Regarding the issuance of the "Action Program for Strengthening Propaganda and Popularization of Laws on Science and Technology (2003-2007)"

Pursuant to Decree No. 22/CP dated May 22, 1993 of the Government on the tasks, powers, and organizational structure of the Ministry of Science, Technology, and Environment (now the Ministry of Science and Technology);

Pursuant to Decision No. 188/2002/QĐ-TTg dated December 31, 2002 of the Prime Minister approving the Action Program of the Government to implement the Conclusions of the Sixth Plenary Session of the Central Committee of the Communist Party of Vietnam's Ninth Term on science and technology;

Pursuant to Decision No. 13/2003/QĐ-TTg dated January 17, 2003 of the Prime Minister approving the Program on popularizing and educating laws from 2003 to 2007;

At the proposal of the Heads of the Legal Department and the Office Director of the Ministry,

 

DECISION:

Article 1. Attached hereto is the "Action Program for Strengthening Propaganda and Popularization of Laws on Science and Technology (2003-2007)"

Article 2. This Decision shall take effect fifteen days from the date of publication in the Official Gazette.

Article 3. The Heads of the Legal Department, the Office Director of the Ministry of Science and Technology, the Heads of units under the Ministry of Science and Technology, the Departments of Science, Technology, and Environment, agencies managing science and technology under various Ministries and sectors, organizations of science and technology, and all related organizations and individuals are responsible for implementing this Decision.

ACTION PROGRAM
STRENGTHENING THE WORK OF PROPAGANDA AND POPULARIZATION OF LAWS
ON SCIENCE AND TECHNOLOGY

(Period 2003-2007)

(Issued together with Decision No. 04/2003/QĐ-BKHCN
dated February 18, 2003 of the Minister of Science and Technology)

 

          I. OBJECTIVES AND REQUIREMENTS OF THE PROGRAM

          1. Objectives:

          Contributing to enhancing the effectiveness of lawmaking, implementation, and improvement of the legal system on science and technology.

          Increasing knowledge of laws on science and technology (ST), intellectual property (IP), technology transfer (TT), standards, measurement, quality (SMQ), radiation safety and control (RSC) among officials and civil servants working in state management agencies, scientific and technological organizations, enterprises, political organizations, political-social organizations, social organizations, and all strata of the people. Thus, raising awareness of compliance and enforcement of laws, contributing to strengthening legal order and discipline, effectively preventing violations of laws on ST, IP, TT, SMQ, and RSC (hereinafter referred to as ST laws).

          Helping officials and civil servants, especially those working in state management agencies on ST at all levels, scientific and technological organizations, and enterprises to grasp the legal system and promptly update new information on ST laws, thereby enhancing their ability to apply and enforce laws in their positions and duties.

          Establishing an effective mechanism for coordinating propaganda and popularization activities of ST laws, incorporating the work of popularizing ST laws into routine practices.

          2. The remaining 60% shall be used to supplement the operating funds of units directly responsible for public debt management at the Ministry of Finance (outside the regular state budget allocation for ongoing operations as currently provided) for the purposes specified in Article 4 of this Decision.

          Propaganda and popularization activities of ST laws must be carried out continuously, widely, and regularly.

          Selecting and applying methods and forms of propaganda and popularization of ST laws must be appropriate to each type of audience.

          Propaganda and popularization activities must ensure scientific accuracy and effectiveness.

          II. CONTENT OF LAWS TO BE PROPA gated AND POPULARIZED

          The content of laws to be propagated and popularized includes all legal documents within the fields managed by the Ministry of Science and Technology, including:

          Laws on ST,

          Laws on IP,

           Laws on TT,

          Laws on SMQ,

          Laws on RSC.

          III. FORMS OF ACTIVITY AND ASSIGNMENT OF RESPONSIBILITY

          1. Organizing direct introduction of legal documents

          a. Content:

          Organizing sessions to introduce and hold roundtable discussions with different audiences on the contents of newly issued ST laws;

          Directly engaging in dialogue with different audiences on specialized legal topics within the fields of ST, IP, TT, SMQ, and RSC;

          Holding press conferences to introduce the contents of important new legal documents.

          b. Responsible Units:

          The Legal Department shall take the lead in coordinating with the Ministry's Office, relevant units under the Ministry, and Departments of Science, Technology, and Environment (STE Departments) to organize these activities for legal documents on ST.

