CIRCULAR
Guidelines for the annual review of poor households

Pursuant to Decree No. 29/2003/NĐ-CP dated March 31, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor, Invalids and Social Affairs;
Pursuant to Decision No. 42/2002/QĐ-TTg dated March 19, 2002 of the Prime Minister on the management and implementation of national target programs;
Pursuant to Decision No. 170/2005/QĐ-TTg dated July 8, 2005 of the Prime Minister promulgating the poverty standard applicable during the period from 2006 to 2010.
The Ministry of Labor, Invalids and Social Affairs provides guidelines for the annual review of poor households as follows:
I. GENERAL PROVISIONS
1. These guidelines direct the annual review process of poor households at the grassroots level (village/commune) to accurately identify the target group of poor households as the basis for building a database managing poor households in each locality.
2. Principles of reviewing poor households: ensuring accuracy; democracy, fairness, transparency, and participation in evaluation by the people.
3. Authority and responsibilities of levels in reviewing poor households.
3.1. Commune level: The People's Committee at the commune level establishes a steering committee for reviewing poor households consisting of village chiefs and representatives of village-level associations to directly implement the review of poor households (referred to as the Steering Committee). The commune-level Steering Committee has the following tasks:
- Disseminating the purpose and requirements of the review of poor households.
- Directly reviewing poor households and organizing public, democratic evaluations.
- Proposing the Steering Committee at the district level to approve the results of the review of poor households in the commune; submitting to the People's Committee of the commune to handle the recognition procedures for households that have escaped poverty and newly identified poor households;
- Monitoring changes in poor households within the commune.
3.2. District level (Department of Internal Affairs - Labor):
- Proposing with the District People's Committee plans for reviewing and identifying poor households; coordinating with relevant agencies to guide the review of poor households;
- Organizing the verification of the results of the review of poor households submitted by communes; if the data reflects inaccurately the actual situation of the locality, they may organize a recheck of the review results.
- Submitting to the District People's Committee for approval the list of households that have escaped poverty, newly identified poor households, and the list of poor households in the district, notifying the People's Committees of the communes to recognize them and reporting to the Provincial Poverty Reduction Steering Committee;
- Managing and monitoring changes in poor households within the district.
3.3. Provincial level (Department of Labor, Invalids and Social Affairs):
- Proposing with the Provincial People's Committee plans for reviewing; unifying the printing of review forms in the province.
- Coordinating with relevant agencies to guide the implementation of the review;
- Submitting to the Provincial People's Committee the results of the annual review of poor households and reporting to the Office of the National Poverty Reduction Steering Committee (at the Ministry of Labor, Invalids and Social Affairs);
- Managing and monitoring changes in poor households within the province.
II. PROCEDURE FOR REVIEWING POOR HOUSEHOLDS
1. Preparation work for reviewing poor households
a. The provincial level issues guidance documents for plans and review forms.
b. Establishing the commune-level Steering Committee.
c. Conducting training on reviewing poor households:
- Training members of the district-level Steering Committee.
- The district conducts training for those directly involved in surveys (concentrated training according to administrative units for districts with few communes, or by commune clusters if the district has many communes).
- The commune-level Steering Committee disseminates the purpose and requirements of the review of poor households to village chiefs, representatives of village-level associations, and residents.
2. Identifying and compiling lists of households subject to review
a. Identifying households with potential to escape poverty:
Examine criteria affecting income increase for each household in the list of poor households in the commune and score (Annex No. 1). Households with a total score of 10 or more are considered to have the potential to escape poverty and are included in the list for further review.
b. Identifying households with income below the poverty threshold:
Examine criteria affecting income reduction and living conditions for households not previously classified as poor and score (Annex No. 2). Households with a total score of 10 or more are considered to have income below the poverty threshold and are added to the list for further review.
c. Compiling the complete list households with potential to escape poverty and the list ofhouseholds with income below the poverty threshold into the list ofhouseholds for reviewwithin their jurisdiction.
3. Methods and organization of reviewing poor households according to the compiled list.
- Directly surveying the income of households subject to review (Annex No. 3).
+ For households not previously classified as poor before the review, collect full information on household demographics, labor force, employment, land, and assets; for households previously classified as poor, only supplement information on demographic changes, labor force, employment, land, and assets if there are changes compared to the previous year.
+ Review the income of households over the past 12 months to determine the average per capita income relative to the poverty threshold.
- Based on the number of households to be reviewed, the commune-level Steering Committee assigns reviewers by village, determining the review time and the time for verifying the review forms.
4. Classifying households after review and organizing public evaluation of households that have escaped poverty and newly identified poor households
a. Verifying the review forms: The commune-level Steering Committee together with supervisors check the accuracy of information on household demographics, labor force, employment, land, and assets; verify the basic data recorded in the form, and if income discrepancies are found, they have the right to request a re-review.
b. Based on the review results (review forms),the commune-level Steering Committee compiles a preliminary list of households classified as: households that have escaped poverty and newly identified poor households.
c. Organizing a public meeting to evaluate households that have escaped poverty and newly identified poor households and compile a final list of poor households through public evaluation.
The head of the village or commune chairs the meeting; participants include representatives from the Party Committee, the People's Committee of the commune, poverty reduction officers, Secretaries of Village Branches, Heads of Village Associations, households listed for evaluation, and representatives from households in the village or commune (the meeting must have more than 50% of household representatives present).
The assessment shall be conducted based on the principles of transparency, democracy, objectivity, and must include voting (raising hands or casting ballots); the voting result must have more than 50% of the participants' agreement to be included in the list of proposed households: those exiting poverty, newly poor households.
The assessment results must be recorded in the minutes. The minutes and the list of poor households from the assessment are to be made in two copies, signed by the village head, commune head, meeting secretary, one copy retained at the village/commune, and one copy sent to the Poverty Reduction Steering Committee at the district level (Annex No. 4).
III. IMPLEMENTATION
The review of poor households must be carried out in November each year, no later than December 15th of each year, the provincial Poverty Reduction Steering Committee must report the results of the review of poor households in their jurisdiction to the Government's Poverty Reduction Steering Committee.
This Circular takes effect fifteen days after its publication in the Official Gazette.
In the course of implementation, if there are any difficulties, the provinces and cities should send their opinions to the Ministry of Labor - Invalids and Social Affairs for timely guidance and supplementation.
