Decision No. 64/1998/QĐ-TTg On reducing the purchase price for housing for certain groups when purchasing state-owned housing they are renting

Regarding the reduction of house purchase price for certain subjects when purchasing state-owned houses they are currently renting

PRIME MINISTER

Pursuant to the Government Organization Law dated September 30, 1992;

Pursuant to Decree No. 61/CP dated July 5, 1994 and Decree No. 21/CP dated April 16, 1996 of the Government;

At the proposal of the Head of the Central Steering Committee on Housing and Land Policy; Ministers of the Ministries of Construction, Finance, Labor - Invalids and Social Affairs, National Defense; Director of the General Department of Land Administration and Head of the Government Price Board,

DECISION:

Article 1. The following subjects, when purchasing state-owned houses they are currently renting according to Decree No. 61/CP dated July 5, 1994 and Decree No. 21/CP dated April 16, 1996 of the Government, shall be entitled to a reduction in the house purchase price as stipulated herein:

1. Administrative, public service, Party and mass organization officials receiving salaries from the State budget;

2. Personnel receiving salaries from the State budget in the armed forces;

3. Non-commissioned officers and soldiers receiving subsistence allowances who have served in A, B, C, and K battle zones;

4. Officials working at communes, wards receiving salaries from the State budget or subsistence allowances according to rates prescribed by the State;

5. Workers and staff members working continuously for one year or more in state-owned enterprises, organizations, units permitted to engage in production, business, and services under administrative, public service, armed forces, Party and mass organizations;

6. Subjects specified in Clauses 1, 2, 3, and 5 of this Article who are assigned to work in foreign-invested enterprises, industrial zones, export processing zones, economic and trade representative offices established and operating in Vietnam, diplomatic agencies, international organizations, non-governmental organizations, foreign press, radio, television agencies located in Vietnam, and other economic sectors;

7. Persons receiving pensions, disability benefits, occupational injury or disease benefits, rubber worker benefits, one-time social insurance benefits, termination benefits before and after Decision No. 111/HĐBT dated April 12, 1991 of the Council of Ministers (now the Government), or before and after the Labor Code;

8. Personnel in the armed forces receiving discharge or demobilization benefits instead of monthly pension or disability benefits due to not meeting the conditions for such benefits; those demobilized before 1960;

9. Persons with meritorious service to the Revolution as defined in Article 1 of Decision No. 118/TTg dated February 27, 1996 of the Prime Minister.

Article 2. The house purchase price shall be reduced as follows:

1. The amount of the house purchase price shall be reduced by VND 100,000 for each year of service. In cases where there is time spent in the armed forces, each year of service in the armed forces shall be reduced by VND 180,000.

2. The amount of the house purchase price shall be reduced by VND 1 million for persons with meritorious service to the Revolution without years of service to calculate the reduction. If the total amount of reduction calculated based on years of service for persons with meritorious service to the Revolution is less than VND 1 million, then VND 1 million shall be reduced for one person. 3. The number of years counted for the reduction of the house purchase price is the actual number of years worked in state-managed agencies and units up to the date of house purchase. When calculating the number of years of service, if there are less than six months, it will be counted as half a year, and over six months, it will be counted as one year.

4. The reduction of the house purchase price according to the above levels shall not be cumulative regarding time and subjects. Each subject shall only be entitled to one reduction when purchasing state-owned rented houses.

5. In a household with multiple members named in the same rental contract or with the same permanent residence registration card belonging to the category eligible for a reduction in the house purchase price, the amount of the house purchase price reduction for each member shall be added together to calculate the total amount of the house purchase price reduction for the entire household, but the maximum reduction shall not exceed the house price (excluding land use fees) in the sale price.

Article 3. The determination of subjects eligible for a reduction in the house purchase price and the actual period of service to be eligible for a reduction shall be based on valid documents as follows:

1. For those currently working, the managing agency shall base its confirmation on the individual file maintained by the managing agency.

2. For those receiving pensions, disability benefits, occupational injury or disease benefits, rubber worker benefits, the social insurance agency at the district or county level shall confirm.

3. For those who have retired and received one-time social insurance benefits, termination benefits before and after Decision No. 111/HĐBT dated April 12, 1991 of the Council of Ministers or before and after the Labor Code, discharge or demobilization benefits, the Government shall issue a decision on retirement and benefit receipt; in case the retirement and benefit receipt decision is lost, the subject must submit a detailed declaration of their work history and obtain confirmation from the former agency or unit.

4. Persons with meritorious service to the Revolution eligible for a VND 1 million reduction shall be confirmed by the Labor - Invalids and Social Affairs Office at the district or county level.

Article 4. THIS DECISION SHALL TAKE EFFECT 15 DAYS FROM THE DATE OF SIGNATURE.

Article 5. For subjects eligible for a reduction in the house purchase price under this Decision who have already purchased state-owned rented houses according to Decree No. 61/CP dated July 5, 1994 and Decree No. 21/CP dated April 16, 1996 of the Government prior to the effective date of this Decision, the following shall apply:

1. If the buyer has paid the full amount, they shall be refunded the amount of the house purchase price reduction according to this Decision.

2. If the buyer has not yet paid the full amount, the amount of the house purchase price reduction according to this Decision shall be deducted from the remaining amount to be paid.

3. The amount of the house purchase price reduction shall not be refunded in cases where the state-owned house has been resold to another subject.

Article 6. The Ministry of Construction and the Ministry of Labor - Invalids and Social Affairs shall take the lead, in coordination with the Ministry of Finance and the Ministry of National Defense, to monitor, urge, and resolve issues within their authority arising during the implementation of this Decision.

Article 7. Ministers, heads of ministerial-level agencies, heads of government-affiliated agencies, Chairpersons of provincial People's Committees under central cities are responsible for implementing this Decision./.