          The Intellectual Property Office shall take the lead in coordinating with the Legal Department, the Ministry's Office, and STE Departments to organize these activities for legal documents on IP.

          The Office of Technical Evaluation and Environmental Assessment of Investment Projects shall take the lead in coordinating with the Legal Department, the Ministry's Office, and STE Departments to organize these activities for legal documents on TT.

          The General Administration of Standards, Metrology, and Quality Control shall take the lead in coordinating with the Legal Department, the Ministry's Office, and STE Departments to organize these activities for legal documents on SMQ.

          The Radiation Safety and Nuclear Safety Board shall take the lead in coordinating with the Legal Department, the Ministry's Office, and STE Departments to organize these activities for legal documents on RSC.

          The Ministry's Office shall take the lead in coordinating with the Legal Department and relevant units to organize press conferences for the Ministry's leadership to introduce the contents of important legal documents.

          2. Organizing training courses on laws.

          a. Content:

          Timely updating the new content of ST laws into the annual training programs for capacity building in science and technology management for officials and civil servants in the fields of ST, IP, TT, SMQ, and RSC, aiming to organize training courses on ST laws for officials and civil servants in science and technology management agencies.

          Annually organizing training courses on legal affairs, inspection, planning and financial management in ST, IP, TT, SMQ, and RSC work, etc., to enhance professional skills and strengthen the ability to accurately grasp and apply necessary legal provisions for officials and civil servants in the fields of ST, IP, TT, SMQ, and RSC.

          b. Organization to implement:

          The Science, Technology, and Environment Management Training School shall take the lead in coordinating with relevant units to incorporate necessary content into the training program for management knowledge in science and technology.

          The Legal Affairs Department, the Ministry's Inspectorate, the Planning Department, the Intellectual Property Office, the Technology and Environment Project Review Office, the Standardization-Metrology-Quality Control General Bureau, the Radiation and Nuclear Safety Authority shall take the lead in coordinating with the Ministry's Office, relevant units within the Ministry, and the Science, Technology, and Environment Departments at provincial levels to organize training sessions in their respective fields of expertise.

          3. Widely publish books on laws related to science and technology.

          a. Content:

          Annually publish two volumes titled "New Legal Documents on Science and Technology" including all new legal documents issued in the year pertaining to the fields of science and technology, intellectual property, industrial property, standardization, measurement, quality control, radiation safety, and nuclear safety.

          Organize the compilation and publication of legal handbooks and question-and-answer books on laws related to science and technology, intellectual property, industrial property, standardization, measurement, quality control, radiation safety, and nuclear safety.

          Additionally, based on practical circumstances, organize the compilation and publication of books titled "Current Legal Documents" for each specialized field of science and technology, intellectual property, industrial property, standardization, measurement, quality control, radiation safety, and nuclear safety.

          b. Implementing unit: The Legal Affairs Department shall take the lead in coordinating with the Ministry's Office and relevant units.

          4. Publish legal documents on the Internet:

          a. Content: Establish a database, collect, and upload legal documents on science and technology to the Internet.

          b. Responsible Units:

          The Legal Affairs Department shall take the lead in coordinating with the Ministry's Office, the Information Technology Center, and the National Science and Technology Information Documentation Center.

          5. Popularize laws through mass media (newspapers, radio, television).

          a. Content:

          Timely introduce and respond to interviews and press conferences regarding the content of legal documents on science and technology, especially those newly issued, in the Ministry's newspapers, magazines, outside the Ministry, and on central and local radio and television stations.

          Closely cooperate with radio and television stations to implement programs and special sections on radio and television about laws on science and technology.

          b. Responsible Units:

        The Legal Affairs Department and the Ministry's Office shall take the lead in coordinating with newspapers, magazines, and relevant agencies within the Ministry, and with the Science, Technology, and Environment Departments at provincial levels.

          IV. Responsibility for Developing Implementation Plans and Funding

         Units assigned to lead the activities mentioned in Section III of this Program shall be responsible for incorporating all these activities into their annual work plans throughout the period from 2003 to 2007.

Funding for the dissemination and popularization of laws on science and technology shall be sourced from the scientific affairs budget.

Units assigned to lead the implementation shall be responsible for budgeting for each specific activity when developing their annual plans and submitting them for approval by the Ministry's leadership.

The Legal Affairs Department and the Ministry's Office shall regularly urge and monitor the implementation of this Program; promptly summarize and evaluate to draw lessons and develop solutions to address difficulties and obstacles during the implementation process.
