Decision No. 04/2002/QĐ-BNV Amending Article 6 of Chapter II of the Regulations issued together with Decision No. 15/QĐ-TCCP dated June 5, 1999 of the Minister - Head of the Government Organizational and Civil Servant Affairs Department Regarding the Provision, Management, and Use of Official Telephones at Home, Mobile Phones, and Official Messaging Devices for Certain Positions of Officials and Civil Servants under the Ministry of Home Affairs

DECISION OF THE MINISTER OF HOME AFFAIRS

Amending Article 6 of Chapter II of the Regulations issued together with Decision No. 15/QĐ-TCCP dated June 5, 1999 of the Minister - Head of the Government Organizational and Cadre Department.

THE MINISTER OF THE MINISTRY OF HOME AFFAIRS

Pursuant to Resolution No. 02/2002/QH11 dated August 5, 2002 of the National Assembly on the list of ministries and ministerial-level agencies under the Government;

Pursuant to Decree No. 181/NĐ-CP dated November 9, 1994 on the functions, tasks, powers, and organizational structure of the Government Organizational and Cadre Department.

Pursuant to Decision No. 78/2001/QĐ-TTg dated May 16, 2001 of the Prime Minister on the issuance of regulations on standards and quotas for the use of office telephones at home and mobile phones for leaders in administrative agencies, public institutions, political organizations, and social organizations;

Article 1: Amending Article 6 of Chapter II of the Regulations issued together with Decision No. 15/QĐ-TCCP dated June 5, 1999 of the Minister - Head of the Government Organizational and Cadre Department, which stipulates the provision, management, and use of office telephones at home, mobile phones, and messaging devices for certain positions of cadres and civil servants under the Ministry of Home Affairs. Specifically as follows:

Regarding the quota for the provision and use of communication means for official purposes.

1. For fixed-line telephones:

1.1. The agency pays the installation cost according to the contract between the cadre or civil servant and the Post and Telecommunications Corporation.

1.2. Allocate 300,000 VND per machine.

1.3. Allocate for individuals to pay monthly to the Post and Telecommunications Corporation the subscription fee and excess usage charges as follows:

1.3.1. Minister: 300,000 VND/month.

1.3.2. Deputy Minister: 200,000 VND/month.

1.3.3. Department Heads and equivalent positions: 100,000 VND/month.

2. For mobile phones:

2.1. The agency pays the network activation fee according to the contract with the Post and Telecommunications Corporation; or allocate according to the unit price at the time of network activation.

2.2. Allocate 3,000,000 VND per machine.

2.3. Allocate for individuals to pay monthly to the Post and Telecommunications Corporation the subscription fee and excess usage charges as follows:

2.3.1. Minister: 500,000 VND/month.

2.3.2. Deputy Minister: 400,000 VND/month.

3. For messaging devices:

In cases where the Minister decides (in writing) to provide messaging devices, the agency will pay the monthly subscription fee to the Post and Telecommunications Corporation.

In other cases, based on the nature and actual work requirements, the Minister may decide (in writing) to provide fixed-line telephones at home or mobile phones after consultation with the Ministry of Finance. The allocation rates are as follows:

- Fixed-line telephone: As applied to Department Heads.

- Mobile phone: Individuals purchase and activate the device themselves, and the agency allocates 250,000 VND/month for usage.

4. Regarding payment:

The payment levels specified above are calculated monthly and paid concurrently with monthly salaries. Individuals directly pay the Post and Telecommunications Corporation according to their contracts and actual usage. These individuals can only be reimbursed for telephone expenses when they actually use the telephone and register their subscriber numbers with the Ministry's Office for work-related contact.

5. Cadres and civil servants who are provided with fixed-line telephones at home and mobile phones must register their telephone numbers with the Ministry's Office and have a regular need to use them for work. - When cadres and civil servants do not use or have no need to use fixed-line telephones and mobile phones, they must inform the Ministry's Office to stop paying the telephone allocation. - Cadres and civil servants who meet the criteria for using fixed-line telephones and mobile phones but are found not to be using them while still receiving allocations will be subject to disciplinary action according to current national and agency regulations.

Article 2. The Chief of the Ministry's Office is responsible for guiding, inspecting, and implementing this decision.

- The Ministry's Office transfers individual family contracts for telephone use to each individual for direct monthly payment of fees to the Post and Telecommunications Corporation.

Article 3. This decision takes effect from July 1, 2002. The Chief of the Ministry's Office and heads of units under the Ministry are responsible for implementing this decision./.
