JOINT CIRCULAR

Guidelines for implementing the rationed meal system and freshwater shortage allowance for workers and officials performing tasks at sea in public service units under the land administration, geology, and meteorology and hydrology sectors.

Pursuant to Decision No. 234/2005/QĐ-TTg dated September 26, 2005, of the Government on special regimes for workers, staff, and officials in certain industries and occupations in state-owned enterprises;

To implement the opinion of Deputy Prime Minister Nguyen Sinh Hung expressed in Official Letter No. 3142/VPCP-VX dated June 8, 2007, of the Government Office regarding the application of special regimes according to Decision No. 234/2005/QĐ-TTg; The Ministry of Home Affairs, the Ministry of Finance, the Ministry of Natural Resources and Environment, and the Ministry of Labor, Invalids, and Social Affairs hereby provide guidelines for implementing the rationed meal system and freshwater shortage allowance for workers and officials performing tasks at sea in public service units under the land administration, geology, and meteorology and hydrology sectors as follows::

I. SCOPE AND APPLICABLE SUBJECTS

Workers and officials performing tasks at sea listed in the payroll of public service units under the land administration, geology, meteorology, and hydrology sectors, including:

1. Workers and officials engaged in seabed surveying and mapping;

2. Workers and officials involved in researching, investigating, and surveying physical geography, geodesy, geology, mineral resources, environmental geology, geological disasters, and marine dynamics;

3. Workers and officials operating vessels and those conducting research and surveying meteorological and oceanographic conditions on research and survey vessels.

II. BENEFITS ENJOYED

1. Rationed Meal System

a) Ration levels, consisting of two levels: 32,000 VND/day and 37,000 VND/day, as follows:

- Level 1: 32,000 VND/day applies to workers and officials engaged in seabed surveying and mapping.

- Level 2: 37,000 VND/day applies to workers and officials involved in researching, investigating, and surveying physical geography, geodesy, geology, mineral resources, environmental geology, geological disasters, and marine dynamics, as well as workers and officials operating vessels and those conducting research and surveying meteorological and oceanographic conditions on research and survey vessels.

b) Calculation Method:

The method of enjoying the rationed meal level shall be implemented in accordance with Clause 3, Section I of Circular Joint No. 35/2005/TTLT-BLĐTBXH-BTC dated December 16, 2005, issued by the Ministry of Labor, Invalids, and Social Affairs and the Ministry of Finance guiding the implementation of Decision No. 234/2005/QĐ-TTg dated September 26, 2005, of the Government on special regimes for workers, staff, and officials in certain industries and occupations in state-owned enterprises (hereinafter referred to as Circular Joint No. 35/2005/TTLT-BLĐTBXH-BTC).

Public service units with subjects eligible for the rationed meal system must organize meals for workers and officials. Based on the meal level specified in Point a, Clause 1, Section II of this Circular, workers and officials receiving the rationed meal system pay 30% of the meal allowance; the remaining 70% of the meal allowance is covered by the public service unit from project costs. The public service unit shall not pay (70% of the meal allowance) to workers and officials and shall not reduce the meal allowance by not collecting sufficient 30% of the meal allowance from contributions made by workers and officials.

Workers and officials receiving the rationed meal system shall not enjoy the heavy work and hazardous allowance in kind or the meal allowance during working hours.

2. Freshwater Shortage Allowance

Workers and officials falling within the scope defined in Section I of this Circular shall receive the freshwater shortage allowance applicable to areas experiencing seasonal freshwater shortages, as stipulated in Clause 2 and Clause 3, Section V of Circular Joint No. 35/2005/TTLT-BLĐTBXH-BTC.

III. EFFECTIVE DATE OF IMPLEMENTATION

This Circular takes effect fifteen days after its publication in the Official Gazette.

For public service units under the land administration, geology, and meteorology and hydrology sectors that have provided rationed meals and expenses for purchasing freshwater for daily use for the subjects specified in Section I of this Circular from January 1, 2005 (the date when Decision No. 234/2005/QĐ-TTg was implemented) until the day before this Circular takes effect, the heads of these public service units shall submit detailed explanations of the funds expended to the Ministry of Natural Resources and Environment for consolidation and submission to the competent authority for review and decision.

The funds to implement the rationed meal system and freshwater shortage allowance as prescribed in this Circular shall be allocated within the annual budgetary plan of the public service units.

Any issues encountered during implementation should be reported to the Ministry of Home Affairs for coordination with the Ministry of Finance, the Ministry of Natural Resources and Environment, and the Ministry of Labor, Invalids, and Social Affairs to study and resolve./.
