Pilot Station Area at Vung Tau

MINISTER OF TRANSPORT

Based on the Maritime Code of Vietnam dated June 14, 2005;

Pursuant to Decree No. 34/CP dated April 4, 2003 of the Government stipulating the tasks, powers, responsibilities for state management, and organizational structure of the Ministry of Transport;

Pursuant to Decree No. 71/2006/ND-CP dated July 25, 2006 of the Government on port management and maritime channels;

Considering the proposal of the Vietnam Maritime Administration at Official Letter No. 1845/CHHVN-PC dated October 25, 2006 regarding the proposal to adjust the position of the Pilot Station at Vung Tau;

At the proposal of the Director of the Legal Department and the Director of the Vietnam Maritime Administration.

DECISION:

Article 1. Now, the position of the Pilot Station at Vung Tau is adjusted as follows:

1. The Pilot Station at Position 1 is the water area limited by a semicircle with a radius of 01 nautical mile towards West-Southwest, with its center at the coordinates: latitude 10o 19' 48" 6 N; longitude 107o 03' 17" 7 E.

This Pilot Station is used for picking up and dropping off pilots for vessels (except those specified in Point 2 of this Decision) entering and leaving seaports within the jurisdiction of Ho Chi Minh City, Dong Nai Province, Binh Duong Province, and Ba Ria-Vung Tau Province, seaports on the Mekong River, and foreign vessels transiting through the Mekong River to Cambodia.

2. The Pilot Station at Position 2 is the water area limited by a semicircle with a radius of 01 nautical mile towards South, with its center at the coordinates: latitude 10o 17' 04" 3 N; longitude 107o 05' 17" E.

This Pilot Station is used for picking up and dropping off pilots for oil-carrying vessels, dangerous goods-carrying vessels, toxic goods-carrying vessels with a gross tonnage of 5000 GT or more, other vessels with a draft of 10 meters or more, and vessels with special reasons requesting to pick up and drop off pilots at this Pilot Station, entering and leaving seaports within the jurisdiction of Ho Chi Minh City, Dong Nai Province, Binh Duong Province, and Ba Ria-Vung Tau Province, seaports on the Mekong River.

Article 2. The Vung Tau Port Control Office shall be responsible for:

1. Based on the actual situation regarding weather, waves, drafts, vessel loads, and types of vessels, designate specific locations for vessels to anchor for picking up and dropping off pilots, quarantine inspections within the water areas specified in Article 1 of this Decision, ensuring maritime safety, maritime security, and environmental protection.

2. Coordinate with relevant Port Control Offices to implement specialized state management over Vietnamese and foreign vessels anchoring and picking up/dropping off pilots within the water areas specified in Article 1 of this Decision.

Article 3. This Decision takes effect 15 days from the date of publication in the Official Gazette. All previous regulations contrary to this Decision are abolished.

Article 4. The Head of the Ministry's Office, the Inspector General of the Ministry, the Heads of the Ministry's Departments, the Director of the Vietnam Maritime Administration, the Director of the Vietnam Inland Waterways Administration, the Director of the Transport Department of Ba Ria-Vung Tau Province, the Director of the Transport Department of Dong Nai Province, the Director of the Ho Chi Minh City Transport and Public Works Department, the Director of the Vung Tau Port Control Office, the Director of the Dong Nai Port Control Office, the Director of the Ho Chi Minh City Port Control Office, the Director of the My Tho Port Control Office, the Director of the Dong Thap Port Control Office, the Heads of agencies, organizations, and individuals related to this matter are responsible for implementing this Decision.
