must be completed no later than 2002. Individuals entitled to support standards who are awaiting resolution may transfer their right to benefit to heirs.
2- The People's Committee of the province shall prepare lists of individuals eligible for support at the prescribed levels, develop specific plans regarding funding, residential land, construction of new housing, implementation schedules... and ensure implementation according to the designated subjects and regulations. For individuals eligible for support who wish to relocate, the support must be implemented prior to relocation.
3- Ministries, sectors, and agencies currently managing housing for individuals eligible for support under Article 1 and Article 3 of this Decision are responsible for transferring management responsibilities to the People's Committee of the province before June 30, 2000, to facilitate the support process.
4- The Ministry of Finance and the Ministry of Planning and Investment are tasked with balancing and allocating sufficient state budget funds for the support as stipulated in Clause 1 of this Article.
5- The Ministry of Construction shall coordinate with the Party Central Organization Department, the Party Central Financial-Administrative Department, the Government Central Organization-Civil Service Department, the Ministry of Finance, the Ministry of Labor, Invalids and Social Affairs, and the General Land Administration to direct the implementation and resolve issues arising from proposals made by the People's Committee of the province within their authority; promptly report to the Prime Minister for guidance on resolving cases not covered by this Decision and difficulties beyond the authority of ministries and sectors.
Article 8. THIS DECISION SHALL TAKE EFFECT 15 DAYS FROM THE DATE OF SIGNATURE.
Ministers, heads of ministerial-level agencies, heads of government-affiliated agencies, Chairpersons of provincial and centrally-administered city People's Committees are responsible for enforcing this Decision.
