THE MINISTER OF POSTS AND TELECOMMUNICATIONS

Pursuant to Decree No. 90/2002/NĐ-CP dated November 11, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Posts and Telecommunications;

Pursuant to Decision No. 217/2003/QĐ-TTg dated October 27, 2003 of the Prime Minister on the management of pricing for postal and telecommunications services;

Pursuant to Circular No. 110/2005/TT-BTC dated December 8, 2005 of the Ministry of Finance guiding accounting procedures and collection of contributions to the Vietnam Universal Service Fund;

At the proposal of the Director of the Department of Planning and Finance,

DECISION:

Article 1. Based on supply and demand relations and market conditions, enterprises providing international telephone services (IDD and VOIP) shall determine and register with the Ministry of Posts and Telecommunications the minimum rates for inbound international settlement charges. The Ministry of Posts and Telecommunications will issue specific guidelines for registration and management of international settlement charges for enterprises.

Article 2. Based on the registered minimum rates for inbound international settlement charges, enterprises providing international telephone services may negotiate and agree upon settlement charge rates for inbound international calls with foreign partners, provided that the agreed rates are not lower than the registered minimum rates with the Ministry of Posts and Telecommunications.

Article 3. To ensure competition, develop the telecommunications market, and fulfill public service obligations as prescribed by law, enterprises with total inbound international call traffic (including IDD and VOIP) exceeding 39% of the total market inbound international call traffic in any quarter shall be responsible for contributing to the Vietnam Universal Service Fund an additional connection fee of 17 US cents per minute for the excess traffic volume.

Article 4. This Decision replaces Decision No. 29/2005/QĐ-BBCVT dated August 25, 2005 and takes effect fifteen days after its publication in the Official Gazette..

Article 5. The Director of the Office, Heads of the Planning and Finance Department, Heads of units under the Ministry of Posts and Telecommunications, General Directors, Directors of enterprises providing international telephone services, and related units are responsible for implementing this Decision./.
